November 27, 1939 Pursuant to adjournment of November 22d, 1939, the City Council met and was called to order at 7:30 P.M. by Mayor M cCallen. Councilmen present:?Aorehouse,Chamness,Henriekson,Talbert,PieCallen. Councilmen absent: None. Canvassing ballots This being the date set for examining and canvassing the of Special Election Nov.21,1939 ballots cast at the special municipal election held Tuesday, Nov - Charter Amend- ment .ember 21, 1939, the Clerk presented the election returns and the Council proceeded to canvas the ballots. The total results of the above named election including absentee ballots were: PROPOSITION #1 Yes - 253 No. - 37 Whereupon the Clerk read the following.Resolution No. 854 Resolution "RESOLUTION NO. 854 No. 854 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, CANVASSING THE RE- TURNS OF THE SPECIAL MUNICIPAL ELECTION HELD IN SAID CITY ON TUESDAY, THE 21st DAY OF NOVEMBER,1939• 'WHEREAS, the City Council of the City of Huntington Beach, California, did at a regular meeting of said City Council held on the 2nd day of October, 1939, adopt Resolution No. 852, ordering, calling and providing for the holding of a special election on November 21, 1939, for the purpose of voting upon the proposition of adoption of a proposed amendment to the Charter of said City of Huntington Beach for the purpose hereinafter stated, and 'WHEREAS, due notice of the holding of said special election has heretofore been given at the time and in the manner provided by law, and 'WHEREAS, this is the time and place provided for the canvassing of the returns of said special election, 'NOW THEREFORE, the City Council of the City of Huntington Beach, California, do resolve, determine and declare as follows: 'Section 1: (1) That the whole number of votes cast in the City of Huntington Beach at said special election, including all absentee votes, is 290. (2) That.the proposition, designated as "PRO- POSITION NO. I", voted_upon at said special election was the following: "SHALL THE PROPOSED CHARTER AMENDMENT CREATING A BOARD OF EDUCATION TO_CONSIST OF FIVE (5) MEMBERS BE ADOPTED?", (3) That the number of votes given at each .consolidated voting precinct for and against said Proposition No. 1 was as follows: Consolidated Voting Precinct A. I No 37 'Section 2: IT IS HEREBY FOUND AND DECLARED that said Proposition No. I, hereinabove recited, to -wit: "SHALL THE PROPOSED CHARTER AbIENDIJ:ENT CREATING A BOARD OF EDUCATION TO CONSIST OF FIVE (5) MEMBERS BE ADOPTED V' received the affirmative votes of a majority of the voters of said City voting at'said election, and the same carried. 'Section 3: The City Clerk is hereby directed to enter on the records of the Clty,-Council" a statement of the result of said election as required by law. 'Section 4: That the City Clerk shall attest and certify to the passage and adoption of this Resolution by a majority of the votes of the members of the City Council of the City of Huntington Beach. Fire Letter er The Clerk read a letter from the Fire Department thanking the City ' thanks Council and other members of the city force for the completion of the new fire hall. Same was ordered filed. Orange Co. League The Clerk read a letter from the Orange County League of Municipal - ities.calling attention to the regular meeting of the League to be held the second Thursday in January 1940. The letter was ordered filed. Petition for light 'at Balti- The Clerk read a petition signed by E. S. Allen, 209 Huntington more & Hunt ington Avenue, P.W.Cockrell, 201 Huntington Avenue and W. C. Leland, 205 Hunt- ington, Avenue asking that a light be installed at the intersection of Baltimore and Huntington Avenue. The matter was referred to the City Page- 3 - :Minutes Nov. 27, 1939. 31-92 Engineer and the Street Committee and the petition ordered filed. Neon Sign On motion by Morehouse seconded by Talbert, the application of the Shell Oil Company to erect Neon sign at 620 Ocean Avenue was approved. Reso. #855 - The Clerk read Resolution No. 855, petitioning the District Legal action on out -fall sewer Attorney to take appropriate legal action to abate the out -fall sewer nuisance and, on motion by Henrickson seconded by Talbert, Resolution No. 855 was passed and adopted by the following vote: AYES: Councilmen: Morehouse, Chamness, Henrickson, Talbert, McCallen. NOES: Councilmen: None. ABSENT: Councilmen: None. Copy of Reso.#855 to Dist.Atty Holden The Clerk was directed to mail a certified copy of the above resolution to the Honorable George F. Holden, District Attorney of Orange County. Bicycles to be On motion by Talbert seconded by Chamness, the City Attorney licensed was Authorized to prepare and present to the Council an ordinance for the purpose of registering and collecting license on bicycles in the City of Huntington Beach. Demands On motion by dhamness seconded by Talbert, demands approved by the Finance Committee were ordered pAid. Water in gutter Councilman Morehouse stated that there was complaints about water on Olive Ave. running in the gutter along Olive Avenue in the vicinity of 12th Street. The matter was referred to the Street Committee and to the City Engineer. Att'y Petty - The City Attorney was authorized to invite Attorney Petty Truck.License Ord. Pavilion - floor covering Junior College of Long Beach - Pavilion for the trucking association to appear before the City Council at re uar theiree6ting Monday, December 4th,,relative to a case now pending for violation of the City's truck license ordinance. The matter of furnishing a floor covering for the dance pavilion was deferred. The City Engineer was directed to write the Long Beach Junior College and inform them that Friday nights January 19th and May 3rd were taken and to suggest to them that they are welcome to use the pavilion by reservation on any nights other than Friday and Saturday, also to suggest to them that Memorial Hall is open for reservation.
