Monday, February 5, 1940 The regular meeting of the City Council was called to order at 7:30 P.M. by Mayor McCa.11en. Councilmen present: Morehouse, Chamness, Talbert, Henrickson, McCallen. Councilmen absent: None. Minutes On motion by Henrickson.se,canded by Morehouse, minutes for the month • of January were approved as read. . Monthly The Clerk read monthly reports of the City Treasurer, City Clerk, reports City Collector, City Judge, Chief of Police, City Engineer and, on motion by Chamness seconded .by. T.a.lbert., .same. were accepted and ordered filed. Memorial Mrs. Ila Dabney address.ed the. Council relative to use of Memorial Hall Hall to conduct dances, music to be furnished by the W.P.A. providing they could have the use of. the hall regularly once each week free of charge. She was informed by the Mayor that the City could not allow any organization • to engage the hall regularly, the, reason being that the hall might be used by all of the people upon making reservations. Request for The Clerk read the following request for assignment: assignment of Garbage "January 30, 1940 contract . . . . . . . . . Honorable Mayor and City Council Huntington Beach California •' Gentlemen: Reference is made to an Agreement dated October 18, 1937, between the under- signed, J.W.McIntosh and F. M. Baldwin, and the City of Huntington Beach, re- garding the collection of garbage within the City. We desire to assign this contract to J. B. Call and Grace G. Minner for the balance of the term of the contract; all provisions of the contract to be in full force and effect. It is understood that the assignees herein cannot assign this contract without the consent of the City, and we desire your assent to said assignment as provided within the contract. • The assignees thereof also agree to furnish a good and sufficient surety bond in the .sum of one thousand ($1,000.00) dollars, as provided by said contract. B. Cail and Grace. G. Minner for faithful performance in the collection and disposal of garbage for the City of Huntington Beach was accepted and ordered filed. Surety Bond On motion by Chamness seconded by Talbert, the surety bond of Dorris Marie Puckett was accepted and ordered filed. Ins. Mayor McCallen suggested the matter of blanket rate of insurance be -deferred until a lower rate is submitted by the insurance companies. C. of flood C. requests The Clerk read a letter from the light or Chamber of Commerce requesting Neon sign that a, flood light or Neon light be installed at the entrance of the Chamber of Commerce headquarters. The matter was referred to the Building Committee, Morehouse, Talbert and the City Engineer to invest- igate cost and make their recommendations to the City Council. Sea Scouts On motion by Chamness seconded by Henrickson, the $2.00 charge for use of the Recreation Park Club house by the Sea Scouts on January 31st was waived. Builders Exchange The Clerk read a letter from the Orange County Builders Exchange calling attention to certain wage scales heretofore submitted by other w organizations. The Builders Exchange asked that the City Council confer with their organization in the matter of prevailing wage scale. The letter was ordered .filed. Neon sign � On motion by Henrickson seconded by Talbert, the application of Ray Dolan to erect Neon sign at 107 Main Street was approved. Page 3, Minutes Feb.5, 1940 4 � ::1_ Sowest Exp. On motion by Morehouse seconded by Talbert, the application of Well #25 the Southwest Exploration Company to drill well known as State No. 25 was accepted and. permit granted. Palm.tree The written request of John H. Eader to have a Palm tree re- fnoved from the front of his property at 411 - 9th Street was referred to the City Engineer, the Park Superintendent and the Street and Parks Committee for their investigation and recommendation. Mun. Pier i:: The Clerk read a letter from City Engineer Overmyer calling attention letter from U.S.Eng.to a letter received by him from the U. S. Army Engineers regarding the reconstruction of a. portion of the municipal pier. The letter from the U. S. Engineering office above referred_ to asks that they be furnished with a tracing and three prints showing the proposed reconstruction with '. .� the request that the revised plans be approved and, on motion by Chamness seconded by Henrickson, the City Engineer was authorized and directed to prepare and submit to the U. S. Engineer..Off ice, 751 So.. Figueroa. Street, Los Angeles, the necessary plans and specifications called for in their letter above referred to. Metal sign On motion by Talbert seconded by Chamness, the application of Al Al Brody Brody to erect electric metal sign at 214 Main Street was approved. Oil Cleaning On motion by Talbert seconded by Henrickson, the application of Plant H. P. Tunsta.11 to construct and operate an oil cleaning plant on Lots 25 and 27, Block 619, 17th Street Section, was referred to the City Attorney with authority to prepare a provisional permit, same to be executed by the applicant. Amusement The Clerk read a letter from J. E. Turney and Carl J. Underwood stand on beach asking for a permit to operate amusement stands on the beach front. The matter was referred to Councilmen Chamness and Talbert with the suggestion that they invite the applicants to meet with the Eity Council and discuss the matter in 'full detail. Ord. 434 The Clerk presented and read title to Ordinance No. 434. This passed - . being the second reading and final reading of this ordinance, the follow- ing motion was made by Henrickson seconded by Talbert, that Ordinance No. 434 be adopted by reference. Motion put and carried unanimously. Ord. 434 On motion by Henrickson seconded by Chamness, Ordinance No. 434, Reg.Comp. _ of city fixing and regulating compensation of city officers and employees, was emp. passed and adopted by the following vote: • AYES: Councilmen: Morehouse, Chamness, Talbert, Henrickson, McCallen. NOES: Councilmen: None. ABSENT: Councilmen: None, Alley On motion by Henrickson seconded by Morehouse, the City Engineer was authorized end directed to start negotiations for the purchase of a 15 foot right of way for an alley across Lots A & B, Block 605, Vista Del Ma.r. s 4111.2 Page 4, Minutes Feb.5, 1940 • Demand approved On motion by Morehouse seconded by.Chamness, the demand of • by Council J.W.B. Blackman for engineering service in connection with the re-' • construction of the municipal pier amounting to $250.00 was approved and ordered paid. Demands On motion by Talbert seconded by Chamness, demands approved by the Finance Committee were ordered paid. 6 in, water Councilman Henrickson recommended that the Southern California line recommended Water Company be asked to install a six inch water line in the alley between 8th and 9th Streets from Palm Avenue to the first alley east- erly from Ocean Avenue also a six inch line in the alley between 12th and 13th Streets from Palm to the first alley easterly from Ocean •~ Avenue. The matter was referred back to Councilman Henrickson, the city • engineer and the fire chief for further recommendations at next meeting of the Council. • Sodium vapor IPolice Chief Grant suggested that sodium vapor lights be placed lights recommend- ed for Oceanalong Ocean Avenue beginning at 23rd Street and ending at the municipal Ave. camp also that three or more goose neck lighting fixtures be placed on `- the southerly side of Ocean Avenue between First Street and the municipal auto camp. The matter was referred to Councilman Talbert, Chamness and Morehouse to make a survey and report back to the City Council. • Adv. for bids - On motion by Talbert seconded by Chamness, the City Clerk was tax deeded authorized and directed to advertise for bids for the sale of the lots . following tax deeded lots; • Lots 17 and 19 Block 613, 17th Street Section, Lot 22, Block �13, 17th Street Section, Lots 2 and 4, Block 413, 17th Street Section, Lots 5, 7 and 9, Block 313, 17th Street Section, it being understood that the first bid offer may be increased 10o by the second bidder and in multiples of $5.00 per bid after the second bid. The City Council reserves the right to reject any and all.bids and to accept the bid deemed to the best interest of the City. Bids to be received at the office of the City Clerk until 7:30 P.M., Monday, Feb- ruary 19, 1940; bids to be opened and examined by the City Council at . that time. Crossing at Councilman Chamness recommended that the City make application 3rd St. for a pedestrian's crossing across'"Ocean Avenue at 3rd Street and, on motion by Henrickson seconded" by Talbert, the City Engineer was direct- ed to make application to the Pacific Electric Railway Company. License Ord. Mayor McCallen stated that he had made a study of City licenses to be amended and recommended that the license ordinance be amended so as to make business license after the first year $1.00 per year.. That the first year be the usual $12.00 rate. On motion by Talbert seconded by Chamness, the City Attorney was authorized to prepare an amendment to z license ordinance effective July 111940 in accordance with the above suggestion. Page 5, Minutes Feb.5, 1940 Mr. Gries The City Attorney presented checks in the amount of $210.00 from • Arnold J. Gries to apply on the settlement of tax expense and on claims in the action entitled "City' of Huntington Beach vs J. F. Day -- J.M.J.P. Corporation" #37729 in the Superior Court for Orange County. The letter enclosed with the check requested that the City deliver a quitclaim deed or a grant deed covering Lots 10 and 12, Block 419, l7th Street Section, Lots•26 and 29, Block 618, 17th Street Section, free of all City and County taxes and bonds except 1940- 41 taxes. The Mayor directed that the check be turned over to the City Clerk to be held in trust subject to a settlement between the City Attorney and Arnold J. Gries. �i Denio et al The City Attorney informed the Council that the case of Denio, Hart, Taubman end Simpson vs City of Huntington Beach was set for 10:00 A. M. �J May 6th in the Superior Court at Santa Ana. Legion quarter.,s.";,Councilman Chamness stated that the American Legion quarters needed painting and 'redecorating; that the cost of material would-be approximately $100.00, The matter was referred to the Building Committee with authority to act. R.N.A. letter The City Clerk was directed to refer the letter from the Royal referred to C. of C. Neighbors camp asking the City for $250.00 to defray expense of a convention during May to the Chamber of Commerce for their recommendations. Storm drain The matter of installing storm drain in the vicinity of 13th and Main was deferred until the meeting of the Council February 19th. Repairs on Engineer Overmyer reported serious leaks in the basement of the libraxy� Library - leaks building and stated that the cost of repairs would be approximately $300.00. The matter was referred to the engineer for a, more detailed report at 2:30 P.M. February 9th. Reso. #864 The Clerk read Resolution No. 864 authorizing the acceptance and re- passed cording of a deed from the Talbert Drainage District and, on motion by Chamnew seconded by Henrickson, Resolution No. 864 was passed and adopted by the follow- ing vote: AYES: Councilmen: Morehouse, Chamness, Henrickson, Talbert, McCallen. 4 NOES: Councilmen: None. ABSENT: Councilmen: None. Planning The City Clerk was directed to notify the Planning Commission that Com. members of the City Council would meet with the Planning Commission at 8:0.0 P.M., Monday February 19, 1940.
