HomeMy WebLinkAbout1940-06-03448 MINUTES Council Chamber, City Hall, - Huntington Beach, Calif. Monday, June 3, 1940. The regular meeting of the City Council was called to order at 7:30 P. M. by Mayor McCallen. Councilmen present: Grable, Talbert, Morehouse, McCallen. Councilman Chamness arrived at 7:40 P.M. Councilmen absent: None. Minutes , On motion by Morehouse seconded by Grable, minutes for the month of May were approved as read. Monthly Reports The Clerk read monthly reports of the City Treasurer, City Clerk, City Engineer, City Judge, City Collector and Chief of Police and, on motion by Talbert seconded by Morehouse, same were accepted and order- ed filed. Pedestrians The Clerk read a letter from Engineer Overmyer calling attention crossing at 3rd St. to an attached letter and map from the Pacific Electric Company re- ferring to the City°s request for a pedestrian's crossing at Third Street and, on motion by Chamness seconded by Morehouse, the City Attorney was authorized to prepare the necessary application and the Mayor was authorized to verify same after which papers are to be sent to the State Railroad Commission for their approval. Notify P.E.Co. On motion by Talbert seconded by Chamness, the City Engineer was directed to notify the Pacific Electric Company that the proposed location of the pedestrian crossing and arrangement for installing same are satisfactory to the City Council. Transit for City Engineer Overmyer informed the Council that it will be Eng. office advisable to purchase a new transit and that same may be had from Belcher and Schacht of Long Beach for the sum of $420.00 less a $75.00 -allowance for the set owned by the city. Action on the request was deferred to a later meeting. Opinion on The Clerk presented an opinion of the Attorney General relative ownership of tidelands to ownership of the tidelands. The opinion was forwarded to the City by the State Lands Commission, Webb Shadle, executive officer. The Clerk was directed to have copies made for the city attorney and each of the City Council. Reso. #869 - The Clerk read Resolution No. 869 accepting quit -claim deed to a Alley portion of Lot A, Block 605, Vista Del Mar, to be used for alley purpose and, on motion by Talbert seconded by Chamness, Resolution No. 869 was passed and adopted by the following vote: AYES: Councilmen: Chamness,Grable, Talbert, Morehouse, McCallen. NOES: Councilmen: None. ABSENT: Councilmen: None. 1 • w 1 • 1 • Page 2, Minutes June 3, 1940 Petition - The Clerk read a petition signed by a number of citizens living, Amusement zone, at 3rd & in the vicinity of Third and Ocean asking the City Council not to grant Ocean a permit or license for an amusement zone at Ocean and Third and, on motion by Grable seconded by Chamness, the petition together with the original application for the permit were referred to the Planning Com- mission for their consideration. + Relief Driver - The request of Fire Chief Sargent for permission to employ Earl Fire Dept. Overmyer as relief driver for 21 months at a salary of y$145.00 per month was approved on motion by. Chamness seconded by Grable. w Application - The Clerk read a letter from Violet M. Coe making application for Violet M. Coe position as city hostess. The letter was ordered filed. Ord. #436 m The Clerk read Ordinance No. 436, establishing stop signs on certain atop sign • streets of the City. This being the second and final reading, on motion by Morehouse seconded by Grable, Ordinance No. 436 was passed and adopted by the following vote: AYES: Councilmen: Chamness, Grable, Talbert, Morehouse, McCallen. NOES: Councilmen: None. ABSENT: Councilmen: None. Weed This being the date set for hearing objections to the Council's re-. nuisance solution to abate the weed nuisance, the Mayor asked if anyone in the audience had any objections to offer. The -City Clerk and Street Superin- tendent were asked the same question, there being no objections, on motion by Chamness seconded by Talbert, the Superintendent of Streets was directed to proceed to abate the weed nuisance. Report on On motion by Talbert seconded by Chamness,, the report of Diehl and audit Edwards covering audit of the city treasurer's office was accepted and ordered filed. Resod#870 - The Clerk read Resolution No. 870, accepting deed to'a portion of Lot Deed for alley B,.Block 605, Vista Del Mar tract, for street purposes and, on motion by Chamness seconded by Morehouse, Resolution No. 870 was passed and adopted by the following vote: • AYES: Councilmen: Chamness, Grable, Talbert, Morehouse, McCallen. NOES: Councilmen: None. ABSENT: Councilmen: None. -Boy Scouts - The application of Leroy Paxson, scout master, for permission to sell Fireworks fireworks during the Fourth of July with the provision:;that sales be made Jby Boy Scouts Troop #1, and that license be waived, was read and, on motion by Talbert seconded by Grable, permission was granted. C. of C. - '"` folders The Clerk read a letter from the Chamber of Commerce asking that the City Council allocate the sum of $365.68 for printing 10,000 advertising folders and 5000 recreation and trailer park folders and, on motion by Talbert seconded by Chamness, the Council appropriated not to exceed the .above named amount. City officials The Clerk read a letter from City Clerk Vegely of Santa Ana inviting invited to Santa Ana city officials to attend the Santa Ana Breakfast Club, Thursday, June 6th, breakfast 4 . 5 ..0 Page 3, June 3, 1940 7:30 A.M. at Broadway and 6th Street. The Clerk *de directed t6 notify Mr. Vegely.that a number of city officials were securing tickets through the Chamber of Commerce and would attend the breakfast. Application On motion by Talbert seconded by Grable, the application of Theodore approved e Theo. Robins Robins to operate garage and sales service at 5th and Olive was approved. Demands On motion by Talbert seconded by Chamness, demands approved by the Finance Committee were ordered paid. Agreement - The Clerk read an agreement between the City and James DeGuelle DeGuelle and.Goldie DeGuelle leasing to the later the building being constructed on the outer end of the municipal pier. Action was deferred until next meeting of the City Council. Southwest Explo. Councilman Talbert asked the City.Clerk if the Southwest Explo- Coo - payment T ide,l and ownership Derrick license Lights for pier ration Company had made the regular monthly payment in accordance with agreement on file and on being informed by the Clerk that payment had not been received, on motion by Talbert seconded by Grable, the City Clerk was directed to write the Southwest.Exploration Company and ask that if check had not already been forwarded, that same be sent the City immediately. Councilman Chamness addressed the Council relative to the matter of beach and tideland ownership. He stated that this question was contin- ually coming up and suggested that the City make investigation with view of of carrying.the question to the higher courts. Following motion by Councilman Chamness: "That the Mayor appoint a committee to investigate with the City Attorney and others and report back to the City Council at an early date. The subject matter of the investigation to cover the question of ownership of the tidelands within the city.limits, also on beach property lying between the ordinary high tide line and the bluff and between the municipal pier and the westerly city limits." Motion. seconded by Councilman Talbert, put and carried unanimously. The Chair appointed Chamness, Talbert and Morehouse on the above named committee. Councilman Chamness stated that in view of the fact that the City is looking for revenue.on account of decrease in oil production, he was of the opinion that relief might be had by increasing the derrick license amd suggested that a committee be appointed to prepare a new derrick license ordinance. The Mayor appointed Councilmen Grable and McCallen on the committee. Engineer Overmyer submitted plans and estimated cost of lights for the reconstructed portion of the pier, The matter of purchasing same was referred to the Beach -and Pier Committee for their report and re- commendation at next meeting. I. 41 14�, ok w1. • Page 4, June 3, 1940 SR Engineer Overmyer informed the Council that S.R.A. laborers heretofore secured would be on hand to report for work in the next few days.
