Pursuant to adjournment of October 7th, 1940, the City Council met and was called to order at 7:30 P.M. by Mayor McCallen. Councilmen present; Grable, Morehouse, McCallen. Councilman Chamness arrived at 7:45 P.M. Councilmen absent; Talbert. Ord. #441 - The Clerk read Ordinance No. 441, an ordinance ordering the first reading closing of certain streets. This was the first reading of Ordinance • No. 441. Ord. #442, The Clerk gave Ordinance No. 442,s:etting the fee for connect - first reading ing with Alabama Street sewer, -'_its first reading at this time. Orange Co. League The Clerk read a letter from the Orange County League of meeting Municipalities stating that the next meeting will be held at 6:45 .- P.M.Thursday, October 24th at the Elk's Club on North Los Angeles Street, Anaheim. He was directed to notify the secretary of the League that six officials will be present from Huntington Beach. �► So. Counties Gas The Clerk read a letter from the Railroad Commission of the Co. a rate hearing State of California calling attention to a hearing before the Commission at the Santa Ana Court House, 2:00 P.M. Thursday, Oct- ober 31st, relative to rates of the Southern Counties Gas Company of California and asked that interested members of the city officials be present. Matter was referred to the City Attorney. Sowest Exp. Co. On motion by Grable seconded by Morehouse, the application of State well #33 - permit the Southwest Exploration Company for permit to drill State Well No. 33 was approved. Project The Clerk presented and read Supplemental Project Statement No. Statement #2 2, dated October 21, 1940, by the Director of Public Works, Sacramento, California, providing for the allocation of State Gas Tax Fund monies to be expended for the construction of culverts at Fifth and Sixth Streets on Ocean Avenue. Whereupon the following motion was made by Councilman Morehouse; "That the Mayor and City Clerk be authorized to execute same on behalf of the City." Motion seconded by Councilman Chamness, put and carried unanimously. Denio et al vs The Clerk informed the Council that there would be some expense City - Court expense on account of jury -men and court reporters in connection with trial Denio, Hart, Taubman & Simpson vs City of Huntington Beach in the City of Santa beginning Tuesday, October 22, 1940. A demand in the sum of $300.00 was ordered drawn for this purpose. Sale of Lot This being the date set for sale at , 3, B1k.1105, g public auction Lots 3 4 and VDM south 1 of 5, Block 1105, Vista Del Mar tract, the Mayor proceeded to call for bids from those present. The Clerk informed the Mayor that he had on file a bid of $100.00 by F.J.Gillespie for Lot 3, Block 1105, above mentioned, that other bids were on file covering Lots 3, 4 and south J of 5. Those present were informed that in accordance with ad- vertisement, Lot 3 would be sold first and that Lots 4 and south J of 5, would be offered in a separate sale. Lot 3 was offered:; the first bid being F. J. Gillespie $100.00. Bids were increased to the amount of $250.00, this being the highest bid, Lot 3 was declared sold to Mrs. Anna L. Farley of 1736 Wall Street, Los Angeles, California. • Lot 4 & soya Lot 4 and south 2 of 5 were. then offered for sale, the highest bid5, 1105, VDM being $65.00 by Mrs. Anna L. Farley, same was declared sold to Mrs. Farley for the sum of $65.00. Mayor McCallen excused At this time 8;05 P.M., Mayor McCallen asked to be excused from the Council. Mayor pro-tem On motion by Grable seconded by Morehouse, Councilman Chamness was Chamness appointed Mayor pro-tem. Garbage contract On motion by Morehouse seconded by Grable, the City Attorney was authorized and directed to prepare a garbage contract for the period of three years in the name of Julius B. Cail and Grace G: Minner for a con- sideration of $140.00 per month. s .d Page 3, Minutes Oct. 21, 1940 4 Demands - Lee -se agreement for roller On motion by Morehouse seconded by Grable, demands approved by the Finance Committee were ordered paid. On motion by Morehouse seconded by Grable, the City Attorney was authorized and directed to prepare a lease agreement with option to purchase a five to eight ton Galion Tandem roller from Brown -Bevis Equipment Company, Los Angeles. The rental cost per month to be approximately $186.69. Motion put and carried unanimously. On motion by Morehouse seconded by Grable, the Council adjourned until 7:30 P.M.. Monday, October 28, 1940. Pursuant to adjournment of October 21st, 1940, the Clerk appeared -at the Council Chamber. There being no quorum present, the Clerk adjourned the meeting.
