Pursuant to adjournment of November 6th, 1940, the City Council met and was called to order at 7:30 P.M. by Mayor McCallen. • Councilmen present: Grable, Talbert, Morehouse, McCallen. Councilmen absent: Chamness. Ord.#443 - The Clerk gave Ordinance No. 443, prohibiting trespassing on private 1st Reading property, its first reading at this time. Claim The Clerk read a letter from Elisabeth Truelson, Salt Lake City, Utah, referring to an accident resulting in an injury to herself which she claims happened in the municipal trailer camp. The letter was referred to the City �+ Clerk with instructions to forward a copy of same to the insurance company. Surety bond - On motion by Morehouse seconded by Grable, the surety bond of S. E. S . E . Talbert • Talbert, housemover, was accepted and ordered filed. Quitclaim deed The Clerk read quitclaim deed from the City of Huntington Beach to Lot 3, 1105, VDM Anna, L. Farley covering Lot 3, Block 1105, Vista Del Mar Tract and, on motion by Morehouse seconded by Grable, the Mayor and City Clerk were autho- rized"to execute same on behalf of the City and the City Clerk was authorized to deliver the deed upon receipt of $250.00. Grant deed The Clerk read grant deed from the City of Huntington Beach to Anna L. • Lot 4' & so.; of 5, 11059VDM Farley covering Lot 4 and So. 2 of Lot 5, Block 11052 Vista Del Mar Tract and, on motion by Talbert seconded by Grable, the Mayor and City Clerk were authorized to execute same on behalf of the City and the City Clerk was authorized to deliver deed upon receipt of $65.00. Ray Yakura - On motion by Talbert seconded by Grable, the City Council ordered the ball of sale payment of $800.00 to Ray Yakura covering bill of sale and all rights, title and interest under a certain lease agreement between the City of Huntington Beach and Ray Yakura. The City Attorney was authorized to prepare bill of • \ sale and completion of agreement and present same to the City Council at its _next meeting. Surety bond- On motion by Talbert seconded by Grable, the surety bond of C. R. Furr, C.R.Furr City Controller, was accepted and ordered filed. Reso.#874 The Clerk read Resolution No. 874, cancelling taxes on city owned cancelling on city property and, on motion by Talbert seconded by Grable, Resolution No. 874 owned property was passed and adopted by -the following vote: AYES: Councilmen: Grable, Talbert, Morehouse, McCallen. NOES: Councilmen: None. ABSENT: Councilmen: Chamness. 0 492 Page 2, Minutes Nov. 18, 1940 Reso.#875 cancelling The Clerk read Resolution No. 875, cancelling taxes on city taxes on city owned property owned property and, on motion by Grable seconded by Talbert, Reso- lution No. 875 was passed and adopted by the following vote: AYES: Councilmen: Grable, Talbert, Morehouse, McCallen. NOES: Councilmen: None. ABSENT: Councilmen: Chamness. Reso.#876, cancelling The Clerk read Resolution No. 876, cancelling weed cleaning weed cleaning charges on tax deeded charges on tax deeded property and, on motion by Morehouse seconded property by-Grable, Resolution No. 876 was passed and adopted by the follow- ing vote: AYES: Councilmen: Grable, Talbert, Morehouse, McCallen. NOES: Councilmen: None. ABSENT: Councilmen: Chamness. Offer on Lots 2 & 4, The Clerk read a letter from Mrs. M. C. Aleridge, 622 - 10th Block 413, H.B. accepted Street offering to pay the City $150.00 net for tax deeded lots Trash disposal 2 and 4. Block 413, Huntington Beach 17th Street section and, on motion by Talbert seconded by Grable, the offer was accepted with the understanding that the buyer is to pay all escrow charges and other charges incurred in making the transfer, also to pay for title insurance and on completion of the escrow that the Mayor and City Clerk be authorized to execute -same on behalf of the City. Motion put and carried unanimously. Mayor McCallen stated that he had discussed the matter of contracting trash disposal with a Mr. Jauman and that they had come to the conclusion that the work could better be handled by the City. Trial e Denio et al Mayor McCallen stated that he had discussed the matter of the trial Denio et al vs City of Huntington Beach with Attorney Drumm and had been informed that the date set for delivering arguments before the Superior Court for a new trial would probably be within the next three weeks.` Mayor McCallen asked that City Councilmen keep in touch with the City Attorney and be on hand at the time of the argument. Drain City Engineer Overmyer stated that he had made a preliminary survey of the proposed drain in the vicinity of 8th and Walnut and found that some 30 acres drain into that locality and that it will take approximately 21 inch pipe to carry the water to the ocean and, on motion by Morehouse seconded by Talbert, the City Engineer was directed to prepare plans and an estimate of cost of drainage from 5th to 17th on Ocean Avenue and back as far as Walnut having in mind a W.P.A. project and present same to the City Council at his earliest convenience. Letter from .Press -Telegram The Clerk read a letter from the Press -Telegram asking the City for a one-half page Ad for its issue of January 2nd. The . 1 1 matter of action by the Council was deferred until its meeting of December 2nd. • Page. 3, Nov. 18, 1940 34 Demands On motion by Talbert seconded by Grable, demands approved by the Finance Committee were ordered paid. Oil derrick Engineer Overmyer stated that an oil derrick on Lots 4 and 5, unsafe Block-813, Wesley Park tract is in lad condition due to poor under- pinning and, on motion by Grable seconded by Morehouse, the city attorney was directed to contact the owner of record and inform him that the derrick must be made safe within 30 days or the City will • take action to demolish the derrick. Neon sign On motion by Talbert seconded by Grable, the City Engineer was authorized to replace Neon sign at Five Points at a cost of approxi- mately $25.00. 13th St. storm Engineer Overmyer reported that the 13th Street storm drain has drain completed �+ beensatisfactorily completed and that the application to W.P.A. for labor to construct a storm drain on the northerly side of Lake Park was not approved by the W.P.A. officials. Contract.- At next meeting of the City Council, the matter of executing • American Air- craft Co. contract with the American Aircraft Company will be discussed.
