HomeMy WebLinkAbout1941-11-03y MINUTES Council Chamber, City Mall, Huntington Beach, California Monday, November 3, 1941 The regular meeting of,the City Council was called to order at I 7:30 P.M. by Mayor McCallen. Councilmen present: Chamness,Grable, Talbert, Morehouse, McCallen. Councilmen absent: None. Minutes Upon motion by Chamness seconded by Morehouse, minutes for the month of October were approved as read. Monthly The Clerk read monthlir reports of the City Treasurer, City Clerk, Reports City Judge,; City Engineer, City Collector and Chief of Police for the month of October and, on motion by Talbert seconded by Chamness, same were accepted and ordered filed. Resolution The Clerk read Resolution No. 891 accepting deed for approximately #891 - accepting ten.: acres along the Coast Boulevard within the city limits and autho- deed to 5 acres along rizing the Clerk to record same and, on motion by Talbert seconded by Coast Blvd. Chamness, Resolution No. 891 was passed and adopted by the following vote: AYES: Councilmen: Chamness, Grable, Talbert, Morehouse, McCallen. NOES: Councilmen: None. ABSENT: Councilmen: None. Mr. Bundy Mr. F.E.Bundy addressed the Council and stated that one of the executive members of the Palisades Corporation had died recently but arrangements had been made for deeding the City certain property for street purposes in the old Methodist camp grounds. Mr. Bundy stated that he had prepared a deed to the City covering a strip on the westerly side of Eleventh Street and asked that the City advance the sum of $400.00 to cover expense of moving fences and a garage. He also stated that he would prepare immediately a deed covering a portion of the circle in the center of the camp grounds. The matter was referred to Councilmen Morehouse and Talbert for their recommendations. Surety bond - on motion by Chamness seconded by Grable, the surety bond of R. R. R.R.Jones Elec. _ Co. Jones Electrical Company was accepted and ordered filed. Renewal of lease - The Clerk presented and read renewal of lease from the Pacific P.E.Ry.Co. Electric Railway Company covering a 22 foot strip of the right-of-way 0 between Main and First Streets and, on motion by Talbert seconded by Chamness, the Mayor and Clerk were authorized to execute same on be- half of the City. Contract - A contract between the City and Stevenson Chemical Company for Stevenson Chemical Co. furnishing the City with liquid chlorine from December 31, 1941 to � December 31, 1942 was read and, on motion by Talbert seconded by More- liouse, the Mayor and Clerk were authorized to execute same on behalf of the Citv_ Bage- 2. o Minutes Nov. 3,1941 71 11 r Bids - This being the time set for opening bids for the construction and Delaware Ave. improvement of Delaware Avenue in the City of Huntington Beach, the Clerk opened and read bid of Sully -Miller Contracting Company, 1500 West 7th Street, Long Beach, California. Their bid was the sum of $4,500.00 and was accompanied by a certified check in the amount of $250.00 and, Y on motion by Chamness seconded by Talbert, action was deferred until next meeting of the City Council. Waste Water The Clerk read a report from the City Engineer calling attention to delinquen- cies a number of oil companies delinquent in paying waste water assessments and, on.motion by Talbert seconded by Grable, the City Attorney was authorized to write letters to the various companies to the effect that if the amounts are not paid immediately steps will be taken to enforce the provisions of Ordinance No. 280. Liability- The Clerk read a letter from Huston, Suter & Huston, agents, offering Sowest Exp. Christmas to attach a rider to the City's liability policy indemnifying the South - display west Exploration Company in the amount of $50,000.00 for one person or $100,000.00 for more.than one in the event a Christmas display is construct- ed and maintained on their pumping wells along Ocean Avenue during the Christ- mas season at a.cost of $50.00 and, on motion by Grable seconded by Chamness, the sum of $50.00 was allocated to pay the above named premium in the event the Southwest Exploration Company decided to proceed with the work. The matm ter was referred to Mayor McCallen for his investigation and report. r Armistice On motion by Chamness. seconded by Grable, the sum of $100.00 was Day float allocated to the Chamber of Commerce to construct float for the Armistice Day parade at Fullerton. Letter - The _Clerk read a letter from E. Raymond Cato _relative to furnishing E.Raymond Cato additional officers in Orange County and to the effect that the State had not provided sufficient funds to increase the force at the present time. The letter was ordered filed. State well On motion by Talbert seconded by Chamness, the application of South- #43 west Exploration Company to drill well known as State No. 43 was approved. Offer on The Clerk read a letter from Beulah Westmoreland enclosing a check Lot 18, Blk. 105 - for $25.00 and offering the sum of $75.00 for Lot 18, Block 105. The Mrs.West- morelapd Clerk was directed to return the check and advise Mrs. Westmoreland that r the property has not been cleared but�that as soon as this has been done she will be notified.and permitted to bid on the lot. Christmas On motion by Chamness seconded by Grable, the Chamber of Commerce was program in Pav-A-Lon given permission to use the Pav-A-Lon on Sunday afternoon, December 21st, for staging a Christmas program, all charges to be waived. Shell Oil The Clerk read a letter from the Shell Oil Company, Inc., Land Dep- Co. - pipe line artment, asking permission to assign their interest in a section of four r inch pipe line on Huntington Avenue from the City limits to the south side of Wichita Street under Street Permit No. 249 to the Beloil darporation, 762 Page 3 - Minutes* Nov.3,1941 Ltd.., whose address is 221 E. Regent Street, Inglewood, California, and on.motion by Councilman Talbert seconded by Councilman Chamness, the request was . gra.nted and the City Clerk directed to so notify the Shell Oil Company. irlemorial Hall: On motion by Grable seconded by Talbert, the Santa Ana Junior Sa.ntaAna Junior College College was given permission to use Memorial Hall for a dance Friday evening, December 19th, 1941, at the usual charge of $5.00, Fullerton Junior On motion by Talbert seconded by Morehouse, the Fullerton Junior College College was given permission to use Memorial Hall for a, dance on Friday evening November 28, 1941, at the usual charge of $5.00. War Department- The Clerk called the City Council's attention to a number of " questions questions to be answered to the War Department relative to the city equipment and especially to No. 4 which reads as follows: "In case y of emergency would you voluntarily hire or lease vehicles to a _ federal agency". The City Council agreed unanimously that answer to this question should be "Yes". Huntington On motion by Grable seconded by Talbert, the application of Signal Oil _ Huntington Signal Oil Company to erect and operate day and night heater on property at 15th and Ocean Avenue was approved. Sgt.Brooks -- The Clerk read a letter from Sergeant Hank Brooks thanking the LLett er _ City Council for past favors. The letter was ordered filed. Demands On Notion by Talbert seconded by Chamness, demands approved by the Finance Committee were ordered paid. Lease - Upon recommendation of Councilman Chamness and on motion by Tipton Chamness seconded by Talbert, the City Attorney was authorized to prepare a new three year lease between the City and Chas. B. Tipton - covering concession on municipal pier in the amount of $300.00.per year, payable $25.00 per month in advance. Terms of the lease to be same as one now in effect. r Resolution 892 - The Clerk read.Resolution No. 89.2, establishing a two hour park - parking Limit Amend. Ord. - stop sign Taxes due City ing limit -on Walnut Avenue between Third Street and Main Street and, on motion by Chamness seconded by Talbert, Resolution No. 892 was passed and adopted by the fallowing vote: - AYES: Councilmen: Chamness, Grable, Talbert, Morehouse, McCallen. NOES: Councilmen: None ABSENT: Councilmen: None On motion by Chamness seconded by Grable, the City Attorney was, authorized to prepare an amendment to City Ordinance providing for a stop sign on the southerly side o-f-Summit Street at its intersection with Main Street. On motion by Chamness seconded by Grable, the City Attorney was authorized to proceed to collect the sum of $48.96, taxes due the City on Lots 19 and 20, Block 602, Vista Del Mar Tract. r I Page 4 - Minutes Nov.3,1941 Quit -claim The Clerk read quit -claim deed by the City covering Lots 5 and 7, deed Block 711, Wesley Park section, for the purpose of clearing title to South Basin Oil Company. On motion by Talbert seconded by Chamness, the Mayor end Clerk were authorized to execute same. Health Attorney Overacker informed the Council that the City would have the Officer choice of one of two plans for the employment*of a health officer. First - The City may enter into a contract with the County similar -to the one now in effect thereby retaining control in the event they wish to employ a City Health officer. Second-- The City can surrender all its rights and turn the matter over to the County to be administered as they desire. After some discussion, the City Attorney was authorized to prepare and present.a contract similar to the one which expired during the month of September, Mrs.Zacharias Councilman Talbert stated that Mrs. Zacharias, owner of the Cook Apartments, had complained about water damaging her property and urged the City Council to take some action to remedy the condition. Mr. F, Talbert was informed that the City had no budgeted funds for the install- ation of a drainage system in that district. Trailer Park_ Councilman Chamness recommended the extension of the trailer park camp extension recommendedto the easterly end of the .City owned beach, also that shower rooms be by Councilman Chamness finished in tile. The matter was referred to the City Engineer and Beach and Pier Committee to furnish an estimate for next meeting :of the City Council and the City Clerk was directed to submit memorandum covering, possible revenue during the present tax period. •- r� Bldg - Councilman Morehouse called attention to a building erected by the American Aircraft American Aircraft Company on City property and expressed the opinion that some action should be taken by the City Council to clear the property and have the building -moved to the city yard. On motion by Chamness seconded by Talbert, the City Attorney was directed to write the American Aircraft Company at their last known address to the effect that the City intends to take possession of the building for the reason that the proposed contract has not been complied with. Mayor McCallen -Mayor McCallen informed the Council that he believed an oil producer Oil was extracting oil from beneath Property_belonging;.to the':City easterly from 23rd Street and recommended that the'.City take some action to recover royalties. Action by the Council was deferred for further investigation. License Mayor McCallen stated that he believed that the City would be justi- fied in collecting license for the operation of marble machines, punch boards and other similar devices. The matter was referred to the City Attorney and Councilmen Chamness, Talbert and Morehouse to investigate and report at next meeting of the City Council. r 11 74 Page 5 - Minutes Nov.3, 1941 Aircraft Associates Councilman Talbert informed the Council that he had been in communication with Aircraft Associates of Long Beach relative to the establishment by them of a landing field and manufacturing plant in or near the easterly city limits. Mr. Talbert stated that the land could be bought at approximately $350.00 an acre and that the total cost to the City would be approximately $95,000.00 including the purchase of the land, drainage and runway. The matter was re- ferred back to Councilman Talbert and the City Engineer to prepare and submit a preliminary estimate of the cost of drainage, runway, etc., after which it was agreed by the Council to meet with the prospective lessee. On motion by Chamness seconded by Grable, the Council adjourned until 7:00 o'clock P.M. Friday, November 7th, 1941.
