Monday, August 24, 1942
Pursuant to adjournment of August 17th, the.City Council met and
was called to order at 7:30 P.M. by Mayor Talbert.
Councilmen present: Henrickson, Grable, Morehouse, Talbert. (Council-
man Hawes arrived at 8:15 P.M.)
Councilmen absent: None.
The Clerk read a letter from Drumm & Drumm, attorneys, relative to
the case of Denio et al vs City of Huntington Beach and containing certain
recommendations and proposals for continuing the case and, on motion by
Morehouse seconded by Grable, the Council voted unanimously to accept
the proposal of Drumm & Drumm and authorize them to proceed with the
case in accordance with the suggestions contained in the letter.
On motion by Henrickson seconded by Morehouse, the application of
Frito Company of California for wheel tax license was approved.
The Mayor appointed Councilman Grable on the Finance Committee.
The Clerk read a letter from insurance agent C. H. King calling
attention to the enclosure of check in the amount of $113.65 repre-
senting the amount of returned premium due on city fire insurance
policy No. 6257 and stating that this was made possible by:a reduct-
ion in rates retroactive to July 1941. The Clerk was directed to call
attention to the change in rates to Huston, Suter and Huston, J. K.
McDonald and Ila N. Dabney, insurance agents, and ask that they have
their companies make the proper refunds.
Harbor Catering The Clerk read a letter from Harbor Catering Company of Long
Co.
license Beach relative to bill from the City for license covering their store
on -Lake Avenue. The company stated that they had not been asked to
pay similar license in other cities and that they were of the opinion
that no license was due the City of Huntington Beach and, on motion by
Morehouse seconded by Henrickson, the Chief of Police was directed to
proceed to collect the license on the grounds that same are due the
City from this company the same as from the public firms in the City
of Huntington Beach.
War Saving The Clerk read a letter from the U. S. Treasury Department suggest -
bonds
ing that the City Council adopt an ordinance or resolution permitting
city employees to file applications with the City to deduct a certain
portion of their monthly pay check for purchase of War Saving Bonds.
The matter was referred to the City Attorney to prepare and present a
proposed plan.
Mothers of The Clerk read a letter from Mothers of Armed Forces of America

asking that a member of the City Council be appointed to act as

committeeman in raising funds to send some 200 Christmas packages to
members of the Armed Forces of the United States. The Chair appoint-
ed Councilman Morehouse as a committee of one to meet with the organization.
Sheldon The application of Sheldon Enders to cut curb at the rear of Lots

curbing 25 and 27, Block 506, Huntington Beach Main Street Section, was approved
on motion by Henrickson seconded by Grable and referred to the City
Engineer for his supervision.
r Claim - The Clerk presented and read a verified claim of the City of
War Dept.
Huntington Beach against the United States War Department for electric
and gas charges paid by the City for the War Department and, on motion by
Henrickson seconded by Gable, the Mayor and Clerk were authorized to
• execute same on behalf of the City and that the claim be verified by the
deputy city clerk after which the city attorney is authorized to file it
for payment with the War Department.

Contract - On motion by Henrickson seconded by Hawes, contract between the City
Clapp of Huntington Beach and Dwight K. Clapp was approved as read.
Lease amended -The Clerk read an. amendment to the lease between the City of Hunt -
Westmoreland Beach and Beulah Westmoreland and, on nation by Henrickson seconded
by Morehouse, the Mayor and Clerk were authorized to execute same on behalf
of the City.
Cancellation On motion by Hawes seconded by Grable, the City Attorney was authorized

Tipton to prepare a cancellation agreement between the City and Charles B. Tipton
covering lease on pier concession with the provision that the amount now due

the City be paid in $10.00 monthly installments.
y Quitclaim The Clerk read quit -claim deed to the City of Huntington Beach from
deed - Frankley
Harriman Frankley-Harriman, Inc. quit -claiming to the City 44 acres, more or less,
{ which was covered by lease of the City dated May 11, 1942. The Clerk read
Reso. #9()I�esolution No. 903, accepting the above named quit -claim deed and, on motion

' by Henrickson seconded by Hawes, Resolution No. 903 was passed and adopted
by the following vote:

ABSENT: Councilmen: None.
Demands On motion by Henrickson seconded by Grable, demands approved by the
Finance- Committee were ordered paid.
` Agreement The Clerk read an agreement dated August 24, 1942, between the City of

Huntington Beach and Adelaide Lucille Merritt and Elizabeth Margaret Guercio
A covering certain real property in Block 412, Huntington Beach 17th Street
' Section, to be used for street purposes and, on motion by Henrickson second-
ed by Morehouse, the Mayor and City Clerk were authorized to execute agreement ,
on behalf of the City.

and, on motion by Henrickson seconded by Hawes , Resolution No.
904 was passed and adopted by the following vote:

Grant The Clerk read Grant deed of the .City of, Huntington Beach
deed
to Adelaide Lucille Merritt and Elizabeth Margaret Guercio covering
a portion of Parcel "C" as described in the decree rendered January
29, 1926 in the Superior Court of the State of California, Defendant
Case No. 19415, included within Block .412, Huntington Beach 17th

Street Section and, on motion by Henrickson seconded by Hawes, the
Mayor and Clerk were authorized to execute the deed on behalf of the
City.
At this time, 9:50 P.M., Councilman Hawes was called from the
Council Chamber.
On motion by Henrickson seconded by Grable, the surety bond of
George M. Mitchell was approved and accepted.
On motion by Henrickson seconded by Grable, the Council voted
unanimously to pay compensation insurance for band employees employed
by the City in the future.
On motion by Henrickson seconded by Morehouse, the City Engineer
was authorized to secure informal bids for moving the Standard Oil
Company recreation building to 37th Street part and submit to the City
Council.
Attorney Overacker informed the Council that progress was being made ..
in collecting delinquent licenses and that he.had found it necessary to
start action against some of the delinquents.
Councilman Hawes returned to the Council Chamber -at 9:15 P.M.
On motion by Henrickson seconded by Hawes, the Council adjourned.
