Pursuant to adjournment of Wednesday, October 6th, the City Council met and was called to order at 7:30 P.M. by Mayor Talbert. Councilmen present: Henrickson,,. Hawes, Morehouse, Talbert. Councilmen absent: None. On motion by Hawes seconded by Grable, demands approved by the Finance Committee were ordered paid. The Clerk presented and read Ordinance No. 476 for the second time and, on motion by Henrickson seconded by Hawes, Ordinance No. 476 was passed and adopt- ed by the following vote: AYES: Councilmen: Henrickson, Grable, Hawes, Morehouse, Talbert. NOES: Councilmen: None. ABSENT: Councilmen: None. C.M.Garrison C. M. Garrison addressed the Council and stated that he wished to purchase .rr contract to purchase Lots 13 and 15, Block 315, Huntington Beach Tract, on which the City holds tax lots title. The price offered being $250.00 to be purchased on contract $100.00 cash and balance when City has cleared title to the lots and, on motion by Hen- rickson seconded by Grable, the City Attorney was authorized to prepare a con- tract providing for 6% interest on unpaid balance. Motion put and carried by the following vote: AYES: Councilmen Henrickson, Grable, Hawes, Talbert. NOES: Councilman Morehouse. �. ABSENT:- None. Denio et al Special Attorney F. C. Drumm informed the Council that'he had had a conference with Attorney Forgy, counsel for Denio et al vs the City of Huntington Beach. That Attorney Forgy had indicated that Denio, Hart, Taubman and Simpson are will ing to settle with the City for a flat sum of approximately $50,000.00, same to be paid in installments over a period of years. Attorney Drumm recommended that the City through a special committee make further effort at settlement by continuing conversation and negotiations for a lesser cash payment in installments and, on motion by Morehouse seconded by Henrickson, the Mayor was authorized to appoint a committee from the City Council to join with Attorney Overacker and Attorney .. Drumm to consult with the attorney and plaintiffs in the above named case. On motion by Grable seconded by Hawes, Mayor Talbert was appointed to represent the City Council on the above named committee and report back to the City Council. v Special Attorney Drumm recommended that the City permit him to employ Judge Craig to assist in briefing the case of Denio et al vs City of Huntington Beach w at a cost not to exceed $250.00 and, on motion by Hawes seconded by Grable, special attorney�Drumm was authorized to employ somebne to prepare a brie' in the above named case-at,,an expense not to exceed $250.00. b r '% 2 Minutes 10-11-43 At this time, 9s05 P.M., the Mayor declared a recess to go Recess into executive session.. The City Council was again called to order at 10:25 P.M. by Mayor Talbert. Councilmen present: Henrickson, arable, Hawes, Morehouse, Talbert. Councilmen absent: None.
