HomeMy WebLinkAbout1943-10-25Y I 16 Huntington State State #4 MINUTES Council Chamber, City Hall, Huntington Beach, California Monday, October 25, 1943 Pursuant to adjournment of October.11th, the City Council met, and was called to order at 7:30 P.M. by Mayor Talbert. Councilmen present: Henrickson, Grable, Morehouse, Talbert. (Councilman Hawes arrived at 8:00 P.M.) Councilmen absent: None. The Clerk presented and read application of Huntington State Company for permit to drill State No. 4, between 20th and 21st Street near the ocean front. The location being only 47 feet from the Pacific Electric Railway_. line,the Mayor stated that he would proceed with the hearing on the appli- cation. City Engineer Overmyer testified under oath that it was his belief that no hazard existed because the derrick construction is to be of steel and that no passenger trains are now being operated on the Pacific Electric �1.. railway. On motion by Henrickson seconded by Grable, the Council voted unanimously to waive the provisions of Ordinance No. 419 and issue the permit. Quitclaim The Clerk read Quitclaim Deed to Gladys C. Harris of Lots 17 and 19, deed Lots 17 & ..$lock 317, 17th Street Section and, on motion by Morehouse seconded by Grable, 19,317 the Mayor and Clerk were authorized to execute the same. War Savings The Clerk informed the Council that the following United States War Bonds pur- chased Savings Bonds, Series G issued as of September 1, 1943, maturity date twelve years from issue, had been received and deposited with the City Treasurer: No. v 261355G $5,000.00 No. M 20237%65G 1,000.00 No. M 1889466G 1P000.00 No. M 1989467G 10000.00 No. M 1889468G 10000.00 ,No. M 188947OG 12000.00 Resolution The Clerk read Resolution No. 919 cancelling weed cleaning charges on #919 cancell- City Tax Deed lots and, on motion by Henrickson seconded by Morehouse, Re- ing weed charges solution No. 918 was passed and adopted by the following vote: AYES: Councilmen: Henrickson, Grable, Morehouse, Talbert. NOES: Councilmen: None. .ABSENT: Councilmen: Hawes. Orange Co. The Clerk read a letter from the Orange County Tax Collector to the Tax Coll. Lot 219 effect that it is his intention to sell at public auction Lot 21, Block 711, 711 W.P. Wesley yark Tractm Huntington Beach. Following motion by Councilman Henrick- son: "That the City Council consent to the County sale and that City Attorney i Overacker be authorized to take the necessary action to protect the City's interest." Motion seconded by Morehouse, put and carried unanimously. Councilman At this time, 8:00 o'clock P.M., Councilman Hawes arrived, Hawes arrived 2Y4 Page #2 - Minutes Oct .25 ,1943 Ordinance #477 The Clerk gave Ordinance No. 477 declaring the destruction of proper - passed ty owned by the City to be a misdemeanor, its second and final reading and, on motion by Grable seconded by Morehouse, Ordinance No. 477 was passed i and adopted by the following vote: AYES: Councilmen: Grable, Hawes, Morehouse, Talbert, Henrickson. NOES: Councilmen: None, ABSENT: Councilmen: None. Applications: On motion by Hawes seconded by Grable, the license application of Hotely W. M. Martinson to operate hotel at 210 Main Street was approved, Furniture Store On motion by Grable seconded by Hawes, the application of Laura Freeman to operate furniture store at 307 Main Street was approved. Land The Clerk presented and read a land lease between the City of - Lease Huntington Beach and B. Aldabe and Felix V. Hernandez dated October 150 1943, and on motion by Henrickson seconded by Hawes, the Mayor and Clerk were authorized to execute same. Surety Bond On motion by Fienrickson seconded by Hawes, the surety bond and '` blanket agreement of the Huntington State Company was accepted and ordered filed. Denio et al Mayor Talbert informed the Council that he and special Attorney Claim Drumm met with Attorney Forgy relative to a settlement of the claim of Denio et al. No definite agreement was reached and Mayor Talbert said Denio et al were still demanding approximately $50,000,00 for a settle- ment. The Clerk read a letter from Attorney Fred Forgy setting forth balance due as claimed by Denio et al which in effect is.in accordance . with their interpretation of the terms of the contract between themselves and the City of Huntington Beach. The letter was ordered filed, Attorney Drumm stated that he had met with former Judge Craig who is making a -study of the case of Denio et al vs City of Huntington Beach and that Judge Craig is continuing his investigations. Special Attorney Attorney Drumm informed the Council it was his opinion that it will .: Drumm •cost the City considerable money in attorney fees and otherwise if the City decides to and is successful in carrying the case to the United States v " Supreme Court and that he has not had time to go into the law sufficiently to state whether or not the City may expect a favorable decision and, on motion by Henrickson seconded by Morehouse, the letter of Attorney Fred, Forgy was referred to City Attorney Overacker and special Attorney Drumm with authority to contact the attorney for Denio et al and inform him that the letter above referred to is not quite clear to the City Council y and that it does not specify a lump sum for settlement and conclusion of -their contract, Hazel Mollica .On motion by Henrickson seconded by Hawes, and upon recommendation of Engineer Overmyer, Hazel Mollica was placed on an hourly basis at 65¢ per hour, Classification "B", effective November 1, 1943. Council again called to order at 10:15 P.M., all five members present. Agreement The Clerk presented and read an agreement between the City of Hunt- ington Beach and J. C. Aldrich dated October 20, 1943, and on motion by Henrickson,seconded by Grable, the Mayor and Clerk were authorized to sign same on behalf of the City.' Agreement The.Clerk presented and read an agreement dated October 20, 1943, be- tween M. N. Young and the City of Huntington Beach and, on motion by Henrick- son seconded by Morehouse, -the Mayor and clerk were authorized to execute same on behalf of the City. 1„ Demands On motion by Henrickson seconded by Hawes, demands approved by the Finance Committee were ordered paid.
