HomeMy WebLinkAbout1943-11-160a 1 A 1 Y 11 J .y MINUTES Council Chamber, City Hall, Huntington Beach, California Tuesday, November 16, 1943 Pursuant to adjournment of November 15th, the City Council met and was called to order at 4:30 P.M. by Mayor Talbert. Councilmen present: Henrickson, Grable, Hawes, Morehouse, Talbert. Councilmen absent: None. Agreement - The Clerk presented and read an agreement between the City and the Office of Price Administration, War prices and Ration Board 82.6.7, Huntington Beach, for the use of Memorial Hall and city owned equipment and, on motion by Henrickson seconded by Morehouse, the Clerk was autho- rized to execute same on behalf of the City. Mr. Drumm Mayor Talbert stated that he had had.a telephone conversation with special attorney F. C. Drumm and that Mr. Drumm had stated that his letter dated November 5, 1943, did not cover fees to be charged while representing the City before the Supreme Court of the United States in Washington, D.C. On motion by Councilman Grable seconded by Councilman Hawes, the Council voted unanimously to employ F. C. Drumm as special counsel for the City in the case of Denio, Hart, Taubman & Simpson in accordance with the provisions contained in the following letter from Attorney F. C. Drumm: "Santa Ana, California November 5, 1943 City of Huntington Beach Huntington Beach, California ATTN. MAYOR T. B. TALBERT and CITY COUNCIL Gentlemen:-,, .f This is to confirm my oral statement to you at a meeting of your City Council on November 1, 1943, that I would accept a retainer of $1000 and $75 per day for services to be performed by me from and after November 1, 1943, in connection with any matters involved.in any litigation between Denio, Hart, Taubman & Simpson and the City of Huntington Beach, whether the services so performed were in court or in my office or elsewhere, other than in the Supreme Court of the United States, in addition to which compensation I am to receive necessary traveling or other expense; the retainer and per diem com- pensation torbe'In%:addit on to any moneys paid or to be paid by the City td me and expended by me in procuring assistance authorited by the City in connection with briefing or other phases of the legal work. It is my understanding that your City Council passed a resolution regarding the retainer and per diem mentioned at the November lat meeting, and if your City Attorney desires any further action by your Council in this connection he will so advise you. Drumm in the amount of $1,000.00 was ordered paid as approved by the Finance Committee. On motion by Hawes seconded by Grable, the Council adjourned until 7:30 P.M. Monday, November 29, 1943.
