'Mayor City ler MINUTES Council Chamber, City Hall, Huntington Beach, California Monday, August 21, 1944 The regular meeting of the City Council was.called to order at 7:30 P. M. by Mayor Talbert. Councilmen present: Henrickson,.Grable, Bartlett,' -Talbert. Councilman Hawes arrived at 7:40 P.M. Councilmen absent: None., Ord,#483 o Ordinance No. 483, regulating use of the public beach, was given' first reading its first reading at this time by the clerk. D. C. Terry - The clerk read a letter from D. C. Terry asking permission to have Tree in parkway tree removed from the parkway,in front of his residence. The matter was referred to the Streets and Parks Committee. Councilman Aawes arrives a Councilman Hawes arrived at this time, 7: 40 P. M. Application o On motion by Grgble seconded by Bartlett, the application of Dale D. _ Cafe Potts to operate cafe at 412 Walnut was a pproved. Application On motion by Hawes seconded by H4enrickson, the application of Lew A. Auto supply Kinney for license to operate auto supply at 121 Main Street was approved. Application o On motion by Bartlett seconded by Hawes, the application of Lew A. Electric -sign Kinney to erect electric sign at 121 Main Street was approved. War Depto The Clerk read a letter from the office of the Division Engineer, War alley Department, asking permission to fence a certain portion of an alley and, on motion by Hawes seconded by Henrickson, permission was granted. All'Renew lease on On motion by Henrickson seconded by Hawes, the Clerk was directed to golf course write the Huntington Beach Company and request renewal of the golf course lease. t J + Page 2 = Minutes Aug. 21, 1944 State Guard The Clerk read a letter from Lieut. H. L. Hopkins requesting Memo Hall permission to use Memorial Hall on each and every Tuesday evening for meetings of the State Guard and, on motion by Grable seconded by Bartlett, the request was granted with the understanding that should an emergency arise whereby the Council should request the use of the hall for other purposes that they may do so. 4. Lot 14, Blk 602, The Clerk read a letter from County Auditor L. W. Eckel VDM stating that.the County had sold tax deeded Lot 14, Block 602, Vista Del Mar Tract, on August 7, 1944 and, on motion by Hawes seconded by Grable, the Clerk was authorized to prepare and submit a record of all taxes and penalties due the City and submit same to the County with the request that the city be given its portion of the money received by the County. Miller - 5:62 And, on motion by Bartlett seconded by Henrickson, the list was re - (erred to the City Attorney with directions to proceed to collect. Co. League of Attorney Overacker stated that the County League of Municipal - Municipalities Aug.24th ities would meet at 6:30 P.M. Thursday, August 24th at the 101 Cafe, Seal Beach. The following officials stated that they would attend: Councilmen Grable and Bartlett, Judge Patton and City Clerk Furr. Mr. Ferris Mr. Ferris, owner and operator of the amusement devices in front of the Pav-A-Lon addressed the Council and asked the Council .Y to continue for another week. After some discussion, it was de- cided permission could not be granted. Mr. Ferris also asked the Council to consider a lease on a certain portion of the beach for the operation of concessions in future years for a period commenc- ing July 1st and ending Labor Day each year. The matter was taken under consideration by the Council. Denio et al vs,City Mayor Talbert stated that on October 2, 1944 the case of Denio of Huntington Beach et al vs City of Huntington Beach would come up in Superior Court at Santa Ana. The Mayor stated that Attorney Drumm needed additional , help to prepare the case and, on motion by Henrickson seconded by Bartlett, Judge Drumm was authorized to employ the required help as suggested to Mayor Talbert in their conversation. �JaF9 Page #3 e Minutes August 21, 1944 t Att'y Overacker m Councilman Hawes stated that he believed Attorney Overacker additional pay while on case should receive additional pay for -his services in the preparation for trial of the above named case, also that he should receive compensation while engaged intrying the case and, on motion by. Hawes seconded by Grable, City Attorney Overacker was granted $50,00 per day for all time spent in doing research work and $75.00 per day for special work during the trial of Denio et al vs City of Huntington Beach, compensation to begin as of August;21, 1944 and continue at the will and pleasure of the City Council. Sidewalk around Councilman genrickson stated that there was a bad place in the Pav®A-Lon cement under the pier which should be repaired, also that the board sidewalk around the southern front of the Pav-A-Lon had developed dangerous splinters. The matter was referred to the City Engineer to investigate and recommend repairs. Ho Bo race track Mayor Talbert stated that horse owners want to use the Hunting- ton -Beach track for meets, also they desired to move some equipment on the property. No action was taken by the City Council pending further investigation. Dance hall Mayor Talbert stated that a Huntington Beach businessman wanted proposed -for beach to lease ground from the city along Ocean Avenue in the easterly part of the city to baild a dance hall, cafe and cocktail room. The matter was taken under advisement. Mr. Overmyer On motion by Grable seconded by Hawes, City Engineer Overmyer was leave granted leave of absence from August 22d to 26th inclusive.
