MINUTES
Council Chamber, City Hall,
Huntington Beach, California
Tuesday, September loth, 1946.
Pursuant to adjournment of September 3d, the City Council met and
was called to order at 7:90 P.M. by Mayor Bartlett.
Councilmen present: Grable, Langenbeck, Bartlett. '
Councilmen absent: Hawes, Terry. (Councilman Hawes arrived at 7:15.P.M.)
Councilman Grable The Mayor appointed Councilman Grable.on the Finance Committee.

` The Clerk read a letter from Ed Bedros asking permission to drop

whiskey bottles containing Bible tracts off the municipal pier and on
motion.by*Grable seconded by Langenbeck, the request was denied.
Reso-#1006 The Clerk read Resolution No. 1006 authorizing the sale of.Lots 33.
Lots 33&359 and 35 in Block 813, Wesley Park Tract, to Kermit M. Riggs and Bonnilynn
Blk 813
Riggs_f or the sum of $400.00, and on motion by Langenbeek.seconded by
Grable, Resolution No. 1006 was passed and adopted by the following vote:
AYES: Councilmen: Grable, Langenbeck, Bartlett.
NOES: Councilmen: None.
ABSENT: Councilmen: Hawes, Terry.
Fire Ins. The Clerk read a letter from Huston, Suter & Huston by D.K. Jones,
to the effect that the real estate agents, namely: Huston, Suter & Huston,
Ila N. Dabney, Chris H. King and J.R. McDonald were forming an association
forthe purpose of dividing insurance commissions in accordance with law.
That they propose to allow Huston, Suter & Huston to write the City's
fire insurance in the amount of $525,000 and to retain 10% of the total
commission and that the remaining .90% be divided equally between the
above named four agencies, and on motion by Grable seconded by Langenbeck,
Huston, Suter & Huston.were authorized to write tae City's fire insurance
for a period of three years at the rate of $1.025 per hundred for three
years,, commission to be divided in accordance with the above named letter.
The City Council agreed that at the expiration of three years Chris H.
King should be permitted to ,write the entire fire insurance in a company
of his choice subject to the approval of the City Council.
Automobile The Clerk informed.the Council that the Rhode Island insurance,
Ins.
represented by Ila N. Dabney, had given notice of cancellation of atto-
mobile insurance as of September 28, 1946, and on September 23rd a new
proposal will be presented the Council to insure automobiles.
New Ford Sedan The Clerk read proposal of Theodore Robins to furnish the City with
a 1946 Ford Super Deluxe Fordor-:� � Sedan, Blue, at a cost of $1,404.54
providing a trade in allowance of $574.00 for the 1939 Plymouth Fordor
sedan, net $830.54, date of delivery on or before September 14, 1946. No
action was taken by the Council pertaining to the proposal.

Loco Ferebee The Clerk read a letter from Engineer Overmyer recommend-

recommendation was approved. ;
Contract,. The Clerk presented afaithful.performance bond in the

Main St. amount of $23, 244. 01 and a contract Bond in the amount of
$11,622.01 for labor and material, presented by John J. Swigart
for the improvement of Main Street, and on motion by Grable
seconded by Hawes, same were accepted and ordered filed.
Deposit chk. On motion by Hawes seconded by.Langenbeck, the Clerk was
authorized,to return deposit check of John J. Swigart which
accompanied bid for the improvement of Main Street.
Storm Drain The Clerk read a letter from Engineer Overmyer submitting

a combined reinforced concrete and vitrified clay pipe storm
drain with its appurtenances on Ocean Avenue, Sixteenth, Seventeenth,
Nineteenth and Twentieth Streets, the cost being estimated at
$17,235.23, and on motion by Grable seconded by Langenbeck, plans
and specifications were approved and accepted.
C. of.Co On motion by Langenbeck.seconded by Grable, the Chamber of
Commerce was asked to furnish an itemized statement of all receipts
and disbursements incurred on account of the Black -Gold Days and
Twin Convention celebration.
Demands On motion by Grable seconded by Hawes, demands approved by
the Finance Committee were ordered paid.
Bond On motion.by Langenbeck seconded by Hawes; the Eagle Oil and

Refining Company was given permission to submit a $1,000.00 blanket
surety bond to be used in making application for drilling oil wells
in accordance with city ordinances.
Amend On motion by Hawes seconded by Langenbeck, the City Attorpey
Ord. 418
was authorized to amend Ordinance No. 418, setting up provisions. -for
a clean up bond in an amount of not less than $5,000.00 for oil well
derricks and operation. +
Attoy City -Attorney Overacker made a verbal request for an increase

of $50.00 per month for office and clerical help, and on motion by
Hawes seconded by Grable, the request was granted as of September]j,
1946.

Resurk ace Councilman Grable stated that he believed it would be well to
back of Police
Dept. resurface the paving back of the Police Department. The matter was
referred to the City Engineer for an estimate.
Lease m Mayor Bartlett stated that he had had a request to lease five

acres at the intersection of Highway 39 and Ocean Avenue on which to
erect and operate a motel. The matter was taken under consideration
and with the suggestion that the applicant submit a proposal.
Smoke Councilman Langenbeck stated that he had investigated the.
nuisance
smoke nuisance at the local laundry and said that it was caused by
burning oil. He stated ths,t if gas could be had and the laundry install
gas burning equipment, he believed this would abate the nuisance. The
Mayor appointed Councilman-Langenbeck and City Engineer Overmyer to
consult the gas company on behalf of the laundry.
Pence Broso
Councilman Langenbeck called attention to the junk yard condition

at Pence Bros. garage across Fifth Street from the City Hall. The matter
was referred to the Chief of Police to have the place cleared in accord-
ance.with Ordinance regulating same.
Riding
Councilman Langenbeck stated that an accident had been caused by
bicycles on
sidewalks
children riding bicycles on the sidewalk. Chief of Police Blossom
stated that Officer Bergey was using his best efforts to stop riders
from using the sidewalk.
Stray
Chief of Police Blossom stated that he had discussed with Chair -
dogs
man of the Supervisors Warner the matter of handling stray dogs and that
this matter was being considered by other beach cities with a view of

having a County Officer call one or two days each week at each city to
collect stray dogs and remove them to the County pound. Further infor-
mation will be furnished the Council in the near future.
Vacation On motion by Hawes seconded by Langenbeck, Councilman Grable

was given permission to be absent from the Council and the State from
September 14th to October 14th, 1946.
On motion by Grable seconded by Langenbeck, the Council
adjourned.
