Councilmen present: LeBard, Terry, Seabridge, Langenbeck, Greer. Councilmen absent: None. Mayor Greer appointed committees as follows: Committees: Police and Fire: Greer, Chairman LeBard Beach and Pier: Terry, Chairman Seabridge Sanitation -and Health: Langenbeck, Chairman LeBard Streets and Parks:' Langenbeok, Chairman Seabridge Building and Insurance: Terry, Chairman 4& Greer. Applications: On motion by Ldngenbeck seconded by LeBard, the following appli- Business License cations for business license were approved: B. B. Mr. Chas. Moauokin appeared .before the City Council and wanted to know what was being done to remove the riding stables located adjacent to Atlanta on the Talbert property. He also stated that the City is not enforcing the Uniform Building Code and are allowing construction to go on without permits and also re- quested that the City Building Inspector inspect the stables to ascer- tain if they comply with the City.and State Building Code. Mr. Nelson Verne Nelson appeared before the Council and stated that rats are appearing at his residence and attributed that as emanating from the adjacent stables. Mrs. Keith Mrs. Keith addressed the Council and asked if there is anything being done regarding rezoning the area adjacent to Atlanta and the property where Bill Jones'has his riding stable. The City Clerk informad Mrs. Keith that the Planning Commission is now working on rezoning that area and that the Planning Commission hopes to have the compiled survey completed shortly. Mr. McNeil Duncan McNeil appeared before the Council and wanted to know what the City is doing in regards to the enforcement of the City and State Building Code. Planning The City Clerk informed the Council that a vacancy existed on the Com. planning Commission due to election of Harry LeBard to the City Council. Mayor Greer asked Mr. McNeil if he would consider an appointment to the Planning Commission to replace Harry LeBard. Mr.'MoNeil stated he would 1� Page #3 - Minutes April 26, 1949. Mayor Greer received the unanimous vote in appointing Duncan McNeil, ll9} Huntington Ave- nue to the Planning Commission. Mr. McNeil was advised that the next meeting of the Planning Commission would be held on May 19, 1949. A resident (name not given) residing on Alabama Avenue addressed the City Council and asked if there was an ordinance prohibiting trucks using the newly paved streets on the east side, especially on Alabama, and pointed out the continual use of streets by trucks would be very detrimental to the newly paved streets. Mayor Greer referred the request to the Streets and parka Committee, City Attorney and City Engineer, and to report back to the Council their findings. The Clerk read a letter received from Sam F. Rhoads, agent for Carlton Beal, stating that Harry Hunter and Associates have agreed on a mutual arrangement for the completion of well on City lots 21 and 03, Block 616, H.B. 17th Street Section. On motion by Langenbeok seconded by Seabridge, that the City permit Harry Hunter and Assoc- iates to join in drilling of the well, was approved. D. G. Higgins The Clerk read a letter from D. G. Higgins, chief lifeguard, stating that it was necessary for him to ask the Long Beach Lifeguard Department for help with boats in trouble during last Friday!.s high wind which necessitated furnishing lunches for the Long Beach Lifeguards who helped out. On motion by LeBard seconded by Terry, the City Clerk was aftliarized to bar to Duffy's place, 211 - 2nd St., the amount of $2.75• Wooden derricks The Clerk read a letter to the City Council received from Harry need repair A. Overmyer, City Engineer, stating that he and his department had made a survey to ascertain the physical condition and safety of all wooden derricks located in what is commonly called the town lot section of the City. The analysis of the inspection was that 45% of the wooden derricks are unsafe and needed repairs and further stated that all record owners are being notified where repairs are necessary. The letter was orders& filed. Water supply The Clerk read a letter received from the Huntington Beach Plan- - ning Commission advising the City Council that the following motion was made at a regular meeting held on April 20, 194S: "On motion by Overmyer seconded by Kaufman, that this Commission recommend to the City Council that they take steps to assure the City of Huntington Beach a more adequate and permanent water supply, was approved". The letter was ordered filed. Beach Con- The Clerk read the request of V.H. Nitzkowski, 403 - 7th Street, cession Huntington Beach, California, for the privilege of serving hamburgers, and soft drinks as an added service to his beach rental service. The Clerk read the agreement drawn up by the City Attorney as requested at a previous meeting, between the City of Huntington Beach and Amos W. Anshutz, for permission to operate a concession to rent beach umbrellas and surf equipment and for no other service, at a location in the municipal trailer park as agreed upon by the City of Huntington Beach and Amos W. Anshutz. The Clerk read a letter received from Amos W. Anshutz in which he requested additional conditions to be included in the concession agreement to cover the sale of hamburgers, hot dogs, soft drinks and candy. Mayor Greer referred the agreement and the additional con- cession request of Amos W. Anshutz to the Beach and Pier Committee. Watkins, The City Clerk presented to the City Council the petition for Albert conditional exception for variance filed by Albert Watkins, 207 Geneva I Street, Huntington Beach, with the City Planning Commission. The variance requested the construction of two nonconforming buildings. The City Planning Commission recommended to the City Council that petition of Albert Watkins for variance be denied. On motion by Langenbeck seconded by LeBard, that the recommendations of the City Planning Commission in the petition of Albert Watkins be upheld, was approved. Memo. On motion by LeBard seconded by Seabridge, that the request of Hall -W. E. Spikes in behalf of the Citizen's Committee for Old Age pensions to use Memorial Hall for a meeting to be held May 22, 1949, 1:00 P.M. to 4:00 P.M. and the charges to be waived, was approved. Parking The City Clerk read a petition signed by 22 business men oper- meters - ating concessions along the beach front and on the pier, said petition petition protesting the replacement of parking meters on Ocean side of Ocean Avenue during the summer months. On motion by Langenbeck seconded W by Terry, that the request of the petitioners be referred to the Police Committee and the City Administrative Officer for a complete investi- gation and report, was approved. Dodge On motion by Langenbeck seconded by LeBard, that the Administrative truck Officer be authorized to purchase from Roy D. Bryant Motor Company, Huntington Beach, one 194E Dodge, * ton express, in accordance with specifications and accessories as contained in the quotation of said • firm dated April 23, 19459 in the amount of $1606.12, exclusive of 1949 license fee and subject to deduction of the Federal Excise Tax of which the municipality is exempt, was approved. De Lux Air Compressor in accordance with quotation dated March ll, 1949, in the amount of $3,030.00 plus California Sales Tax plus the additional accessories as outlined by the City Engineer in accord- ance with detailed quotations submitted by the Shaw Sales and Service Company, was approved. _ Report on The Clerk presented to the City Council the informal report of Pier the Quinton Engineers who had been contracted with by the City to make a survey of the municipal pier for structural defects and de- 0 terioration. Mayor Greer requested that the Beach and Pier Committee make a study of the report and make recommendations. Oil & Gas - The Clerk presented oil and gas lease agreement made and entered lease into the 4th day of February, 194g, between the City of Huntington Brashears j Beach and J. W. Brashears and Zora Brashears, covering Lot 6-and southwesterly 15 feet of Lot S. Block 314, Huntington Beach Tract. A minimum rental of $50.00 per month is to be paid and 1/8th royalty on production, thereafter when royalty on production exceeds minimum rental. On motion by Langenbeck seconded by LeBard, that the Mayor and City Clerk be authorized to execute the oil and gas lease between the City of Huntington Beach and J. W. Brashears and Zora Brashears, after the City Attorney has transmitted a letter of conditions to J. W. Brashears and Zora Brashears in regards to the title and that acknowledgment of the letter be appended to the oil and gas lease - agreement, was approved. Lifeguards Bud Higgins, chief lifeguard, addressed the Council and stated State Park that it would be advisable to request a meeting with the State Park officials, Board of Supervisors of'Orange County and the City Council in order to work out the lifeguard problems which are presenting them- selves due to the development of the adjacent beach State Park. Mayor Greer referred the request to the Beach and Pier,Committee to arrange for a meeting. Senate Bill The Clerk read a letter received from Dave Foltz, advertising 1988 agency, located in Long Beach, California, in which they requested the City Council to adopt a resolution in accordance with suggested form attached, the resolution supports Senate Bill No. 1989, granting title of the tidelands to the State. On motion by Langenbeok seconded by Terry, that the request be tabled, was approved. Additional The Clerk react a letter received from the Orange County Committee water supply on Additional Water Supply suggesting that a resolution be passed by the Reso. 1037 City Council and forwarded to the District Engineer, U. S. Engineering Department; The Chief of Engineers, War Department, Washington, D. C. and the Secretary, Orange County Committee on Additional Water Supply, Santa Ana, California. On motion by Langenbeck seconded by Seabridge, that the Mayor and City Clerk be authorized to sign the resolution re- 2.1 Page #6 - Minutes April 26, 1949. solving to request the Federal Government, through its appropriate agency, to determine that the use of the water of the SanVLAna River for munioipal, domestic, irrigation, and basin replenishment are para- mount to it's use for recreational purposes and to prevent the use of federally owned lands in the Prado Basin for any purpose which would cause a wastage of water or impair the ability of the aforesaid salvage project to recover evapo-transpiration losses for use in Orange County, was approved. Courts The Clerk read letter received 'from Phil S. Gibson, Chief Justice of the Supreme Court and Chairman of the Judicial Council, requesting that the questionnaire covering a plan for a uniform organization of Courts in the State of California be completed and returned before May 1, 1949, and on motion by Langenbeok seconded by LeBard, that the City Attorney and Administrative Officer be authorized to complete the questionnaire, was approved. * Civilian On motion by Langenbeck seconded by LeBard, that the Administrative Defense Officer of the City be instructed to attend the meeting of the Orange County Civilian Defense Council to be held at 2:00 P.M., May 7, 1948, in the Board of Supervisors Chambers, Court House, Santa Ana, was approved. Tanks The Administrative Officer advised the Council that Mr. Towers of the Fish and Game Commission had requested the City Council to consider the installation of 500 barrel tanks to be located at the storm drain outlets at the beach for the purpose of catching oil when breaks occur., "The Mayor referred the request to the Beach and Pier Committee and City 1 W Engineer. Beloil The Clerk read letter received from the Beloil Corporation, Ltd., Corp. ' Ltd. advising that Dave Wilson from the City of Huntington Beach is author- ized to act for them before the City Council in the -matter of the pro- posed change of collecting mineral rights taxes and placing same on the secured roll. The letter was'ordered filed. Occidental On motion by Langenbeck seconded by Seabridge, that the City Clerk Life Ins.' ' be authorized to execute the endorsement to Policy 755054 as requested by the Occidental Life Insurance Company of California, said endorsement changing group insurance policy from a participating form to a non- participating form, as outlined in request of February 3, 1948.
