Mayor Langenbeck called the regular adjourned meeting of
the CJty Council.:of the City of Huntington Beach to order at 7:30
P.M.
Councilmen present: Talbert, LeBard, Seabridge, Greer, Langenbeck
Councilmen absent: None
Hearing - Mayor Langenbeck announced that this was the date and hour
Verne Spaulding
set for the public hearing on a petition for conditional exception
filed by Verne Dwight Spaulding for permission to erect a building
on the property of the Pacific Electric Railway Company to be
located at the southeast corner of the entrance to the State Beach
Park on Highway #101 and said building to be used for a bait and
tackle shop.
The City Clerk advised the Mayor no verbal or written
statements have been filed except for those letters read at the
previous regular meeting of the Council and one letter was on hand
from the Division of Highways, Department of Public Works, State
of California.
Div. of The Mayor requested the Clerk to read the letter from the
Highways
Division of Highways which protested the granting or issuing of a
zone variance for the bait and tackle enterprise on the grounds
that it would create a traffic hazard.
Div.of Beaches Mayor Langenbeck asked if there was anyone in the audiende
and Parks, State
of Calif. that wished to speak for or against the proposed variance. Mr.
Miles Allen of the Lands Purchasing Office of the Division of
Beaches and Parks of the State of California appeared before the
City Council and protested against the issuance of the zone variance.
Randolph Karr, Attorney for the Pacific Electric Land Company
appeared before the City Council and stated the position of the
Pacific Electric Land Company in asking in behalf of Verne Dwight
Spaulding for permission to construct the building to house a bait
and tackle enterprise, and stated their company was only interested
in leasing to those who will build to conform to the best interests
of the community and will demand that their clients maintain their
buildings and premises so that development will be a credit to
the community.
Att'y Bauer Mayor Langenbeck asked the City Attorney what the Council's
legal position was in this matter as to granting or rejecting the

variance. City Attorney.Bauer instructed the Council as to
their legal position by referring and reading Section 6 of the
Districting Ordinance No. 495, of the City of Huntington Beach.
Mayor Langenbeck requested the City Clerk to read the
conditions contained in the bity Planning Commission'.s recom-
mendation to the City Council for granting of the variance to
Verne Dwight Spaulding to construct a building to house a bait
and tackle enterprise. On motion by Talbert seconded by LeBard
that the petition for conditional exception be granted to Verne
Dwight Spaulding to construct a building to house a bait and
tackle enterprise upon the conditions contained in the recom-
mendations of the City Planning Commission to the City Council
to grant the permit, subject to revision of condition No. 1,
contained in the City Planning Commission recommendations to
add the wording - "Said plan marked Exhibit "A" and made a part
hereof", and the wording "and shall be approximately the same
color of the nearby State Park building", be deleted, was approved.
Councilman Greer stated that he wished to place himself
on,r ecord that in the event that any odors eminated from the oper-
tion of Verne Dwight Spauldingts bait and tackle enterprise and
complaints lodged he would do all in his power to have the enter-
prise closed.
Mayor Langenbeck requested the City Clerk to read the
recommendation of the Planning Commission for the granting of a per-
mit to Ted W. Bartlett to erect a service station at the southeast
entrance to the Municipal Trailer Park at Highway #101. On motion
by.Seabridge seconded by Greer that the conditional exception be
granted to permit Ted W. Bartlett to erect a service station upon
the conditions as outlined in the recommendations of the City
Planning Commission to the City Council recommending that a
variance be granted to Ted W. Bartlett to erect a service station
at the aforesaid entrance, was approved.
City Attorney Bauer called to the attention of the Council
that the appointment of members to the Re -development Agency made
at the regular meeting:of the City Council held on May 1, 1950,
did not include the period of time that each member appointed was
to serve and that it was a requirement in the provision of the
Planning Act of the State of California.
Mayor Langenbeck recommended to the City Council that
Collins Terry serve one year; James Sayer serve two years; Frank

Hinshaw three years; Robert Mandic four years and Chris King
for four years and recommended that Chris King be Chairman of
the Re -development Agency. n
On motion by Greer seconded by-Seabridge that the recom-
mendati ons_ of Mayor Lang-enbeck> •for -the terms tobe.served by
members of _the R.e-development-Agency .be_.ac.cepted. was.. approved.
` ' On motion by Seabridge -second-ed by -Greer that the City
Attorney be%authorized to draw up.an agreement between the City
of Huntington Beach and Ray H. Overacker covering provisions to"
permit Attorney Ray H. Overacker to assist th'e City Attorney on
quiet title actions on City tax title lots as outlined by the
City Attorney and that the Mayor and the City Clerk be authorized
to execute the agreement, was approved,
Agreement betwn. On motion by Talbert seconded by Greer that the City
City & Marshall
amended Attorney be authorized to prepare an amendment to the agreement
between the City of Huntington Beach and Robert M. Marshall and
Agnes A. Marshall to increase the provisions of Section 15 of the
agreement -increasing the amount toward the construction of a club-
house on the said property from $2,50.0.00 to $5,000.00 subject to
the conditions .of :Section 15 and also that Robert M. Mairlsh&ll
shall build a clubhouse that has a value of not less than $15,000.00,
was approved.
On motion by LeBard seconded by Greer the adjourned meeting
of the City Council of the City of Huntington Beach adjourned.
