Councilmen present: Greer, Talbert, LeBard, Seabridge, Langenbeck Councilmen absent: None Mayor Langenbeck called for a short recess. The City Council reconvened at 7:35 o'clock P.M. and Mayor Langenbeck called the Council members to order. Remove trees - On motion by Seabridge seconded by Greer that the 14th - Quincy request of the Huntington Beach Company for permission to remove five large trees along the parkway on the westerly side of 14th Street from Quincy southerly to the elementary school for the purpose of bringing the bluff down to grade prior to the installation of sidewalks, was approved. Reso.#1167- The City Clerk read Resolution No. 1167, a resolution Wages - of the City of Huntington Beach establishing the general pre - Resurfacing of Walnut Ave•vailing rate of hourly wages for each craft or type of workman et al or mechanic needed in the resurfacing of Walnut Avenue from 14th Street to 17th Street, Olive Avenue from 17th Street to 23rd Street, Palm Avenue from Main Street to 17th Street and Alabama Avenue from Atlanta Avenue to Indianapolis Street in the City of Huntington Beach, California. Minutes - February 18, 1952 City Engineer Overmyer reported to the City Council that the general prevailing rate of hourly wages as outlined in Resolution No. 1167 are the general prevailing rate of hourly wages in this locality in accordance with his findings. On motion by Talbert seconded by LeBard Resolution No. 1167 was passed and adopted by the following roll call vote: AYES: Councilmen: Greer, Talbert, LeBard, Seabridge, Langenbeck NOES: Councilmen: None ABSENT: Councilmen: None Advertise for On motion by Seabridge seconded by LeBard that the bids - Walnut Ave. et al. City Clerk be authorized to advertise for sealed bids for the resurfacing of Walnut Avenue from 14th Street to 17th Street, Olive Avenue from 17th Street to 23rd Street, Palm Avenue from Main Street to 17th Street and Alabama Avenue from Atlanta Avenue to Indianapolis Street in accordance with plans and specifications approved and submitted by the City Engineer and said bids to be received and opened at a regular adjourned meeting of the City Council on March 10, 1952, at 8:00 o'clock P.M., was approved. Ord. #580- amends The City Clerk gave Ordinance No. 580, an ordinance of #535 , salary the City of Huntington Beach amending Ordinance No. 535 entitled "An Ordinance of the City Council of the City of Huntington Beach creating various classifications and positions and pro- viding for the rate of compensation and repealing all ordinances or parts of ordinances in conflict therewith", its first reading. Hearing- Special Mayor Langenbeck announced that this was the hour set for permit Sextette Oil Co. the hearing of petition for special permit of the Sextette Oil Company to drill a new well known as Well #1, located on Lot 9, Tract #73 , City of Huntington . Beach and requested the City Clerk to read the notice of hearing of petition for special permit. The City Clerk reported that there had been no oral or written statements made for or against the petition for special permit filed by the Sextette Oil Company. Mayor Langenbeck asked if there was anyone in the audience that wished to make a statement for or against the petition for special permit of the Sextette Oil Company. On motion by Talbert seconded by Seabridge that the petition for special permit of the Sextette Oil Company to drill a well located on Lot 9, Tract #73, in the City of Huntington Beach, said well to be located approximately 60 feet from a railroad track was granted by the following roll call vote: AYES: Councilmen: Greer, Talbert, Seabridge, LeBard, Langenbeck NOES: Councilmen: None ABSENT: Councilmen: None Notice of sale Mayor Lan genbe ck announced that this was the time set old public for the sale of the old public library located at the corner library bldg. of 8th and Walnut Streets in the City of Huntington Beach and requested the City Clerk to read the Notice of Sale. The City Clerk read the Notice of Sale published in the Huntington Beach News January 31, 1952, stating that sealed bids will be received by the City Clerk in the City Hall in said City until 8:00 o'clock P.M. February 18, 1952, for the purchase of real property described as follows: Lots 20, 229 24, 26 & 28, Block 107, Huntington Beach, subject to the covenants, conditions and restrictions of record and the improvements on said real property consisting of two story brick building which has been used as a public library and that the terms of said sale shall be as follows:- Minimum acceptable bid shall be $7,500.00 cash in lawful money of the United States to be paid upon delivery of grant deed not later than thirty days following said sale, and that at the opening time of said sale that any person may submit oral bids and said first oral bid shall not be less than 10% higher than the highest acceptable sealed bid submitted and thereafter any person may raise said bid in multiples of not less than fifty dollars, and no bid shall be accepted unless accompanied by cash or lawful money of the United States in an amount not less than 10% of the bid and that the City of Hunt- ington Beach reserves the right to refuse or reject any and all bids and withdraw the property from sale. The above described property shall be sold in its present condition and without added expense to the City of Huntington Beach and no warranty, either expressed or implied, made as to condition of said building or its fitness for use for any purpose. By order of the City Council the 21st day of January, 1952. The City Clerk reported that there had been no sealed bids filed up to the hour of 8:00 o'clock P.M. February 18, 1952. Mayor Langenbeck asked if there was anyone in the audience that wished to make an oral bid on the property. There being no bids forthcoming Mayor Langenbeck declared that the- sale of the old public library located at the corner of 8th and Walnut Streets was closed. 0* Page #5. Minutes - February 18, 1952 Ord. #581 - The City Clerk gave Ordinance No. 581, an ordinance benches along public ways of the City of Huntington Beach providing for the placing and regulations of benches in and along public ways, its first reading. Open sumps & The City Clerk read communications received from the debris on Main and 14th Sts. Huntington Beach Elementary School District, the Huntington Beach Union High School and the Huntington Beach Chamber of Commerce calling to the attention of the City Council the deplorable condition that exists on Main and 14th Street due to the open sumps and other debris on the property and that it is a definite hazard to the children that must walk past it that area to the schools and asked that the City Council do all in their power to eliminate the hazard and take steps to abate the nuisance. City Attorney Bauer reported that there may be some method by law to permit civil action in order to abate the nuisance caused by the open sumps and other debris on the property referred to in the letters read by the City Clerks., Att'y to check On motion by Talbert seconded by Seabridge that the procedures for abatement of City Attorney be instructed to check into the legal procedures nuisance. that might be used in order to effect the abatement of the nuisance of the open sumps on the properties referred to in the letters received from the Huntington Beach Elementary School District, Huntington Beach Union High School and the Huntington Beach Chamber of Commerce and report to the City Council what action can be taken, was approved. Garris Bros. The City Clerk read a communication received from the proposal for exchange of Garrish Bros. requesting the City Council to consider the ex - property change of the 10 acres in their possession for the 10 acres that they lease from the City which would permit the City to do a minimum of grading on the ten acre strip along with grading on the remaining thirty acres of the City would give an airport that would be more of a credit to the City and also suggested another alternative, to be allowed to purchase one acre immediately in the vicinity of the present buildings. Mayor Lange nbe ck referred the request of the Garri sh Bros. to the Airport and Real Estate Committee for study and report. Assoc.Telep.Co. The City Clerk read a communication received from the appl. to incr. Public Utilities Commission advising the City that on January rates 11, 1952, the Associated Telephone Company, Ltd. , Inc. , applied to the California Public Utilities Commission for authority +9 192 Page #6. City of Albany The Clerk read a letter received from Jerome Blank of pro test to incr. pr.Tce the City of Albany soliciting the City Council of the City of of milk Huntington Beach in protesting to State Representatives and to the Governor of the State of California the ever increasing price of milk. Library- On motion by LeBard seconded by Seabridge that the Additional $2,000.00 for request of the Library Board for an additional appropriation expenses of $2,000.00 to cover the unforeseen expenditures required for the completion of furnishing the Library and that $2,000.00 be transferred from the General Fund to the Library Fund, was approved. Agrmt. Berry The City Clerk read the agreement between the City of & Davis bait concession Huntington Beach and Herbert F. Berry and Lonnie T. Davis dba Herb and Lon's Sportfi shing, for permission to conduct the business of selling live and salt fish on the pier to be used as bait by the fishermen. On motion by LeBard seconded by Greer that in accord- ance with the recommendation of the Beach and Pier Committee that the agreement between the City of Huntington Beach and Berry and Davis be approved, and the Mayor and the City Clerk be authorized to execute the agreement between the City of Huntington Beach and Herbert F. Berry and Lonnie T. Davis was approved by the following roll call vote: AYES: Councilmen: Greer, Talbert, LeBard, Seabridge, Langenbeck NOES: Coun ci lmen : None ABSENT: Councilmen: None Beautify On motion by LeBard seconded by Greer that the City bluff at Engineer be instructed to prepare plans and estimate of cost th e beach to grade or/and terrace and beautify the bluff section at the beach between 9th Street and the Huntington Beach Company 04 Plunge, was approved. Auto racing City Council members the provisions contained in Ordinance license fees No. 500 which fixes the rate of licensing for conducting, carrying on, managing or maintaining any place of business where automobile racing or including midget automobile racing is conducted within the City of Huntington Beach is fixed at the sum of 1% of gross gate receipts and also to the required liability insurance required by the ordinance, and stated that to be consistent with licensing of different businesses in the City the 1% should be eliminated and a set license fee imposed and the insurance requirements should be lowered to $25,000.00 for injury to one person and $50,000.00 for any one accident and $5,000.00 for damage to personal property. Mayor Langenbeck referred the matter of reviewing Ordinance No. 500 to the Finance Committee for study and report. Ferris case City Attorney Bauer reported to the City Council that motion for new trial the Ferris case was in progress on a motion for a new trial and that the trial had been continued until Wednesday. 17th St .Crossing On motion by Greer seconded by Talbert that the City Attorney be authorized to obtain the necessary signatures re- quired on the instruments covering the property required for the 17th Street crossing and place same in Escrow, was approved. On motion by LeBard seconded by Seabridge that the regu- lar meeting of the City Council of the City of Huntington Beach adjourned.
