P.M. Councilmen present: Wood, Talbert, Seabridge, Councilman arrived at 7:55 P.M. Le$ard Councilmen absent: Langenbeck. �I Minutes On motion by Talbert "seconded by Wood that the minutes of the City -' Council for the month of July, 1952 as transcribed and mailed by the City Clerk be accepted, was approved. Wood'on Mayor Seabridge appointed Councilman Wood to serve on the Finance Finance Comm. Committee in the absence of Councilman Langenbeck, Monthly The Clerk read the reports for the month of July, 1952 filed by Reports. the City Treasurer and City Cl.erk, City Collector, Chief of Police, Man&gar bf Municipal Trailer Park, City Engineer, City Judge, Fire 'Chief, and Chief Lifeguard. On motion by Talbert `seconded by Wood that the reports of the department heads for the month of'July, 1952 as read by the Clerk be accepted hndordered filed, was approved. Bond term.- On motion by Wood seconded by Talbert that termination of Brown #4. clean-up bond #T-145 of the Travelers Indemnity Company covering Well Brown #4 located 150 feet south and 720 feet east of the center line of Quincy and Delaware and which the City Engineer reported the requirements of Ordinance No. 515 had been complied with, was approved. Agrmt.- The Clerk read a letter from.the City Engineer submitting in P.E.Railway 17th St.Cross-. duplicate an agreement YLth the Pacific Electric Railway Company concerning certain right-of-way across the.3r property in connection with the new proposed 17th Street grade crossing. The Clerk commenced reading the agreement betw•e.en the. City ,of, Huntington Beach and the Pacific Electric Railway Company -for cer- tain expenditures .to be made by the City of Huntington Beach for rehabilitation work, paving of the track area, and the installation of two flashing light signals. Sealed bids - At this time 8:00 o'clock P.M.- the Mayor announced that this Install. of sewers - Rlks. was the hour for the opening of the sealed bids received for the 911-& 913, W.P. etc. construction and installation of sanitary sewers in Blocks 911 and 913, Wesley Park Tract; Tract #68; and Blocks 1703, 1803, and 1903, Tract #12 in accordance with the notice inviting sealed bids published in the Huntington Beach News July 24, 1952 and July 31, 1952, and requested the Clerk to open and read the bids received. The Mayor asked if there was anyone in the audience that wished to be heard. Petition for Mrs. Janice Avants appeared before the City Council and read stop sign - Alabama & a petition containing 102 signatures in which they request that Indianapolis. stop signs be installed at the blind intersection of Indianapolis Street and Alabama Avenue and which theystate there have been numerous accidents and near -accidents at this corner, making it a hazard to motorists as well as to the many children who play or await school busses near the intersection. Minutes, August 4, 1952. -Mrs. Avants further stated that although it was not contained r in,the original petition it was felt by the petitioners that the stop -signs should be either a four-way stop or on Alabama Avenue, Mayor Seabri$ge refereed -the petition to the}Police and Fire Committee for further study. --The -Mayor asked if ; there was anyone else in the. audience that wished to be heard. ' John Marion Dave,X. Jones, of Huston; -Suter and -Huston, -Inc., presented offer to buy I - 1 acre from .'.-a-letter which 40 requested be read to the City Council. The Clerk City. read the ' letter of Mr. ,Jo3 es in which he stated_ that on behalf of his client, Mr. John H. Marion, he is submitting an offer of $10,500.00 for that portion of City owned property lying Westerly of Huntington Avenue fronting on Ocean Avenue consisting of approximately one acre and attached a check for $1,500.00•to be used in an escrow at the Huntington. Beach Branch of the Security - First National Bank of Los Angeles. He stated that in view of the recent sale by the City of approximately 52 acres on the corner of Highway 39 and Ocean Avenue for $40,000.00 he fliet that this offer represents a liberal valuation -for the property in its present condition as -it fronts on only one major highway, and was his belief that the City should give serious consideration to this offer as the development of this property will enhance the value of other property owned by the City and speed up the development of the 52 acres. He further stated that this offer is submitted subject to the usual 5% Real Estate Broker's Commission. Mayor -Seabridge referred the offer of John H. Marion, client of Dave K. Jones of Huston,, Suter and Huston, .Inc., for the pur- chase of approximately 1 acre: -of City owned property lying westerly of..Huntington Avenue and fr!ontifig-On Ocear•! Avenue to the Real Estate Committee for study and report. On motion by,Wood seconded by Talbert that the City -Engineer Util.Comm.- - 17th St.Cross. and the City Attorney be instructed to make a formal application to • the -Public Utilities Commission of the -State of -California for permission to construct the grade crossing on 17th Street between Pine Street and Yorktown Street, was approved. Joint use agrmt. The Clerk read a letter from City Engineer Harry A. Overmyer, • Pacific Tel& Tel., install submitting a joint use agreement between the City of Huntington pole. Beach and the Pacific Telephone and Telegraph Company which states it will be necessary to move one of their poles and install an ddditional pole to clear the right of way for street purposes in connection vL th the construction of the proposed grade crossing on 17th Street at the Pacific Electric railroad, and that the cost .of this work is $160.00 and is to be paid by the City of Huntington Beach. On motion be Talbert seconded by LeBard that the City Engineer be authorized to give a work order for the vork to..be done in accordance with the agreement between the City of HuntingtD n Beach and the Pacific Telphone and Telegraph Company in connection with the 17th Street grade crossing, was approved. The Clerk read a letter from the Pacific Electric Railway ... , . ,�. Company referring to permit dated April 22,.1952, giving permission to enter upon right of way of the Newport Line, between Sixth Street and Ninth Street, Huntington Beach, for the purpose of leveling and grading right -of way on the southerly side of track and stating that said permit is hereby cancelled. No action necessary. The Clerk read a request from D. G. Higgins, Fire Chief, for the purchase of the following items, which were listed in the budget under the Capital Outlay Fund: 1. Replace Chiefs sedan with all metal station wagon 6 about Page #6. H. Archer- On motion by LeBard seconded by Wood that the request of patrolman. B. H: Dulaney, Chief of Police, to appoint Henry Archer as a patrolman in the Police Department for a probationary period of six months, effective July 25, 1952 and salary to be in Bracket "A" of Range 23 of salary ordinance No. 535, was approved. Hearing- The Clerk read notice resetting hearing before the Public Public Util. Comm. Utilities Commission of the State of California, in the matter of application No. 33341 of the Southern Counties Gas Company of California,*for a general increase in gas rates under Section 454 of the Public Utilities Code, from August 20, 1952 to August r 21 and AugtAt 22, 1952 at 10.00 A.M., Pommission Courtroom, Los Angeles, California. City of The Clerk read a; letter received from the City of Arcadia Arcadia -pro- test against stating they•ar'e protesting the Application #33341 of the increase in gas rates. Southern Counties Gas Company before the Public Utilities Commi- ssion for a general -increase in gas rates and are proposing a plan whereby adjoining cities who are agreeable to the protest to join together and obtain the services of a rate engineer to . study the matter and the cost of his services to be proportionately charged to the cities. On motion by Wood seconded by Talbert that the City Attorney be authorized to contact the Mayor of the City of Arcadia and in- form him that the City of Huntington Beach is agreeable in princi- pal wL th the protesting of Application #33341 of the Southern 0.� Page P. Counties Gas Company before the Public Utilities Commission for a general increase in gas rates and the City is interested in obtdning more information in the matter as long as the cost does i not exceed $500.00. was approved. 40/. statewide The Clerk read a letter from the City of Inglewood submitting salles tax. a copy of their resolution opposing the County Supervisors Associations proposal for a 4% statewide sales tax. The matter was,taken under advisement until 'the next meeting. dr.Co.9ldr1s. The Clerk read a letter from the Orange County Builders' Assoc. - State Labor Law. Association stating that Section 3800 of the State Labob Law is Demands Fill sump hole on 17th St. rideso.#1178, quitclaim eed-M.TResser Repairs to canopy at Fire Station. 1 not being enforced by Building Departments in Orange County and request the City Council assist in the enforcement of this statute. The matter was referred to the City Attorney an& the City Engineer for study and report. On motion by LeBard seconded by Wood that the demands as approved by the Finance Committee be ordered paid,'was approved. t On motion by Wood seconded by LeBard that the City Engineer be authorized to fill the sump hole on 17th Street adjacent to the proposed 17th Street grade crossing, was approved. The Clerk read Resolution No. 1178, a resolution of the City of Huntington Beach, California, accepting quitclaim deed to cer- tain property and authorizing the recording of sAid deed. On motion by Talbert seconded by LeBard Resolution No.1178 be -passed and adopted by the following roll call vote: AYES: Councilmen: Wood, Talbert, LeBard, Seabridge., NOES: Councilmen: None. ABSENT: Councilmen: Lazgnebeck. On motion by Wood seconded by LeBard that the City Engineer be instructed to make -the necessary repairs to the canopy at the fire'station, was approved.
