Councilmen present: Wood, Talbert, Langenbeck, LeBard, Sea - bridge. Councilmen absent: None Business On motion by Wood seconded by Talbert that applications Licenses for -business license' to conduct business in the City of Huntington Beach were granted as follows: M. E. Horst Co., Cbsta Mesa, California, paving and grading Contractor. W. F. Tally, service station at 602 Ocean Avenue. Mayon Foods, Colton, California, wheel -tax (restaurant supplies;). Long Beach Awning Co., Long Beach, California, installing awnings. W.O'L.Lich-' On motion by Talbert seconded by LeBard the application lyt er-New Well #1 for oil well permit of W. L. Lichlyter, 609 Ocean Front, Santa Monica, to drill --a new well #1, located on Lots 11 and 12, Block 1204, Vista Del Mar Tract, was granted. Beloil Corp. On motion by LeBard seconded by Wood the application for New Well oil well permit of Beloil Corporation, Ltd., of Inglewood, California, to drill a new well on Lot 12, Block 1106, Vista Del Mar Tract, was granted. The Clerk read the findings of the Planning Commission of Ceramic'' Tile Mfg-0 the City of Huntington Beach following a public hearing held Co.petit. recom.by on October 6, 1952, relative to the petition for conditional P1an.Comm. exception filed. by the Orange County Ceramic Tile Manufacturing . Co., at 201 Frankfort Street, requesting permission to expand their present facilities. The Planning Commission after hearing all those voicing their opinions for or against the request, the findings of the Planning Commission were as per the following motion duly made and carried: "On motion by Commissioner Davis seconded by Commissioner Stang that the Planning Commission recommend -to the City Council of the City of Huntington Beach that the petition for conditional exception of the Orange County Ceramic Mfg. To provide and utilize off street parking. 2. To maintain the alley free of debris and manufacturing waste at all times. 3.To maintain maximum dust prevention controls. 4. To keep all waste materials inside of building. 5. "To comply with the recomriendations of the City Fire Chief as outlined in letter dated October 6, 1952, to the Planning Commission, as follows: (1) Remove the drying room from the west side of the kilns. Allow 4feet clearance from.kilns to any flammable surfaces. . (2) Cover the drying room easterly of the kilns with . fire resistive materials. (3) Remove the cockloft in the new section of the present plant. (4) Install at least a one hour wall between the present kiln room and the storage and office room. ('5) Cut down the size of openings between sections of, the plant and install metal fire doors. (6) Enlarge all aisleways in the building to a mini- mum of3feet. (7) No stock or material to be stored within 3 feet of the ceilings. (8) All future work to be done in accordance with the building code and good fire safety practices. Motion passed and adopted by the following roll call vote: 0 O A`.IES: Commissioners: Davis, Pyles, Kettler, Stang, Schryer ,NOES: Commissioners None ABSENT: Commissioners: Tunis, Hinshaw." m Mayor Seabridge asked if there was anyone in the audience that wished to voice their opinions for or against the recom- mendation of the Planning Commission of the City of Huntington Beach as read by the City Clerk. The following people addressed the City Council voicing their opinions against granting the request of the Orange County Ceramic Tile Mfg. Co. for ex- pansion of plant facilities for reasons that the dust eminat- • ing from the plant was a danger to health, complaints about 1 C.B.Sturgeon • noise and the traffic hazard due to the large van trucks that unload and load materials while parking on Alabama Avenue: Mr. & Mrs. Albert Watkins,, Mr. Peter Bender, Mr. Howle, and Frank Marter Mr, C. B. Sturgeon, President of the Orange County Ceramic -Tile Mfg. Co. addressed the City Council and stated that since the plant went into operation in its present location 'it has been expanded on a previous variance granted and that the plant has corrected the conditions covering complaints heard this evening, lodged by the people appearing before the City Council and that inhalators have been installed for dust collection purposes, the noise has been eliminated and the debris in the alley has been Page #3- Minutes, October 20, 1952 taken care of, and that they have provided access parking across the street from the plant, and also stated that if the request was not granted that the company would make other plans. Mayor Seabridge ordered a recess at 8:30 P.M. of the'City Council in order that c the Council members could go to the � Orange County Ceramic Tile Mfg. Co. to make a short inspection. The City Council reconvened at 9:50 o'clock P.M. and Mayor Seabridge called the meeting to order. Fairchild The Clerk.read a communication from Fairchild Aerial Aerial Sur- 1 veys Inc.. Surveys Inc. stated they had submitted a proposal to the County of Orange for an aerial Photographic survey and re- questdd that the City 0 participate in the expense as the County was going to pay half of the cost for areas covering each of the cities that would participate in the survey. The communication was ordered filed. Dave Jones Dave Jones, President of the Chamber of Commerce, appeardd • before the City Council, and reported that the Board of Directors of the Chamber of Commerce voted unanimously to request the City Council to uphold the recommedations of the Planning Commission of the City of Huntington Beach recommending the granting of the petition for conditional exception filed by the Orange County Ceramic Tile Mfg. Co. for permission to expand its facilities. -A general discussion was held by the Council members rela- tive to adding another condition to the variance request of the Orange County Ceramic Tile Mfg. Co. in regards to the solid. content of the air resulting from the operation s in the plant and Councilman Langenbeck suggested that the following con- • dition be added to the variance if granted: "When the discharge of the solid content of the air ex- ceeds for a period of one minute that which is found safe by the minimum standards used by the Los Angeles County Smog Cohtrol Board, steps must be taken to correct the condition." • Variance On motion by Wood seconded by Talbert that the City Council plus con- ditions grant the petition for conditional exception of the Orange granted , County Ceramic Tile Mfg. Harold E. The Clerk read a communication from Harold E. Hermann, Hermann 906 Florida Avenue,,,informing the City Council that he wishes • to deed to the City a portion of his property for right of way for alley purposes. On motion by Langenbeck seconded by Wood that in accordance with the recommendation of the Streets and Parks Committee that the City Clerk be instructed to contact the property owners in' Block 907, Vista Del Mar Tract, to consider deeding to the City the required right of way for alley purposes, was approved. Ray E. The Clerk read a communication from Ray E. Vidal of Rays Vidal Transfer, requesting the City to consider amending the present • wheel -tax regulation in the City license ordinance to the affect that trucks making deliveries into the City be allowed to do sa once a week free. Mayor Seabridge referred the request of Ray E. Vidal of Ray►s Transfer to the Committee now studying the City license ordinance. • City Atty. The Clerk read a copy of Resolution adopted by the Board to give legal'aid -of Directors of the Orange County Water District dated October l eg i s ; c omrim . Or.Co.Wtro 8, 1952,. and a letter dated October 17, 1952, addressed to the District Honorable Mayor and City Council requesting that the Council • cooperate W- th the legislative committee that has been set up by authorizing the City Attorney to cooperate by lending legal counsel and advice in order to help to accomplish an approach to the solving of the water problem in the Orange County Water Basin. • On motion by Langenbeck seconded by Talbert that the City Attorney be instructed to give any legal counsel and advice that he can to the legislative sub -committee that has been set up to help solve the water problem of the Orange County Water Basin Conservation Committee, was approved. 0 Page #5 Minutes, Monday, October 20, 1952 Ord.##591, The Clerk gave Ordinance No. 591, an ordinance of the City Ameridoetc. Ord.Code of Huntington Beach amending Section 1321 and 1325 of the Hunting- ton Beach Ordinance Code and repealing Section 1322 of said code its first reading. 112 Acre- Councilman Talbert presented a sketch prepared by City Garr i sh Bros. Engineer Overmyer showing a location of the buildings wherein are confined the operations of the Garr.ish Bros. at the Hunting- ton Beach Airstrip, and that it was the recommendation of the Airport Committee that the City sell the one-half,acre to the Garrish Bros, in accordance vt,th their request. • A general discussion was held by the City Council and r-gxestions asked by John and Henry Garrish, who were present, and it was of the opinion that the Council did not wish to enter into a direct sale of the one-half acre but probably would consider a long term lease as requested by Garrish Bros. • in the event the City did not wish to enter into a sale of the one-half acre piece of property involved that their. -buildings, are located on. Supervisors of Orange County acting as ex=,officio Board of Super- visors of Orange County Flood Control District held on September 30, 1952, whereby the following motion was made and carried; • "A motion of supervisor McFadden duly seconded and unanimously carried by the Board members present, letter from T. B. Talbert, Committee Chairman, rep- resenting the City of Huntington Beach and the Eastern Huntington Beach Development Association owners of the land paralleling the ocean from the Santa Ana River to the Huntington Beach Mesa in regards to flood conditions in this Huntington Beach.Area was, ordered referred to the flood control engineer for filing."
