On motion by Wood seconded by LeBard that the minutes of
the City Council for the month of February, 1953, be accepted
as transcribed and mailed by the City Clerk, was approved•
The Clerk read the reports for the month of February,
1953, of the City Treasurer and City Clerk, City Engineer,

Fire Chief, Chief of Police, Manager of Municipal Trailer
Park, and Superintendent of Recreation.
On motion by Talbert seconded by Wood that the monthly
reports of the various department heads for the month of
February, 1953, as read by the City Clerk be accepted and
ordered filed, was approved. I.
On motion by Wood seconded by Talbert that the applica- •
tions for license to conduct business in the City of Huntington
Beach were granted as follows:

On motion by Wood seconded by LeBard that the Mayor.and
the City Clerk b e' authorized to execute the agreement between
the City of Huntington Beach and M.M. Tooker for one year be-
ginning February 4, 1953, and ending on February 3, 1954, to
permit the business of operating paying.washing machines in the
Municipal Trailer Park, was approved.
On motion by Langenbeck seconded by Wood that the City

Audley Wolfe- On motion by Wood seconded by Langenbeck that the request

provide for a.driveway to the house. and for permission to
remove ten feet of curbing for driveway, subject to the
supervision of the City Engineer, and that the City Engineer

On motion by LeBard seconded by Talbert that the request
of the. Huntington Beach Garden Club for an appropriation of
$175.00 to defray the expenses of the Annual Flower Show, and
that the charges be waived for the use of Memorial Hall on
May 1, 2, and 3", 1953, was granted, subject that the expenses:
submitted shall not exceed that of $175.00, was approved.
At 8:00 P.M. Mayor Seabridge announced that this was the
hour and date set for the opening of bids for the resurfacing
of Baltimore Street From Alabama Avenue to Huntington Avenue;
Chicago Street, from Alabama Avenue to California Avenue;
Detroit Street, from Alabama Avenue to California Avenue; loth
Street, from Ocean Avenue to Palm Avenue; 13th Street, from
Ocean Avenue to Brest Avenue, in the City of Huntington Beach,
California, and requested the Clerk to open and read the bids
received. The following bids were opened and reads

for the resurfacing of portions of Baltimore Street, Chicago
Street, Detroit Street, loth Street and 13th Street, as read
by the City Clerk be referred to the City Engineer for analysis
and report., was approved.

On motion by Langenbeck seconded by LeBard that the City
Council approves the agreement between the Huntington Beach
Union High School and the Public Recreation Commission of the
City of Huntington Beach for the use of the baseball field
and bleachers for league baseball games and recreational games,
and activities during the months of June, July, and August,
1953, subject to paragraph No. 2 be changed to read as follows:
"Whereas the Commission desires to use certain facil-
ities at the School in order that the children residing
within the boundaries of said School District and in
said City, which City is within said School District
boundaries, may be permitted to avail themselves of the
benefits of the said activities and use of said
facilities#"

Councilman Langenbeck reported that a Committee has been

Decision on Southwest Exploration Company and Signal Oil and
Gas Co. cases, that they were wrong, would probably terminate
the matter but apparently it has not and it is unfair to all
the rest of us taxpayers in this community to go on with this
hanging over our heads, this threat of appeal, and we hold
substantial funds on the bare possibility that they may find
a technicality in the law that will result in their recovery.
Well, there is no reasonable doubt, inasmuch as.the Cities of

California for many years have been adopting a graduated
licensing ordinance* It might be well for the City to adopt
a graduated licensing . ordinance tad. th a flat fee for say the
first $250, 000.00 of business, sales or use, and thereafter
start graduating it from one -quarter million to one million
at a l% rate, one million to five million at a 5% rate, and
all over five million at a 10% rate, such funds to go into a
reserve to accumulate equal to the amount of all fines of any
protested matters to one million, -whichever is larger, and
after that amount is attained that the remainder of it be
used for general revenue,.�fund, purposes of the City.
On motion by Langenbeck seconded by Wood that the
Licensing Committee be instructed to prepare to work for the
preaparation of additions to the licensing ordinance along
those lines, was approved.
Demands On motion by LeBard seconded by Talbert that the demands
as approved by the Finance Committee be•:dereda paid, was
approved.

had investigated the request for boulevard stop at 14th and
Palm and it was their recommendation that no boulevard stop
be installed at that intersection but recommended that the
Street Department paint in pedestrian lines crossing.at that
intersection to assist in the slowing down of traffic.
Carden- On motion by LeBard seconded by Langenbeck that the City

Lifeguard Dpt. Fred Swartz, Chief Lifdguard., to transfer from the Street
Department to the Lifeguard Department Edward B. Fredricks,
Equipment Operatro, in the same range and bracket in effect
at present and for permission to employ Hubert Combs. as
Laborer in Range l�j, Bracket "A", effective as of Mach 1st9
1953, was approved.
Requests'of Councilman Wood reported on the following requested by
Fire Chief
for Fire the Fire Chief, D. G. Higgins, for consideration by the Council:

1. By ordinance and competitive examination of .all
the personnel establish the'job classification
of AssistAnt Chief..
2. Establish the title and job classification of
Call Fireman and increase the pay scale to $5.00
per drill for three' drills per month and $5.00
per fire up to 3 hours, plus $1.#00 per hour overtime.
3. Declare the 1922 Seagrave 750 EPM pumper, unsafe -for

On motion by Wood seconded by Langenbeck that the City
Purchasing Agent be instructed to purchase the items as requested
by D. G. Higgins, Fire Chief, and as read by Councilman Wood
except the six and twelve.volt battery charger and the engine
house heater, was approved.
Mayor Seabridge referred the request of D. G, Higgins,
Fire Chief , to.establish title and job classification of
call firemen at rates indicated be referred to the Finance
Committee for study and report.
Mayor Seabridge referred to the Police and Fire Committee
for study and r.eport the request of the Fire Chief for the
junking of the old Seagrave pumper -and the purchase of a new
1, 000 EPM pumper.
Mayor Seabridge referred the request of D. G. Higgins,
Fire Chief, to have competitive examination of all personnel
in the Fire Department and establish a job classification of
Assistant Chief to the Finance Committee for study and report.
AttIy Bauer City Attorney Bauer reported to the City Council that the
reports on
suits cases of the Southwest Exploration Company and Signal Oil and
Gas Company in connection with the annexation suits were ruled
in favor of the City of Huntington Beach 'in Judge Thompm nts
Superior Court.
City Engr. City Engineer Overmyer presented to the City Council a
map on sub-
division preliminary map of the proposed subdivision for the 52 acres.
On motion by Talbert seconded by Langenbeck the regular
meeting of the City Council of the City of Huntington Beach
adjourned. °
