Commissioners present: Schryer, Davis, Pyles, Tunis Commissioners absent: Hinshaw, Kettler, Stang Others present: City Engineer Overmyer, City Attorney Bauer, and City Clerk Henricksen Public Chairman Schryer read the legal notice of public hearing:; hearing published in the Huntington Beach News June 4. 1953, giving notice that a public hearing will be held by the Planning Com- mission of the City of Huntington Beach in the Council Chamber of the City Hall, Huntington Beach, California, at the hour of6:30 o'clock P.M. on Monday the 15th day of June, 1953, for the purpose of considering a petition for conditional ex- ception to regulations of the Districting Ordinance. Masonic Chairman Schryer read the petition for conditional Temple Asslnpxception, as referredto in the legal notice read, filed by petit,cond. the Masonic Temple Association of Huntington Beach, California, exception- and said petition for conditional exception showing the owner to constr. as the Masonic Temple Association of Huntington Beach, concrete California, and the description of property which conditional bl.bldg. exception is to affect is Lots 1, 3, 5, 7, and 9, Block 705, Wesley Park Tract, present zoning of property R-3, present use of property vacantp description of intended use of property, fraternal organization building, brief description of type and number of buildings and or structures which are to be located upon such property are: 1 concrntb;; block building with fire retardant roof, size 75 feet by 112 feet, portions of property to provide auto parking. Three conditions justifying said conditional exception: The fact that exceptional or extra ordinary circumstances or conditions are applicable to the property involved or its intended use which do not apply generally to the property in the same zone are explained as follows: 1. That because of the angle of the lots, streets, and alleys, it is difficult to get the best use of the property and still maintain the full front yard requirements as set "forth in the ordinance. 2. That the preservation and enjoyment of one or more sub- stantial property rights are dependent upon a variance are explained as follows: In order to get the best full use of the property it is necessary to encroach approximately four feet on the set back requirements for the front yard. 3. That the granting of said proposed variance would not be materially detrimental to the public welfare or injurious to the property or improvements in the district in vh ich said property is located, for the following reasons: 0 Page #2 Minutes - Planning Commission, Monday, June 15, 1953 The applicant owns and will use all of the property between Palm Avenue and the Church of the Foursquare Gospel adjacent to the north and therefore there would be no interference from the adjacent property. The block opposite the property on Lake Street is light manufacturing and the block immediately to the south is zoned C-3 which permits construction to the front property line, and tb3 applicant further states that they are willing and able to carry out the purposes for which the conditional exception is sought and that they will proceed to do so without unnecessary delay. The Chairman opened the discussion on the petition by the Commissioners present, and City Engineer Overmyer was asked if he had any comments to make relative to the petition. City Engineer Overmyer stated that he finds nothing in the propasdd plans regarding the proposed improvements and stated that the conditions as outlined in the petition were correct and could not find anything that would be objectionable in their request. On motion by Pyles seconded by Davis that the Planning Commission of the City of Huntington Beach recommend to the City Council that the petition for conditional exception of t Masonic Temple Association of California for permission to construct a concrete block building as outlined 1-n-the petition on the property described as Lots 1, 3, •5, 7, and 9. Block 705, Wesley Park Tract, be.appr oved. Motion carried, • The Secretary was instructed to inform the Planning Com- mission of the County of. Orange, California, that the Planning Commission of the City of Huntington Beach had reviewed the Subdivision map of Tract 1872 and find no objections to the proposed subdivision.
