M. • Councilmen present: Terry, Lockett, Bartlett, LeBard, Seabridge Councilmen absent: None Monthly The Clerk read.the reports submitted for the month of Aeoorts -- November, 1954 by the City Clerk, City Treasurer, City Engineer, Manager of Municipal Trailer Park, City Collector, Fire Chief, Chief of Police and Recreation superintendent. • On motion by Bartlett seconded by Lockett the reports for the month of November, 1954, as submitted by the department heads and mead by the City Clerk were approved. Minutes On motion by LeBard seconded by Terry, the minutes for the City Council meetings of November 1 and November 15, 1954, as transcribed and mailed by the City Clerk, were approved. Business On motion by LeBard seconded by Terry the applications for Licenses license to conduct business in the City of Huntington Beach were granted as follows: Jane H. Schwartz, P. 0. The Clerk read the notice of hearing on petition for special permit published in the Huntington Beach News December 2,•19541 • on. a petition for special permit under Section 2423 to 2425.8 of Article 242.of the -Huntington Beach Ordinance Code as amended, of the City of Huntington Beach, California. Mayor Seabridge asked if anyone in the audience wished to make any statement in regard to the petition for special permit as read by the City Clerk, There being no statements filed for or • against the request either verbally or written, the Mayor declared the hearing closed. Crown Coach The Clerk read the agreement between the City of Huntington & body Co. - Agreement Beach and the Crown Body and Coach Corporation, wherein the Crown Agreement State Civil Defense Agreement City of H.B.. Herfurth, Coates,& England Ord. #616 2nd.read-' ing • • Body and Coach Corporation agrees to furnish to the City in accordance with specifications on file, a Crown fire apparatus Model CP 100-93-2566T,for a sum of $29 985.00. On motion by LeBard seconded by Lockett the Mayor and City Clerk be.authorized to execute the agreement between the City of Huntington Beach and the Crown Body and Coach Corporation, was approved. On motion -by LeBard seconded by Lockett that the Mayor and City.Clerk be authorized to execute the agreement for temporary transfer of vehicular equipfnent between the State of California acting by and through its duly appointed, qualified and acting Director of Civil Defense, and the. City of Huntington Beach Fire Department, was approved. On motion by Lockett seconded by,Ba.rtlett thi;eMayor and City Clerk be authorized to execute the agreement between the City of Huntington Beach and Coates, Herfurth and England, a do -partnership, to retain the services of actuaries for the investigation and valua- tion to be the basis of determination by the Board of Administration ✓ of the State Employees Retirement System and any necessary adjustment in the contributions required of agency under the contract between the City'of Huntington Beach and State•r'mployees Retirement System, Board, was.approved. The Clerk gave Ordinance No. 616, an ordinance of the City of Huntington Beach relating to stop intersections at Olive Avenue and 17th Street in the City of Huntington Beach and adding Sections 6217.6 and 6227.6 to the Huntington Beach Ordinance Code its second reading by title. Entity, taxes to be derived from the area of the Metropolitan Water District of Southern California lying within the corporate entity as such amount of taxes shall be fixed.in August, 1955, by resolution of the Board of Directors of the district in levying taxes for the fiscal year 1955-1956, was approved. Page #6 Minutes - December 6, 1954 J. P. Green The Clerk read a'communication from John P'. Green;:,Float lease. Specialists, inquiring about leasing a piece of ground 200' x 200' near, the old airport for the purpose'of erecting a building to manufacture and store parade floats that was referred to a committee of the City Council sometime ago. Mayor Seabridge referred the request of Mr. Green to the Building Committee and the City Engineer and a meeting was arranged for the morning of .December 7,'1954 to go ove.r.the area. :for the purpose of locating the building. Ethel,M. Ethel M. Miller of 1401 Delaware Avenue, appeared before the Miller, gas odor' City Council and reported that a gas odor was eminating from the well operated by Mr. Holmes, just south of her residence on Delaware Avenue, and also requested that they eliminate the derrick as it was a constant source of mental -hazard as long as it stayed there. Mayor Seabridge referred the request to the Oil Committee for study and report, and asked the Fire Chief to check into the reported gas eminating from the well,. The Manager of Pacific Trailer Park located on Huntington Sump hole open - Avenue reported to the City Council that the Wilson Peterson Well, proposed easement. that was drilled first had the sump hole still open and there have been numerous complaints. He also reported that in the agreement with Thomas Talbert and the trailer park operators in the deed provisions, Talbert was now ready to deed for easement purposes, for street burposes, the 30.feet south of the trailer park property line.. On motion by Bartlett seconded by LeBard the City Engineer be Instructed to prepare a legal description of the proposed easement for street purposes of the area at the southerly line of the Pacific Trailer Park.east of Huntington Avenue and to request a report from the Orange County Title Company covering ownership of record on the easement strip required was approved by the follow- ing roll call vote: AYES: Councilmen: Terry, Lockett, Bartlett, LeBard, Seabridge. NOES: Councilmen: None. ABSENT: Councilmen: None. Agreement On motion by Lockett seconded by Bartlett the Mayor and H.B.Co. B1k.1012 the City Clerk be authorized to execute the agreement between the W.P. Huntington Beach Company and the City of Huntington Beach covering the use of Block 1012, Wesley Park Section, in the City of Huntington Beach for a public playground, was approved. Beach consent to the execution by the Public Recreation Commission of & H.B.U.H.S. use of gym. the City of Huntington Beach of the agreement between the.Huntington Beach Union High School District and the Public Recreation Commission • of the City of Huntington Beach for use of the schools gymnasium, was approved. The Clerk read Resolution No. 1231, a resolution of intention Reso. 1231 of the City Council of the City of Huntington Beach to vacate a portion • of Bushard Street in said City and giving notice of a hearing on said vacation. On motion by LeBard seconded by Bartlett Resolution No. 1231, was passed and adopted -by the following roll call vote: AYES: Councilmen: Terry, Lockett, Bartlett, LeBard, Seabridge. NOES: Councilmen: None. • ABSENT: Councilmen: None. On motion by Bartlett seconded by Lockett the request of City Reclassify- Chaney,' Engineer, Harry Overmyer, to reclassify the following Street Department Kramer & Kuchenbecker employees and to become effective on December 1, 1954, was approved; Gary D. Chaney from Laborer -.Range 20, Bracket A, to Tree Trimmer, Range 21, Bracket A; Frank J. Kramer from Street ✓ Maintenance Man - Range 2Z, Bracket E.to Street Maintenance Leadman in Range 23, Bracket E; Earl Kuchenbecker from Truck Driver - Range 212 Bracket D to Street Maintenance Man - Range 22, Bracket D. Est.cost The Clerk read to the City Council the estimate of cost sub - Pistol mitted.by the City Engineer for the re -construction of the pistol Range range located on the City property at the sewage disposal plant and said cost to be approximately $2,215.00. Mayor Seabridge referred the re -construction of the pistol range as submitted by -the City Engineer in accordance with specifica- tions of the Police Department, to the Police and Fire Committee for study and report. On motion by Terry seconded by Lockett the request of Bud Higgind Vacation- Bud Higgins to take his.vacation starting December loth, 1954 and authorize the Assistant Chief to be in charge during his absence, was approved. • On motion by Terry seconded by Bartlett the request of Vernon Cut curb V.Nolin Nolin of 311 - 9th Street to out the curb at 619 Hartford Street for driveway purposes and all work to be done under the supervision and to the satisfaction of the City Engineer, was approved. • Page #8 • Minutes - December 6, 1954 On motion by Lockett seconded by Terry the request of Julius Cut .curb J.Gomes Gomes, 209 Lincoln Avenue for permission to cut the curb for drive- way purposes at 213-215 Joliet Street, .and the work to be done under the supervision and to the satisfaction of the City Engineer, was approved, Claim for The Clerk read the claim for damages ,filed by Wm. J. Rhind damages - Wm.J.Rhind for wrongfull death of Ronald Richard Rhind, who drowned on the 29th day of August, 1954, in the water in the beach area of the Hunting- ton Beach State Park in the general vicinity of -lifeguard tower #7, i and said claim in the amount of $50,000.00, and burial expenses and special damages in the amount ° of $1, 250.00. On motion by Lockett seconded by LeBard the claim of Wm. P. Rhind for Ronald Richard Rhind be referred to the City Attorney, was approved. ! City Attorney Bauer recommended to the City Council that the City of Huntington Beach deny the.claim for damages filed by Wm. J. Rhind for Ronald Richard Rhind. On motion by LeBard seconded by Bartlett that the claim filed by Wm. J; Rhind for Ronald Richard Rhind, and in accordance with the recommendation of the City Attorney, be denied, and the claimant be informed, was approved. Councilman Bartlett reported that certain gees on Acacia Trees removed Avenue between 6th and 7th Streets should be removed because they are 6th & '7th 'r Streets dead and cause considerable nuisance. On motion by Bartlett seconded by Terry the City Engineer be ; instructed to remove the trees on Acacia Avenue between 6th'and 7th Streets, in accordance with the recommendation of the Streets and Parks Committee, was approved. Light in On motion by Bartlett seconded by Terry in accordance with alley - Hill Street recommendations of -the Streets and Parks Committee, the City Engineer • be instructed to arrange for the installation of a light in the alley at Hill Street between Frankfort and Geneva Streets, was approved. Councilman Lockett reported that his committee had checked into Request - Garrish the request of Garrish for an extension of their lease for an additional ext. lease. five years and the committee would recommend such an extension pro- vided Garrish-put a new roof ont-the'building and certain enclosures, and if that was not done, then the lease to be extended for only a period of three years. On motion'by Lockett seconded by Terry the City Attorney be in- structed to drawup a lease with Garrish in accordance with recotmenda- tions as outlined and rental be -set at Forty Dollars per month, was approved.. On motion by Terry seconded by Bartlett the City Purchasing Purchase 1955 Dodge Agent be authorized to purchase from Roy D. Bryant Motor Company, Sedan - Police Dept. one 1955 Dodge Four -Door Sedan, V-8, with standard transmission, and equipped in accordance with the offer of'Roy D. Bryant Motor Company, at a price including California State'Sales Tax in the amount of $2,853.36, and the,City to trade in police car, 1953 Four -Door Plymouth #451 for $703.16, resulting in a net amount of $2,150.00, was approved. Mayor Seabridge referred to tie Sanitation Committee for study Storm Drain cleaned and report the request of the Gity Engineer to have the old storm draih line in the vicinity of 12th Street and Main:Street cleaned as It has been.showii through tests that the line is sound enough to continue to be used, and only requires cleaning out. On Motion by LeBar-dseconded by Bartlett the demands as D@mands approved by the Finance Committee be ordered paid, was approved.
