Remove Motion by Bartlett seconded by Terry, the request of Milton trees, B1k.201 Barratt and Ernest W. Bysshe, Jr. for permission to remove the trees in the parkway of Lot 32, Block 201, Huntington Beach Tract, in order that a drilling unit may be moved in, at their own cost and subject to the supervision of the City Engineer, was approved. W.E.Draper- The request of W. E. Draper to purchase from the City, at a tax title lots price of $300.00, without warranty of.title, tax title Lots 171-:-and 19 in Tract No. 73, was tabled. Remove Motion by Bartlett seconded by Terry, the request of Southern Palm trees B1k.201 California Petroleum Corporation for permission to remove two palm trees from the parkway in front of Lot 24, Block 201, Huntington Beach Tract, to facilitate the drilling of an oil well, at their own cost and subject to the supervision of the City Engineer, was approved. The Clerk read the report of the City Engineer submitting plans concrete block fence for the construction of a four foot height reinforced concrete block fence of such type as showing on the plan, together with an estimate Of cost for same. The cost figure is the estimate if the work is to be done by contract and in the opinion of the City Engineer that due to the nature of the work, that the work could be done for 20% less money by force account. than by contract, and is based on using City labor and equipment wherever possible. On motion by LeBard seconded by Bartlett, in accordance with re- commendation of the Beach and Pier Committee concurring with the Engineer �,. as outlined in his report and the City Council find and determine that the work and construction of the concrete block fence to be located at the Municipal Trailer Park can be done at a lesser cost by force account using City labor and equipmentrwherever possible and the City Engineer be instructed to proceed in accordance with the plans and specifications as presented, was approved by the following roll call vote: AYES: Councilmen: Terry, Lockett, Bartlett, LeBard, Seabridge NOES: Councilmen: None ABSENT: Councilmen: None Public hrg. Mayor Seabridge announced that a public hearing has been set for Vacate por- tion 8:00 o'clock P.M. this date, tova.cate a portion of Bushard Street in Bushard St. • the City of Huntington Beach, and requested the Clerk to read the Resolution of Intention. The Clerk read the City of Huntington Beach Resolution No. 1233, published in the Huntington Beach News on December 16, 1954, the Reso- lution of Intention of the City Council of the City of Huntington Beach to vacate a portion of Bushard Street in said City and giving notice of a hearing on said vacation. The Clerk read the affidavit of posting notice to vacate a portion of Bushard Street by Harry A. Overmyer, Street Superintendent and that after adoption of Resolution of Intention No. 1231, by the City Council of the City of Huntington Beach on the 6th day of December, 1954, he did post conspicuously along said street described in said resoution, notices of the passage of the resolution headed "Notice to Vacate a Portion of Bushard Street", one of which notices similar to the notice as aforesaid is annexed hereto and made a part hereof of the affidavit of posting notice, and that four notices were posted in accordance with Section 8322 of the Streets and Highways Code, and that he completed all posting of said notices on the 21st day of December, 1954, and 63 Tentative Map Tract No. 1776 Hearing on above set for 1/17/55 Police Dept. alter. & improv. Page #4 Minutes - Monday, January 3, 1955 thereafter made this affidavit and filed with the City Clerk of the City of Huntington Beach which was subscribed and sworn to before me this 3rd day of January, 1955, by John L. Henricksen, City'Clerk, Mayor Seabridge asked if anyone present wished to make a statement regarding the vacation of a portion of Bushard Street as described in the Resolution of Intention read by the Clert.. Lew Blodgett, Attorney -at -Law, appeared before the City Council on behalf of his client, Peter Aarales, and requested the City Council to take immediate action on the vacation of Bushard Street as co#ered in the public hearing held. Mayor Seabridge declared the hearing closed. On motion by LeBa.rd seconded by Bartlett the City Attorney be Instructed to draw up an order to officially abandon a portion of Bushard Street in the City of nuntington Beach in accordance with provisions in Resolution No. 1231, read by the City Clerk and upon which a hearing was held, was approved by the following roll call vote: AYES: Councilmen: Terry;: LeBa.rd, Bartlett, Lockett, Seabridge v NOES: Councilmen: None ABSENT; Councilmen: None The Council members continued the study of the Tentative Map Tract No. 1776, which the Planning Commission had recommended for approval subject to certain conditions. Oscar Perez, appearing for the subdivider stated the applicant would agree to a 20 foot alley to the east but the alley to the west has to be 18 feet and they desire the culdesac street as shown on the tentative map tract to be 55 feet wide instead of 60 feet required, and therefore, all the conditions could be complied with except the 18 foot alley and the 55 foot street and not to demand installation of main and lateral sewer lines as no grades have been established in that area, and it would be many years before such lines would be used. On motion by Terry seconded by Bartlett the City Clerk be instructed to insert in the local paper, the Huntington Beach News, a legal notice of'public hearing on the tentative map of Tract No. 1?76, and said hearing to be held at 8:00 o'clock P.M. on January 17, 1955, was approved. The Clerk read a report from Harry A. Overmyer, City Engineer, submitting a sketch showing the proposed alterations and improvements to the Police Department located in the City Hall Building, and said lu Page #5 Minutes - Monday, January 3, 1955 improvements including the renovation and the furnishing of new file cabinets and to construct a new roof over the northeasterly side of the City Hall, for purpose of additional coverage for Police Cars, the total cost of which is estimated to be-$4,950.00. On motion by Lockett seconded by Terry the City Engineer be instructed to proceed with the renovation of the Police Department quarters located in the City Hall in accordance with the report and estimate outlined by the City Engineer, and as read by the City Clerk, was approved. Green for permission to utilize an area approximately 200 feet by 200 feet located in the area of the 44 acres owned by the City, upon which the municipal Sew- age Plant is located, for the purpose of using the premises for the ,/ manufacture, sale, and display of floats and other.similar incidental uses and said rental to be $30.00 per month, and said period of lease to be for a term of three years from the lst day of January, 1955, and the Myaor and the City Clerk be authorized to execute the lease agreement, was approved. Ltr..f rom The Clerk read a communication received from H. A. Hiltscher, City of Fullerton City Administrator of the City of Fullerton, California, expressing re: H.B. Fire Dept. the City's gratitude for the mutual aid given to the City of Fullerton by the Fire Department of the City of Huntihton Beach in helping to overcome the greatest conflagration in the history of the City of Fullerton. Remove On motion by Bartlett seconded by LeBard the request of Camay trees, Blk. 201 Drilling Company for permission to remove two to four palm trees from the parkway in front of Lots 22 and 24, Block 201, Huntington Beach Tract, and the.removal of trees be subject to the supervision of the City Engineer and the cost of removal of trees to be borne by applicant, was approved. Pave alley, On motion by Bartlett seconded by Terry the City Engineer be 12th, 13th, Park & Lake instructed to proceed with the paving of the alley between 12th and 13th Streets and Park and Lake Avenues, was approved. Barrett City Engineer reported to the City Council that in his opinion contract, advise - Yit might be advisable to negotiate with J. S. Varrett who was recently defer work awarded the contract for the storm drain in the vicinity;�of 7th Street due to the fact of the expanding oil drilling that it might be advis- able to defer some of the work until later, if an agreement can be worked out with the contractor. Mayor Seabridge referred the request of -Harry Overmyer for review of the negotiation of the J. S.
