In the absence of Mayor Seabridge the City Clerk called the
regular meeting.of the City Council of the City of Huntington
Beach to order at 7:30 o'clock P.M., and stated that a motion
was in order to appoint a Mayor pro-tem in the absence of Mayor

• Seabridge.
On motion by Bartlett seconded by Terry Councilman LeBard
be appointed Chairman pro-tem in the absence of Mayor Seabridge,
was approved,

Minutes On motion by Lockett seconded by Bartlett the minutes of the
City Council meetings for the meetings of January 3rd, January loth,
January 17th, January 24th, January 31st, as transcribed and mailed
by the City Clerk be accepted and ordered filed, was approved.
Monthly The Clerk read the reports of the Department Heads for the
Reports
month of January, 1955, of the City Treasurer, City Clerk, City
Collector, City Engineer, Manager of Municipal Trailer Park, Fire
Chief, and the Recreation Superintendent.
On motion by Bartlett seconded by Terry the reports of the
Department Heads for the month of January, 1955, as read by the
City Clerk be accepted and ordered filed, was approved.

The Clerk read notice to L. J. Bjerknes which was served
on December 31, 1954,'calling for an appearance before the City
Council on February 7, 1955, at the hour of 7:45 o'clock P.M., to
show cause, if any, why the agreement between the City of Hunting-
ton Beach and L. J. Bjerknes, should not be terminated, and lessee
to remove at his own expense all property placed on the Huntington
Beach Pier and the conduct of the business of live bait.
L. J. Bjerknes appeared before the City Council and said it
was not due to his lack of effort but'due to the consistent break-
down of the old equipment he purchased from his predecessor and
the failure of the bait man to deliver bait regularly, and stated
he would be happy to cooperate with whomsoever the City of Hunt-
ington Beach made arrangements to carry on the vending of live bait.
On motion by LeBard seconded by Terry the agreement between
the City of Huntington Beach and L. J. Bjerknes for permission to
sell live bait on the Huntington Beach Municipal Pier be cancelled
and Bjerknes be directed to move all the equipment at his own
expense from the Huntington Beach Pier was approved.
On motion by Lockett seconded by Terry the application for
oil well permit,of Milton Barratt and Ernest W. Bysshe, Jr., to
directional drill a new well Wood No. 1, to be located on Lot 7,
Block 202, Huntington Beach Tract, subject to approval for form
by the City Attorney of the drilling and cleanup bonds.
On motion by Bartlett seconded by Lockett the application for
oil well permit of Milton Barratt and Ernest W. Bysshe, Jr. to
directional drill a new well Huntington Beach No. 7, to be -located
on Lot 17, Block 202, Huntington Beach Tract, was granted, sub-
ject to the approval for form by the City Attorney of the drilling
and cleanup bonds.
On motion'by Bartlett seconded by Terry the application for
oil well permit of Cather, Rogers, Barnes and Cree, to drill a
new well Nichols No.l, to be located on Lots 17, and 19, Block 201,
Huntington Beach Tract, was granted, subject to approval for form
by the City Attorney of the drilling and cleanup bonds.
On motion by Terry seconded by Lockett the application for
oil well permit of Cooper and Brain to whipstock a new well Walker
No. 1, to -be located on Lot 16, Block 105, Huntington Beach Tract,

form by the City Attorney of the drilling and cleanup bonds.
New Well, On motion by Lockett seconded by Bartlett the application

No. 1 for oil well permit of John N. Phillip, Operator, to drill a new
well McDonald No. 1, to be located on Lots 23, 25 and 27, Block
107, Huntington Beach Tract, was granted subject to the approval
for form by the City Attorney of the -drilling and cleanup bonds.
New Well, On motion by Bartlett seconded by Lockett the application

No. 1 for oil well permit of Rothschild Oil Company to drill a new
well, Kirkpatrick No. 1, to be located on Lot 8, Block 306,
Huntington Beach Tract, was granted, subject to the approval
for form by the City Attorney of the drilling and cleanup bonds.

well, Gullickson No. 1, to be located on Lot 8, Block 307, Hunt-
ington Beach Tract, was granted, subject to the approval for form

No. 1 oil well permit of the Sabre Oil Company to drill a new well
Wallace No. 1, to be located on the north 15 feet of Lot 17, and
Lot 19, in Clock 102, Huntington Beach Tract, was granted, subject
to the approval for form by the City Attorney of the drilling and
cleanup bonds.
New Well, On motion by Lockett seconded by Bartlett the application

for oil well permit of R. B. Watkins, to drill a new well Howe
No. 1, to be located on Lots 16 and 18, Block 106, Huntington Beach
Tract, was granted, subject to the filing of the drilling and

Lyndon A. The Clerk read a communication received from Lyndon A. Wells,
Wells -
informing City Council that the derogatory statements made regard-
ing his home which was moved from the First Street area to the
Memphis Street area, was not based on facts as the structure had
been examined by competent building inspectors and proven sound.
Tr.. #1776, The Clerk read_an estimate of cost submitted by the City

proposed subdivision to be located within the vicinity of Yorktown
and Florida Strees shown more particularly on the tentative map
Tract on file known as No. 1776 and that the estimate of cost for

paving including any street lighting, is $5,475.00.

Leroy The Clerk read the offer of Leroy Hermann of 416 15th Street,
Hermann
Huntington Beach, offering the City $500.00 for Lots 18 and 20,
Block 414, Huntington Beach Tract, and for the City to sell same
without warranty of title and subject to the clearing of title by
the buyer.
Chairman pro-tem LeBard informed Mr. Hermann that the City's
policy up to this time is to auction all tax title lots at a
public auction and until the policy of the City has been changed
In regards to offering at public sale only those tax title proper-
ties upon which the title has been cleared.

The Clerk gave the first reading of Ordinance No. 618, and'
ordinance of the City of Huntington Beach, California, relating
to the rules and regulations of the Munl6ipal Trailer Park,
amending Section 7711, 7712.1, 7713.2, 7714, 7716.1, 7718.4, 7718.5,
.7718.6, 7719, 7719.3, 7721, 7724, 7726, repealing Sections 7701,
7718.1, 7718.2, 7718.3 and adding Sections 7714.5, 7714.6, 7714.7,
7714.8, 7719.4, 7719.5.
The Clerk gave the first reading of Ordinance No. 619, anc`.
ordinance of the City of Huntington Beach, California, adding a
new Article 946 to the Huntington Beach Ordinance Code, establishing
an A-1 District -to be known as .the "Agricultural District"; adding

The Clerk gave the first reading of Ordinance No. 620, an ordinance
of the City of Huntington Beach, California, relating to the drilling
of oil wells -and the regulation thereof;.declaring an emergency
to exist; repealing Sections 2423,3, 2444.4, 2444.5, amending
Section 2421, 2421.1, 2421.2, 2421.4, 2422, 2422.1, 2443, 2444,
2444.1 and 2444.2 of the Huntington Beach Ordinance Code; and addding
Sections 2421.01, 2422.11, 2428, and 2431.3. to said Code.
J.S.Barrett The Clerk read the agreement between the City of Huntington

Beach and J. S. Barrett wherein the original contract on the 7th
Street storm drain work was cancelled and -the contract items
amended and adjusted in the new agreement.
On motion by Lockett seconded by Bartlett the Mayor and the
City Clerk be authorized to execute the agreement between the City
of Huntington Beach and J. S. Barrett, was approved.
Mr.Miller Mr.. Miller of the Standard Oil Company of California, appeared
of Std.Oil-
oil code before the City Council and asked to meet sometime with the Oil
Committee and stated that he represented the Land Use Committee
of the Western Petroleum.Association and could be of considerable
assistance in helping the City in the amendments and changing of
their oil.code.
Reso.#1235, The Clerk read Resolution No. 1235, a resolution of the City
accepting
grant deed Council of the City of Huntington Beach accepting Grant Deed to
certain real property and authorizing the recording of said deed.

On motion by Terry seconded by Lockett Resolution No. 1235
was passed and adopted by the following roll call vote:

The Clerk read the agreement between the City of Huntington.
Beach, Orange County -Water Works District No. 3, and Orange
County Water Works District No.. 5, wherein the parties to the
agreement make provisions for the construction of facilities
recommended by engineers and to make provisions for the joint
exercise powers to select and constitute an agency to administer
and execute the agreement and consitixting the West Orange County
Water Board.
The Clerk read Resolution No. 1236, a resolution of the Cii'
Council of Huntington Beach, California, adopting and authorizing
the signature of an agreement constituting the West Orange County
Water Board.
On motion by Terry seconded by Lockett Resolution No. 1236,
was passed and adopted by the following roll call vote:

NOES: Councilmen: None

The.Chairman pro-tem referred the request of Ben Dulaney,
Chief, of Police, for a two-way boulevard stop to.be•placed on
llth Street at the intersection of Palm Street to the Police and
Fire Committee, for study and report.
On motion by Bartlett seconded by Lockett the Orange County
Society for Rrippled Children and.Adults*be given permission.to
sell paper lapel Easter lilies on the streets in the City of
Huntington Beach on March 25th and March 26th, was approved,
On motion by Lockett seconded by Bartlett the Mayor and the
City -Clerk be instructed to execute on behalf of the City the
agreement between the City of Huntington Beach and Gus D. Allen
for operation -of a cafe and restaurant business located upon the
end of the Huntington Beach Municipal Pier for a period of three
years from January 1, 1955, to. December 31, 1957, inclusive, was
approved.
On motion by Lockett seconded by Terry the Mayor and the City
Clerk be instructed o execute on behalf of the City the agreement '
between the City of Huntington Beach and Dwight K. Clapp and Jack
K. Clapp to operate a beach concession for an additional period
of three years from and after the 1st day of January, 1955, was
approved,

On motion by LeBard seconded by Lockett the agreement be-
tween the City of Huntington Beach and Wm. C. Wantz to permit
the selling of live fish, salt bait, fresh dead fish to be used
as bait, and to rent fishing poles for use only on the sport -
fishing boats operated by lessee, was approved.
The Clerk was instructed to instruct L. J. Bjerknes that the
City Council had made arrangements with Wm. C. Wantz to operate a
live bait business at the end of the pier.
The Clerk read a communication received from the State Zands
Commission asking the City when they might expect to receive a
letter of application for permit to cover that portion of the
Municipal Pier which occupies State lands.
The Clerk read a Resolution received from.the City of Seal
Beach requesting the -City of Huntington Beach to take the same
action requesting the Pacific Electric Railway Company to remove
their tracks as they are not being utilized as contemplated under
their permit.
The request of the Seal Beach City Council was taken under
advisement by the entire City Council members.
On motion by Bartlett seconded by Terry the demands as
approved by.the Finance Committee be ordered paid, was approved.
Councilman Lockett requested the City Council to consider
retaining Harry Ashton as.legal counsel for the City of Huntington
Beach on the West Orange County Water Board.

On motion by Lockett seconded by Terry that Harry Ashton
be requested to submit a letter covering compensation for services
for his proposed legal counsel for the City on the West grange
County Water Board, was approved.
On motion by Bartlett seconded by Lockett, that in accord-
ance with the request of Fire Chief Higgins the City Engineer
be instructed to construct three portable lifeguard stations
and the budgeted amount be charged to the. Special Fund for
Capital Outlays, and said work to be completed by April 1, 1955,
was approved by the following roll call vote:
AYES: Councilmen: Terry, Bartlett, Lockett, LeBard
NOES: Councilmen: None
ABSENT: Councilmen: Seabridge
Chairman pro-tem referred the matter referred by the Airport
Committee covering the request of the Southwest Airplane Dust
Cropping Corporation for permission to use an air strip adjacent
to the Georgianna Garrish-lease to the Building Committee for
study and report.
On motion.by Lockett seconded by Bartlett the regular meet-
ing of the City Council of the City of Huntington Beach adjourned,
