Commissioners present; Bazil, Schryer, Bardwell, Stang Commissioners absent: Valentine, Presson, Davis Chairman Stang announced that a public hear- ing had been called at the hour of 7:4.5 o'clock P.M. (Reso.#33) and classification of the following described land in said City: All of the land .which is now within the boundaries of the City of Huntington Beach and lies easterly of Hampshire Avenue, northeasterly of Ocean Avenue as it exists.at present and southerly of the center line of Atlanta Street and said line extended east- eVlYwiof Santa Ana River* And, that said hearing will be held on Tuesday, May 17, 1955, at the hour of 7:45 o'clock P.M., and all interes- ted persons are invited to appear at said hearing and express their opinions for or against said proposed changes. The Secretary reported that a notice of the public hearing and a copy of the resolution No. 33, ini- tiating the hearing,,were mailed to all property owners within the area proposed to be reclassified, and that no verbal or written protests had been filed as of 5:00 o'clock P.M. May 17, 1955. The Secretary reported that the County Sanita- tion Districts of Orange County, California, Districts No. 1 to 11 respectively, have no comment or interest as to change in zoning as set forth in Resolution No. 33• Chairman Stang asked if anyone present wished to make any statements in regard to the hearing on the reclassification. •Attorney Lew Blodgett appeared before the Com- Attorney missioners and said that he represented some of the pro - Blodgett perty owners of record in the area proposed for reclassi- fication and made -the following statements: The re -zoning causes a hardship on owners of large acreage as the proposed reclassification of use limits activities for building purposes and commercial purposes to five acres, and would pro- hibit the sale of property for less than five acres. No consideration has been given for property front- ing Highway #101 or Highway #39, and permits the use of the property for agricultural purposes but not for commercial use as permitted in other parts of the City. Planning Commission May 17, 1955 That the proposed r©-zofilng is arbitrary and un- reasonable, that the area was brought into the City under the uninhabited act and the property owners have paid City taxes on it ever since without receiving any benefits whatsoever from the City. Also, to classify all the land in the same cate- gory, such as the high land owned by his client, which is productive agricultural land with the swamp areas adjacent to the highways is positive= ly unreasonable. Mr. Flynn appeared before the Commissioners, representing the Mills land and Water Company and stated Mr. Wynn that the proposed reclassification is just as unrealis- tic as the, present R-1 Zone. He also stated that -the land is good for oil exploration which was manifested by the -property owners at a prior hearing before the Commissioners and the present proposed reclassification would prohibit the property development of their pro- perty fronting Highway #39, which they are negotiating, and that consideration should be given to zoning the properties fronting the highways for commercial and. business purposes. Mrs. Thorpe Hook asked why the area under proposed reclassification was annexed in the first place, Mrs.Thorpe as she has paid taxes continually to the City and appar- Hook ently the'low land she owns adjacent to the highway is only good for the exploration of oil except' a very narrow strip fronting Highway #101, and as a property owner she stated her preference for keeping the area in the R-1 Zone. Chairman Stang continued the hearing on the proposed reclassification of the area initiated by Planning Commission Resolution No. 33, to the regular meeting to be -held on June 21, 1955, due to the lack of a voting majority. The Commissioners present held a general dis- cussion on the statements and requests of the property owners present and representatives of property owners. Cons.Parks- On motion by Schryer seconded by Bazil, Con - leave of sultant Parks be given leave of absence for the month of absence July, 1955, for vacation purposes, was approved. On motion by Schryer seconded by Bazil the Secretary be instructed to write a communication to the Orange County Planning Commission to oppose the variance request of James R. Glenn to establish an automobile wr ecking yard in the M=-1 Light Industrial District on the property on the west side of Hunting- ton Avenue about 400 feet north of Main Street in the north Huntington Beach area, as the Commission considers it an undesireable use of the land in that particular area, which is under discussion for annexation to the City, was approved.
