On motion by LeBard seconded by Bartlett the request of-R.B. City of Watkins for termination of Glens Falls Insurance Company cleanup bond H.B.Well #2 - Term. The Clerk read the. affidavit of posting notices of Use District hearing, dated May 23, 1955, by Harry A. Overmyer, City Engineer, swearing that he is now and was dAring all the times mentioned the duly appointed, qualified, and acting City Engineer of the City of Huntington Beach in said County and State, and that on the 16th day of May, 1955, the City Council of said City approved the recommendation of the Planning Com- mission to reclassify a parcel of land from S-1 District to R-1-0 Dis- trict as contained in the planning Commission Resolution No. 36, and 00 521 Page #4 Minutes-Ttieaday, May 31, 1955 that in accordance with Article 925 of the Huntington Beach Ordi- nance Code notices were posted conspicuously along the property described in the resolution, one of which notice is similar to the notices posted and annexed to the affidavit and made a part thereof, and that he completed all the postings of said notices on the 20th day of May, 1955, and thereafter made the affidavit and filed it with the City Clerk of the City of Huntington Beach, and subscribed and sworn to before the City Clerk on the 24th day of . May,1955. The Clerk reported that no statements or protests had been filed for or against the proposed changes of use district boundary and classification for thehm-riag to be held by the City Council at 7:45 o'clock P.M., tuesday, May 31, 1955. Mayor Seabridge asked if anyone present wished to make any statements in regard to the proposed change of use district boundary and classification on property described in the notice read by the City Clerk. There being no statements forthcoming relative to the proposed changes of use district boundary classification in the area described in the legal notice read by the City Clerk, Mayor Sea - bridge dedlared the hearing closed. The Clerk read Resolution No. 1245, a resolution of the City Reso.#1245 Council of the City of Huntington Beach, re-classifying certain lands now shown on Sheet 13 of the Districting Maps of the City of Huntington Beach, from a S-1 Zone to R-1-0 Zone. On motion by LeBard seconded by Bartlett Resolution No. 12459 was passed and adopted by the following roll call vote: AYES: Councilmen: Lockett, Bartlett, LeBard, Seabridge NOES: Councilmen: None ABSENT:CoUncilmen: Terry The Clerk gave Ordinance No. 627, an ordinance of the City of Ord. ##627 Huntington Beach reclassifying certain lands from S-1 District to R-1-0 lct. rdg. District, and amending Sheet No. 13 of the Districting Map of the City of Huntington Beach, State of California, as set forth under Ordinance Code Section 9211.2 its first reading. E.S.Nick- On motion by Bartlett seconded by Lockett the request of Earle erson- request S.Nickerson for permission to break the curb at 520-13th Street, in order to cut curb to build a front approach and carport on his property, and said work to be done under the supervision of the City Engineer was granted. On motion by Lockett seconded by LeBard the Mayor and the City Civil Defense Clerk be authorized to execute the agreement for temporary transfer of trfr.veh. equip. vehicular equipment between the State of California, acting by and through • 522 • Page #5 Minutes May 31i 1955 its duly appointed, qualified, and acting Director of Civil Defense, and the City of Huntington Beach Fire Department, was approved. Mayor Seabridge announced that a public hearing had been set for 8:00 o'clock P.M. and requested the Clerk to read the notice of public hearing. The clerk read the notice of public hearing published in the Huntington Beach News on May 19, 1955, relative to.proposed changes of District boundary and use classification of the following described par- cel of real property in said City: All that certain land -situated in the City of Huntington Beach, County of Orange, State of California, described as follows, to -wit: Beginning at a point on the southwesterly line of a 40 foot strip of land conveyed to the Santa Ana and Newport Railway Company by deed recorded in Book 44. Page 66 of Deeds,reeords of Orange County, California, 1610.4 feet northwesterly from the point of intersection of the southwesterly line of Santa Ana and Newport Railway Company's right-of-way and the easterly line of Section Fourteen (14), Township Six (6) South, Range Eleven (11) West, S,B.B.&M.; thence northeasterly at right angles to the said southwesterly line of said Santa Ana and Newport Railway Company's right-of-way to the point of intersection with the southwesterly line of the Pacific Electric Railway Company's • right-of-way; thence southeasterly along the southwesterly line of said Pacific Electric Railway Company's right-of-way to.the gasterly line of said Section Fourteen (14); thence southerly along the easterly line of said Section Fourteen (14) to the line of ordinary high tide of the Pacific Ocean; thence northwesterly along said ordinary high tide line to the point of intersection with a line drawn at right angles to the. southwesterly line of the said Santa Ana and Newport Railway Company's right-of-way from a point distant 1610.4 feet north- westerly measured along said right-of-way line from the easterly line • of said Section Fourteen.(14); thence north easterly to the point of beginning, Also, that the said hearing will be held on Tuesday, May 31, 1955, at the hour of 8:00 o'clock P.M., and all interested -persons are invited to appear .at said hearing and express their opinions for or against the proposed changes, The Clerk read affidavit of posting notice of use district hear- ing filed by Harry A. H. Sylvester, speaking for the Veterans of Foreign Wars VFW - Post Huntington Beach, appeared before the City Council and requested fireworks stands to utilize an area of.the City property east of Huntington Avenue and north of Highway #101 for use of fireworks display, as the area owned 523 C C, 11 Page #7 Minutes-T'esday, May 31, 1955 by McCallen at the junction of Highway #39 and Highway #101 for the Fourth of July period has been leased to another cm-gsA,1dairtftand they have no place in which to sell their fireworks, and said operation would be subject to the salectf ,"flrexorks regulations of the City of Hunt- ington Beach, County and the State. On motion by Lockett seconded by LeBard the Veterans of Foreign Wars Post, Huntington Beach, be permitted to use the area east of Hunting- ton Avenue north of Highway #101 for fireworks stands and said use to be subject to the Huntington Beach drdinance Code fireworks regulations, the County and State regulations, and said operation be under the super- vision of the Fire Chief was approved. Henri Garrish of Garrish Bros. Aircraft Engine Service appear- ed before the City Council and stated that they are incorporating their Garrish concern and to satisfy certain requirements asked the City Council to Bros. - change take action for permissionto change their present operating name from lease name Garrish Bros. Aircraft Engine Service to Garrish Engineering, Incor- porated, as such a move would be necessary before their lawyers could complete the incorporation papers, and that the functions of the cor- poration will remain the same and that John1G. Garrish and Henri w. Garrish would retain the majority control of the corporation. On motion by Lockett seconded by LeBard that consent be given by the City Council to the Garrish Bros. bequest to change the lease from Garrish Bros. Aircraft Engine Service to Garrish Bros, Engineering, Incorporated, subject to the filing with the City, proof of assignment from Garrish Bros. Aircraft Engine Service to Garrish Bros, Engineering, Incorporated, was approved, Mayor Seabridge called a recess of the City Council at 8:25 o'clock P. M. Councilman Terry arrived at this time, 8:35 o'clock P.M. The City Council re -convened at 8:40 o'clock P.M. Mayor Seabridge asked Lem Berry, Manager of the Municipal Trailer Park, if he found any objection to the reclassification of the area described in Resolution No. 1246, Mr. Berry stated that In his opinion the area to be rezoned Lem for 011�..roduction operation would not interfere with the trailer park Berry operations and further would not interfere with the recreation of the beach area or for trailer expansion on the beach area. He also stated that there was a measured distance from the seawall of the Trailer Park In that area 330 feet distant to mean high tide. Chief of Police Dulaney confirmed the statements made Chief by Lem Berry, Manager of Municipal trailer Park, relative to any Dulaney detrimental affect to the beach area or expansion of the Trailer Park on the beach area. Mayor Seabridge asked if anyone else had anything to say , or wished to make a statement relative to the rezoning of the area described in the resolution read by the City Clerk affecting the eastern portion of the trailer park proper. No comment was made from anyone present. The Clerk read the proposed amendment of the oil and gas Signal Oil & Gas Co. lease with Signal Oil and Gas Company entered into on January 24, 1955. The Clerk road Resolution No. 1247, a resolution of the City Council of the City of Huntington Beach finding and declaring that it be for the best interest of the City to enter into and.agree- Aeso.No. 1247 ment of amending an existing oil and gas lease covering certain City owned property, and finding and declaring that the use of portions of said City -owned land as a drill site will not substantially interfere with the use of such property for other purposes now existing. On motion by Lockett seconded by LeBard Resolution No. 1247 was passed and adopted by the following roll call vote: AYES: Councilmen: Terry, Lockett, LeBard, Bartlett, Seabridge NOES: Councilmen: None ABSENT: Councilmen: None The Clerk gave Ordinance No. 625, an ordinance of the City Ord.# 625 Council of the City of Huntington Beach, California, setting the fee final reading for connecting with sewer lines in Block 180a of Tract No. 12, and providing.the penalty for violation thereof its second and final reading by title. On motion by Bartlett seconded by LeBard the request of Aeclass- Harry A. Overmyer, City &ngineer, to reclassifty James B. Way as ify James B. Way Equipment Operator in salary Range #27, Bracket "B", effective June 1, 1955, was approved. The request of Vernon L. Mauldin, for installation of curb Vernon L., and gutters on the south side of Memphis Street between Alabama Avenue Mauldin and the Pacific Electric tracks to alleviate muddiness and drainage during the rainy season and to serve as incentive to further improve property was referred to the Streets and Parks Committee by Mayor Seabridge. The request of the Huntington Beach City Employees Credit H.B.City Employ Cr.Union Flood lights, pier, for night f i shing Union to lease the Horseshoe Club Building to be used as an office'for the Credit Union, a non-profit orgaAka8tion licensed by the State of California, was referred to the Building Committee for study and re- port by Mayor Seabridge. On motion by LeBard seconded by Bartlett the City Engineer be instructed to furnish the City Council with a cost estimate for the installation of four or five flood lights to be installed on the pier for the purpose of night fishing and electrical installation to be so arranged that it can be controlled from the inside of a building, was approved; On motion -by LeBard seconded by Bartlett the City Engineer be tequested to furnish a cost estimate to provide for adequate lighting on the beach area between the east side of the p&Rr to the western limits of the Trailer Park on the beach, was approved.
