Councilmen present: Terry, Lockett, Bartlett, LeBard, Seabridge Councilmen absent: None On motion by Lockett, seconded by LeBard the minutes for Minutes the meetings of the City Council for the month of May, 1955, as transcribed and mailed by the City Clerk be accepted and ordered filed, was approved. The Clerk read the reports of the department heads for Monthly the month of May, 1955, of the City Clerk, City Treasurer, City Deports Collector, City Engineer, Manager of Municipal Trailer Park, Fire Chief, Police Chief, and Superintendent of Recreation, On motion by Bartlett seconded by Terry the reports for the month of May, 1955, of the department heads as read by the City Clerk be accepted and.ordered filed, was approved. Mayor Seabridge recommended the appointment 6f Miss Miss Agnes Smith,- Agnes Smith to fill the unexpired term of Dante Siracusa on the Aecr.Comm. Recreation Commission of the City of Huntington Beach. On motion by Bartlett seconded by LeBard the appointment of Miss Agnes Smith by Mayor Seabridge to fill the,unexpired term of Dante Siracusa on the Recreation Commission be confirmed, was approved. On motion by Lockett seconded by LeBard the applications Business Licenses for license to conduct business in the City of Huntington Beach were granted as follows: Chambers Hardware & Building Supply, Bellflower, delivery service, wheel -tax. Stanley D. Olson, Anaheim, plastering and lathing contractor. Frank Resnik, Long Beach, trucking. A. H. Shipkey Company, Anaheim, delivery auto accessories, wheel -tax. E. R. The Clerk gave Ordinance No. 627, an ordinance of the Ord. #621 final rag. City of Huntington Beach reclassifying certain lands from an S-1 District to an R-1-0 District and amending Sheet 13 of the Dis- trict Map of the City of Huntington Beach, County of Orange, State of California, as set forth under Ordinance Code Section 9211.2 its second and.final reading by title. Ori motion by Lockett seconded by LeBard the reading of • Ordinance No. 627 in full be dispensed with was approved. On motion by LeBard seconded by Lockett Ordinance No. 627-was passed and adopted by the following roll call vote: AYES: Councilmen: Terry, Lockett, Bartlett,'LeBard, Seabridge NOES: Councilmen: None ABSENT: Councilmen: None The Clerk gave Ordinance No. 628, an ordinance of the City of Huntington Beach reclassifying certain land from an S-1 Ord. #628 final rdg. District to an R-1-0 District and amending Sheet 16 of the Dis- tricting Map of the City of Huntington Beach-, County of Orange, • State of California, as set forth under ordinance Code Section 9211.2 its second and final reading by,title. • On motion by Lockett seconded by Terry the second reading of Ordinance No. 628.1n full be dispensed with, was approved. On motion by Lockett seconded by Terry Ordinance No. 628, was passed and adopted by the following roll call vote: AYES: Councilmen: Terry, Lockett, LeBard, Bartlett, Seabridge NOES: Councilmen: None ABSENT: Councilmen: None The Clerk gave Ordinance No..629, an ordinance of the Ord..#629 City of Huntington Beach, California, providing for the issuance bond issue., lst.rdg. of bonds of said City in the amount of $860,000.00 its first reading. On motion by Lockett seconded by_ LeBard the request of Leo W. D. G. Higgins, Fire Chief, to appoint Leo W. Farwell as relief Farwell, Relief Vac. vacation Fire Engineer in the Fire Department in Range 27, Fire Engr. Bracket "A" of the salary classification, of the Huntington Beach Ordinance Code, and said appointment to be effective on June 15, 1955, was approved. On motion by Terry seconded by Bartlett the request of Lois Kitts the City Clerk to change --the classification of Lois Kitts to classifi- cation Senior Typist Clerk in Range 24, Bracket "B", of .the City of changed 525 Huntington Beach salary classification lode, and to*be effective 525 Page #3 Minutes - Monday, June 6, 1955 July--1, 1955,-was approved. On motion by Bartlett seconded by LeBard the request Rosenow lease trfd. of Verl F. Rosenow for the consent to trasfer his lease with the D.Gay City of Huntington Beach to David Gay, -was approved. Mayor Seabridge announced that a hearing was set for 8:00 o'clock P.M. this date, and requested the City Clerk to read the notice of public hearing. The Clerk read the notice of public hearing calling for a hearing to be held by the City Council of the City of Hunting- Calumet--• ton Beach in the Council Chamber in the City Hall, at the hour Well #1 Term.drlg. of 8:00 o'clock P.M. on Monday the 6th day of June, 1955, for the, bond purpose of considering the request for termination and cancellation of drilling bond as provided for in Section 2427.4 of the Huntington Beach Ordinance Code, on producing well located on property described as follows: Lots 2 and 4., Block 318, Huntington Beach Tract, City of Huntington Beach, as per map thereof recorded in Book 4, Page 10, Miscellaneous Maps, Records of Orange County, California. The Clerk read the affidavit of C. D. Howe, duly sub- scribed and sworn to before a notary public, stating that he is drilling superintendent of Gene Reid Drilling Company and that in such capacity he supervised the�dbilling of the oil well known as Calumet No. 1, owned by D. E. Fairbanks and that as such drilling superintendent it.is his responsibility to drill said well as near vertical as possible,•and that directional surveys known as single shot surveys were taken and that if any deviation shown of more than twenty minutes the same was corrected, and baseing his experience In drilling of oil.wells and knowledge of the well as set forth, his knowledge of single shot surveys affiant, stated that the well., could not drift more than twenty minutes from the vertical. Mayor Seabridge asked if anyone present wished to make a statement in regard to the cancellation of drilling bond as request- ed by the applicahh. There being no statements forthcoming for or against the request for termination of drilling bond on well located on Lots 2 and 4, Block 315, Mayor Seabridge declared the hearing closed. On motion by LeBard seconded by Bartlett the request of D. E. Fairbanks for termination of drilling bond, Hartford Accident Indemnity Company No. 2529338, covering Calumet Well #1, located on Lots 2 and 4, Block 318, Huntington Beach Tract, was granted by the following roll call vote: 526 Page #4 Minutes - Monday, June 6, 1955 ._1 AYES: Councilmen Terry, Lockett, Bartlett, LeBard, Seabridge NOES: Councilmen: None ABSENT: Councilmen: None Mayor Seabridge announced that this was the date set to hear from property.owners having any objections to the proposed removal of weeds, rubbish, refuse and dirt, and show cause, if any, why they should not -be removed. The Clerk read the affidavit of.posting notices to de - Abatement stroy weeds filed with the City Clerk by Street Surperintendent • of weeds, etc., per Harry A. Overmyer on the 24th day of May, 1955, stating that he • Reso.#1243 posted conspicuously along all the streets and property within the district described in the resolution of intention No. 1243, adopted by the City Council on the 2nd day of May, 1955. Mayor Seabridge asked if anyone present wished to make a statement in the matter to abate the nuisance of dangerous weeds, rubbish, and dirt on -property as posted in accordance with the affidavit of the City Engineer, and the Resolution #1243 adopted by the City Council the 2nd day of May, 1955. There being no statements forthcoming for or against the order to abate the nuisance tp remove and destroy weeds, rubbish; refuse and dirt, Mayor Seabridge declared the hearing closed. On motion by Bartlett seconded by Terry the Street Superintendent of the City of Huntington Beach be instructed to abate the nuisance of obnoxious and dangerous weeds growing upon or in front of property and that rubbish, refuse and dirt upon or in front of property be removed in accordance with statutes -of the State of California, was approved. The Clerk read Resolution No. 1248, a resolution of the Re so .#1248 inviting City Council of the City of Huntington Beach directing the City sealed pro- posals -bonds Clerk to publish a notice inviting sealed proposals for $86o,000.00 bonds of said City. On motion by Lockett seconded by Terry Resolution No. 1248 was passed and adopted by the following roll call vote: AYES: Councilmen: Terry, Lockett, -Bartlett, LeBard,.Seabridge NOES: Councilmen: None ABSENT:Councilmen: None Mayor Seabridge announced that a hearing was set for 8:15 o'clock P.M. this date; and requested the Clerk to read i the petition and -notice of public hearing. The Clerk read the application of Hamilton and Sherman Operators for Special Permit under -Sections 2423 to 2425.8, in - elusive, of Article 242 of the Huntington Beach Ordinance Code 00 526 Hamilton & Sherman Operators= special permit for drlg..oil well VFW -request construct curbs & gutters W.Or.Co. Wtr.Bd.- acmuis.for right -of way pur- posesrre: water lines Page #5 Minutes - Monday, June 6, 1955- as amended, requesting the.City Council to grant a.apecial per- mit to drill an oil well to be located near the Pacific Elec- tric Railway right-of-way adjacent to 12th Street and the center of the hole of.'the proposed well will be within 51 feet of the nearest rail -of the Pacific Electric Railway tracks. The Clerk. read the notice of.hearing on petition for special permit of Hamilton and Sherman Operators, published in the Huntington Beach News, May 26th, 1955, calling for a public hearing to be held in the Council.Chamber of the City Hall on Monday, the 6th day of June, 1955, at 8:15_6 clock P.M. The Clerk reported that no protests orally or written f had been received up to the hour of 8:15 o'clock P.M., June 6, 1955, relative to the petition for special permit of Hamilton and Sherman Operators. Mayor Seabridge asked if anyone present wished to make a statement for or against the request for special permit of Hamilton and Sherman Operators to drill a well within 51 feet of the nearest rail,of the Pacific Electric Railway, and ad- jacent to 12th Street. There being no statements forthcoming.from anyone pre- sent Mayor Seabridge declared the hearing closed. On motion by LeBard seconded by Bartlett the request of Hamilton and Sherman'Operators for special permit under Sections 2423 to 2425.8, inclusive, of Article 242 of the Huntington Beach Ordinance Code as amended, to drill an oil well within 51.feet of the nearest rail of the Pacific Electric Railway adjacent to 12th Street and seaward of.the railway tracks, was granted by the follow- ing roll call vote: AYES: Councilmen: Terry, Lockett, Bartlett, LeBard, Seabridge NOES: Councilmen: None ABSENT: Councilmen: None Mayor Seabridge referred the request of the Huntington Beach Post No. 7368, Veterans of Foreign Wars of United States for the construction of curbs and gutters at the location of the V.F.W. Hall at 319 Yorktown Street to -the Streets and Parks Com- mittee for study and report. The Clerk read a communibation from Harrison and Woolley Consulting Engineers advising the City.Council that in accordance .,w-ith the minute order of the West Orange Coutty Water Board dated April 27, 1955, they have prepared a list of owners of record and legal descriptions of property, required for the purpose of acquisition for right-of-way purposes for the water lines to serve the City of Huntington Beach, and transmitting 1 1. • •• I •�1 527 Page #6 Minutes.- Monday, June 6, 1955 herewith threee copies each of the list of the owners of record and legal description and also sheets No. 9 and No. 10 of the Huntington Beach feeder plan and profile delineating parcels No. 1 through 20, inclusive. On motion by Lockett seconded by LeBard that the list of owners of record and legal descriptions of properties for the purpose of acquisition for right-ofway purposes for the water line to.serve the City of Huntington Beach as prepared and presented by Harrison and Woolley, consulting engineers, • in accordance with the West Orange County Water Board be re- 1 ferred to the City Engineer, the City Attorney, and the City Clerk to negotiate for the right-of=way and to be given author- ization to incur the necessary title expense was approved by the following roll call vote: AYES: Councilmen: Terry, Lockett, Bartlett, LeBard, Seabridge NOES: Councilmen: None .ABSENT: Councilmen: None On motion by LeBard seconded by Lockett the demands as Demands approved by the Finance Committee be ordered paid was approved. Mayor �eabridge referred the request of Cortell Swann C.Swann removal f or,removal of. tree at 506 - 13th Street to the 'streets and of tree Parks Committee for study and report. On motion by Lockett seconded by Terry the City Engineer Ext.paint- ing of be instructed.to proceed with the exterior painting of the Memo. Hall Memorial Hall Building as outlined and discussed, was approved. Councilman Terry brought up the subject of the condition of the Log Cabin at Lake Park being used by the Scouts and re - Lake Park quested.that it be reconditioned and cleaned up for use by Girl Log Cabin Scout groups. Mayor Seabridge referred the request of Councilman Terry for the reconditioning of the Log Cabin at Lake Park to the Building Committee and the City.Engineer, for study and report. On motion by LeBard seconded by Bartlett the request of the City Attorney to be excused from attending the meeting of June 20, 1955, was approved.
