M. Councilmen present: Lockett Bartlett, LeBard, Seabridge Councilmen absent: Terry (Terry arrived at 8:25 o'clock P.M.) On motion by LeBard seconded by Lockett the minutes of Minutes the City Council for the meetings of August, 1955, as transcribed and mailed by the Clerk be accepted and ordered filed, was approved. The Clerk read the reports for the month(of August, 1955 Monthly Reports of the City Treasurer, City Clerk, City Collector, City Engineer, Fire Chief, Chief Lifeguard, Manager of Municipal Trailer Park, Police Chief, and the Superintendent of Recreation. On motion by Bartlett seconded by Lockett the reports of the department heads for the month of August, 1955, as read by the City Clerk be accepted and ordered filed, was approved. Mrs. Shupe and Mrs. Cusolito appeared before the City Council and reported on the Status of the tax title lot 24, in Block 813, Wesley Park Tract, and stated that they had contacted all Mrs.Shupe purchases property owners on that side of the block relative to quitclaiming lot, $400. to each other in order to correct the error in survey made some years ago, which was what the City Council had requested them to do, to ,See, if the matter could be clarified by the property owners, which it would have to be, and since one property owner would not go a- long with it, they request the City Council to sell to them the lot as is, and reaffirm their offer of 4400.00 for the purchase of the lot. On motion by Lockett.seconded by Bartlett the offer.of Mrs. Shupe in the amount of 4400.00 for the purchase of Lot 24, in Block'813, Wesley Park Tract, be accepted and the City Attorney be instructed to draw up a quitclaim deed, was approved. On motion by LeBard seconded by Lockett the applications Business: for license to conduct business in the City of Huntington Beach Licenses were granted as follows: Louis Schmetzer Company, Tustin, furnances and heating installation. Ahddrson Plumbing Company, Santa tina, plumbing contractor. Ray L. Smith, Huntington Beach, plastering contractor. Southwest Shows, Baldwin Park, carnival. Mayor Seabridge reported that the hour of 8:00 o'clock Biller- P.M., this date, has been set for a public hearing, and requested Snyder Spec. Permit, the Clerk to read the application and the notice of public hearing, Approved as published in the Huntington Beach News. Snyder for special permit under Sections 2423 to 2425.8, inclusive, of Article 242 of the Huntington Beach Ordinance Code, as amended, to permit the drilling of an oil well on a parcel of land, said land being a strip 40 feet wide, situate in the City of Hunting- ton Beach, County of Orange, in Section 11, Township 6 South, Range 11 West, S.B.B. & M., being a portion of Parcel No. 1 described In deed dated May 11, 1948, between Southern Pacific Railroad Company and its lessee Southern Pacific Company to Pacific Electric Railway Company, recorded, June 6, 1948, in Book 1653, Page 503, Official Records, in the office of the Recorder of Orange County, lying e- qually 20 feet on each side of the center line described as follows: - Beginning at the southeast corner of the west half of said Sectionl 11; thence northerly along the east line of the west half of said Section 11, 1320 feet. There being no protests filed or written for or against the request for special permit of 0. Biller & Sol. 0. Snyder, the Mayor declared the hearing closed.. On motion by Lockett seconded by LeBard the following Beloil cleanup bonds of Centuny Surety and Insurance Corporation covering Corp. - Cleanup the Beloil Corporation, Ltd. wells, and requirements found by the Bonds City Engineer complied with the cleanup ordinace and the bonding company and the operator be notified of the termination, were zra.nted: Bond No. 247304, covering Huntington Beach Community No. 1 4 well located on Lots 24, 26, and 28, Block 205, Huntington Beach Tract. Bond No. 247311, covering the Huntington Beach Community No. 2, located on Lot 26, Block 205, Huntington Beach Tract. Bond No. 247314, covering the Huntington Beach Community No. 3, located on Lot 28, Block 205, Huntington Beach Tract, Bond No. 250157, covering Huntington Beach Community Well No. 5, located on Lots 24, 26 and 28, Block 205, Huntington Beach Tract. On motion by Bartlett seconded by Lockett the request of G & A. Oil the G. and A. Oil Company for Termination of the Glens Falls Insurance Co.- term.clean- Company cleanup bond No. 551890 covering the Hoffman No. 1 well, lo- up bond. Gated on the southeasterly 58.75 feet of Lot:T26 and 28}7eit,Blockt O9, huntFl:ngtontBeacheTtact, and confirmed by the City Engineer as having complied with the requirements of the cleanup ordinance and the bond- ing company and the operator be notified of the termination, was grant- ed. Mayor Seabridge referred the request of Victor Nitzkowski, Victor to add a 12 feet by 20 feet extension to the present beach concession Nitzkowski building, as the space is needed for additional storage of soft drinks. and for the sale of soft drinks and ice cream, and the approximate cost of the building and the remodeling will be $7,500.00, to the Beach and -'Pier Committee for study and report. On motion by LeBard seconded by Bartlett the City Attorney Draw up be instructed to prepare an ordinance in accordance with the request Ordinance re;removal of the Chief of Police to accomplish the removal of abandoned vehicles of abandoned vehicles- that have been parked upon a street or highway for 120 or more con- secutive hours, in accordance with the vehicle code provisions, was approved. On motion by Lockett seconded by Bartlett the request of Off.Archer- the Chief of Police, Ben Dulaney, to reclassify Officer Henry T. reclass. Ident.Tech.- Archer from Police Officer to Identification Technician, in salary Range #28, Bracket C, and said change to be effective September 16, 1955, was approved. On motion by LeBard seconded by Lockett the request of Bette Seltzer the City Clerk to place temporary employee, Bette Seltzer, having Clk. Typist served 6 months probationary period, in classification Typist Clerk, Range 21, Bracket A, effective September 16, 1955, was approved. Councilman Terry arrived at 8:25 o'clock P.M. Fire Chief On motion by ferry seconded by LeBard the -request of D. to attend Fire Chiefs G. Higgins, Fire Chief, for permission to attend a conference of Convention & League of the Pacific Coast and Intermountain Fire Chiefs Convention at Sun Cities Conf. Valley, on September 14 to 17, 1955, and the California League of Cities Conference on September 18 to 20, 1955, and the necessary expenses as budgeted, be allowed, was approved. The Clerk read the report of D. G. Higgins, Fire Chief, Fire Chief's informing the City Council that they will accept delivery of the report re: New Pumper new pumper on the 26th day of September, 1955, to replace the 1.922 Seagrave 750 gallon pumper and requested the City Council to declare the 1922 Seagrave 750 gallon pumper as surplus, and take steps to sell 552 Page #5 Minutes - Tuesday, September 6, 1955 it, and suggested that the terms of sale include no guarantee of the brakes or mechanical condition, and that advertisements be run in the Western City Magazine and the Pacific Coast Fire Journal,' and that the delivery of the new pumper will not require anyfurther use of the State Civil Defense_ pumper, and due to the need of space is asking the State of California to cancel the contract and make other arrangements to quarter their equipment. On motion by LeBard seconded by Bartlett that the 1922 1922 Pumper Seag_rave 750 gallon pumper be declared surplus and the City Clerk declared sur- plus. be instructed to advertise it for sale as outlined by the Fire Chief, was approved. The Clerk reported that the Planning Commission of the Russell B. City of Huntington Beach held a public hearing at 7:30 o'clock P.M. Watkins J petit.cond. on Tuesday the 16th day of August, 1955, for the purpose of consider - exception granted ing a petition for conditional exception to regulations of the Dis- tricting Ordinance to permit the drilling for oil and gas and other hydrocarbons together with uses for commercial purposes as may be in- dicated on the property described as follows: E. ',of SE 4, Section 13, TWP. 6 S, Range 11 W (1695 ft. south and 1870 ft.' east from center of Section 13,) and said area being zoned R-1. There were no verbal or written protests for or against the application of Russell B. Watkins to drill an oil well on the area described in the petition for conditional exception. The Planning Commission after closing the hearing.passed the following- motion: "On motion by Davis seconded by Schryer, the Planning Commission of the City of Huntington Beach recommend to the City Council the granting of the variance requested by Russell B. Watkins, on the property described in the petition as read by the Secretary, sub- ject to the following conditions; 1. Such operations and construction shall be in conformity with the Huntington Beach Ordinance Code provisions. 2. The uses permitted shall not be construed as permitting ro- tary mud dumps, sumps or disposal of petroleum refining or processing or storage of oil, gas in tanks exceeding 1,000 barrel capacity, or storage in any�tank exceeding 16 feet in height from ground of surrounding land. 3. All service equipment such as top of well, pumps, tanks, and, like shall be at least 150 feet from the nearest portion of any public road, street or state highway, and shall also be at least 25 feet from any lot line which is not common with a public road, street or state highway line. 4. Signs shall be limited to two in number and each shall have an area of not over 12 square feet. 5. That the granting of the conditional exception together with the terms and conditions is an offer which is accepted and said terms and conditions agreed to if any of the privileges au- thorized are used." Watkins permission to drill an oil well on the property des- cribed in the petition for conditional exception upon which the Planning Commission held a public hearing on the 16th day of August, 1955, and subject to the conditions imposed by the Commission, was approved. On motion by LeBard seconded by Terry the City Pur- Purchase chasing Agent be authorized to issue a purchase orderto Mandic Plymouth from Mandic Motors, Inc., in accordance with informal estimate of bid sub - Motors mitti�.d for one 1955 Plymouth Model Savoy - 8, 4-Dr., and to in- Demands clude the trade-in value offered for the 1953 Plymouth Cambridge, resulting in a net amount of $1,538.40, was approved. On motion by Bartlett seconded by LeBard the Classi- fication of General Office Assistant be advanced from Salary Range 10-E to 13-E, and said change to become effective Septem- ber 1, 1955, was approved by the following roll call vote: AYES: Councilmen: Terry, Lockett, Bartlett, LeBard, Seabridge -NOES: Councilmen: None ABSENT: Councilmen: None Mayor Seabridge referred to the Beach and. Pier Committee for study and report the possibility of arranging for the installing of metered parking in the area 1st. Street to 8th Street, oceanward of the Pacific Electric Railway Tracks. On motion by LeBard seconded by Lockett the demands as ap- proved by the Finance Committee be ordered paid, was approved. On motion by LeBard seconded by Terry the purchasing agent Re -roof City Hall be authorized to issue a purchase order to the Holmes Roofing Company & repair Memo.Hall for the re -roofing of the City Hall and repairs to the roof of the roof Memorial Hall, in accordance with estimate submitted, was approved. The Clerk reported that on Tuesday, the 30th day of August, 1955, at 7:30 o'clock P.M., the Planning Commission of the City of Huntington Beach held a public hearing on the petition for conditional exception filed by Frank M. Christiansen for permission to drill an Frank M. oil well on Lot 24, Block 102, Hunting�'on Beach Tract, and said pro- Christansen petit.cond. perty zoned C-3. exception denied. Appearing before the Commission, representing Frank M. Christiansen was Loyal Pulley of the legal firm of Hunt, Ball, and Hart of Long Beach, California, and stated that they were not asking for the Commission to recommend the varying of the area, but pointed out that the property of the applicant was only separated by and alley from 14 producing wells, and suggested the applicant's property be re -zoned to permit drilling, 553 Page # 7 Minutes - September 6, 1955 u Jack Pyles, resident of Huntington Beach, appeared before the Commission and stated that as a resident he was op- posed for any varying of the present zoning of the C-3 district as any variance would set a precedent and tend to spread to other restricted areas in the City. After the public hearing upon the application of Frank M. Christiansen by the Planning Commission was closed, the fol- lowing motion was made by the Planning Commission: "On motion by Bazil seconded by Schryer the Planning Commission re- commend to the City Council of the City of Huntington Beach the ap- plication of Frank M. Christiansen for permission to drill an oil well on Lot 24, Block 102, Huntington Beach Tract be denied, was aporoved by the following roll call vote: AYES: Commissioners: Ba.zil, Schryer, Davis, Stang NOES: Commissioners: None ABSENT: Commissioners: Presson, Valentine" On motion by Bartlett seconded by LeBard that the City Council approved the recommendation of the Planning Commission and that the petition for conditional exception of Frank M. Christiansen to permit the drilling for gas, oil and/or other hydrocarbons on the property described as Lot 24, Block 102, Huntington Beach Tract, be denied, Motion carried by the following roll call vote: AYES: Councilmen: Terry, Lockett, Bartlett, LeBard, Seabridge NOES: Councilmen: None ABSENT: Councilmen: None On motion by Lockett seconded by LeBard in accordance with Deposit re: the report of the City Attorney the City Clerk be instructed to draw Condemnation proceedings- up a demand for an additional $1,000.00 made payable to B. J. Smith, Water lines, W.O.Co.Wtr. County Clerk, as a deposit re: - Condemnation proceedings for the right- Bd.. Construc . program. of -way for the City of Huntington Beach owned portion of the Water lines of the West Orange County Water Board construction program, was approved.
