Councilmen present: Bryant, Lockett, Irby, Bartlett, Terry Councilmen absent: None On motion by Lockett seconded by Irby the minutes,of the City Council held on Monday, May 7th, and Monday, May 21st, 1956, as transcribed and mailed by the Clerk, be accepted and ordered filed, was approved. On motion by Lockett seconded by Irby the applications for license to conduct business in the City of Huntington Beach were granted as follows: Roy D. Bryant, dba H.B. Auto Sales, foreign cars agency.at 311 Walnut Avenue. Masaharu Marumoto, Long Beach gardener. Lee Haight, installing heating systems. Jerry J. Worthy, 519 Walnut, radio and TV repair shop. The Clerk read the reports for the month of May, 1956, as filed by the City Treasurer, City Clerk, City Collector, City Engineer, Chief Lifeguard, Fire Chief, Chief of Police, Manager of Municipal Trailer Park, and Superintendent of Recreation. On motion by Bartlett seconded by Irby the reports of the department heads for the month of May, 1956, as read by the City Clerk be accepted and ordered filed, was approved. The Clerk read the amendment to agreement made and entered into as of the lst day of April, 1956, by and between the City of Huntington Beach and Lee S. Chamness. On motion by Lockett seconded by Bartlett the Mayor and the City Clerk be authorized to execute on behalf of the City the amendment to the agreement made and entered into as of the lst day of April, 1956, by and between the City of Huntington Beach and Lee S. Chamness, was approved. On motion by Bartlett seconded by Lockett the request of A. H. and Doris D. Trester for termination of the drilling and clean-up bonds on -the Petco #2 well located on Lots 6, 8, 10 and 12, Block 515, Huntington Beach.Tract, and having com- plied with Sections2427.3 and 2448.1 of the Huntington Beach Ordinance Code, and filing a sub -surface survey of the well and complyng-- with the re-uirements of the clean-up ordinance and the Glens Falls Insurance Company be notified of termination of clean-up bond No. 578541 and drilling bond No. 578542 and the owner also be notified of the termination, was approved. 628 Page #2 Minutes - Monday, June 4, 1956 On motion by Irby seconded by Bartlett the request of the Hedges Oil Company for termination of the Travelers Leone Pearl Indemnity Company clean-up bond No. 523518 for the Leone #3 -'term. clean-up bd. Pearl No. 3 well, located on Lot 7, Block 109, Huntington Beach Tract, and having complied with Section 2448.1 of the Huntington Beach Ordinance Code and the bonding company and the operator be notified of the termination, was approved. On motion by Bartlett seconded by Bryant the request A.H.Trester of A. H. Trester for permission to cut the curb at Lots 10 permto cut curb and 12, Block 515, Huntington Beach•Tract, for an oil well driveway subject to work being done under the supervision of the City Engineer, was approved. On motion by Bartlett seconded by Bryant the reauest Melvin H. of Melvin H. Mann, for permission to'break the curb and install Mann a new approach at 1304 to 1314 Palm Street, Huntington Beach, for the two duplexes now under construction and for the removal of Palm tree in each of. the driveways and said work to be under the supervision of the City Engineer and to his satisfaction, was approved. Mayor Terry referred the request of Eugene Emmert, EuL•ene 1204 Palm Street, and Frances A. Patterson of 707 - 12th Street, Emmert requesting the Eucalyptus trees on 12th Street between Palm and Crest be topped or at least radically trimmed, to the Streets and Parks Committee for study and report. On motion by Lockett seconded by Bartlett the request Native Sons- perm.sell of the Paradise Parlor No. 282, Native Sons of the Golden nest, soft drinks 4th July for permission to sell soft drinks at the parade formation site on Lake Avenue during the morhhg and afternoon of July 4th, 1956, was. granted. Mayor Terry announced that 8:00 o'clock P.M. was the time set for a hearing of petition for special permit and asked the Clerk to read the petition. From this true point of beginning, thence southeasterly along the southerly line of the PE R/W 127.00' to a point; thence southwesterly at right angles 38.00' to a point; thence northwesterly at right angles and parallel to the- south-erly line of said PE R/W, 127.00' to a point; thence northeasterly at right angles 38.00' to the true point of beginning. Said petitioner represents that the center of the hole of the proposed well will comply with the requirements of said Sections 24.23 to 2425.8 inclusive, of Article 24.2 of the Hunt- ington Beach Ordinance Code as amended except as follows: Location of well No. "State" B-3 is: 18' southwesterly, and 60' northwesterly from the northeast corner (mea- sured parallel and perpendicular) of the above described property; or - 128' southwesterly, and 80' southeasterly at right angles, from the intersection of center lines of 12th Street and Ocean Ave. Description more parti- cularly set out in detail upon the map filed with the City Engineer herein. Said petitioner represents that the center of.the hole of the proposed well will be within 51 feet of the nearest rAil of the Pacific Elec- tric Railway, and that only approximately 2 trains pass the location per day. That petitioner desires -to drill said well into the offshore pool, to offset other wells In the vicinity drilled into the same pool, and that this location is :the only - pract ical locat ion' that 'can be secured for the drilling of said well. The Mayor asked if anyone present wished to make any statement for or against the petition for special permit of Hamilton and Sherman, Operators. The Clerk reported no verbal or written statements has been filed for or against the petition. There being no statements forthcoming, verbal or written, the Mayor declared the hearing closed. Fred Ma-uldin appeared before the City Council and Fred Mauldin- asked permission to ask the City Attorney to explain the legal abandonment of llth St. rights of the City in the.11th Street easement for street crossing . purposes, that was recently abandoned by the City. City Attorney Bauer answered the question presented by Fred Mauldin by reviewing the type of easement given to the City by the Huntington Beach Company and the steps taken to abandon the easement in accordance with the California State Code provisions. Mayor Terry referred to the Streets and Parks Com- mittee for study and report the question of the abandonment of the llth Street crossing for report at the regular meeting of the City Council on June 18, 1956. Mayor Terry called a recess for five minutes at 8:45 o'clock P.M. The City Council reconvened at 8:55 o'clock P.M. The Clerk read a communication from the Huntington Mrs. `ones & E. G. Hasson Beach Public Library to inform the City Council that the terms Libr.Bd, Trustees of Mrs. Pearl Jones and Mr. E. G. Hassonwill June 0 expire 3 1956, on the Library Board of Trustee and at the regular li- brary board meeting of May 28th, it was approved to recommend' to the City Council of the City of Huntington Beach the re- appointment of Mrs. Jones and Mr. Hasson for another term end-ing June 30, 1959. 630 Page #6 Minutes - Monday, June 4, 1956 Mayor Terry recommended the appointment of Mrs. Pearl Jones and E. G. Hasson to the Library Board of Trustees for a term ending June 30, 1959. On motion by Bartlett seconded by Lockett the City Council approved the recommendation of the Mayor appointing Mrs. Pearl Jones and E. G. Hasson for another term on the Library Board of Trustees. Motion carried. The Clerk reported that the West Orange County Water Baker-Ander- Board held a meeting at 3:30 o'clock P.M. on June 4, 1956, at son Cor�.- Change rder which meeting Change Order #6 to.Baker-Anderson Corporation #6 contract, constructing the water distribution lines for the West Orange County Water Board, and said Change Order in the amount of $16,095.84, and recommended for approval by the con- sulting engineers, was approved by the Board. On motion by Irby seconded by. Bartlett the City Coun- oil of the City of Huntington Beach confirm and approve the action of the west Orange County.Water Board in approving Change Order #6 to the Baker -Anderson Corporation contract with .the West Orange County Water Board, adding $16,095.84 to the original contract and prior approved change orders. Motion carried. The Clerk gave Ordinance No. 647, an ordinance of Ord. #647 steam elec. the City of Huntington Beach relating to steam electric gen- gen.stn., final read- erating station, amending the Huntington Beach Ordinance Code ing. by adding Section 9443.1, its second and final reading by title. On motion by Bartlett seconded by Bryant Ordinance No. 647 was passed and adopted by the following roll call vote: AYES: Councilmen: Bryant, Lockett, Irby, Bartlett, Terry NOES: Councilmen: None ABSENT: Councilmen: None On motion by Bryant seconded by Irby the request of Leo Farwell Fire Chief D. Page #7 ,x Minutes - Monday, June 4, 1956 631 The Clerk read a communication received from the Signal Oil and Gas Company relative to the Signal Oil and Gas Lease cover- Signal Oil ing the area utilized in the Municipal Trailer Park for drilling & Gas Co. - area for purposes and proposed to restore said area in the Municipal Trailer drlg.pur- poses in Park to the condition that existed before Signal Oil and Gas Com- Mun.Tr.Pk. pany took possession and will temporarily surrender possession to the City on approximately June 1 and the City to retain such pos- session until October 1, 1956, whereupon the subject area shall again be.made available to the Signal Oil and Gas Company under the terms of the lease as amended. ♦ On motion by Irby seconded by Bartlett the offer of the Signal Oil and Gas Company for the City to take possession of the area in the Municipal Trailer Park used during the drilling oper- ations and temporarily surrenders to the City for the period June 1, 1956, to October 1, 1956, be accepted by the City and the City Clerk be instructed to inform the Signal Oil and Gas Company in writing of the acceptance of the proposal. City Attorney Bauer reported in accordancewith the request from the City Council at a prior meeting to contact Atty.Bauer the Southwest Exploration Company and the Signal Oil and Gas Company as to possible compromise on the northwest extension annexation suit and Ad Valorem tax refund suits and referred the City Council to a letter dated May 28, 1956 from the Signal Oil and Gas Company and. Southwest Exploration Company relative to the suits.
