Councilmen Present: Bryant, Lockett, Irby, Bartlett, Terry Councilmen Absent: None The Clerk read a petition filed with the City Clerk and Petition re: signed by 212 residents of the City of Huntington Beach, reading legalized gambling as follows: "We, the undersigned citizens of the City of Huntington Beach, are definitely opposed to legalized gambling in any form. We further want to go on record as opposed any .and all effort to get our City Councilmen, and the Council, to rescind the ordinance now held in the statute laws of our City." On motion by Bartlett seconded by Lockett the petition filed with the City Clerk as read be ordered filed. Motion carried. Minutes On motion by Lockett seconded by Bryant the minutes of the City Council for the meetings of Monday, June 4th, and Monday, June 18th , 1956, as transcribed and mailed by the City Clerk be accepted without changes and ordered filed. Motion carried. Monthly The Clerk read the reports of the department heads filed Reports for the month of June, 1956, of the City Treasurer, City Clerk, City Collector, Fire Chief, City Engineer, Chief Lifeguard, Manager of the Municipal Trailer Park, Chief of Police, and Superintendent of Recreation. On motion by Bartlett seconded by Bryant the reports for the month of June, 1956, as filed by the department heads and read by the City Clerk be accepted and ordered filed. Motion carried. Business On .motion by Irby seconded by Bryant the applications for Licenses license to conduct business in the City of Huntington Beach were granted as follows: James M. Minutes - July 2, 1956 Fidelity and Deposit Company of Maryland drilling bond No. 7177814, having complied with Section 2427.3 of the Huntington Beach Ordi- nance Code, filing a sub -surface survey of the well, and the Fidelity and Deposit Company of Maryland clean-up bond No. 7177815, having complied with Section 2448.1 of the Huntington Beach Ordinance Code, covering well State B-2 located 128, southwesterly and 85' south- easterly at right angles, from intersection of center lines of 12th 'Street and Ocean Avenue, and the bonding company and the operator be notified of the termination. Howe, for termination of the Glens Falls Insurance 'Company drilling bond No. 506833, covering the B.W.F.Oil Company well Hunter #1, located -on Lots 1-3-5-7, Block 517, Huntington Beach Tract, having complied with Section 2427.3 of the- Huntington Beach Ordinance Code, filing a sub -surface survey of the well, and the bonding com- pany and the operator be notified of the termination. Motion carried. Re-classify On motion by Lockett seconded by Bartlett the request of Harry H. L. Robert- son A. Overmyer, City Engineer, to re-classify Homer L. Robertson, Maint- enance Man, to Park Caretaker, Range 25, Bracket "E" of the salary compensation plan, effective July 1, 1956. Motion carried. Reso.#1281, The Clerk read Resolution No. 1281, a resolution of the City deed to • property Council of -the City of Huntington Beach accepting right-of-way deed to certain real property and authorizing the recording of said deed. On motion by Lockett seconded by Bryant the Mayor and the City Clerk be instructed to execute Resolution No. 1281 on behalf of the City of Huntington Beach, and the City Clerk be authorized and directed to cause the deed to be recorded in the office of the County Recorder of Orange County, California. Motion carried. The Clerk read the recommendation to the City Council re - Sully -Miller Contracting ceived from the City Engineer for the acceptance of the work done Co. - notice of by the Sully -Miller Contracting Company for the re -surfacing of •� completion Walnut Avenue from First Street to Fifth Street, Olive Avenue from First Street to Seventeenth Street, Orange Avenue from Lake Avenue to Seventeenth Street, Second Street from Ocean Avenue to Lake Ave- :n;ue., Sixth Street from Walnut .Avenue to Orange Avenue, and Eighth. Street from Walnut Avenue to Orange Avenue, and that all the mate- rial has been furnished and all the work has been completed in ac- cordance with plans and specifications and special provisions. Minutes - July 2, 1956 Contracting Company on the re -surfacing of various streets as contained in the recommendation of the City Engineer be accepted and the Clerk be instructed to file notice of com- pletion with the County Recorder. Motion carried. City Engr, The Clerk read a report from City Engineer Harry reports on areas re: Overmyer, covering the most feasible and economical manner sanitary sewers of -serving certain areas in the northeast portion of the City with sanitary sewers, a study which had been requested by the City Council previously, and reported that several conferences were held with the general manager of the Orange County Sanitation District, together with the ' Engineer of District. No. 3, and was not in a position, at this time, to file a preliminary report on the subje ct , but is sure that he will be able to work out something with the adjoining san- itation.district whereby the City can serve not only that area which lies whithin the northeast area of the City but also that general area which lies to the north and to the east of Clay 'Street and Hampshire Avenue, which program appears now to be the most beneficial and economical approach, and he hopes to have more to report on this subject at the next • regular Council meeting. Public Hrg. The Mayor opened the annual public hearing on the re: Budget 1956-572 City of Huntington Beach budget as advertised in the Hunt - accepted ington Beach News calling for a public hearing at 8:00 o'clock P.M., on Monday, July 2, 1956, and asked if anyone present wished to make any statements regarding the budget. The Clerk passed out copies of the budget to all those present at the meeting. The Mayor asked the Administrative Officer to give a �• review of the budget. The Administrative Officer referred to the letter en- closed .with the copies of the budget and pointed out certain ' financial" procedures that were adopted by the City Council in order to hold the tax rate at last year's rate. Mayor Terry asked if anyone present wished to make any statements for or against the budget presented. There being no statements made verbal or written re- garding the 1956-1957 budget as presented the Mayor declared the hearing closed. 638 Page #5. Minutes - July 2, 1956 On motion by Bartlett seconded by Irby the City of Huntington Beach 1956-1957 budget be accepted as presented with no additions or deletions. Motion carried. Purchase T On motion by Irby seconded by Bryant the City Purchasing pick-up for Oil Field Agent be authorized, in accordance with the regiB st of Harry A. Overmyer, Inspe ctor to purchase one J Ton pick-up to be used by the Oil Field Inspector and to trade in the 195.1 Chevrolet Sedan. Motion carried. Chamber of C . On motion by Bartlett seconded by Lockett the Mayor and the agreement — promotion promotion and. City Clerk be authorized to execute on be of the City the agree - advertising ment between the City of Huntington Beach and the Huntington Beach Chamber of Commerce covering the promotion and advertising work to be done and performed for the City of Huntington Beach during the fiscal year 1956-1957, and the City to pay certain sums for maint- enance of the Chamber of Commerce operations. Motion carried.. Dual Parking On motion by Bryant seconded by Bartlett that in accordance Meters - Ocean Avenue with the request of the Chief of Police Ben Dulaney, the parking meters on the north side of Ocean Avenue between Third and Fifth Street, numbering eighteen in all, be replaced with Dual Parking Meters -and the Mayor and the City Clerk be authorized to execute an agreement on a lease basis from the Dual Parking Meter Company for the replace- ment of the eighteen meters by Dual Parking Meters, on the north side of Ocean Avenue. Motion carried. Grant Deeds- On motion by Bryant seconded by Lockett, the Mayor and City Tax title lots sold at public Clerk be authorized and directed to execute, on behalf of the City, auction described grant deeds conveying the following/property to the purchasers as follows: Lots 29 and 31 in Block 813 of'Wesley Park t6 Earl C. Renfro, real estate broker, as read - Renfro by the City Clerk, offering to the City 231 acres of land located between Garfield and Yorktown Streets and one quarter mile east of Highway #39, and located thereon a subterranean storage tank lined with.concrete and having a capacity of forty-two million gallons, or one million barrels of liquid, and stating that the present owners are offering the property for sale with the ex- • clusion '6f mineral rights and without right of entry, at a price of $150, 000.00 , and that' the City of Huntington Beach might be interested in acquiring the property to use. as a water storage reservoir since the City has recently run the Metropolitan Water distribution lines to the City limits. The communication of John C. Renfro, real estate broker, was ordered filed. Demands On motion by Bartlett seconded by Lockett the demands as approved by the Finance Committee be ordered paid. Motion .carried. Agreement re: Councilman Lockett reported on the arrangements made Golf Course between the Huntington Beach Company and the present operator of the Golf Course, Mr. & Mrs. Robert M. Marshall, to modify and change existing pole lines and power- .limes on the golf course, and that the Huntington Beach.Company had presented the agreement between the Huntington Beach Company, the City of Huntington Beach and Robert M. Marshall and Agnes A. Marshall, that requires the signature on behalf of the City of Huntington Beach. 1• M L Ray H. Overacker re: Client, Mr. Mann Bill Hengoed re-classified Page #7. Minutes - July 2, 1956 On motion by Lockett seconded by Bartlett the Mayor and the City Clerk be authorized to execute on behalf of the City the agreement between the Huntington Beach Company, the City of Huntington Beach, and Robert M. Marshall and Agnes.A. Mar- shall. Motion carried. Councilman Lockett presented a request received from Ray H. Overacker, attorney -at -law, stating a .client, Mr. Melvin H. Mann, has purchased some property from the Dabney Estate in- cluding Lots 21 and 22, Block 518, and in an attempt to clear title to the property finds there has been a previous sale of mineral rights for non-payment of taxes. Since Mr. Mann owns the surface of these , two lots and owns other lots in the vicinity including Lots 24, 25 and 26, in the same block,- and feels he should own the mineral rights under these two lots as well, and is therefore offering the City $150.00 cash for the mineral rights under the two lots. Mayor Terry referred the request of Ray H. Overacker, on behalf of his client Mr. Melvin H. Mann, to the Oil Committee for study and report. On motion by Bryant seconded by Lockett in accordance with Fire Chief Bud Higgins, Wm. Hengoed be re-classified from Engi- neer to Fire Captain in the appropriate range and bracket effective July 1, 1956. Motion carried. Councilman Irby voting "No't. City Engineer Overmyer reported on the congested condition of the sewage flow in the area of Main Street an-d Utica Avenue, and the trouble occasioned by the sewerflow backing up in the homes in that area due to the small diameter flow line installed some - years ago, and happens when the fresh water plunge.at the Huntington Beach Union High School is emptied and the flow cannot be contained, and stated that the Union High School has offered to pay for the construction of a line to meet the ten inch sewer line available in the vicinity. Mayor Terry referred the matter as reported by the City Engineer to the Sanitation Committee for study and report. On motion by Bartlett seconded by Bryant the regular meeting of the City Council of the City of Huntington Beach adjourned.
