Commissioners Present: Stang, Presson, Schryer, Davis, Bazil, Bardwell Commissioners Absent: None Commissioners Vacancy: One Minutes On motion by Schryer seconded by Davis the min- utes for the month of June, 1956, as transcribed and mailed by the Secretary be accepted and approved without change. Motion carried. Thomas Talbert, Sr. and Tim Talbert, Jr. appeared before the Commission and appealed on behalf of their Dave's 'client Dave's Automobile Wrecking and requested the Com- Auto mission to reconsider their recommendations made to the Wrecking Orange County Planning Commission relative to their client's request application to •establish an auto wrecking yard in the R-4 Commission Suburban Residential District to be located on the•west reconsider side of Delaware Avenue approximately 400 feet south of application Garfield Street -and North Huntington Beach area and stated that their client would carry on a•very high class form of automotive and trailer wrecking yard and the location for that purpose would not be detrimental, as it was near the Orange County Dump and between two refineries. Chairman Bardwell announced that a public hearing had been set on the petition for conditional exception at 7:45 o'clock P.M., Tuesday, the 17th day of July, 1956, and requested the Secretary to read the petition for con- ditional exception. The Secretary read the petition for conditional exception filed by the Shell Oil Company of Los Angeles Shell Oil upon which a legal notice of public hearing was published Co. in the Huntington Beach News on July 5, 1956, calling for variance a public hearing at the hour of 7:45 o'clock P.M., on recommended Tuesday, the 17th day of July, 1956, for the purpose of to City _considering a petition for conditional exception to regu- Council lations of the Districting Ordinance to permit the drill- ing for oil, gas and other hydrocarbons, together with uses for commercial purposes as may be indicated on the property described as all that portion of the Northeast quarter of Section 19, Township 6 South, Range 10 West, S.B.B.& M. , lying west of the easterly line of the Rancho Las Bolsas, excepting therefrom that portion thereof con- veyed to the Newport Protection District in the strips of land conveyed to the City of Santa Ana, and that portion lying northeasterly of the following described line: Beginning at a point in the north line of Section 19, Township 6 South Range 10 West, S.B.B.& M., which bears North 89a 36, 15" E. 453.21 feet from the north quarter corner of Section 19, thence S. 490 10' 0$" E. 2002.90 feet more or less to a point in the westerly line of that certain strip described in the deed to the City of Santa Ana, and said mentioned point being the northeast corner of County Sanitation District "Treatment Plant Site" property. he Secretary reported that there had been no verbal or written statements made or received, for or against the Page #2. Chairman Bardwell asked if anyone present wished to make a statement for or against the application for .conditional exception. as read by the Secretary. There being no statements forthcoming the Chairman declared the hearing closed. Following the discussion on the application for conditional exception of the Shell Oil Company, the following motion was made: On motion by Davis seconded by Presson the Planning Commission recommend to the City Council the petition for conditional exception filed by the Shell Oil Company for permission to drill for the produc- tion of oil, gas and other hydrocarbons, in an R-1 zone, on the property described in the legal notice of public hearing as read by the Secretary, be granted subject to the following conditions: 1. Such operations and construction shall be in conformity with the Huntington Beach Ordinance -Code provisions. 2. Uses permitted shall not be construed as per- mitting rotary mud dumps, sumps or disposal of petroleum refining or processing or storage of oil, gas in tanks exceeding a 1000 barrel capac- ity or storage in any tank exceeding 16 feet in height from ground on surrounding land. 3. All service equipment such as top of well, pumps, tanks, and like, shall be at least 100 feet from the nearest portion of any public road, street or State Highway, and shall also be at least 25 feet from any lot line which is not common with a public road, street or State Highway line. 4. Signs shall be limited to two in number and each have an area of not over twelve (12), square feet. 5. That the granting of the conditional exception together with the terms and conditions is an offer which is accepted and said terms and con- ditions ageed to if any of the privileges authorized are used.' Motion carrie d. Chairman Bardwell stated that a public hearing had been set for 8:00 o'clock P.M., on Tuesday the 17th day of July, 1956, and requested the Secretary to Shell Oil read the application. Co. Variance The Secretary read the petition for conditional recommended exception filed by the Shell Oil Company of Los to City Angeles requesting permission to permit drilling for Council oil, gas and other hydrocarbons together with uses for commercial' purposes, as may be indicated on the property described as Parcel #1, a portion of the north one-half of the northwest quarter of Section 19, Town- ship 6 South, Range 10 West, S.B.B.& M., and Parcel #2, that portion of the northeast quarter of the north- east quarter of Section 24, Township 6 South, Range 11 West, S.B.B.& M., present zoning R-1. Said notice was published in the Huntington Beach News, July 5, 1956, The Secretary reported 1 1 Page #3 . - Minutes -July 17, 1956 H.B.Planning Commission that no verbal or written statements had been filed for or against the petition for conditional exception filed by the Shell Oil Company. Chairman Bardwell asked if anyone present wished to make any statement in regards to the application by the Shell Oil Company. There being no statements forthcoming, Chairman Bardwell declared the hearing closed. After discussion by the Commissioners, on the ap- plication of the Shell Oil Company to drill an oil well on the property described in the notice read by the Secre- tary, the following motion was made: On motion !sF by Stang seconded by Davis the Planning Commission recommend to the City Council that the petition for conditional exception filed by the Shell Oil Company for permission to drill for the production of oil, gas and other hydrocarbons in the R-1 zone on the prop- erty described in the legal notice as read by the Secretary, be granted, subject to the following conditions: 1. Such operations and construction shall be in con- formity with the Huntington Beach Ordinance Code provisions. 2. Motion carried. . Earl T.& Chairman Bardwell opened the continued hearing on Mary Irby- the petition for conditional exception filed by Earl T. variance - and Mary Irby for permission to construct two multiple denied dwellings of four units each on Lots 20 and 21, in Block 102, Vista Del Mar Tract, present zoning R-3-0. After the Commissioners discussion on the applica- tion of Earl T. and Mary Irby, on motion by Schryer seconded by Presson the Planning Commission recommend to the City Council that the petition for conditional Page A. Irby and Mary Irby for permission to construct two multiple dwellings of four units each on Lots 20 and 21-, Block 102, Vista Del Mar Tract, in the present R-3-0 zoning, be denied. Motion carried.
