Monday, December 17, 1956
Mayor Terry called the regular meeting of the City
Council to order at 7:30 o'clock P. M.
Councilmen present: Bryant, Lockett, Irby, Bartlett, Terry.
Councilmen absent: None.
Elect. On motion by Bartlett seconded by Bryant the Ohio Casualty
Contr. Bond -
Santa Ana Insurance Company of Hamilton, Ohio, surety bond for Santa Ana
Elect. Const
Co. Inc. Electrical Construction Co., Inc. and as approved for form by the
City Attorney, be accepted and ordered filed. Motion carried.
Petition - The Clerk read a petition signed by $5 residents of the
Re: examine
por. Main St. City of Huntington Beach requesting the City Council to authorize
NE of H.B.U.
H.S. competent Highway Engineers to examine thoroughly the portion of
Main Street northeast of the Huntington Beach Union High School
where many tragic accidents have occured, and negotiate to have
that portion of Main Street corrected as soon as possible if the
survey proves that the area is unsafe or hazardous in any way to
public safety.
The City Council reported to the spokesman
of the
petit-
ioneer's that the particular area mentioned in the petition
has
been projected for improvement and will be commenced
in the
very
near future.

from the

of Police, Ben H. Dulaney, covering the studies made
on the

on Main Street between Mansion and Clay where three
persons
were
killed in recent accidents.
On motion by Irby seconded by Lockett the applications
for license to conduct business in the City of Huntington Beach
as approved by the Health Officer, Building Inspector, Chief of
Police and Fire Chief were granted as follows:
Jack L. Gosney, Cafe at 410 Ocean Avenue, H. B.
Bay & Beach Termite Control Service, business of termite control.
Edward F. Cadieux, business of peddling balloons, Veterans license.
Don B. Fay, business of peddling balloons. Veterans license.
Thomas Shoen and Son, business of General Contractor.

Term.
On motion by Bartlett seconded by Irby, the request of the
Clean-up
bond -
Marsh Oil Company for termination of the Glens Falls Insurance Company
Marsh Oil
Co.
clean-up bond No. 506813, covering the Blue Star No. 1 well, located
on Lots 5-7, Block 415 H. B. Tract, having complied with Section 2448.1
of the Huntington Beach Ordinance Code and the operator and the bonding
company be notified of the termination. Motion carried.
Term.
On motion by Bartlett seconded by Bryant the request of
drilling
bond -
Warren L. Meeker for termination of the Glens Falls Insurance Company

drilling bond No. 551723 covering the "Little Four" #1 well, located
.on Lots 16-18-20-22-24-26-28, Block 306, H. B. Tract, having complied
with Section 2427.1 of the Huntington Beach Ordinance Code by filing
report -of abandonment with the Division of Oil and Gas, State of
California, and the operator and the bonding company be notified of
the termination. Motion carried.

action of approval by the West -Orange County Water Board, Change Order

No,. 24 amending the Miscellaneous Construction Improvements contract
with the Jebco Engineering Contractors increasing the amount of the

contract by $312.60, be confirmed and approved. Motion carried.
Bruce E.
Mayor Terry referred the request of Bruce E. Swartout

relative to construction of lateral sewer line in the alley to serve
the properties in Block 203, Vista Del Mar Tract, to the Streets and
Parks Committee for further consideration and.report.
Agreement-
On motion by Bryant seconded by Lockett the City Council

consent to'the execution by the Recreation Commission of the City of
Pub. Recr.
Com.
Huntington Beach the agreement between the Huntington Beach Elementary
School District and the Public Recreation Commission of the City of
Huntington Beach whereby the school grants to the Commission the right
to use the school gymnasium for the purpose of conducting basketball
and volleyball leagues during a period of'1957. Motion carried.

On motion by Bartlett seconded by Bryant, that the City of

Huntington Beach file a claim with the insurance company to recover

amount of wages paid to Fred DeWitt arising from an accident while
driving a police canon Ocean Avenue and said claim to be re-covered
in accordance with Section 3852 of the Labor Code of the State of
California and the City Attorney be instructed to file the claim with
the Insurance Company. Motion carried.

for Beach Concession purposes be extended for a term of one year
and on the same terms as in accordance with the present lease.
Motion carried.
Mayor Terry announced that a public hearing was set for
8:00 o'clock P. M. this.date and opened the hearing and requested the
City Clerk to read the Notice published in the Huntington Beach News.
The Clerk read the notice of public hearing published in the
Huntington Beach News, December 6, 1956, relative to proposed changes
of Use District Boundary and Classifications as had previously been
requested by the Southern California Edison Company and upon which the
Planning Commission had held a public hearing and made recommendations
to the City Council for its approval, and said proposed change of Use
District Boundary and Classification f rom an R-1 district to an M-2-0
:district for the real property described as follows:
"That portion of the fractional southwest quarter of Section
13, in Township 6 South, Range 11 West, in the Rancho Las Bolsas, as
shown on a map thereof recorded in Book 51, page 7, et seq.,-of
Miscellaneous Maps, in the office of the County Recorder of said county,
described as follows:
Beginning at the intersection of the east line of said fract-
ional southwest quarter of Section 13 with the northeasterly line of
the strip of land, one hundred feet in width,'described and designated
as "Second" in the deed to Pacific Electric Land Company recorded
December 20, 1905, in Book 123, Page 91 of Deeds, in the office of
said County Recorder; thence northwesterly along.said north-easterly
line a distance of 665.00 feet; thence northeasterly, at right angles
to said northeasterly line, a distance of'940.18 feet to said east line
of the fractional southwest quarter of Section 13; thence southerly,
along said east line, 1151.59 feet to the point of beginning. Excepting
therefrom that portion thereof included within the boundary lines of
Pacific Coast Highway, 90 feet wide."
The Clerk reported that a placard in accordance with size
required by the City of Huntington Beach and the Planning Act of
California was posted by the Street Superintendent and,said Street
Superintendent filed an affidavit of Posting Notices of Use District
Hearings with the City Clerk on the 12th day of December, 1956.
The Clerk reported no verbal or written protests had been
filed with the'City relative to the proposed changes of Use District
Boundary and Classification, in accordance with the publication'in

The Mayor asked if any one present wished to make any state-
ments in regards to the proposed changes in Use District Boundary and
Classification. There being no statements forthcoming written or
verbal Mayor Terry declared the hearing closed.
City Att. On motion by Lockett seconded by Bartlett the City Attorney
draw up Ord.
Use Dist. & be instructed to draw up -the required Ordinance covering the proposed

On motion by Bryant seconded by Lockett the "Municipal
Services" report prepared by the City Engineer be filed and the City
Engineer be instructed to continue the study of Municipal Services.

for study
& report descriptions presented to the City Council for study and report cover-
ing classification of City Engineer, Assistant City Engineer, Street

Superintendent and Building Inspector be accepted and approved.
Motion carried..
Demands On motion by Bartlett seconded by Irby the Demands as approved
by the Finance Committee be approved and ordered paid. Motion carried.
General On motion by Lockett seconded by Bartlett in accordance with

reimbursed request of the City Clerk there be placed in the Minutes the motion
that was left out of the 1st regular meeting of the City Council in
July, 1956, the General Fund be re-imbursed for expenditures made for
the following Funds and in the amounts as follows:

City Clerk On motion by Bartlett seconded by Irby the. City Clerk and

City Mgr's. Administrative Officer be authorized to attend the Spring meeting of

Recommend Councilmen Bartlett, Chairman of the Streets and Parks
Action be

for study and report the proposal that a new model load packer be
purchased for the Street Department.
Procure William Lewis, Street Superintendent informed the City

On motion by Lockett seconded by Bryant the City Attorney be
instructed to draw up the necessary easements to provide for sewer
line as requested by the Street Superintendent and said descriptions
to be furnished to the City, Attorney by the Engineer's office for
easement purposes. Motion carried. '
Remove tree- On motion by Bartlett seconded by Irby in accordance with

under the supervision of the City Engineer. Motion carried.
On motion by Lockett seconded by Bryant the City Council of
the City of Huntington Beach adjourn to.5:00-o'clock P. M., Friday,
