M. Councilmen present: Bryant, Lockett, Irby, Bartlett, Terry. Councilmen absent: Nc-ne. Term. cleanup On motion by Bartlett seconded by bond - Douglas Oil Co. Irby the request of Douglas Oil Company Well #2 of California for termination of the Aetna Casualty and Surety Company cleanup bond No. 33S36173, covering well No. 2, located on State Tidelands Lease #PRC1524.1 (P. E. VW near 8th Street), having complied with requirements of cleanup ordinance Code Section 2448.1 and the operator and the bonding company be notified of the termination be granted. Co. - Bryant the request of the Viking "Vogel" #1 Petroleum Company for termination of the Hartford Accident and Indemnity Company cleanup bond No. 2920641, covering the Vogel No. 1 well, located in Block C, Tract 837, having complied with Huntington Beach Ordinance Code Section 2448.1. and the operator and the bonding company be notified of the termination be granted. Motion carried. Cut curb- On motion by Irby seconded by Lockett Tri Crown Const. Co. the request of the Tri Crown Construction Company for permission to cut the curb for driveway purposes for residence at 720 Huntington Avenue, entrance to be on Hartford Street, and said work to be done under the supervision and to the satisfaction of the City Engineer, be granted. Megle - const. drive- the request of Mrs. Frances R. Megle, ,,vay at 1520 Magnolia for permission to construct a drive -- way at Magnolia Avenue for garage purposes, said location being at 1520 Magnolia Avenue, and said work to be done under the supervision and to the satisfaction of the City Engineer, be granted. Motion carried. H. B. GARDEN 0n motion by Bartlett seconded by Irby Club Mem. Cerebral On motion by Bryant seconded by Irby Palsy to convict fund the request of the United Cerebral drive - month of May Palsy Association of Orange County, Inc. to conduct their non-profit drive for funds in the City of Huntington Beach during the month of May, 1957, be granted. Motion carried. VfW invitation. The Clerk read an invitation received to City Council re: installation from. Huntington BeachPost No. 7368, of Officers Veterans of Foreign Wars of the United States, extending an invitation to the City Council and all department heads to the installation for the newly elected Poet Officers, to be held Wednesday night April 17th, 1957, at 8:00 P. M. at Memorial Hall, Civic Center. Mrs. E.W. Mayor Terry referred to the Streets Coxwell re- qu>st to re- and Parks Committee for study and report move trees referees to the request of Mrs. E. W. Coxwell, of C omm . 215 Crest Avenue, for inspection of three trees, two pines and one Eucalyptus, claiming they have broken the sidewalk in front of their home and the dropping of leaves and needles etc., are a constant damage to the roof of the house and tidiness of the yard, and also certain chemicals these trees deposit in the ground make raiaing flowers and lawns an impossibility. City purchase On motion by Bartlett seconded by tax title lots - Bryant the City of Huntington Beach Lots 26 & 28 Blk. 419, HB purchase tax title lots re- T.C. #827, from the State, Lots 26 and 28, Block 419, Huntington Beach, for the amount of the tax de- linquency of $100.00 plus $20.00 for cost of ad- vertising, etc., and the Treasurer be authorized to draw a warrant payable to Don S. Mozley, County Tax Collector. Motion carried. 44 PaEe #4 Minutes - Monday, April 15, 1957 On motion by Lockett seconded by Bryant the City of Huntington Beach, in aceordande with the request of Don S. Mozley, County Tax Collector, consent to the sale of tax sale T. C. Sale #830, by the County of Orange. Motion carried. East The Clerk informed the City Council Annexation that the proponents of the East Ann- exation had filed Notice of Intention to circulate petition relating to annexation of certain terr- itory to the City of Huntington Beach under the annexation act of 1913, and filed a copy of the legal notice published in the Huntington Beach News dated April 11, 1957, which notice reads: "Notice of Intention to Circulate Petition Re- lating to Annexation of certain territory to the City of Huntington Beach under the Annexation Act of 1913". Reso. #1306 The Clerk read Resolution No. 1306, a resolution of the City Council of the City of Huntington Beach acknowledging the receipt of a copy of notice of intention to circulate petition for the annexation of territory designated as "East Annexation" and an affidavit of publication thereof and approving the circulation of the petition. On motion by Bartlett seconded by Bryant Resolution No. 1306 was passed and adopted by the following roll call vote: AYES: Councilmen: Bryant, Lockett, Irby, Bartlett, Terry. NOES: Councilmen: None. ABSENT:Councilmen: None. Reso. #1307 The Clerk read Resolution No. 1307, a resolution of the City of Huntington Beach calling a special election to be held on the 4th day of June, 1957, pertaining to the North Annexation to the City of Huntington Bead. 45 Page #5 Minutes - Monday, April 15, 1957 On motion by Bartlett seconded by Irby Resolution No. 1307 was passed and adopted by the following roll call vote: AYES: Councilmen: Bryant, Lockett, Irby, Bartlett, Terry. NOES: Councilmen: None. ABSENT:Councilmen: None. Final reading The Clerk gave the second and final reading Ord. #660 to Ordinance No. 660, by title. An Ordinance of the City of Huntington Beach relating to the removal of refuse and amending Section 3234 of the Huntington Beach Ordinance Code. On motion by Lockett seconded by Bryant Or- dinance No. 660 was passed and adopted by the following roll call vote: AYES: Councilmen: Bryant, Lockett, Irby, Bartlett, Terry. NOES: Councilmen: None. ABSENT -.Councilmen: None. Cadillac Oil The Clerk presented as assignment, Co. - Assigns cer- assumption, and consent form received tain interests to Utex Oil from the Huntington Beach Company giving consent to the Cadillac Oil Company assigning certain interests in the lease to the Utex Oil Co. On motion by Bartlett seconded by Irby the Mayor and the City Clerk be authorized to execute the assignment, assumption, and consent for the Cadillac Oil Company to assign certain interests in a lease dated July 20, 1956, to the Utex Oil Company, as presented by the Huntington Beach Company. Motion carried. Employee - On motion by Bryant seconded by Bart - Richard M. Magolli, lett the request of Sidney L. Lowry, Enge. Aid. City Engineer, for permission to employ Richard M. File notice On motion by Bartlett seconded by Irby of completion San. sewers, that in accordance with the recommendations Blk. 1704, Tr. #51 of the City Engineer the construction done by A. H. Famularo for the construction and install- ation of sanitary sewers in Block 1704, Tract No. 51 be accepted and approved, and the Clerk be instructed to file with the County Recorder a notice of completion. Motion carried. Request of Mayor Terry referred to the Beach and Parks Lifeguard Chief re- Committee for study and report the request ferred tc Comm of Chief Lifeguard D. G. Higgins, to acquire permission to place lifeguard stations on the bluff to Standary Oil Company property and about 1500 feet north- west of 23rd Street. Civil from the County of Orange Civil Defense Defense - re: trans and Disaster Relief Council, requesting. mittcr-re- ceiver the City to provide in their fiscal budget of 1957-1958 the cost of a transmitter -receiver on 37.42 MC's to be installed in the Control Center, Police Department or Fire Department headquarters as the City so desired. Corm-unication The Clerk read a communication received C. of C. re: kiddy rides from the Huntington Beach Chamber of Commerce whereby the Board of Directors of the Huntington Beach Chamber of Commerce voting unanimously to oppose the requestof Charles A. Derigo to place kiddy rides in the area of the Open Air Beach Amphitheatre. No action take by the City Council. 471 Par, e #7 Minutes - IAonday, April 15, 1957 Report by The Clerk read a report made by the City City Engr. re: Gas Engineers at the request of the Committee Tax funds on Gas Tax Funds of the Orange County League of Cities covering the equitable distrubition of Gas Tax Funds from the Mate level to the County level and a pro- posed method of financing an arterial highway program, and that a more equitable distribution of Gas Tax funds should be made at the State level and recommending a five point plan which they believe will adjust many of the inequities now existing. On motion by Bryant seconded by Lockett the City Council of the City of Huntington Beach approve in principal the report of the City Engineers made to the Committee on Gas Tax Funds with the Orange County League of Cities division, and said action be trans- mitted to the Orange County League of Cities Division. Motion carried. Regaest of Mayor Terry referred the request of Virgil Virgil L. Vines - L. Vines to the Streets and Parks Committee referred to Corm. for study and report on the request for the removal of four big palm trees directly in front of his property located at 912 - 10th Street. Councilman Councilman Irby brought up the subject of Irby re: trellis providing a windbreak or an overhead or tre- Lake Park llis at the Lake Park picnic table locations. Mayor Terry referred the request of Councilman Irby to the Streets and Parks Committee for further study and report. Procure bids- On motion by Lockett seconded by Bryant re: heating system, City the City Engineer be authorized to pro - Hall cure informal bids on the required charges in heating system in the City Hall. Motion carried. Mayor Terry informed Chief Lifeguard Higgins and the press that the Council will meet with him at the Council Chamber, at 6:30 P. M. on Friday, April 19th, 1957. Demands On motion by Lockett seconded by Irby the demands as approved by the Finance Committee be ordered paid. Motion carried. On motion by Bryant seconded by Bartlett the reg- ular meeting of the City Council of the City of Huntington Beach adjourned.
