Mayor Terry called the regular meeting of the
City Council of the City of Huntington Beach to
order at 7:30 o'clock P.M.
Councilmen present: Bryant, Lockett, Irby, Bartlett,
Terry.
Councilmen absent: None.
Business On motion by Bartlett seconded by Bryant
Licenses the applications for license to conduct
business in the amity of Huntington Beach were
granted as follows:
H. C. Davis, Laguna Beach, the contractor.
Western States Home Improvement Company, Los Angeles,
asbestos siding and rodfing.
J. Raymond Dunham, Westminster, sewage disposal
contractor.
Donald E. Treece, Huntington Beach, art and Mign

Clerk be instructed to make the first reading of Ordinance

The Mayor asked if anyone present wished to
bring any business before the City Council now is the
time to be`_heard.
Albert Albert Thompson residing at 714 Park
Thompson re:

iterated their previous complaint on the condition
of the small cottage situated at 322 - 9th Street,
and stated that he had 4iscussed the matter with
the City Attorney, Fire Chief, and the County Coroner
tofind out if something legally could be done to re-
move the nuisance which at this tij2.e was making it
impossible to rent an adjacent house from the odors
emanating, etc.
Grace McKinnon appeared before the City Council
and stated that she lives cross the street from this
particular cottage that Mr. Albert Thompson referred
to and that on certain days the odors are simply
obn6xious.
City Attorney Bauer related to the City Council
and tLose present the processes of law relative to
constitutional rights of property owners and atated
that his office had checked into all angles of the
City Ordinances and state codes and had been unable
at this time to find any solution for anyone other
than proper legally interested people to enter the
premises for any removal of dirt or property.

Open sealed Mayor Terry announced that 8:00 o'clock,

of concrete lighting standards on Crest Avenue betw.en
Lake Avenue and 14th Street in the Cityof Huntington
Beach and requested the City Clerk to open bids received.
l bid reb-ived The Clerk announced that only one bid was
from Pec. Union
Metal Co. received, that of Pacific Union Metal
Company, and proceeded to open same.
The Clerk read the bid of Pacific Union Metal Company
for the furnishing of all labor, materials, and equipment
and to do all incidental 'work necessary to furnish
and erect thirty one centrifugally spun reinforced con-
crete street lighting standards complete in place in
strict conformity with the plans and specifications on
file in the office of the City Engineer, City of Huntington
Beach, California, for the sum of $6,756.48.
Councilman Bryant stated that he was not in accord
with the policy of the City in purchasing a standard that
could only be furnished by one manufacturer and recommended
that his bid be rejected and the bond be returned to the
bidder, and stated that the City should investigate other
types of standards manufactured by competent and qualified
manufacturers.

ed two new sections to the State Employee's
Retirement System, Section 20024.01 providing that in cal-

culation of allowances, the average of the highest
three consecutive years shall be used instead of the
average of five years as formerly, and Section
21367.51, providing an increase in the death bene-
fit payable to the beneficiary or beneficiaries of
members who die after retirement, the former. amount
was $300.00 and increased to $400.00, and that it is
necessary for the City of Huntington Beach tomake
application for amending the City's contract to in-
clude these two new sections.

Huntington Beach gives lifeguard services in unincorporated

Mutual Fire On motion by Bryant seconded by
Aid Agreement
Irby, in accordance with recommendation of the
Fire Chief the City of Huntington Beach enter
into a Mutual Aid Fire Agreement with the City of
Newport Beach, Costa Mesa, Santa Ana, Garden Grove
Seal Beach, and later with Tri-City when they take
over fire service from the County fire district,
and said agreement be in the form as approved by
the Orange County League of Cities, be approved.
Motion carried.
Demands On motion by Bryant seconded by Lockett
the demands as approved by the Finance Committee
be ordered paid. Motion carried.
Fred Hermann The Clerk read a request received

move Bldgs. from Fred C. Hermann for permission
to move two buildings from the Standard Oil
lease to the southeast corner of Nashville and
Huntington Avenue on a lot to the southeast corner
of Nashville and Huntington Avenue on lot size
100' x 110' and stated the buildings when moved
will comply rith City Building Code as to wiring,
plumbing, roof and foundation, and stated that he
has only seven days to proceed and will appreciate
immediate action on this matter.
Norman Wells, Building Inspector, reported
to the City Council that the buildings that Mr.
Fred Hermann had requested to move into the City
does not fully comply with the.City Building Code
and even though much of the construction would have
to be done on the building he does not recommend
acceptance of the buildings.
Fred Hermann appeared before the City Council
and stated that he knows that parts of the building
do not comply with the Code and pointed out that
many other buildings in the past have been moved

into the City that did not totally comply with all
provisions of the City Building Code.

of Huntington Beach, and the Clerk reported that the
Wager and Walker Motorcycle Company, Santa Ana,
entered a quotation in the amount of $1658.25, plus
California and City Sales Tax, and that J. F. Karns,
filed a quotation of $1668.25, pl'zs California
and City Sales Tax.
On motion by Bryant seconded by Bartlett the
City Purchasing Agent, in accordance with request
of Chief of Police, issue a purchase order to ',lager
and Walker Motorcycle Company, for the purchase of
one 1957 three wheel motorcycle equipped in accordance
with quotation received in the amount of $1658.25,
plus California and City Sales Taxes, and said ex-

the end of the Municipal Pier is approximately one half
of the original estimate received from the Macco
Corporation. The estimate as reported by Wm. Lewis
was referred by the City Council for further study.

Street, from Joliet to Knoxville Street, the City
Engineer be instructed to proceed with the work,
be approved. Motion carried.
Trees at Chairman Bartlett reported on the request

to remain for removal of certain trees at the Colo-
nial Inn and stated his committee had examined the
condition of the trees and find that they are doing
no particular damage and the recommendation of the
Streets and Parks Committee are that they remain.
