Councilmen present: Bryant, Lockett, Irby, Bartlett, Terry. Councilmen absent : None. Minutes On motion by Bartlett seconded by Lockett the minutes of the City Council of the meetings of February 3rd and February 17, 1958 as transcribed and mailed by the City Clerk be accepted and approved without correction. Motion carried. Monthly The Clerk read the reports of the Department Heads Reports for the month of February, 1958 filed by the City Treasurer, City Collector, City Engineer, Fire Chief, Building Inspector, Manager of the Municipal Trailer Park, Chief of Police, Chief Lifeguard and the Superintendent of Reoreation. On motion by Bartlett seconded by Bryant the reports of the Department Heads for the month of February, 1958 as read by the City Clerk be accepted and ordered filed. Motion carried. Business On motion by Irby seconded by Lockett the applications Licenses for license to conduct business in the City of Hunt- ington Beach as approved by the Health Officer, Building In- spector, Chief of Police, Fire Chief, and Planning Technician for zoning, were granted with the exception of the Lyon's Wrecking and Salvage application to conduct the business of salvage with office only located at 223-2nd Street and said application to be deferred for further study. Corporation for term- ination of the Central Surety and Insurance Corporation drilling bond No. 30--59--78 for Davenport #5 well, located on Lot 10, Block 2201, Vista Del Mar Tract, having complied with Section 2427.3 of the Huntington Beach Ordinance Code and the operator and the bonding company be notified of the bond termination, be approved. The Clerk gave Ordinance No. 683 its second and final read- ing by title, an Ordinance of the City of Huntington Beach approving the Annexation of certain uninhabited territory de- signated as "Harper Annexation" to the City of Huntington Beach. 2. 294. Hickory Homes On motion by Bartlett seconded by Lockett the to break curb at 202 Joliet St. request of Hickory Homes for permission to break the curb at 202 Joliet St. for driveway pur- poses and said work to be done under the supervision of the City Engineer, be approved. Motion carried. Variance -- The Clerk reported that the Planning Commission of Arthur Webb the City of Huntington Beach held a public hearing on February 18, 1958, on Use Variance #105, filed by Arthur Webb of 990 Linden Place, Costa Mesa, California, to allow small out- board boat sales and storage yard, on Lot 4, Block H, Tract No. 7, and said location approximately 300 feet south of Ellis Avenue on the West side of Highway #39, for a C-2 use in an R-4 district and the Planning Commission made a motion duly carried, recommending the approval of Use Variance #105 subject to the following con- ditions-: AMPLE PARKING SPACE 1. That there be a graded and paved surface along the north 75 feet frontage of Lot 4, and that the paving extend to a depth of 60 feet or more from the_ front property line. CURBS AND GUTTERS 2. That curbs and gutters be installed in accordance to City and State standards. And that curb lines shall be established in location required by State. There shall be curb breaks to pro -- vide for only one location of ingress and egress, it having a maximum of 68 feet in length. ROADWAY PARKING r 3. That the area between the paved highway fronting the premises and the described curbs shall be improved to state specifications. 3• 295 Page #4 Minutes - Monday, March 3, 1958 PROVISIONS FOR A SIGN 4. That only two signs shall be permitted: A. One may be a double faced lighted sign of 40 square feet located no closer than 26.4 feet from the State Highway #39. B. The second sign shall be an unlighted sign of 50 square feet which shall be attached to the structure. SUBMITTED PLANS 5. That the structure shall be built according to the submitted plans. MINOR CHANGES 6. That the Building Inspector shall have authority to grant approval of any minor change which he believes not contrary to the original intent of the variance. PINAL APPROVAL BY BUILDING DEPARTMENT 7. That the Building Inspector shall not be authorized to place final approval upon the construction and that he recommend denial of a business license until all the previously stated conditions are satisfactorily complied with. Variance granted On motion by Bryant seconded by Lockett Arthur Webb the City Council apprmve Use Variance #105 as recommended for approval by the Planning Commission subject to the conditions recommended to be imposed was approved by the following roll call vote: AYES: Councilmen: Bryant, Lockett, Irby, Bartlett, Terry. NOES: Councilmen: None. ABSENT: Councilmen: None. Variance- The Clerk reported the Planning Commission J.P.Terry. held a public hearing on February 18th, 1958 on Use Variance #104 filed by J. P. Terry, 603 Main Street Huntington Beach, to allow the repair, maintenance, and storage of engines, electric motors, and oil tool equipment of Lots 9 and 11, Block 415, Huntington Beach Tract, address location 411-15th Street, and the Planning Commission on a motion duly made and carried recommended approval of Use Variance #104. 4. Page #5 Min tes - Monday, March ', 1958 Mayor Terry asked to -be excused from the chair in the dis- cussion of Use Variance #104 as the applicant was related to him. On motion by Bryant seconded by Bartlett, Councilman Earl Irby be appointed Chairman pro-tem during the discussion on Use Variance #104. Motion carried. Chairman pro-tem Irby asked if anyone present wished to make any statements for or against Use Variance #104 filed by J. P. Terry. Fred Hermann, local resident appeared before the City.Council and stated that he had appeared before the Planning Commission on the hearings conducted on the Variance for J. P. Terry and stated the legal requirements of Notice, etc. required to notify property owners within 300 foot radius of the property upon which a variance has been requested had not been complied with and further- more speaking for residents in the area that the M-1 proposed zone for that particular area will be opposed and stated that he had filed a petition with 90 percent of the residents within the 300 foot area of the property proposed for variance with the Planning Commission, in which they protested the issuance of this variance. Clifford Tripp, Secretary Technician of the Planning Com- mission reported to the City Council that the petition Fred Her- mann reported on had only been signed by 11 property owners. Charles A. Bauer, City Attorney, informed the City Council the Planning Commission in his interpretation of the notice re- quirements had complied with all the necessary codes in giving notice to property owners. Robert Bazil, Chairman of the Planning Commission appeared before the City Council and reported that the members of the Plann- ing Commission made several field surveys of the area covered by Block 415 and the surrounding area and stated that in their opinion due to the oil industry operation in that area and general area showed the area which is proposed for re -zoning in the Master Plan is compatible with the M-1 use. 5. 29 Page #5 Minutes - Monday, March 3, 1958 Variance On motion by Bryant seconded by Bartlett the City Gran t e d- J.P.Terry. Sewers Clerk to read the Notice inviting sealed bids for the construction and installation of Sanitary Sewers on Quincy Street between Lake Avenue and Ala- bama Avenue, on Alabama Avenue between Quincy Street and Utica Street, and on Springfield Street between Alabama Avenue and Delaware Avenue, City of Huntington Beach. The Clerk read the notice inviting sealed bids as published in the Huntington Beach News, February 6, 1958 for the construction and installation of sanitary sewers on Quincy Street between Lake Avenue and Alabama Avenue, on Alabama Avenue between Quincy Street and Utica Street, and on Spring- field Street between Alabama Avenue and Delaware Avenue in Accordance with plans special provisions and specifications and contract documents now on file in the office of the City Clerk and City Engineer of said City. Each bid to be sub- mitted in strict accordance with the specifications therefor. Mayor Terry requested the Clerk to open the bids re- .ceived. VFW presents Rex Neeld representing the Veterans of Foreign plaque Wars Post appeared before the City Council and presented a plaque to the City covering a citation for the fine cooperation and support given the Veterans programs in this community. Tim Masher & Tim dasher and Roger Bushe, residents of Sun - Roger Bushe re: Annexation set Heights area appeared before the City Council and reported the residents of that area desired consideration to be annexed to the City of Huntington Beach and asked many questions about the services the City would give and who would pay for those services, and invited members of the City Council to attend a meeting to discuss annexation with the residents of that area. E.E.Fairbanks re: letter on Oil conditions E. E. Fairbanks of the Socal Refining Company appeared before the City Council and reported on the distressed condition of oil operations of the local independent oil operators that cannot sell crude oil because oil contracts have been cancelled which in fact is de- trimental to good business conditions and will if allowed to con- tinue damage the entire economy of this area and is due to ex- cessive oil imports from foreign lands into California, and asked that the City Council cooperate by mailing the letter Mr. Fairbanks presented and read by the City Clerk to be addressed to Captain M. B. Carson, Jr., Adminstrator of Voluntary Oil Imports Program, Department of,Interior, Washington, D. C. On motion by Bartlett seconded by Lockett the letter pre- sented by E. E. Fairbanks be approved for transmittal with certain changes and additions in context of the letter dis- cussed, be approved. Lotion carried. The Clerk read the petition for Special Permit filed by the Standard Oil Company of California, requesting a permit to drill an oil well to be known as the Pacific Electric Well No. 459 to be located at the intersecting center lines of Ocean Avenue and 23rd Street, 1923 feet easterly along Ocean Avenue; thence 127 feet southerly at right angles and said petitioner represents that the center of the hole of the proposed well will comply with the requirements of said Sections 2423 to 2425.8, inclusive, of Article 242 of the Huntington Beach Ordinance Code as amended except as follows: 65 feet from nearest railroad. The Clerk read the Notice of Hearing, of Petition for Special Permit filed by Standard Oil Company of California, published in the Huntington Beach News, February 20th, 19589 and reported that there had been no verbal or written protests filed with the City and that the applicant had complied with all the requirement procedures outlined in the Huntington Beach Ordinance Code, under Article 242. Mitchell The Clerk reported that at 4:15 P.M., on February 27, 1958, a summons was served on the City Clerk for an action brought in the Superior Court of the County of Orange by Plaintiff, Verba H. Mitchell vs the City of Huntington Beach, Ernest A. Ingersoll also known as E.A. Ingersoll; and Doe 1 through 1V, both inclusive, and said action as the result of injuries sustained by Plaintiff, while debarking from the boat operated by Ernest A. Ingersoll causing Plaintiff to be injured while landing from said water taxi to boat landing at the end of the Municipal Pier. Motion carried. Hourly wages re: Assistant Engineer Lewis reported to the St.lht stds. City Council that the general prevailing rate of hourly wages in this locality needed for the furnish- ing and erection of concrete street lighting standards are in his findings the same as incorporated in the Resolution establishing the prevailing hourly wages for the work. 10. 303 Page #11 Minutes -- Monday, March 3, 1958 Reso.#1340 The Clerk read Resolution #1340, a Resolution of the City of Huntington Beach establishing the general prevailing hourly wages for each craft or type of workman or mechanic needed for the furnishing and erection of concrete street lighting standards on Eleventh Street between Ocean Avenue and Main Street and on Walnut, Olive, and Orange Avenues between Ninth and Eleventh Streets, in the City of Huntington Beach, California. NOES: Councilmen: None. ABSENT: Councilmen: None. City Engr. The Assistant City Engineer presented to the presents plans & Spec. re: City Council plans and specifications and an Toilet B1d.g. Main entrance estimate of cost for the construction of a Mun.Tr.Pk.on beach toilet building which is proposed to be constructed on the Beach adjacent to the main entrance to the Municipal Trailer Park, and that the building is similar in design to the toilet buildings which -were recently constructed at other locations on the beach and said proposed construction to cost $9,000.00 if it is to be done by force account, and reported that if it were to be done by contract it would cost approximately 20% more that the estimate, and that it is.a budgeted item in this fiscal year. Hourly wage The Assistant Engineer reported that the general rate re: resurfacing prevailing rate of hourly wages in this locality for workmen needed in the resurfacing and improvement of Fifth Street from Ocean Avenue to Main Street for the resurfacing of the Ocean Front Parking area from Ninth Street to "At' Street, are those wages now being paid in this general area and as included in the Resolution to establish the general pre -- nailing rate of hourly wages for each craft or type of workman or mechanic needed. The Clerk read Resolution No. 1341, a Resolution of the City of Huntington Beach establishing the general prevailing rate of hourly wages for each craft or type of workman or mechanic needed in the resurfacing and improvement of Fifth Street from Ocean Avenue to Main Street, and for the resurfacing of the Ocean Front Parking area from Ninth Street to "A" Street, in the City of Huntington Beach, California. Shirley Capps On motion by Bartlett seconded by Irby in accordance with the recommendation of the City Clerk that Shirley Capps classified as Typist Clerk having served the probationary period of six months be placed on the permanent roll in same classification, be approved. Communication The Clerk read a communication received from received from Pub.Utilities the Public Utilities Commission and said commission _ communication notifying the City that the Comm- issioner's Engineering Section for investigation is investi- gating the railway crossing at Wintersburg Avenue in Accordance with the previous request from petitioners and the City Council, and that the City will be informed about any action after the investigator has arrived at a conclusion. Chief Lifeguard On motion by Irby seconded by Lockett that to construct 4 portable stations the Chief Lifeguard be given permission to start construction of four portable type lifeguard stations to be used for the 1958 season at an estimated cost of $450.00 and said cost to be charged to the Specidl Fund for Capital Outlay Reserve and be permitted to purchase one air operated jack at an approximate cost of $179.50, was approved by the following roll call vote: AYES: Councilmen: Bryant, Lockett, Irby, Bartlett, Terry. Page #15 307 Minutes - Monday, March 3, 1958 Minutes from The Clerk reported that a copy of the minutes boundary comm. re:Reso.-#1335 of the Boundary Commission of Orange County, California, of a meeting held on February 24th, 1958, had been received and the excerpt of minutes referred to the proposed annexation of territory to the Orange County Sanitation District No. 11 (Huntington Beach Resolution No. 1335 Y and that a motion was made and duly carried that the petition for the proposed annexation of territory to the Orange County Sanitation District No. 11 (Huntington Beach Resolution No'. 1335) was received and ordered referred to the County Assessor and County Surveyor for checking and based upon their reports, the Boundary Commission finds that the boundaries of the proposed annexation are reasonably definite and certain. City Attorney The City Attorney informed the City Council re: Lots 2 & 4 B1k.414 HB Tr. relative to the title report covering Lots lots clear except for 2 & 4, Block 414 Huntington Beach Tract, homestead filed by Fred C. & shows Lots clear with the exception of a Myrtle Hermann homestead filed against it by Fred C. Hermann and Myrtle Hermann and that there is no evidence that they had title to the lots. The Clerk reported that the records of the City such as Treasurer's Receipts, filing of offers, the purchase of Tax Title Lots, and copies of escrows and recordings of Council meetings do not indicate in the year 1944, Lots 2 and 4 were ever placed for Public Auction or that the City had ever accepted a deposit for the sale of the particular lots. Letter - On motion by Irby seconded by Bryant the City Fred C. & Myrtle Hermann Clerk be instructed to write a letter to Fred C. Hermann and Myrtle Hermann, informing them that there is no evidence that the City had ever accepted a deposit for the sale of the Lots, or that they had been offered for Public Auction, be approved. City Council On motion by Lockett seconded by Bartlett to attend National that all members of the City Council be Safety Council award dinner authorized to attend the National Safety 3 9/58 , _. Council award dinner to be held at the Ambassador Hotel, Los Angeles, on the evening of March 19, 1958, for the purpose of accepting the placque honoring the City as a 1st place winner in group "B" class for the year ending December 31st, 1957, be approved.
