Councilmen present: Bryant, Lockett, Irby, Bartlett, Terry. Councilmen absent: None. Ord.#684 The Clerk gave Ordinance No. 684 its second and adopted final reading by title, an Ordinance of the City of Huntington Beach relating to Inspection Fees for moving of buildings, amending Section 8132 of the Huntington Beach Ordinance Code. The Clerk reported to the City Council Wtr.Bd. re: Plans & Spec's that the West Orange County Water meter install Board at a meeting held on Wednesday, March 12, 1958, approved plans and specifications pre- sented by Harrison and Woolley, Consulting Engineers for the meter installation on Line No. 5, said location being near Smeltzer Avenue and Newland Street extended on Metropolitan Water line of the City of Huntington Beach and that on a motion duly made and carried, the West Orange County Water Board approved the plans and specifications and at an estimated cost of $7500.00 and that said plans and specifications be submitted to the Huntington Beach City Council for their approval and to 3. 312 Page #4 Minutes - Monday, March 17, 1958 request a directive to authorize the West Orange County Water Board to advertise the work for bid and award the contract subject to confirmation by the City Council should the City desire not to do the work directly. The Clerk read a communication from City Sidney Zowry Engineer Sidney Lowry, advising the City Council that the plans and specifications for the installation of a master meter in the Huntington Beach Metropolitan Water District feeder main prepared by Harrison and Woolley, consulting Engineers, have been reviewed by their office and recommend that the City Council approve the plans and specifications and requests the West Orange County Water Board to proceed with advertising for bids, for awarding the contract, and the construction of work in accordance with those plans. On motion by Lockett seconded by Bartlett approved re: meter install.' in accordance with the action of the blest Orange County Water Board and the recomm- endation of the City Engineer the plans and specifications for the installation of the master meter in the Huntington Beach Metropolitan Water District feeder main prepared -by Harrison and Woolley, Consulting Engineers be approved and to direct the West Orange County Water Board to proceed with advertising for bids awarding the contract and the con- struction of work in accordance with those plans was approved by the following roll call vote: AYES: Councilmen: Bryant, Lockett,Trby, Bartlett, Terry. Granas The Clerk read a transmittal received re: division of land from the Huntington Beach Planning Commission Secretary informing the City Council that a Public.Hearing was held on March 4th, 1958, by the City Planning Commission on the division of land request of Harry D. Granas of 1015 So. Los Angeles Street, Los Angeles, California 4. 31, 1 Page #5 Minutes - Monday, March 17, 1958 to allow division of one 100 ft. frontage lot into two 50 ft. frontage lots containing approximately 7000 sq. ft. apiece, location of said property being at the south- west corner of Utica and Pine Street, legal description Lot 11, Block 1802, Tract No. 12 that a motion duly made and carried it was recommended to the City Council the DV #101 be approved without conditions. On motion by Bryant seconded by Irby the DV #101 application of Harry D. Granas for division of one 100 ft. frontage lot into two 50 ft. frontage lots containing approximately 7000 sq. ft. apiece, legal description being Lot 11, Block 1802, Tract No. 12, and in accordance with the recommendations of the Planning Commission be granted. Motion carried. Reso.#48 The Clerk read a letter of transmittal re - Master band Use Plan ceived from the Planning Commission Secretary with a copy of Resolution No. 48 a Resolution of the Planning Commission of the City of Huntington Beach recommending adoption of the Master Land Use Plan for said City by the City Council, which was adopted by the Planning Commission at a regular held meeting on March 4th, 1958, following a series of Public Hearings held upon the Master Land Use Plan. Notice of On motion by Bryant seconded by Lockett the Public Hearing City Clerk be instructed to insert in the Huntington Beach News a legal notice calling for a Public Hearing on the Master Land Use Plan as re- commended for adoption by the City Planning Commission and said Public Hearing to be held at 8:00 o'clock P.M. on April 21st, 1958, be approved. PubTic IT,- grin- Mayor Terry opened the Public Hearing No'rtr Nc . 2 Arnexat -on set for 8:00 o'clock P.M. to receive protests for the "North No. 2 Annexation" and requested the Clerk to read the legal notice. The Clerk read the legal notice published in the Huntington Beach News, February 13th and February 20th, 1958, and also published on February 14th and February 21st, 1958 in the Westminster Herald giving notice of proposed annexation to the City of Huntington Beach'of that certain uninhabited territory described in Resolution #1332 and designated as "North No. 2 Annexation" and giving notice of time and place for hearing of protests thereto. The Clerk reported that up to the hour of 7:30 o'clock P.B. March 17th, 1958, no oral or written protests of property owners of record had been filed with the City Clerk. The Clerk read the certification filed by the City Clerk to the effect that the written consent of the owners of more than two-thirds of the value of the territory in - eluded in the North Annexation No. 2 has heretofore been filed with the City Clerk, consenting to the taxation of the property in said annexation equally with the property within the City of Huntington Beach to pay the entire bonded indebtedness of the City of Huntington Beach, out- standing or authorized at the date of the filing of the petition for Annexation for the acquisition, construction or completion of municipal improvements. Mayor Terry asked if any property owners present washed to present a protest of the "North No. 2 Annexation" to make themselves known. 6. 315 Page #7 Minutes - Monday, March 17, 1958 There being no further protests or comments the Mayor declared the hearing closed. Ord.#685 The Clerk gave Ordinance No. 685 its first lst Reading reading an Ordinance of the City of Huntington Beach approving the Annexation of certain uninhabited territory designated as "North No. 2 Annexation" to the City of Huntington Beach. Agreement- On motion by Bartlett seconded by Irby H.B.Recreation & H.B.Union the City Council gives consent to the High School District Public Recreation Commission of the City of Huntington Beach to execute the agreement between the Huntington Beach Union High School District and the Public Recreation Commission of the City of Huntington Beach giving permission to use facilities for certain recreational activities during the months of March, April, May, June, July and August of 1958, be approved. Motion carried. Councilman Lockett excused from voting. Public Hearing "North No-3 Annexation Mayor Terry announced that a Public Hearing was set for 8:15 o'clock P.M. to receive protests on the "North No. 3 Annexation" and requested the Clerk to read the legal notice. The Clerk read the legal notice published in the Huntington Beach News, February 13th and February 20th, 1958, and in the Westminster Herald on February 14, and 21st, 1958, giving notice of proposed Annexation to City of Huntington Beach of that certain uninhabited territory described in Resolution No. 1331 and designated as "North No. 3 Annexation" and giving notice of time and place for hearing protests thereto. The Clerk informed the City Council that no oral or written protests from property owners of record in the area within the "North No. 3 Annexation" had been 7. 316 Page #8 Minutes _ Monday, March 17, 1958 filed with the City Clerk up to the hour of 7:30 o'clock P.M. of March 17, 1958. Ord.#-686 The Clerk gave Ordinance No. 686 its first lst reading reading an Ordinance of the City of Huntington Beach approving the Annexation of certain uninhabited territory designated as "North No. 3 Annexation" to the City of Huntington Beach. H.B.Chamber Mayor Terry referred to the Streets and Parks of Commerce 4th_,of�July Committee, the request of the Huntington Beach Chamber of Commerce to set aside 3 or 4 acres for the location of the 4th of July Carnival amusement equipment. Request of Mayor Terry referred to the Streets and Parks VFW fireworks stand Committee the request of the Huntington Beach Veterans of Foreign Wars of the United States for permission to use the property at the southeast corner of Huntington Avenue and Coast Hiway #101, for their annual fireworks sales stand. Request of Mayor Terry referred to the Streets and Parks Native Daughters Committee the request of the Silver Sands Parlor No. 286 of Huntington Beach for permission to have a booth at Lake Park on July 4th, 1958 to serve and sell 317 Page #9 Minutes - Monday, March 17, 1958 ice cream and candy. H.B.Ambulance On motion by Irby seconded by Lockett in Service - ,agreement accordance with the request of the Hunting - extended ton Beach extend the subsidy agreement and amended agreement for a period of 30 days to and including April 30, 1958, be approved. Motion carried. Public Hearing Mayor Terry announced that 8:30 o'clock re: vacate par, of alley Blk. P.M. was the time set for Public Hearing "A" Tr. 528 for the purpose of receiving protests to vacate a portion of an alley in Block "A", Tract'528 and, rep - quested the Clerk to read the legal notice. The Clerk read the legal notice published in the Huntington Beach News on February 27th, 1958, giving notice of a hearing to vacate a portion of an alley in the City of Huntington Beach that certain alley running through Block "A", Tract No. 528, and said hearing set for 8:30 o'clock P.M., on the 17th day of March, 1958, at which hearing all persons interested in or objecting to the proposed vacation may be heard. The Clerk reported that no written or oral protests had been received at the City Clerk's office up to and including 7:30 o'clock P.M., March 17, 1958. Wm.Lewis The Clerk read the affidavit of posting notices St.Supt. � to vacate alley filed by William S. Lewis, Street Superintendent, certifying that in accordance with Reso- lution No. 1336, passed by the City Council on the 17th day of February 1958, that he posted conspicously along the property described in said Resolution copies of Resolution in accordance with Section 8330 of the Streets and Highways Code of the State of.California, and that he completed all the posting of said Notices on the first day of March, 1958 and thereafter he made the affidavit and filed same with the City Clerk and the City of Huntington Beach. 9. Page #10 Minutes - Monday, March 17, 1958 The Mayor asked if anyone present wished to make any comment or protests on the vacation of the alley. Mrs.Funk Mrs. Funk addressed the City Council and stated that she was a property owner of two lots abutting the alley proposed to be vacated and stated that they intend to build a multiple dwelling and the alley was necessary for their building program. Mr.Stewart Mr. Stewart filed a letter with the Clerk signed by three property owners who own twenty lots abutting the alley proposed to be vacated and stated that the alley as it existed is unimproved and is used primarily by the petitioners as a secondary means of ingress and egress to their property, and because it is unimproved it points a future construction maintenance problem to the City. There being no further comments or protests regarding the vacating of the alley, the Mayor declared the hearing closed. City Attorney, Charles Bauer, reported to the City Council that in the deliberation to vacate, the intention of the Council to consider vacating of the alley the City Council must determine from all the evidence submitted that the alley described is un- necessary for the present or as a prospective public street and alley purpose. On motion by Bryant seconded by Irby the City Council does order that certain public alley situated in Block "A" of Tract No. 528 running northerly from Wintereburg Avenue through said Block "A" to the northerly terminus of said alley be closed, was approved by the following roll call vote: AYES: Councilmen: Bryant, Lockett, Irby, Bartlett, Terry. NOES: Councilmen: Drone. ABSENT: Councilmen: None. Reso.#1343 The Clerk read Resolution No. 1343, a Resolution of the City Council of the City of Huntington Beach vacating alley situated in Block "A" of Tract 528. 10. 319 Page #11 Minutes -- Monday, March 17, 1958 On motion by Bartlett seconded by Bryant Resolution No. 1343 was passed and adopted by the following roll call vote: AYES: Councilmen: Bryant, Lockett, Irby, Bartlett, Terry. NOES: Councilmen: None. ABSENT: Councilmen: None. Mayor Terry called a short recess of the City Council at 8:45 o'clock P.M. The City Council reconvened 9:00 o'clock P.M. and Mayor Terry called the meeting to order. Public Hearing- Mayor Terry announced that a Public re: pipeline franchise So. Hearing was set for 8:45 o'clock of Cal. Edison Co. April 3, 1958, and requested the Clerk to read the notice of the hearing. The Clerk read the legal notice published in the Huntington Beach News on February 27, 1958, a Resolution of the City Council of the City of Huntington Beach declaring its intention to grant a pipeline franchise to Southern California Edison Company and said hearing set for 8:45 o'clock P.M. Monday, March 17, 1958. The Clerk reported that no oral or written pro- tests had been filed for or against the request of the Southern California Edison Company for a pipeline franchise. Mayor Terry asked if anyone present wished to make any comment for or against the request of the franchise of the Southern California Edison Company. There being no comments or protests from anyone present the Mayor declared the hearing closed. Ord.No.587 The Clerk gave the first reading of Ordin- Ist Reading ance No. 687 an Ordinance of the City Council of the City of Huntington Beach, granting to Southern California Edison Company its successors and assigns, a franchise, for an indeterminate term to construct, lay, operate, maintain, use, renew, repair, replace, move, change the sime and number of, and remove or abandon in 11. 320 Page #12 Minutes - 'Monday, Marc i 17th, 1958 place a system of pipelines and appurtenances, for the purpose of conducting, transporting, conveying and carrying gas, oil, petroleum, water and other substances, on, along, in, under and across public streets, ways, alleys and places within the City of Huntington Beach, together with the right to construct, operate, maintain and use a private communication system to be used in connection with the operation and maintenance of said system of pipelines and appurtenances as aforesaid. Blind Industries James Coates and John Bauer officials of Sales, _Inc. the Blind Industries Sales Inc. of Santa Ana appeared before the Council and explained their method of operating their association,selling the products of the Blind Industries Sales Inc., and further explained their telephone sales service and procedure and that it was a nonprofit organization and all proceeds go to the rehabilitation of the Blind and their livelihood. Mayor Terry continued the study of the Blind Industries Sales request for a permit to sell and deliver the Blind made products in the City of Huntington Beach to the Committee for further study and report. L.II.Fink 0n motion by Bartlett seconded by Irby the Tax Titre Lot offer of L. M. Fink of 2216 Lime Ave., Long Beach, California to purchase tax title Lot #5 in Block 100E be rejected, be approved. Lotion carried. B1dg.Dept. On motion by Irby seconded by Bartlett that the autoi,aobile City Purchasing Agent be instructed to receive informal quotations for one automobile for use of the Building Department, be approved. Motion carried. Filing cabinet- On motion by Lockett seconded by Bartlett Bld .Dept. the request of the Building Inspector, Norman Wells, for the purchase of one filing cabinet for use in the Building Department with an estimated cost of $185.00 be approved, and the City Purchasing Agent be authorized to make the purchase. On motion by Bryant seconded by Irby the vacation request of Norman Wells, Building Inspector, to take five days of his annual vacation starting on March 31st through April 4th, 1958, be approved. Motion carried. Sewer bid On motion by Bartlett seconded by Lockett in awarded to L.H.Henson accordance with the findings of the City Engineer the sanitary sewer work which bids were received on March 3, 1958, be awarded to the low bidder L. H. Henson, 4721 E. Florence Avenue, Bell, California, and the Mayor and the City Clerk be authorized to execute the con- tract and bonds and all other bids received, be returned, be approved. Motion carried. Demands On motion by Lockett seconded by Bryant the de- mands as approved by the finance committee be ordered paid. Motion carried. Request - E. W. Hoke extension of Yorktown St. E. W. Hoke realtor of Midway City appeared before the City Council and requested that the City consider extending the extension of Yorktown Street to the East to the proposed sub -division tract. Mayor Terry referred the request of E. W. Hoke to the Streets and Parks Committee for study and report. Re-classify- On motion by Irby seconded by Bartlett the Jack Weide request of D. G. Higgins, Fire Chief, to re --classify Jack Weide to the classification of Fire Engineer in the appropriate salary range, be approved. Motion carried. Angelo Mollica On motion by Irby seconded by Lockett in vacation relief Fire Dept. accordance with request of D. G. Higgins, Fire Chief, Angelo Mollica be employed as a Fire Engineer to work vacation schedule of approximately 9 months, and due to his experience he be placed on the 3rd step of the appropriate range classification was approved by the following roll call voT;e: AYES: Councilmen: Bryant, Lockett, Irby, Bartlett. Higgins, Fire Chief and the City Attorney be instructed to work with the County Counsel and Forest Ranger Scherman to draw up necessary changes or additions to the present existing fire protection contract for the approval of the City Council and Board of Supervisors, be approved. Motion carried. Board of The Clerk informed the City Council that a Supervisors re: Public Resolution of the Board of Supervisors of Hearing Re;o. Orange County setting a public hearing for #1335 April 29 1958 at 9:30 o'clock A.M. had been received wherein acknowledgement of the City Council, Resolution No. 1335 has been received and according to the County Sani- tation District No. 11, Orange County will be benefited by the annexation thereto of that certain territory, and Sidney Lowry be instructed to attend said hearing, be approved..Motion carried. Tri-Cro•�,,n Const. On motion by Bartlett seconded by Irby the Co. to Gut curb 715 Alabama Ave. request of Tri-Crown Construction Co., Inc. for permission to cut the curb and pour an 8 foot approach and an 8 foot sidewalk on the construction for Amanda A. Yelle at 715 Alabama, Huntington Beach, subject to supervision of the City Engineer and the contractor be required to remove existing unused driveway and remove all the present 4" sidewalk and relocate the gas meter, be approved. Motion carried. Lylyan Mossinger On motion by Lockett seconded by Irby the re - re : Memorial Hall quest of Lylyan Mossinger, City Librarian, to use Memorial Hall for the meeting of the Huntington Beach Library Trustees and Staff and the Orange County Library Club, and the fees for the use of the hall be waived and said use to be on May 8, 1958, be approved. Motion carried. 14. 323 Page #15 Minutes - Monday, March 17, 1958 Request - Mr. Mayor Terry referred to the Streets and Mrs. Nelson Mauerer re: Parks Committee for study and report the St.li ht request of Mr. & Mrs. Nelson E. Maurer, 821 Main St. for consideration to place a street light in the alley running back of 821 Main St., and 330 Crest term- inating on Crest and eleventh Street. Request.- Mayor Terry referred to the Streets and Mr. Mr. L.G. Cramer re- Parks Committee for study and report moval of tree regarding the request of Mr. & Mrs. L. G. Cramer for the removal of a large Star Pine Tree planted at 410-7th Street. Portable On motion by Irby seconded by Bartlett the Trailer Park Office Mun. City Engineer be instructed to prepare and Tr.Pk. submit plans and estimate of cost for a portable trailer park office to be located where the con- cession building is being torn down at the entrance to Section A of the Municipal Trailer Park, be approved. Motion carried. Letter to The Clerk reported that a letter had been Fred Hermann re: Lots 2--4 transmitted to Fred Hermann relative to B1k.414 his claim of making a deposit to the City back in 1944 for the purchase of lots 2 and 4 in Block 414 and reported that the City records reveal that no Treasury receipt had been issued for such a deposit on the lots mentioned or that the City Council in that period had ever advertised lots 2 and 4 for sale..
