Monday, April 21, 1958 Mayor Irby called the regular meeting of the City Council to order at 7:30 o'clock P.M. Councilmen present: Lambert, Bryant, Terry, Waite, Irby. Councilmen absent: None. Following Pledge Of Allegiance, Reverend Auger of the First Church of Christ gave the invocation. Mayor names Mayor Irby named the following committees, committee first name to be the Chairman of the Committee: Recreation - Lambert & Waite Beach & Pier - Bryant & Lambert Golf - Terry & Waite Building & Insurance - Lambert & Bryant Oil - Terry & Lambert Finance - Waite & Bryant Police & Fire'- Bryant & Waite Streets & Parks - Waite & Bryant Drainage & Sanitation - Lambert & Bryant Personnel - Terry & Lambert Crown -Hunt. Motion carried. Charles On motion by Waite seconded by Bryant the re - Camp -term cleanup quest of Charles W. On motion by Lambert seconded by Bryant term.cleanup Bond -Davenport: the request of Beloil Corporation for Well termination of the Central Surety and Insurance Corporation cleanup bonds No. 30-59-77, and 30-59-74 for the Davenport #5 well, located on Lot 10, Block 2201 V.D.M. Tract, and the Dabney #2 well, located on Lot 2, Block 1901 V.D.M. Tract, having complied with the requirements of the cleanup ordinance and the bonding company and the operator be notified of the bond termination be approved. Motion carried. Plumber's bond- On motion by Waite seconded by Lambert, So .Coast Ply. Plumbers License bond of the Great American Indemnity Company for the South Coast Plumbing and approved for form by the City Attorney be accepted and ordered filed. Motion carried. Wheeler Elect.- On motion by Bryant seconded by Lambert bond the Pacific Indemnity Company Electrician's Bond for Forrest E. Wheeler dba Wheeler Electric, and as approved for form by the City Attorney be accepted and ordered filed. Motion carried. Business License On motion by Waite seconded by Lambert the application for license to conduct business in the City of Huntington Beach of Harvey Edward Leimbach to conduct the business of Breakers Hotel at 106 Ocean Avenue, as approved by the Health Officer, Building Inspector, Chief of Police & Fire Chief, be granted, Motion carried. The Clerk reported that the Planning on conditional permit #104 Commission held a public hearing on filed by Ai Gonzales April 159 1958 on Conditional Permit #104 filed by Al Gonzales of 11917 Dehne 2' 375 Page #3 Minutes - Monday, April 21, 1958 Avenue, Inglewood, to allow sand and gravel excavation in an A-1 Zoning District; to include the removal of sand and to process same by drying and screening. Equipment to consist of rotary kiln, dryer, screens, and hoppers for storage of sand, location north side of Taylor Avenue mid- way between Goldenwest and Edwards Streets, and said con— ditional permit by motion duly made and seconded and carried recommending approval of the CP #104, subject to the following conditions: ULTIMATE EXCAVATION 1. No portion of the exterior line of excavation shall be less than the following: 50 feet from the north property line 50 feet from the south property line 50 feet from the east property line no limitation on the property line adjacent to existing excavation pit. SLOPE 2. All portions of the exterior line of excavation shall be a finish slope of existing undisturbed material reposing at a gradient not steeper than 1* foot rise in 1 foot horizontal measurement. FENCING 3. A fence shall be erected enclosing the entire permit area including all buildings, structures, yards, parking areas, reservoirs or other uses incidental to the operations thereon in -accordance with the following minimum specifications: (a) Said fence shall be a five strand five foot post and barbed wire fence. (b) Fence gates shall be required at all vehicular and pedestrian points of ingress and egress. Fence gates shall also be 5 feet high and shall have 5 strands of barbed wire. The maximum depth of the permitted excavation shall not be lower than the ground level existing at the NEB- of NW4 of Sec. 349 T-5-So R-11-W. TIME LIMITATION 5. CP #104 shall expire within seven years from the date of approval. On motion by Terry seconded by Waite in accordance with the recommendation of the Planning Commission for approval of Conditional Permit #104 filed by petitioner Al Gonzales be granted subject to the conditions recommended be imposed by the Planning Commission, be approved. Motion carried. Area Varia~,.e The Clerk reported that the Planning Commission #114 filed `)y Tneo►J. Bose held a public hearing on April 15th, 1958 on Area Variance #114, filed by Theodore J. Bose of 17725 H.B.Blvd., to allow the installation of _ one 35 sq. ft. double faced neon sign and one 26 sq. ft. double faced neon sign within front yard area in a C-1 Zoning District location being the northwest corner of Newman and H.B.Blvd., and the motion was made and duly seconded and carried that the Planning Commission recommend to the City Council the approval without conditions. On motion by Waite seconded by Terry in accordance with the recommendation of the Planning Commission area Variance #114 Piled by Theodore J. Bose, of 17725 H.B.Blvd. be granted. Motion carried. Area Variance The Clerk reported that the Planning Commission #113 Dr. Bernard Mason held a public hearing on April 15th, 1958, on Area Variance #113 filed by Dr. Bernard 4. 377 Page #5 Minutes - Monday, April 21, 1958 Mason of 825 - 12th Street, Huntington Beach, to allow the construction of an eight foot high decorative screen panel in the side yard, location being northwesterly corner of 12th and Main Streets, and that on a motion duly made and seconded and carried, the Planning Commission recommend approval of Area Variance #113 without conditions. Motion.carried. On motion by Terry seconded by Lambert in accordance with the recommendation of the Planning Commission, Area Variance #113, filed by Dr. Barnard Mason of 825 12th St. be granted without conditions. Motion carried. H.B.Ambulance The Clerk read a request of the Huntington Service Beach Ambulance Service requesting the City to consider a subsidy in the amount of $200.00 on annual basis in support and maintenance of the service in the City of Huntington Beach the year round. Seals Ambulance Gilbert Seals of the Seals Ambulance Service Service appeared before the City Council and stated that they had a license in the City of Hunting- ton Beach to operate an ambulance, said office being at 523 Main Street, and requested the City give consideration to the division of the subsidy. No action taken. H.B.Ambulance On motion by Terry seconded by Bryant the Service City Council authorize an agreement with the City of Huntington Beach and H.B. Ambulance Service and direct the City to draw up said agreement for a period of three months at a stipulated amount of $200.00 per month, was approved by the following roll call vote: AYES: Councilmen: Lambert, Bryant, Terry, Waite, Irby. NOES: Councilmen: None. ABSENT: Councilmen: None. Pick-up On motion by ferry seconded by Bryant in truck for St.Dept. accordance with the request of the Street Superintendent the City Purchasing Agent be instructed to receive informal bids on a pick-up truck to be 5. 378 Page #6 Minutes - Monday, April 219 195€3 used in the Street Department, be approved. Orange County On motion by Bryant seconded by Lambert the Assoc. for retarded request of the Orange County Association for Childron to sale nosegays Retarded Children_ for permission to offer June 6 1958 for sale fresh nosegays in the business Streets in the City of Huntington Beach, for donation purposes on June 6, 1958, be granted. Motion carried. Request of Mayor Irby referred to the Streets and Parks Del Burry Park.Lot Committee for further study and report the re- quest of Del Burry to continue operation of a parking lot on City property adjacent to Huntington Avenue - and Hiway #101, for the summer season. Public Hear. Mayor Irby announced that 8:00 o'clock P.M. Ma.s'.er Land Use and St. was the time set for a public hearing on the 3C Hiway Plan proposed adoption of the Master Land Use Plan and the Master Street and Hiway Plan, as recommended for adoption at the public hearings by the Planning Commission of the City of Huntington Beach and requested the Clerk to read the Notice of Public Hearing. The Clerk read the Notice of Public Hearing, published in the Huntington Beach News on April 3rd and April loth, 1958, following a hearing on the Master Land Use Plan and the" Master Plan of Streets and Hiways encompassing all territory within the present city limits in order to guide future development, and that the public hearing will be held on said plan in accordance with the State Law and said hearing set for 8.-00 o'clock P.M., on the 21st day of April, 1958, in the Council Chambers of the City Hall, of the City of Huntington Beach, and that any and all interested persons may appear and be heard thereon. Mayor Irby opened the hearing and requested Wm. Wey- bright, representative of the Planning Consultants for the City of Huntington Beach to present and outline the proposed plan. Weybright presented the plans and dis- cussed the proceedings that have been held by the Planning Commission and comments made by the property owners and those interested in the over-all plans, changes that have been made to conform to the wishes of the people when they were deemed advisable and that this discussion and study has gone on for the past four or five months and ultimately now has been presented to the City Council for adoption by the Planning Commission. Following presentation of the Master Plans of Land Use and Streets and Hiways by Planning Consultant Wm. Weybright, the Mayor requested anyone present who wished to make any comments or protests to do so at this time. Ernest Gisler Ernest Gisler addressed the City Council and stated that he was not in accord with the program of the drainage canal in that it does not alleviate the condition that is now existing over on Bushard and Banning Sts. Mr. Gisler was informed that this hearing had no bearing on Flood Control at this time. Stuart Gibbs Stuart Gibbs addressed the City Council and stated that he was opposed to the re -zoning for R-1 abutting Highway #39 and that he has property at the north- west corner of Ellis and Main Street and further asked about precise zoning upon which Mr. Weybright enlightened him and stated that the precise zoning followed the Master Land Use Plan if adopted, and which the Planning Commission would start hearings on this month. Wm.Houston William Houston, local realtor, addressed the City Council and stated that he did not agree with the planners viewpoint relative to zoning along Hiway #39 7. 380 Page #8 Minutes - Monday, April 21, 1958 and recommended that the entire area abutting Hiway #39 for the full length of Highway #39 in the city limits be zoned for comm- ercial and business purposes at least 600 ft. on each side of the Highway. Robert Bushnell Robert M. Bushnell addressed the City Council stating he has property at the intersection of Hiway #39 near Main Street and said that he does not under- stand this particular study or hearing going on relative to use of land. Mr. Weybright enlightened him by explaining Land Use Plan and also the precise zoning which follows the Land Use Plan. Nm.Bray Wm. Bray, local merchant, addressed the City Council and stated that he was not in accord in any of the socialistic planning going on in the City and stated that he saw no reason why people should not be allowed to develope their property as they see fit. Sherman Denny Sherman Denny, representing the Huntington Beach H.B. C o.n jl any Company and local land lease manager, re- ported to the City Council that the Plan as presented to the City Council from studies made by the Planning Commission and re- commended for adoption, is in accord with the findings of his company and expressed his appreciation to the Planning Commission and to the Planning firm and that they should be commended on the splendid job that they have done in the studies on this Land Use Plan and Master Streets and Hiways Plan and their company has no objection to the Plan as presented for adoption. There being no further comments from anyone present Mayor Irby declared the hearing closed. NOES: Councilmen: None. ABSENT: Councilmen: None. Mayor Irby called a short recess at 9:20 o'clock P.M. Recess The Council reconvened at 9:30 o'clock P.M. and called. Mayor Irby called the meeting to order and stated that this is the time & place that had been set for the sale of real property at public auction and he requested the Clerk to read the legal notice. Notice of The Clerk read the Notice of sale of Real Sale of Real Property Property at Public Auction, published in Public Auction the Huntington Beach News on April 3rd and April. loth, 1958, whereby the City of Huntington Beach will sell at public auction, to the highest and best bidder for cash, lawful money of the United States, in the Council Chamber at the City Hall in the City of Huntington Beach, on Monday, the 21st day of April, 1958, at the hour of 9:00 o'clock P.M. or as soon thereafter as said sale can be held, all its right, title and interest, excepting therefrom the mineral rights without right of surface entry to certain described property. City Att'y City Attorney Bauer reported to the City Bauer . Council certain conditions of the property to be offered for sale should be known at this time and reported that the following parcels are subject to easements of right - of --way, pipelines now in place. Parcel #1 - Lots 2 & 4, Block 215, an oil line located along the east line of the property. Parcel #2 - Lots 6 & 8, Block 313, a line located along Lot 6, along the east line and along the east line on Lot 8. The lines being located more or less 10 ft. from within the property line. Mayor Irby opened up the Public Sale and requested the Clerk to open written bids received. Bids The Clerk opened up the following written bids: on received Lot 6 & 8, Block 313 - Glenn C. Kurtz - $2,100.00 R.C. Schweitzer- $2,155.00 Lot 11, Block 314 - G. C. Kurtz - $900.00 Lots 21 & 23, Block 314 -- G. C. Kurtz - $2,500.00 Lots 25 & 27, Block 314 - G. C. Kurtz - $2,750.00 Lots 25 & 28, Block 314 - G. C. Kurtz - $2,500.00 Mayor Irby asked for bids on Lots 2 & 4, Block 215 and as there were no written bids received the minimum acceptable bid would be in order. There being no bids offered on Lots 2 & 4, Block 215, the property was withdrawn from sale. Mayor Irby offered Lots b & 8, Block 3139 and asked for a bid of 5% above the highest written bid of $2,155.00. R.C.Schvicitzer There being no oral bid above the $2,155.00 written bid, the property was sold to R. C. Schweitzer for the amount of the written bid $29155.00. Mayor Irby asked for oral bids on Lot 11, in Block 314 and stated that the next bid would have to be 5% above the $900.00 written bid. Glenn C. There being no further bids over and above the Kurtz written bid, Lot 11, in Block 314 was sold to Glenn C. Kurtz for $900.00. Mayor Irby offered Parcel #4, Lots 21 and 23, Block 314 and stated that the first bid would have to be 5% above the written bid of $2,500.00 received. There being no bids offered over and above the $2,500.00, written bid, declared the property sold to G. C. Glenn C. Kurtz Oral bids were received and Mayor Irby declared the Parcel #5, Lots 25 & 27, Block 314, sold to Glenn C. Kurtz, the highest bidder in the amount of $3,305.00, Mayor Irby offered Parcel #60 Lots 26 & 28, Block 314 and stated that the first bid would have to be 5% above the written bid of $2,500.00. There being no further bids Mayor Irby declared Parcel #6, Lots 26 & 28, Block 314 sold to Glenn C. Kurtz for $2,500.00. Mayor Irby offered Parcel #7, Lots 11 and 13, Block 812 and there being no written bids, the first bid must be a minimum acceptable bid of $3,500.00. Robert R. Allen A bid of $3,500.00 was made. There being no further bids Parcel #7, Lots 11 and 13, Block 812 was sold to Robert R. Allen, for $3,500.00. Mayor Irby offered Parcel #8, Lots 15 & 17, Block 812 and stated the first bid must be $3,500.00 the minimum acceptable bid. Robert R. Title policies to bo issued On motion by Lambert seconded by Waite the City Attorney or the City Clerk be directed to see that title policies are issued, can currently with the deed for the property sold and ordered recorded in order that the properties be placed on the tax roll, be approved, Motion carried. Demands On motion by Bryant seconded by Waite the demands as approved by the Finance Committee be ordered paid, was approved. Motion carried. Sidney L. The Clerk read the following communication re -- Lowry City Ens;-neer ceived from Sidney L. Lowry, City Engineer, to wit: "submit herewith for your consideration and approval final plans and specifications for certain Orange County Flood Control work to be constructed, known as the "Santa Ana River, Green- ville -Banning and Talbert Channel" project. A portion of said project liew within the boundaries of the City of Huntington Beach. Please be advised that I have reviewed the plans and specifications and have given them my approval. Therefore, it is my recommendation that the plans and specifications be approved by your honorable body and the Orange County Flood Control District be notified of your action." On motion by Terry seconded by Bryant the Plans and Specifications for the Santa Ana River, Greenville -Banning and Talbert Channel project be approved. Library Mayor Irby referred to the Building Committee and Board the Finance Committee for study and report the re- quest of the Library Board of Trustees recommending to the City Council that the City take over the branch Library at Ocean View as the County will discontinue the branch library on June 30th of this year. City Attly On motion by Bryant seconded by Terry the re - to attend League of quest of the City Attorney for permission Cities Conv. to attend the City Attorney's section of the League of Cities Convention which is being held in Palo Alto, California, on April 23rd, 24th, & 25th, 1958, with expenses not exceeding the budgeted amount, be approved. Motion carried. Alice On motion by Bryant seconded by Lambert in Hamilton Sec -Steno accordance with the request of the City Attorney, Alice M. Hamilton be appointed as Secretary to the City Attorney in the classification of Secretary -Stenographer, be approved. Motion carried. Police Slept. Realignment Mayor Irby referred the agreement presented by of Main St. the Huntington Beach Company for the realignment of Main Street to the Streets and Parks Committee for study and report. Realignment of Wm. Lewis, Assistant City Engineer presented easterly ramp entrance of to the City Council a plan showing a real - State Park ignment of the easterly ramp entrance from the State Park entrance and stated that the State Division of Highways would re -construct on the basis as presented upon request of the City, without any additional cost to the City. 14. 38? Motion carried. Purchse 4 On motion by Bryant seconded by Lambert bincculars for rife- in accordance with the request of the card Dept. Chief Lifeguard, the City Purchasing Agent be authorized to purchase ¢ binoculars in accordance with specifications of the Chief Lifeguard and said cost be charged to the Capital Outlay Reserve Fund in the amount of $151.00 was approved by the following roll call vote: AYES: Councilmen: Lambert, Bryant, Terry, Waite, Irby, NOES: Councilmen: None. Bertrand as a lifeguard for night duty during the summer season in salary 3rd year Lifeguard - $1.92 hour was approved by the following roll call. vote: AYES: Councilmen: Lambert, Bryant, Terry, Waite, Irby. Kirkbride, On motion by Terry seconded by Waite the Wilson, Harzfeld & City Clerk be instructed to inform the Wallace attorneys Attorney's and Counselor's of law Kirkbride, for "Off St. Park." project Wilson, Harzfeld, & Wallace who have been retained as the "Off Street Parking" pro- ject attorneys for the City of Huntington Beach to make an appointment convenient to them and to members of the City Council for consultation in the matter of processing this project, be approved. On motion by Waite seconded by Bryant the City Engineer be instructed to proceed with the additional paving necessary and as discussed and outlined at the east end of the Municipal Trailer Park adjacent to the access ramp being put in by the State Highway, be approved. City Attly On motion by Bryant, seconded by Lambert, to attend meetings the City Attorney be directed, in accordance with Resolution No. 1333 to attend, on be- half of the City, the following commission and board meetings; Planning Commission, West Orange County Water Board, County Sanitation District No. 3 and County Sanitation District #11. Motion carried. Name of Assistant City Engineer Lewis stated that it at.North of Edson was the desire of the Southern California Company Edison Company and the local commercial operators on the street located north of the Edison Plant to receive a name to avoid confusion for future deliveries, and directions. Mayor Irby referred the subject of giving a street name to the road north of the Edison Plant, to the Streets and Parks Committee for study and report. On motion by Bryant seconded by Waite the regular meeting of the City Council of the City of Huntington Beach adjourned.
