Mayor Irby called the regular meeting of the
City Council of the City of Huntington Beach to order at
7:30 o'clock P.M.
Councilmen present: Lambert, Bryant, Terry, Waite, Irby.
Councilmen absent : None.

retention of
Hahn, Wise & Commission at a meeting held on May
Berber, Plann.
Consultant 6th, 1958, recommended to the City
Council the retention of the Planning
Consultant Firm of Hahn, rise & Barber, for an additional
year following expiration of the present contract, ex-
piring on August 31st, 1958, and a new agreement to
be based on $270.00 per month fee, which would include
two consecutive days in the City, or 2 days in their
office and one day a month in the City and travel
expenses to be included in the monthly fee, and any
blueprinting or reproduction would be at cost, when
and if ordered by the City.

Use Var.#115 The Clerk reported that the Planning
Atlantic Oil
Company _ Commission on May 19th, 1958, held
a Public Hearing on Use Variance
1159 petitioner being the Atlantic Oil Company, to
permit drilling for oil and gas on property located at
the NE corner of Lot 1119 W.T. Newland Tract, and re-
commended the approval with the following conditions:
FENCING AND LANDSCAPING
1. Said well site shall be properly fenced in accord-
ance with Section 2429, Huntington Beach Ordinance
Code with further provision that upon written
notice from the City Council, there shall be
planted and maintained landscaping such as shrubs
and trees in accordance with the City Engineer's
recommendations.

OIL STORAGE LIMITATIONS
2. The uses permitted shall not be construed as permitting
rotary mud dumps, sumps, or disposal, petroleum re-
fining, or processing or storage of oil or gas in
tanks exceeding 1000 barrel capacity and 8 feet in
height above ground level.
SIGNS
3. Signs shall be limited to two in number and each may
have an area of not over 12 square feet.
PERMANENT CLEAN-UP BOND
4. Aside from all other City and State bonds which are re-
quired, there shall be a $1000.00 permanent cleanup
bond posted with the City of Huntington Beach Engineer-
ing Office for each and every oil well drilling site
prior to the issuance of an oil drilling permit. Said
permanent cleanup bond shall be released by approval of
the City Council upon recommendation of the City
Engineer at the time the site has been permanently
abandoned and cleaned up.
LOCATION
5. All service equipment such as top of well, pumps, tanks,
and the like, shall be at least 150 feet from the
nearest portion of any public road, street, or state
highway, and shall also be at least 25 feet from any
lot line which is not common with a public road, street,
or state highway line.
The specific drilling site granted by this variance shall
be that location designated on map filed by the applicant
and shall be located with a twenty-five foot radius
circular area from said designated point.

Use Var.#117 The Clerk reported that at the Planning

Assoc. Commission meeting of May 19th, 1958, a
public hearing was held on Conditional
Exception Use Variance 117 filed by Roy Gill & Associates
for permission to drill for oil and gas, on property lo-
cated approximately 200 feet westerly of Bushard Street and
440 feet northwesterly from the intersection of Brook-
hurst and Bushard Streets, and said petition be recommended
for approval with the following conditions:
FENCING
1. Said well shall be properly fenced in accordance
with Sections 2429 Huntington Beach Ordinance Code.

Peter Peter Karales appeared before the City Council and
Karales
stated that he was the property owner of the pro-
perty on which Roy Gill & Associates filed for a permit to
drill for oil and gas and that he opposed the approval of
the Use Variance #117 as the company had not signed a
lease with him.
Lynn Lynn Sault, of the Dulin Company, Engineer's
Sault stated that they are the Engineer's for the Roy
Gill and Associates and that in his experiences this was
the first time the question had ever come up in regards to
an oil well drilling permit where a property owner objects
on the grounds that a lease has not been executed.
Use.Var. Mayor Irby deferred action on the Use
#117_ deferred
Variance #117 until the next meeting of
the City Council.

Use Var. The Clerk reported that at the meeting of
#116 Roy
Gill & Assoc. the Planning Commission held on May 19th,
1958, a public hearing was held on Use
Variance #116 filed by Roy Gill and Associates, for per-
mission to drill for oil & gas, on the property located
approximately 710 feet southwesterly from centerline of
Bushard and Brookhurst Streets; 550 feet northwesterly at
right angles to Brookhurst Street, and that Use Variance
#116 was recommended by the Planning Commission for approval
subject to the following conditions:
FENCING
1. Said well shall be properly fenced in accordance with

Peter Peter Karales reported to the City Council
Karales
that bars. Thorpe Hook, owner of the pro-
perty upon which Use Variance #116 is applicable to, had
informed him that the company had not signed a lease with
her and that she was sick and unable to attend this
meeting.
Lynn Lynn Sault of the Homer R. Dulin Company,
Sault
Agents for the Roy Gill & Associates reported
that they have received the bonds, drilling and cleanup
bonds, covering this proposed drilling under Use Variance
#116 and therefore the matter of the lease status is be-
tween the property owner and the petitioner, and also
stated that it is a situation that has never occurred
his experience in the oil business.
Corwin & Custom A representative of the Corwin and
Drlg. Gompany
Custom Drilling Company appeared be-
fore the City Council and stated that they are the drill-
ing contractors for the drilling of the well, under this
Use Variance #116, and stated that they are ready to start
and have been retained by Roy Gill & Associates to do the
work.

Beach City Employees' Association, for the City to amend the
City's contract with the State Employees' Retirement System to
include Section 20952.5 of the Retirement Law, which reads
as follows:
"A new Section 20952.5 was added to the law providing that
local safety members may be retired at age 50, providing they
have 20 years of continuous service, but the allowance pay-
able would be on a discounted basis. The normal retirement
remains at 55 with half pay as the goal. As the normal re-
tirement basis is unchanged, no valuation is necessary to
adopt this amendment and the rates of contribution by the
member and by the employer will not be changed."
Gannon & Winel Mayor Irby referred to the Oil Committee
No.2 referred

a co -partnership, to approve the transfer
of the Oil and Gas Lease agreement between the City of
Huntington Beach and Charles E. Black, covering that portion
of the lease known as Lots 9 and 11, in Block 315, and said
lease having been previously assigned to J. D. Rush & Burl
G. Varner and who have sold the lease to Gannon and Winel
No. 29 a co -partnership, subject to the consent of transfer,
by the City of Huntington Beach.
Fred Hermann Fred Hermann appeared before the City
re:Lots 2 & 4
Block 414 Council and filed a copy of a letter,
dated May 19th, 1958, addressed to the
City Council, which outlined his version of the negotiations
for lots 2 and 4, in Block 414, on which he has filed a home-
stead even though he did not have title to the lots and that
he desires to negotiate with the Council for the purchase of
the lots.
On motion by Bryant seconded by Waite the Mayor
appoint a Committee to discuss the possibility of the sale
of Tax Title Lots 2 and 4, in Block 414, to Fred Hermann.
Motion carried.

Mayor Irby appointed the Building Committee to dis-
cuss with Fred Hermann the possible sale of Tax Title Lots
2 and 4, in Block 414, Seventeenth Street Section.
H.1.City Empl.Assoc.- Mayor Irby referred the request of
re: Group Life Ins.
referred to Personnel the Huntington Beach City Employee's
Commission
Association, for the City Council to
consider revising the existing provision now providing 50%
group life insurance and medical and hospital servicO bene-
fits for employees, to be increased to 100% employer con-
tribution rather than imposing the employee contribution,
and further that the City pay 50% of the premium for group
medical and hospital service on the spouse and dependents
of the employees, to the Personnel Committee and all mem-
bers of the City Council for study and report.
Ord. 689 Ordinance No. 689, an Ordinance relating to
Vehicle Off -Street Parking Districts, was given
its first reading.
Ord.#690 Ordinance No. 690, an Ordinance of the City of
Huntington Beach relating to Stop Intersections
in the City of Huntington Beach; adding Sections 6217.7, 6227.79
6217.8 and 6227.8 and repealing Sections 6241.21 and 6243.21,
of the Huntington Beach Ordinance Code, was given its
first reading.
Sidney L.Lowry The City Clerk read a report of Sidney
report re -Talbert
Drainage Dist.(D-2) L. Lowry, City Engineer, reporting
that there had been submitted for
review and recommendation plans for the construction of the
Talbert Drainage Channel (D-2) proposed to be constructed by
the Orange County Flood Control District, and the project
involves the construction of bridges across the proposed
channel at Adams and Atlanta Streets and a culvert at Garfield
Street. The structures proposed by the Flood Control Dis-
trict will provide for a roadway width of two 12ft. lanes or
24 feet. Since Garfield, Adams and Atlanta Streets are shown
on the City's Master Plan of Highways as four lane highways,

it was recommended to the City Council that the City enter
into an agreement with the Flood Control District to pro-
vide for the widening of these three structures to pro-
vide for our ultimate requirements, and the estimated cost to
the City of the betterment work is as follows:

Adams Street - 219585.92
Atlanta Street - 19,927.04
Total $459541.76

Talbert & Co. On motion. by Waite seconded by Bryant
to erect sign
according to the recommendations of the
Streets and Parks Committee the request of Talbert & Co.
for permission to erect a sign aft x 4ft to advertise
certain rental units, and said sign to be erected at the
corner of Huntington Avenue and Ocean Avenue subject to
the approval of Del Burry, lessee Hof the area, for parking
purposes, and said sign be located at the designated
location, only during the period of June, July, and August,
1958. Motion carried.
Notify St.Div.of On motion by Waite seconded by
Hiways re: Ped.
Cross.Maint. Bryant the City Clerk be directed
to notify the State Division of
Highways that in the event of the construction, by the
State Highway Department,of a pedestrian overcrossing near
Huntington Avenue and Pacific Coast Highway Freeway, in
the vicinity of Highway 39, the City will assume the
responsibility of the maintenance of said pedestrian
overcrossing upon its completion and that the Maintenance
Agreement for said pedestrian overcrossing be included in
the Freeway Agreement with the City of Huntington Beach.
Motion carried.
Paint toilet bldgs. On motion by Bryant seconded by

Lambert the City Engineer be in-
structed to proceed with the painting of the toilet
buildings #3, #49 #5, located in the Municipal Trailer
Park, was approved by the following roll call vote. -

suit filed by
Fred Herman City Council that Case No.- 76592 has
been filed in the Superior Court, and

Plaintiff thereon being Fred Hermann, one of the defendants
being of the City of Huntington Beach, said suit being re-
lative to certain charges affecting the agreement between
the City of Huntington Beach and the Wilshire Oil Company,
and asked what instructions or disposition the City Council
wished to make.
Mayor Irby Mayor Irby made the following statement, "as
a member of the City Council I can see no
other answer but to defend the Honesty and Integrity of
the Council members, and the good name of the City of Hunt-
ington Beach. The Plaintiff thru his attorney has seen fit
to file bribery and other charges against the City Council.
I believe the council members, of the past and as of now,
are an honest as the day is long, and absolutely truthful in
all council deliberation. I feel that the Present City
Council should do everything possible to combat these charges
along with the Wilshire Oil Company. So, I would like a
motion at this time to instruct our City Attorney to take
whatever steps he deems necessary to answer their charges."

the action of Fred Hermann versus the City of Huntington
Beach and`.the Wilshire Oil Company, said case being re-
ferred to as No. 76592, in the Superior Court of the County

Roger Boucher -e: Roger Boucher of Sunset Heights
protest petition
appeared before the City Council and
filed a protest petition signed by 107 residents and pro-
perty owners of that area protesting any action to annex
the Sunset Heights area to the City of Huntington Beach and
filed the petition and map of the area with the Clerk.

Mayor Irby informed Mr. Boucher that his pro-
test petition was a little premature as the City Council
has not up to this time been presented with any formal
petition for Annexation.
Ord.#691 Ordinance , gl, an Ordinance of the City of
. Huntington Beach, relating to Salaries, and
compensation of Officers and Employees' of the City of
Huntington Beach, amending, repealing and adding
Sections to the Huntington Beach Ordinance Code, was
given its first reading.
On motion by Bryant seconded by Lambert the
City Council adjourn until 7:30 o'clock P.M. Monday,
May 26th, 1958
