M. Councilmen present: Lambert, Bryant, Terry, Waite, Irby. Councilmen absent: None. Minutes On motion by Terry seconded by Waite the minutes of the City Council for meetings of June 2nd, June 9th, and June 16th, 1958, as transcribed and mailed by the City Clerk be accepted and ordered filed. lotion carried. Business On motion by Lambert seconded by Waite the Licenses applications for license to conduct business ,in the City of Huntington Beach as approved by the Health Officer, Building Inspector, Chief of Police and Fire Chief, were granted as follows: Jack D. Croce, dba Bit of Swiss, tavern and dancing at 210-5th Street, transfer from David dim. Hook. Abelardo Platt, selling novelties, veteran license. John Rogan, selling novelties, veteran license. M. Barratt and E. W. Bysshe, Jr., oil well servicing. Mrs. Harrold, parking lot at Northwest corner of 3rd and Walnut Avenue. H. B. Monthly The Clerk read the reports for the month Reports of June, 1958 filed by the department heads of the City. On motion by Terry seconded by Bryant the reports of the department heads for the month of June, 1958, as read by the City Clerk be accepted and ordered filed. Motion carried. `Public Hearing - Mayor Irby announced that 7:45 o'clock P.M. Weed ahatement charges was the time set to hear objections from property owners relative to weed and rubbish abatement charges in accordance with list posted by the Street Superintendent on the second floor of the City Hall adjacent to the Council Chambers. Affidavit of The Clerk read the affidavit of posting Street Supt. report of weed and rubbish abatement charges by the Street Superintendent subscribed and sworn to before the City Clerk on the 1st day of July, 1, 1958, stating that on the lst day of July, 1958, he posted in the hall on the second floor of the City Hall adjacent to the Council Chamber, a list of weed and rubbish abatement charges for the year 1958, said list being a partial list of charges, to be confirmed by the City Council at their meeting on July 7, 1958 at 7:45 P. M. and that at the above mentioned date and time the City Council will hear any objections from the property owners which are assessed for weed and rubbish abatement charges. 2. 461 Page #3 Minutes - Monday, July 7, 1958 Mayor Irby,- Mayor Irby asked if any property owners present wished to make objections to charges for weed and rubbish abatement as appears on the list posted. Hearing Closed There being no objections raised from any property owners present, Mayor Irby declared the hearing closed. Weed Charges On motion by Waite seconded by Bryant the confirmed charges for weed and rubbish abatement as included in the list as posted by the Street Superintendent being a partial list of charges for weed and rubbish abatement charges for the year 1958, be confirmed and approved, and that all charges as listed and not paid by the property owners in the time provided by State Code requirements, be certified to the County Auditor, to be included as a lien, on the assessment roll for the year 1958-1959. Motion carried. Petition -cleaning Mayor Irby referred to the Street Super - of storm drain - Speer Street intendent for study and report the petition of property owners living in the vicinity of Speer Street requesting that the City Council order the storm drain in the vicinity of Speer Street be cleaned, as the condition of this stopped up drain has caused considerable damage. Bill Hattig On motion by Waite seconded by Lambert the offer to purchase lots rejected offer of Bill L. Hattig, in the amount of $3,705.00 for tax title lots 21 and 22, Block 9119 Wesley Park Section, be rejected, and Bill L. Hattig be notified of the rejection. Motion carried. Bill Hattig The Clerk read the offer of Bill & Helen offer to purchase tax title lots Hattig on tax title lots 19 and 20, Block 913, Wesley Park Tract, in the amount of $3,850.00, and ordered to apply the Cashier's Check on deposit with the City as a deposit on the bid should the bid be accept- ed by the City Council. 3. 462 Pa ,e �#4 i "inutes — Monday, July 7, 1958 Karl. Kandler offer Karl Kandler, 17313 Nichols Street, appeared to purchase tp.x title lots before the City Council and stated that he desired to make a bid on Lots 19 and 200 Block 913, Wesley Park Tract, and offered $4,000.00. Cjj� Attorney_ City Attorney Bauer stated that for Mr. Kandler's information that the lots would be sold without mineral rights, and without right of surface entry and subject to all covenants, restrictions and reser- vations, and liens of record. Tax Title hots Mayor Irby declared Lots 19 and 209 Block sold to Karl Kandler 913, Wesley Park Tract sold to Karl Kandler for the amount of $49000.00 subject to reservation of mineral rights and without right of Surface entry and subject to all covenants, restrictions and reser- vations, and liens of record. City Attorney to On motion by Terry seconded by Waite the prepare deed for sale of lots to City Attorney be instructed to prepare the Karl Kandler "! necessary deed for the sale of Lots 19 and 20, Block 913, Wesley Park Tract, to Karl Kandler and said deed subject to reservation of the mineral rights and without right /subject to all of Surface entry, and covenants, restrictions, and reservations and liens of record, and the Mayor and the City Clerk be author- ized to execute the Deed on behalf of the City of Huntington Beach. Motion carried. Karl Kandler Karl Kandler deposited with the City Clerk deFW3it the amount of $500.00 as a deposit on the purchase of Lots 19 and 20, Block 913, Wesley Park Tract. Offer of Bill On motion by Bryant seconded by Terry the Hattig to purch- ase lots re- bid of Bill and Helen Hattig for Dote 19 jetted and 20, Block 913, Wesley Park Tract in the amount of $3,850.00 be rejected and the Clerk be instructed to notify Bill and Helen Hattig of the bid rejection and instructed 4. 4621 Page #5 Minutes - Monday, July 7, 1958 to return the Cashier's Check in the amount of $400.00 that had been deposited with the City of Huntington Beach on the prior bid on Lots 21 and 229 Block .911, Wesley Park Tract. Motion carried.. Lois A. Kitts On motion by Bryant seconded by Lambert Deputy City Collector the request of Wm. M. Clegg, City Collector, for permission to appoint Lois A. Kitts, Deputy City Collector, in accordance with Section 1434.1 of the Huntington Beach Ordinance Code, be approved. Motion carried. Building Inspector to take vacation On motion by Lambert seconded by Bryant the request of Norman Wells, Building Inspector, to take his annual vacation beginning on -Monday July 21, 1958, be approved. Motion carried. Sec -Planning Commission -to take vacation On motion by Terry seconded by Bryant, in accordance with request of the Planning Commission of the City of Huntington Beach, to allow the Secretary to take a portion of his accrued vacation starting on July 21st to July 25th, 1958, be approved. Motion carried. Claim against City The Clerk read a claim against the City of filed by Pearl Fowler Huntington Beach filed by Kinkle and Kinkle, Attorneys, for $50,000.00 against the City for personal injuries sustained by Linda Fowler while playing in and about the public beach fronting the Huntington Beach Municipal Trailer Park, and said injuries resulted from the negligent manner in which the City of Huntington Beach main- tained said beach, and the swimming area adjacent thereto, and said 41aim against the City of Huntington Beach signed by Pearl Fowler father of the injured. Fowler claim On motion by Terry seconded by Bryant that denied in accordance with the recommendation of the 5. 464 Page #6 Minutes - Monday, July 7, 1958 City Attorney the claim against the City of Huntington Beach signed by Pearl Fowler and filed by Kinkle and Kinkle, Attorneys of Los Angeles, be denied, and the claim be referred to the City Attorney of the City of Huntington Beach, and the insurance carrier for the City of Huntington Beach. Motion carried. Demands On motion by Bryant seconded by Terry the demands as approved by the Finance Committee be ordered paid. Motion carried. Or.Co-Music,Tnc. The Clerk read a request from the Orange request for change in lic- County Music, Inc., requesting the City ense fee Council to give consideration to change the license fee on record playing machines as the present fee under the City license ordinance is prohibitive and uneconomical for further operation, and stated that they have but two alternat- ives if no changes are made in the fee -- 1. Remove the machines from the various places in which they have been placed, or - 2. Sell the machines to the various proprietors and let them operate them under the business license they are now paying. Request for Mayor Irby referred the request of the chanY;e in license fees Orange County Music, Inc., for consideration referred to Police Committee of license fee changes for record playing machines to the Police Committee for study and report. Oscar Stricklin- Oscar Stricklin, 17292 Goldenwest Avenue, objections to CP 105 appeared before the City Council and stated that he was speaking on behalf of the property owners in the general area and that some of them were present at this meeting referring to Mr. Slater, Mr. Star, Mr. Tubach, Mr. Beem, and others not present such as Mr. John Murdy Jr., and Lon Peek, and stated that he himself and the gentlemen referred to want it understood that they do not want to take a stand that may retard the growth of the City, and 6. 465 Pae #7 minutes - Monday, July 7, 1958 that they have no objections to the filling of the property as referred to in a petition for conditional permit by Lawrence Kramer on a piece of property in that vicinity and had no obje- ctions if filled with inert materials but not to be used as a general dump in order to accomplich their purpose, and feel that it will be detrimental to all the property contiguous to the proposed dump site, and that the group he represents wish to enter objections to any consideration favoring the granting of Conditional Permit 105. Motion carried. Wilson- On motion by Lambert seconded by Waite the Peterson -term cleanup bond - request of Wilson -Peterson Oil Company for Well #12 termination of the Glens Falls Ins. Company cleanup bond No. 551733 for well #129 located on Lots 22 and 24, Block 210, Huntington Beach Tract, having complied with Section 2448.1 of the Huntington Beach Ordinance Code, and the bonding company and the owner be notified of the bond termination, be approved. lotion carried. 7. 466 Page #6 tilintes - Monday, July 7, 1958 Ord. 692, The Clerk gave Ordinance No. 692, an ordinance parking, 1st reading of the City of Huntington Beach relating to parking and adding Sections 6312, 6312.1 and 6312.2 to the Huntington Beach Ordinance Code, its first reading. Copy of Ord. On motion by Lambert seconded by Bryant the 692 to Division of Highways Clerk be instructed to mail a copy of Ord- inance No. 692 to the State of California Division of Highways, Los Angeles, for an approval of the prov- isions contained in ordinance No. 692. Motion carried. amity Attorney City Attorney Bauer informed the City Council re - Ord. 692 m� that the second reading of Ordinance No. 692 could not be made until consent is received from the Division of Highways.} L.A.County Fair On motion by Bryant seconded by Waite the Assoc.- banners across streets request of the Los Angeles County Fair Assoc- iation to place banners across streets in the City of Huntington Beach and subject to approval of locations by the Street Superintendent and that the firm installing the banners file with the City of Huntington Beach adequate certi- ficates of insurance to assure adequacy of liability insurance, be approved. Reso.Board of The Clerk read the resolution of the Board of Supervisors - Industrial Supervisors of Orange County, California, Road Camp passed and adopted on June 24, 1958, advising the City of Huntington Beach that -it is.the intention of the Board of Supervisors to establish an Industrial Road Camp for the County of Orange and that persons from incorporated cities will be maintained at said camp'for the sum of One Dollar per day per person. Reso.-Engineer's The Clerk read a communication from the Division, Governor's offices of the Governor of the State of Traffic Safety Conference California attaching a resolution of the Engineering Division, Governor's Traffic 8. 4671 Page #9 Minutes - Monday, July 7, 1958 Safety Conference whereby they ask each legislative body of each entity in the State of California to support the engin- eers in a program of cooperative highway planning with other jurisdictions to the end that each proposed highway improve- ment project becomes, first, a part of a local integrated system, and secondly, a part of an over-all integrated system. Pedestriali On motion by Bryant seconded by Lambert the Crossing - Gothard & City Engineer be instructed to paint pedest-- Wintersburg rian crossing at the intersection of Gothard and Wintersburg Road. Motion carried. City Employees On motion by Terry seconded by Bryant, in CPS 21a.n denied accordance with the recommendation of the Finance Committee the request of the City Employees Association for the City to pay the CPS family plan rate for the employees bedenied. Motion carried. City Employees On motion by Terry seconded by Waite, in SERS amendment denied accordance with the recommendation of the Finance Committee, the request of the Police and Fire Personnel, to request the City Council to consider the amendment to the State Retirement oontract to retire safety members at the age of 50, be denied. Motion carried. Leo Farwell - The Street Superintendent, Wm. Lewis, re - weed charges ported to the City Council that the weed charge objection filed by Leo Farwell has been straightened out to the satisfaction of Mr. Farwell and that he has agreed to pay the charges. Weed abatement On motion by Terry seconded by Bryant the charges approved weed and rubbish abatement charges as posted by the Street Superintendent which included the charges on Leo Farwell's property, Lot 8, Block.713, Wesley Park Tract, be approved and if not paid by the property owner in the time stipulated by the State Code requirements the City Clerk be • 10. 469 Page #11 Minutes - Monday, July 7, 1958 instructed to certify the charges to the County Auditor for inclusion on the 1958-59 assessment roll. Motion carried. Lucille Allaire Mayor Irby recommended Mrs. Lucille Allaire appointed to. LibraU Board to fill the vacancy caused by the resignation of Mrs. Vavra to the Library Board. On motion by Waite seconded by Lambert the appointment of Lucille Allaire to the Library Board to succeed Mrs. Vavra be confirmed'and approved. Motion carried.
