M. Councilmen present: Lambert, Bryant, Waite, Irby. Councilmen absent: Terry. (Councilman Terry arrived at 8:30 o'clock P. M. Minutes On motion by Waite seconded by Bryant the minutes for the meeting of August 4th and August 18th, 1958, as transcribed and mailed by the clerk be accepted and ordered filed. Motion carried. Monthly_ Reports The Clerk read the reports filed by the Depart— ment Heads for the month of August, 1958. On motion by Bryant seconded by Lambert the reports of the Department Heads as read by the City Clerk, for the — month of August, 1958, be accepted and ordered filed. Motion carried. Business On motion by Lambert seconded by Waite the Licenses applications for license to conduct business in the City of Huntington Beach, and as approved by the Health Officer, Building Inspector, Chief of Police, and Fire Chief, were granted as follows: .Mitts Electric, 3344 W. 118th Place, Inglewood, electrical contractor. -Edward G. Reeser, retail meat market, at 327 -- 11th Street, transfer from Clifford Ozbun. C. T. Audry, Goldenwest Auto Wrecking and Salvage, 18470 Goldenwest Ave. Fae Felegy, lunch place at 17712 Huntington Beach Blvd. The Clerk gave the first reading of Ordinance No. 694, an ordinance of the City of Huntington Beach creating class titles and setting forth the number of employees by adding new sections to the Huntington Beach Ordinance Code and by amending certain sections 17 Page #2 - Minutes, September 2, 1958 thereof. Quincy Oils LTD - The Clerk read a report filed by Wm. S. Cleanup Require- ments not met Lewis, Assistant City Engineer, appointing out to the City Council that on May 22, 1958, the Quincy Oils Limited was notified that the leases covering the cleanup bonds of the Pacific Employers Insurance Company of Los Angeles No. O1-B-57915 and No. O1-B-57952 for oil well Permit No. 242 and No. 261, issued on November 18, 1957, and February 6, 1958, for the Quincy -Newland #1 well and Quincy -Newland #2 well, respectively, had not been cleaned up in accordance with requirements of the Huntington Beach Ordinance Cade, and that on June 12, 1958, the Pacific Employers Insurance Company of Los Angeles, who is the bonding Company were notified by registered mail of the conditions which exist on the -above mentioned leases, and that there has been no work done in regards to cleanup of the leases to date. On motion by Bryant seconded by Lambert, the City Clerk be instructed to notify the Pacific Employers Insurance Company of Los Angeles relative to the condition of oil leases operated by the Quincy Oils Limited covering clean- up bonds #01-B-57915.and #01-B-57952 and request the bonding company to take the necessary steps for the cleanup of the leases in accordance with the provisions of the Huntington Beach Ordinance Code and bonds on file, be approved, Motion carried. Rogan Harrell Mayor Irby recommended to the City Council on Recreation Commission the appointment of Rogan Harrell to fill the vacancy on the Recreation Commission of the City of Huntington Beach. On motion by Bryant seconded by Lambert the recommendations of Mayor Irby to appo,int Rogan Harrell to fill the vacancy on the Recreation Commission Board be con -- firmed and approved. Motion carried. 2. Mr Page #3 - Brutes, September 2, 1958 Mitts Electric Co. On motion by Bryant seconded by Waite the Elect. Contractor Bond. Columbia Casualty Company surety bond No.84386 for Chester E. Mitts as principal, dba Mitts Electric, and as approved by the City Attorney, be accepted and ordered filed. Motion carried. A. L. Sisler - On motion by Waite seconded by Bryant the Elect. Contractor Bond. License Bond of The Travelers Indemnity Company of Hartford, Commecticut No. 730598, for A. L. Sisler, as principal, and approved for form by the City Attorney, be accepted and ordered filed. Motion carried. George Potts - Mayor Irby referred to the Beach and Parks Sportfisuing Boats Committee for study and report the request of George D. Potts, 16962 - 9th Street, Sunset Beach, California, requesting a concession for the operation of a sport - fishing enterprise off the Huntington Beach pier landing. Planning Commission Mayor Irby referred the request of the Huntington request to attend League of Cities. Beach Planning Commission members to permit the attendance of four members to attend the annual California League of Cities Convention with expenses for the three meeting days and travel expense, to the Finance Committee for study and report. Public Auction- At 8:00 o'clock P. M. Mayor Irby announced the Sale of Tax Title Lots sale of real property at public auction, and requested the Clerk to read the legal notice. The Clerk read the legal notice published in the Huntington Beach News August 14th and August 21st, 1958, covering notice of sale of real property at public auction to be held in the Council Chamber, City Hall, City of Huntington Beach, on the 2nd day of September, 1958, at the hour of 8:00 o'clock P. M., or as soon as thereafter as said sale can be held, and outlined the procedures and terms of the sale. Written Bids Received The Clerk reported to the City Council that the followin; written bids had been received: Parcel No. 5 - Lots 5 and 6, Block 913, of Wesley Park Section, a 3. Page #4 -Minutes, September 2, 1958 bid of $4,000.00 from George Cottingham of Westminster, Calif- ornia, with a bid deposit of a certified check in the amount of $400.00. Parcel No. 2 - Lots 12 and 139 Block 202, Vista Del Mar Tract, a bid of $3,001.00, with a Cashier's check as bid deposit for $575.20 to cover bid on Parcel No. 20 and Parcel No. 3. Parcel No. 2 - Lots 12 and 13, Block 202, Vista -Del Mar Tract, from George S. Shaw, Lakewood, California, in the amount of $3,405.00, with a Cashier's Check in the amount of $1,000.00 covering bid on Parcel No. 2, 3, and 4. Parcel No. 3 - Lots 1 and 2, Block 1103, Vista Del Boar Tract, a bid from George S. Shaw; in the amount of $3,205.00. Parcel No. 3 - Lots 1 and 2, Block 11039 Vista Del Mar Tract, from Donald E. Goodell, in the amount of $2,751.00. Parcel No. 4 - Lots 9 and 10, Block 1103, Vista Del Mar Tract, a bid from George S. Shaw, in the amount of $39205.00. Oral Bids Mayor Irby announced that oral bids will Accepted be accepted from the floor and the first oral bids must be 10% above that of a written bid filed and subsequent bids must be in multiples of $5.00 each. Parcel No. 1 Mayor Irby opened the bidding on Parcel Withdrawn No. 1, covering Lots 2 and 4, Block 215, Huntington Beach Tract, there being no written bids received or oral bids made Parcel No. 1 was ordered withdrawn from sale. Mayor Irby opened the bidding on Parcel No. 2, Lots 12 and 13, Block 202, Vista Del Mar Tract, Donald E. Goodell, bid $3,745.00 for Parcel No. 2, and Mayor Irby declared the parcel sold to Donald E. Goodell. Parcel No. 2 sold On motion by Waite seconded by Bryant to Donald Goodell Parcel No. 2, Lots 12 and 13, Block 202, Vista Del Mar Tract, be sold to the highest bidder Donald E. Goodell, an individual and a single man, for the amount of $39745.00 and the City Attorney be instructed to prepare the 4. NOES: Councilmen: None. ABSENT: Councilmen: Terry. Mayor Irby opened the bidding on Parcel No. 3, Lots 1 and 2. Block 1103, Vista Del Mar Tract, Section 11 a high bid of $3,205.00 was bid by George S. Shaw, there being no further bidding Mayor Irby declared Parcel No. 3 sold to George S. Shaw of 3740 Centralia Avenue, Lakewood, California, a married man. Parcel No. 3 On motion by Bryant seconded by Lambert that sold to George S. Shaw Parcel No. 3, covering Lots 1 and 2, Block 1103, Vista Del Mar Tract, be sold to George S. Shaw, a married ma49 for the sum of $3,205.009 and the City Attorney be instructed to draw up the necessary deed and order the policy of title and the Mayor and the City Clerk be authorized to execute the deed, and the deed and the policy of title be delivered to the purchaser within thirty days of purchase subject to balance of bid purchase price be deposited with the City Treasurer, was approved by the following roll call vote: AYES: Councilmen: Lambert, Bryant, Waite, Irby. NOES: Councilmen: None. ABSENT: Councilmen: Terry. Mayor Irby opened the bidding on Parcel No. 49 covering Lots 9 and 10, Block 1103, Vista Del Mar Tract. There being no oral bids forthcoming Mayor Irby declared Parcel No. 4 sold to George S. Shaw for the amount of the written bid in the amount of $3,205.00. Parcel No. 4 sold On motion by Bryant seconded by Lambert that to George S. Shaw, a married man, and the City Attorney be instructed to draw up the neces- sary deed and order the policy of title and the Mayor and the City Clerk be authorized to execute the deed, and the deed and the policy of title be delivered to the purchaser within thirty days of purchase subject to depositing with the City Treasurer the balance due, was approved by the following roll call vote: AYES: Councilmen: Lambert, Bryant, Waite, Irby. NOES: Councilmen: None. ABSENT: Councilmen: Terry. Mayor Irby opened the biding for Parcel No. 5, covering Lots 5 and 69 Block 913, Wesley park Section. There being no oral bids forthcoming Mayor Irby declared Parcel No. 5 sold to George W. Cottingham and Mildred L. Cottingham, husband and wife, as joint tenants., for the written bid of $4,000.00. Parcel No. 5 sold On motion by Bryant seconded by Waite to George Cottingham. Parcel No. 5, Lots 5 and 6, Block 913, Wesley Park Section, be sold to George W. Cottingham and Mildred L. Cottingham, husband and wife as joint tenants, in the amount of $4,000.00, and the City Attorney be instructed to draw up the necessary deed and the policy of title, and the Mayor and the City Clerk be author- ized to execute the deed, and the deed and policy of title be delivered to the purchaser within thirty days from date of purchase subject to payment to the City Treasurer the balance due, was approved by the following roll call vote: AYES: Councilmen: Lambert, Bryant, Waite, Irby. NOES: Councilmen: None. ABSENT: Councilmen: Terry. Lyndon Wells Re: Lyndon A. Wells, appeared before the City Off -Street Parxing Council and request the City Attorney to read a portion or paragraph of the petition being circulated for the off-street parking. Clifford Truxel Clifford Truxel, a resident of the City of Hunt - Re: Trash Collection ington Beach appeared before the City Council and stated that he was opposed to the present consideration to contract out the trash and refuse in the City of Huntington Beach, as he and other neighbors in his area were quite satisfied with the present service.° Councilman Terry Councilman Terry arrived at 8:30 o'clock P. M. Arrived. -Letters protesting Trash Letters were filed with the City Clerk pro - Contract testing the City contracting for trash and refuse collection in the City of Huntington Beach, as follows: Lena Mae Wallace, 703-1 Huntington Avenue. H. B. Mrs. Dallas Carter, 701 Huntington Avenue, H.'B. Mrs. Edythe Thompson, 202 Geneva Street, H. B. David Baker Request David L. Baker of Garden Grove appeared before To Lease City Acreage. the City Council and stated his desire to lease the acreage owned by the City adjacent to Highway #39 and #101 for the purpose of developing a trailer park. It was explained to David Baker that the amount of acreage the City will have left after the proposed development of interchange along Highway #101 adjacent to Highway #39, was undetermined at this time. Proposed Freeway Mayor Irby referred,to the Assistant City Eng- H. B. Blvd. ineer James Wheeler, the proposed design cover- ing the proposed freeway between Huntington Avenue and Huntington Beach Boulevard, on the City's property, and the interchange at Wright Street for further study. Garrish Bros. Mayor Irby referred to the Streets and Parks Committee and Building Committee for study and report the request of Garrish Bros. for the purchase of the present site leased from the City for a consideration of S4,000.00. License Bond 0n motion by Lambert seconded by 'Waite, the Provisions_Repealed City Attorney be instructed to prepare the 7• .3 Page #8 - Minutes, September 2, 1956 necessary ordinance to repeal Section 82429 Chapter 82, and Section 8463: Chapter 84, covering bond provisions in the Huntington Beach Electrical and Plumbing Code, as requested by Norman 'Wells the Building Safety Director. Motion carried. Co. Tax Collector- On motion by Terry seconded by Bryant the T. C. Sale #864 City of Huntington Beach inform the County Tax Collector that the City gives consent to the sale of T. C. Sale #864, Covering undivided interests in the West 30 feet in Block 1401, T. J. Watsons Resubdivision, and does not object to the sale. Lotion carried. Trash Collection The Clerk read the offer of Kenneth C. Price Contract Proposals Price & Rainbow to give semi -weekly trash collection in the Disposal area in the City of Huntington Beach which existed prior to August 1, 1957, at a price of S.95 per unit, and the Clerk read the proposal of Rainbow Disposal Company offering to gave trash and garbage collection twice weekly in all residential areas in the entire City of Huntington Beach and daily trash and garbage service to the commercial districts excluding Sunday, at a unit price of $1.40 per unit. Contract for Trash On motion by Bryant seconded by Lambert Collection awarded to Rainbow Disposal the City Attorney be instructed to prepare a contract agreement between the City of Huntington Beach.the Rainbow Disposal Company for trash and garbage collection in the City of Huntington Beach in accordance with proposal submitted to the City Council by the Rainbow Disposal Company. Motion approved by the following roll call vote: AYES: Councilmen: Lambert, Bryant, Waite. NOES: Councilmen: Terry, Irby. ABSENT: Councilmen: None. Demands On motion by Waite seconded by Bryant the demands as approved by the Finance Committee be ordered paid. Motion carried. 8. 24 Paae #9 — Minutes, September 2, 1958 Boy Scouts to use On motion by Terry seconded by Waite the Lake Park request of Paul G. Love, Institutional Repre— sentative of the Boy Scout Troop #117, for permission to use the fake Park area for an over night camp on September 27th and 28th, 1958, in conjunction with a 50 mile bicycle trip to complete.the requirements for the Cycling Merit Badge which six of the boys have been working on all summer, be approved. Motion carried. Req-west for Mayor Irby referred the request of Ben Dulaney, Position of Assistant Chief Chief of Police, for the creation of the pos— of Police ition of Assistant Chief of Police, to the Police and Fire Committee for study and report. Request for 2 On motion by Lambert seconded by Waite in new Police Cars accordance with the request of Ben Dulaney, Chief of Police, the City Purchasing Agent be authorized to obtain informal bids for the purchase of two new Police Cars and to trade in Car #452, 1957 Plymouth 4—Door, Sedan, be approved. Motion carried. Purchase of Truck On motion by Lambert seconded by Waite in & Trailer for /request of Wm. S. Lewis, Street Dept. accordance with the Street Superintendent, the City Purchasing Agent be authorized to purchase one used Studebaker truck and Fruehauf tilt bed trailer, and to obtain informal bids for the furnishing one new -J ton pickup truck and to trade in the present 1950 Chevrolet z ton pickup, and to re— build the present beach rake at an approximate cost of $200.00, be approved. Motion carried. Fire Chief to On motion by Bryant seconded by Waite request attend Conference of D. G. Higgins, Fire Chief, for permission to attend the Joint Meeting of the International Fire Chiefs and Pacific Coast Intermountain Fire Chiefs conference to be held in Los Angeles, September 14 to 19th, 1958, and reasonable expensis be allowed, be approved. Motion carried. Motion carried. Main Street Mayor Irby referred the Main Street impr- Improvement ovement project to the Streets and Parks Committee and the City Engineer for further study and report. Hamilton & On motion by Bryant seconded by Waite, Bushard Streets Improvement the City Engineer be instructed to include in specifications of the Hamilton and Bushard improvement, the Atlanta Avenue improvement to Highway #39 and Bushard Avenue, be approved. Motion carried. Revision of Water On motion by Bryant seconded by Lambert Lines - Beach Front the Street Superintendent be instructed to proceed with the revision of water lines serving the facil- ities on the Beach ]Pront, in order to correct the present deficiencies as outlined by the Street Superintendent, be approved.
