Commissioners Absent: None. Minutes: On motion by Liles and seconded by Stang, the minutes of the Huntington Beach Planning Commission of Tuesday, September 16th, 1958, as transcribed and mailed by the Sec- retary were accepted as mailed. USE VARIANCE: UV 129 A petition was submitted by the .Applicant - A. D. Sellers applicant requesting a variance to allow polry production to operate in variance to Land Use Ord No 351 as adopted by Interim Ord 668. Located on approximately one acre 500 ft south of Slater Avenue on the west side of Newland Street and legally described as the W 265.98 ft of E 511.84 ft of S 160 ft of NE 4 of NE j of SW -j of SEC 25, T.5.S., R.11.W., SBB&M. A public hearing was held open to the audience: A. D. Sellers, 17601 Newland Street, Huntington Beach, California, questioned the three year time limit recommended in the Secretary's report. It was explained that only the one acre would be affected and not the existing property. The Planning Commission determined that the existing R-4 Reslcisti;al zoning was A-1-62Cenaral A cowl-tura3 Districting, and that the area was being proposed for RA Residential Agricultural use. It was further determined that the applicant only holds a three year lease on the proposed property. A MOTION WAS MADE BY DAVIS AND SECONDED BY LILES TO RECOMMEND APPROVAL WITH THE FOLLOWING CONDITIONS: 47 Page 2. blinutes - H. B. Planning Commission Tuesday, October 7th, 1958 TIME LIMIT 1. This variance shall permit the use of polry production to operate on the described property for a period of only three years. REMOVAL OF FERTILIZER 2. There shall be no storage or curing of chicken droppings and fertilizer in commercial quantities on the premises, except those waste products which are accumulated during normal operations and which are periodically removed from the premises. ROLL CALL VOTE: AYES: ttl6s, Davis, Schryer, Bazil, Stang, Presson, Bork. NOES: None. ABSENT: None. THE MOTION CARRIED. MASTER PLAN OF The Plan as prepared and presented by PARRS AND RECREATION the consulting firm of Hahn Wise & Barber, was reviewed for the Planning Commission by the Secretary. There were no changes proposed. . PUBLIC HEARING: The Chairman opened the public hearing to the audience. There was no comment, the hearing was closed. The next.public hearing date was set for November.4th, 1958. Two public hearings held for a master plan are required by law before the Planning Commission takes final action. MASTER PLAN OF PUBLIC BUILDINGS: The Plan as prepared and presented by the consulting firm of Hahn, Wise & Barber, was reviewed for the Planning Commission, along.with two civic center alternate plans prepared by the Planning Department. PUBLIC HEARING: The Chairman opened the public hearing to the audience. There was no comment, the hearing was closed. The next public hearing date was set for November 4th, 1958. TENTATIVE APPROVAL OF ALTERNATE PLAN: The Planning Commission indicated approval of the baste Hahn, Wise & Barber study which outlined requirements for civic buildings -in the future, however the -Civic Center analysis resulting -in a proposed O Page 3. Minutes- H. B. Planning Commission Tuesday, October 7th, 1958 civic center plan did not meet with approval in its entirety. The proposed civic center addition to be located westerly of Sixth Street was classed as contrary to present Planning Commission philosophy, and alternate plan were submitted for scrutiny as was requested. The Planning Commission voiced their approval of a third civic center alternate whereby the fire station would be relocated to a site not within the civic center. The police Department would occupy a building at the present fire station building site. The future municipal court would be located easterly of Fifth Street in the event it was sanctioned by both city and county authority. The present city hall would be replaced by a modern single story structure on the same site. Commissioner Schryer questioned the feasibility of remov- ing.the present city hall building in view of the Chamber of Commerce civic center report. .The Planning Director replied that to his best knowledge, the present structure has been declared basically unsound, leaving no perogative, except event- ual removal. The Chairman, a building contractor, concurred in the opinion that the present building will have to be oondemned in a few years. RESOLUTION 51,A FIRE STATION SITE: In view of the fact that either alternate plan would require the acquisition of another fire station site, the Commission deliberated the plausibility of.acquiring a site at the SE corner of Frankfort Street and Lake Street as recommended by the Fire Chief and the Planning Department. Following a discussion, it was ascertained that the proposed site is presently available and would hake an ideal location. Because -time is of the essence, it was decided that immediate and forthcoming action to acquire a fire station site would be necessary prior to adoption of the Master Plan of Public Buildings. ROLL CALL VOTE: Resolution No 51 AYES: Liles, Davis, Schryer, Bazil, Stang, Presson, Sork. NOES: None. ABSENT: None. REVIEW SUBDIVISION CODE REVISION: Six revisions to the subdivision code were proposed by the Planning and Engineering Department staff for Planning Commission Study. Several revisions pertained to street widths; one pertained to removing a contradiction to the Zoning Ordinance, and the 6th revision was an addition of recreation and park fees per lot in new subdivisions. Tentatively, a unanamous opinion was arrived at, and a first public hearing was set for November 4th, 1958. DIVISION OF LAND: DV 113 Located at the SE corner of Applicant - Everett R. Thrower . smeltzer Avenue and Bolsa Street .( near to Garfield Avenue ) and legally described as follows: Division I: The west 100 ft of Lot 18, Blk "E", Garfield Street Addition Tract. Division II: The east 80 ft of the west 180 ft of Lo-t 18, Blk "E", Garfield Street Addition Tract. Division III: The east 60 ft of the west 240 ft Lot 18, Blk "E", Garfield Street Addition Tract. Division IV: The east 60 ft of Lot 189 Blk "E", Garfield Street Addition Tract. A MOTION WAS MADE BY LILES AND SECONDED BY SCHRYER TO RECOMMEND APPROVAL WITH THE FOLLOWING CONDITION: DEDICATION OF R/W. Steuart west of Hwy 39 on the south side of Liberty Street and legally described as follows: Division I: The west 46 ft of the N of Lot 18, Tract 411. Division II: The east 86-ft of the N of Lot 18, Tract 411. ON MOTION BY LILES AND SECONDED -BY STANG, DIVISION OF LAND DV 114 WAS RECOMMENDED FOR APPROVAL. THE MOTION WAS CARRIED. TENTATIVE TRACT MAP 2558: On the basis of study from previous meeting and with due consideration to the general public and the applicant, A MOTION WAS MADE BY PRESSON AND SECONDED BY LILES TO RECOMMEND APPROVAL WITH THE FOLLOWING CONDITIONS: 1. Proposed Lisa Street shall have a 60 feet right-of-way with 36 feet of pavement. 2. Proposed Lisa Street shall be extended to a dead end -at the south boundary of said proposed tract with proper street end barriers to'be furnished by the sub -divider in accordance to the City Engineer's specifications. 3. All Street intersection radii shall be in accordance with - the subdivision code.' XIJ 4. All street drainage slopes shall be less than 0.2% in grade, unless otherwise approved by the City Engineer. 5. "D" Street as indicated on tentative map shall be named Taylor Avenue. 6. "A", "B", "C", Streets shall be given other names and which will be called Circles. 7. Lots 16, 30, 39, 409 49, 50, 59, 63, and 79 shall be an average minimum width of 70 feet, 8. Sidewalks shall be required on both sides of all streets, including Cul-de-Sacs, in accordance with City Engineer's specifications. 9• All fill to be compacted to 90% relative denisity. 10. Street lighting, street signs, and street lighting shall be furnished by the sub -divider, in accordance to the City Engineer's specifications. 51 Page 6. Minutes - H. B. RECONSIDERATION OF CONDITIONS At the request of the applicant, FOR UV 125 - Walter Miller The Planning Commission was asked for further consideration concerning the possible removal of the variance conditions. The applicant specific- ally protested the condition requiring a 50 ft setback, the prohibition of new boat construction, and the prohibition of excessive nusiance created by boat repairing. NO POSITIVE ACTION WAS TAKEN BY THE PLANNING COMMISSION. ENFORCEMENT OF PREVIOUSLY GRANTED VARIANCE CONDITIONS: Upon the submission of a report by the Planning Department, A MOTION WAS MADE BY STANG AND SECONDED BY DAVIS RECOMMENDING A MEMORANDUM BE DIRECTED TO THE CITY.COUNCIL REQUESTING ENFORCEMENT BY BUILDING AND POLICE DEPARTMENT OFFICIALS OF CONDITIONS OF THE FOLLOWING VARIANCES: USE VARIANCE UV 84 - John R.
