Commissioners Absent: None. Minutes: On motion by Schryer and seconded by Davis, the Minutes of the Huntington Beach Planning Commission of Tuesday, January 6th, 1959, as transcribed and mailed by the Secretary were accepted as mailed. Use Variance UV 7#139 To permit one 4' x 16' sign and Applicant - A. L. Best four 4' x 4' signs to be constructed along Highway 101A on private property as an addition to existing retail food market in an R-1 Zoning District located approximately 400 feet Southwest of State Highway #39 along the northerly side of Pacific Coast Highway 101A., by allowing exceptions to Article 931. Street address - 21692 Pacific Coast Highway. A motion was made by Sork and seconded by Davis to RECOMY1 END APPROVAL OF UV #139 WITH THE FOLLOWING CONDITIONS: PERMANENT MATERIALS 1. All signs shall be constructed of permanent materials consisting of painted plywood or similar materials, not to include paper signs. CANCELLATION CLAUSE 2. The 41.x'16' sign shall be granted as permanent. The 4' x 4' signs shall be granted as temporary signs and shall be removed upon 30 day written notice by the City Council in accordance with a 30 day cancel- lation clause. Division of band DV #119 The applicant requested a Applicant - Leslie Potts - 602 Yorktovm single parcel to be split Street, Huntington Beach into four parcels. The lots are located at the southeast corner of England and York- town Streets and are legally described as follows: DIVISION I: The S 60' of N 120' of E 125' of W 155' of Block 2406, East Side Villa Tract. A motion was made by Schryer and seconded by Liles to RECOMMEND APPROVAL OF DV #119 WITHOUT CONDITIONS: The requirement for posting bonds for curbs'and gutters has been waived because they have been previously installed in accordance to City Engineer's specifications. A motion was made by Schryer and seconded by Liles to RECOMMEND APPROVAL WITH THE FOLLOWING COND- ITIONS: DEDICATION AND IMPROVEMENTS OF R/W 1. The applicant'shall dedicate and improve the S 10' of the E 53.5' of Lot 1, Tract 528. CURBS AND GUTTERS 2. The installation of curbs and gutters shall be assured by the posting of $1358.00 cash bond with the City Clerk on the basis of $2.00 per running foot, provided that the City Engineer shall waive that portion of the required bond where there are existing curbs and gutters existing in accordance with City Engineer's specifications or where the City Engineer may certify those portions deemed impractical for construction of curbs and gutters. The cash bond shall be redeemed if the applicant constructs curbs and gutters along the frontage of his lots according to city standards within the specified period. The cash bond shall forfeited and the City Engineer shall order the required construction accomplished at no additional expense to the applicant, in the event the curbs and gutters are not constructed within 120 days after the City Engineer has officially notified the applicant of establishment of grades and elevations. ROLL CALL VOTE: AYES: Liles, Davis, Schryer, Bazil, Presson, Stang, Sork. NOES: None. ABSENT: None. THE TOOT ION CARRIED. Review of Chairman Bazil requested the Secretary Use Variance for Orange County to report on his interview with Ceramic Tile Co. Mr. C. L. Sturgeon, Manager of the Tile_Company located at the NE corner of Frankfort and Alabama Streets. The Secretary -reported that the firm had rented a,once vacant lot on the SW corner of Frankfort and Alabama Streets, which effectively parked 10 cars. 3. 102 Page #4 Minutes - H. B. Planning Commission Tuesday, January 20th, 1959 However the rented lot has since been built, upon. The Secretary asked the Manager if they had made efforts to acquire another off-street parking site. The reply was that the firm had attempted unsucessfully to make arrangements to park cars on nearby lots. Condition No 1. of the variance was discussed at length. The condition read: 1. To provide and utilize off-street parking: The consensus of the Commission was that since the applicant had originally complied with the off-street parking re- quirement, there was then established the fact the firm acknowledged and accepted the intent of the condition and was therefore -now in violation of condition No 1. because adequate off-street parking was not now being provided. A motion was made by Davis and seconded by Stang instructing the Secretary to transmit the facts of the case and the opinion of the Planning Commission that the applicant is in violation of Condition No 1. and that therefore the action to be taken shall be at the discretion of the City Council. ROLL CALL VOTE: AYES: Liles, Davis, Schryer, Bazil, Presson, Stang, Sork. NOES: None. ABSENT: None. THE LOTION CARRIED. Late Protestant: Richard Wilson, 608 Olive Street, representative of Osage Oil Co., addressed the Commission and -protested the proposed zoning ..on the 60 acres located at the SW corner of Atlanta and Highway #39. Planning Commission Tuesday, January 20th, 1959 the matter was out of the Commission hands and that it b would at the discretion of the City Council to make changes of proposed zoning at the City Council public hearing to be heard on February 2nd for the newly proposed master zoning ordinance.
