Mayor Irby called the regular meeting of
the City Council of the City of Huntington Beach to order at
7:30 o'clock P. M.
Councilmen Present: Bryant, Lambert, Waite, Irby.
Councilmen Absent: Terry. (Councilman Terry arrived at
8:00 p.m.)
Minutes On motion by Bryant seconded by Waite the
minutes for the Council meetings of January
the 5th and January the 19th, 1959, as transcribed and mailed by
the City Clerk be accepted and approved. Motion carried.
yonthly.Repo_rts The Clerk read the reports filed by the
Department Heads for the month of January,1959.
On motion by Bryant seconded by Lambert the
reports of the Department Heads for the month of January, 19599
as read by the City Clerk be received and ordered filed.

relative to Use Variance #139, petitioner being A. L. Best, of
Corona Del Mar, Calif.,'requesting to allow one 4' x 16' sign
and four 4' x 4' signs to be constructed along Highway 101 A
on private property as an addition to existing retail food
market in an R-1 Zoning District, the location being approk-
imately 400 ft. Southwest of State Highway 39 along the north-
erly side of Pacific Coast Highway 101 A by allowing exceptions

Pursuant to the Conservation and Planning law of the State
Government Code, a public hearing was helf on January 20th,
1959 by the City Planning Commission, following'the required
legal public notice. After due consideration given to the
petitioner and the general public, the following recommendation
was made by the Planning Commission. A Motion was made by
Sork and seconded by Davis to recommend approval of UV #139
with the following conditions:
PE.RUNENT MATERIALS
1. All signs shall be constructed of permanent materials
consisting of painted plywood or similar materials, not
to include paper signs.
CANCELLATION CLAUSE
2. The 4' x 16' sign shall be granted as permanent. The 4' x
4' signs shall be granted as temporary signs and shall be
removed upon 30 day written notice by the City Council in
accordance with a 30 day cancellation clause.

by Liles to recommend approval without conditions, the re-
quirement for posting bonds for curbs and gutters has been
waived because they have previously been installed in accordance
to the City Engineer's specifications, motion carried by the

by the Planning Commission, after legal public notice was
properly given prior to the hearing. After due consideration
given to the petitioner and the general public, the following
recommendation was made by the Planning Commission. A motion
was made by Schryer and seconded by Liles to recommend
approval with the following conditions:
DEDICATION AND IMPROVEMENTS OF RZW
1. The applicant shall dedicate and improve the S 10' of
the E 53.5' of Lot 1, Tract 528.
CURBS AND GUTTERS
2. The installation of curbs and gutters shall be assured by
the posting of $1358.00 cash bond with the City Clerk on
the basis of $2.00 per running foot, provided that the City
Engineer shall waive that portion of the required bond where
there are existing curbs and gutters existing in accordance
with City :engineer's specifications or where the City `
Engineer may certify those portions deemed impractical for ,
construction of curbs and gutters.

The Cash bond shall be redeemed if the applicant con-
structs curbs and gutters along the frontage of his
lots according to City standards within the specified
period. The cash bond shall be forfeited and the City
Engineer shall order the required construction accomp-
lished at no additional expense to the applicant, in
the event the curbs and gutters are not constructed with-
in 120 days after the City Engineer has officially
notified the applicant of establishment of grades and
elevations.
The motion was carried by the following roll call vote:

Jake R._Stewart Jake Stewart appeared before the City
Council and requested that the conditions
__ requiring to install curbs and gutters along "All Street front-
ing Division of band III and IV, as.requested, be waived as
there are no curbs and gutters along the street at present
and which was in County territory prior to Annexation by the
City and stated that at a future date when curbs and gutters
are a requirement on that street he would comply and const-
ruct same and asked for relief at this time.

accordance with the recommendations of
the Planning Commission, DV #120 be granted subject to the
conditions imposed by the Planning Commission but excepting
therefrom the provision to install curbs and gutters on "A"

the City of Huntington Beach, in the Council Chamber of the
City Hall, at the hour of 8:00 o'clock P. M. on Monday, the
2nd day of February, 1959, for the purpose of considering
the request for the termination and cancellation of drilling
bond as proveded for in Section 2427.4 of the Huntington Beach
Ordinance Code on producing well located on property described
as follows: Lots 23, 25, 27, in Block 418 Huntington Beach
Seventeenth Street section.
Affidavit of drlg. The Clerk read the affidavit of the

NcNee & Rubin drilling superintendent for Lebow; McNee
and Rubin and that in such capacity he
supervised the drilling of that certain oil well known as Hunt-
ington #2, drilled on Lots 23, 259 27, Block 418, Tract 10,
Huntington Beach, and based on his experience in drilling oil
wells and his knowledge of the wells set forth, states that
the well set forth above could not drift out of the boundaries
of the above stated property.
There being no statements for or against

Beverly Anshutz Beverly Anshutz appeared before the City

Cost analysis The Clerk read an economic study filed
re: Motor Grader
by the City Engineer covering an analysis
of the cost of owning versus renting a motor grader, wherein
the analysis showed that the full time rental of the motor
grader procedure at present, costs nearly twice that of owner-
ship.

Councilman Lambert informed members of
the City Council that he has manor business relations with
one of the bidders on the gasoline contract and excused him-
self from the deliberations and actions on the gasoline bid.

Public Hearing - Mayor Irby announced that 800 o'clock

P. M. was -the -time set this date for a
public hearing for a Master Zoning Ordinance, and asked the
Clerk to read the legal notice.
The Clerk read the Notice of Public
Hearing for Master Zoning Ordinance published in the Hunt-
ington Beach News, January the 15th and January the 22nd,
1959, setting the hour of 8:30 o'clock P. M. on the 2nd day
of February, 1959, for a public hearing in regard to the
adoption of the Master Land Use Plan and a Comprehensive Zbning
and District Ordinance encompassing all the territory within
the present City limits as a precise plan.
Mayor Irby opened the public hearing and
stated that Clifford Tripp Planning Director of the City of
Huntington Beach and Harry Wise of the Planning Consulting
firm retained by the City would answer any questions in regard
to the plan submitted by the Planning Commission of the City
of Huntington Beach and recommended for approval.
Clifford. T rim Clifford Tripp, Planning.Director out-
lined the process of studies that had been
carried on by the Planning Commission for many months and the
many public hearings that were held on the plan presented,
and explained the symbols on the maps and as shown on schedules
for the precise zoning and presented the sectional district
maps to be reviewed.

audience and stated that it was im-
perative that the Master Plan such as submitted be adopted in
order that the future of the City can be assured for proper
and healthy development and for the best interest of all

the City appeared before the City Council
and said he represented some 800 signatures on a petition
that had been presented to the Planning Commission and that
-they wished to have surface drilling rights kept on the
residential district of the City on the Eastside.
Mr. "Vilson Mr. Wilson of the Osage Oil Company
appeared before the City Council and
strenuously objected to the restrictions placed on the property
under which he has under lease from Mr. Talbert in the map
Section 14-6--119 and stated that it was discrimination as the
0 was retained on the property to the north and the east of
his lease, and asked that his property be given the same
consideration.
Ilowa.rd Tra -atnt Howard Trabant appeared before the City
Council and stated that the property
owners in the area bounded on the west by Highway #39 and on
the north by Garfield street on the East and parallel to
Highway #39 on the south by Yorktown wished to withdraw the
petition that they filed asking that the R-1 Zoning be changed
to R-4 and stated that the property owners would work with the
Planning Commission for further studies in that area.

Avenue on -the South, requesting that the status of the property

such operation by the State of California and the present
existing City Ordinances.
On motion by Waite seconded by Lambert
the petition presented by Lyndon Wells be received and filed.
Motion carried.
Lyndon A. Wells presented a petition signed
by Lyndon Wells for property owners in the Watson's Addition
in the City of Huntington Beach requesting that the status and
the zoning of this area remain the same as at present and no
change be made whatsoever.
On motion by Bryant seconded by Lambert
the petition presented by Lyndon Wells be received and filed.
Motion carried.
R. D. Barger, of the Southern California
Edison Company appeared before the City Council and filed a
copy of letter addressed to the Honorable Planning Commission,
January 30, 1959, Reference No. A-5074-H9 wherein they request
changes in the zoning for Public Utility buildings and uses
in the M-1 zone, parking requirements, hiway setbacks, and
architectural review of side plans, non -conforming uses, spe-
cial use permit procedure, as suggestions to guide the Plan
ping Commission study of the matter.
W. ;. 1diller - W. M. Miller appeared before the City
,lestern Gas &
Oil Assoc. Council and stated that he represented
the Western Gas & Oil Association members
and made a recapitulation of'minor zoning problems that he
wished the Council would take under consideration, as con-
tained in a letter addressed to the Planning Commission re-
questing consideration for certain changes in zoning and use
permit procedure. Mr. Miller expressed his appreciation for
the fine cooperation of the Planning Commission and that the
oil committee had given the Western Gas & Oil Assoc. members

in attempting to resolve the oil code and the zoning problems
of the City and stated that the job has been well done by the
Planning Director and the Planning Commission.

firm retained by the City made a short re-
buttal on the Southern California Edison Company request and
W. M. Millers request on behalf of the Western Gas & Oil Assoc.
There being: no further comments or state-
ments from the audience relative to the public hearing on the
Master Zoning Plan, the Mayor declared the hearing closed.
Ord. No. 706 The Clerk gave Ordinance No. 706 its first

reading "An Ordinance of the City of Hunt-
ington Beach, amending the Huntington Beach Ordinance Code
.adopting a.zoning plan being a precise section of the land use
plan unit of the Master Plan and an Official Plan of said City:
specifying the purposes and effects of the adoption of said
plan, whereby various districts are established in said City:
specifying the uses of land and of buildings permitted in said
districts: requiring certain yards and other open spaces with-
in said districts: prescribing for the erection, construction,
alteration, and maintenance of building, structures and other
improvements in said districts, including the requirements
that certain permits shall be secured for certain of such
buildings, structures and improvements, and for the use there-
of and of land: defining the terms used herein: specifying the
procedure for the amendment hereof: repealing all Ordinances
or parts of Ordinances in conflict herewith: and prescribing
