Commissioners Present:Davis, Stang, Chairman - Bazil. Commissioners Absent: Liles, Sork, Schryer, Presson. Minutes: Chairman Bazil took roll. There being no quorum, the meeting recessed until 5:30 P.M. RECONVENED MEETING AT 5:30 P. 2-q. Commissioners Present:Davist Stang, Presson,. Schryer, Chairman - Bazil. Commissioners Absent: Liles, Sork. CONDITIONAL EXCEPTION: TENTATIVE TRACT MAP NO 2973 Applicant - Joe Abandonato The Secretary read the requesting petition of the applicant who asked waiver on the following subdivision requirements; lot widths, corner lot area requirements, street lighting, curbs and gutters, tree planting, and the $50.00 per lot park recreation fee. He based his request on the fact that Map 2973 is merely a resubdivision of a subdivided block inside of the old town area. The legal description of the Tract is given as Block 907-B, Vista Del Mar Tract. The Chairman opened the hearing to the audience, there being no comment, the hearing was closed. A discussion was held by the Commission panel. Commissioner Davis reported that he and the Secretary checked on the street lights and sidewalk situation. He stated that he felt that the street lights now existing 117 Page #2 H. B. Planning Commission Wednesday, February 25th, 1959 at the intersections, were adequate for the short blocks. - He further advocated a 20 feet alley and sidewalks on Georgia -Street. The Secretary reported that the 20 ft. alley requirement was not specified in the subdivision ordinance. It was suggested by the Commission that a sidewalk along Georgia Street should be required as well as 5 additional feet of' dedication to obtain a 20 ft. alley. It was pointed out that with apartments being proposed, the need for the 20 feet alley was -severe. It was further concluded that some of the other subdivision requirements could be waived with the condition that the applicant accept a 20 ft. alley requirement. A MOTION WAS MADE BY PRESSON AND SECONDED BY STANG TO APPROVE TENTATIVE TRACT MAP NO 2973 CONDITIONED UPON THE CITY COUNCIL APPROVAL OF A CONDITIONAL EXCEPTION - RECOMMEND APPROVAL OF CONDITIONAL EXCEPTION 2973 WITH THE FOLLOWING CONDITIONS AND REASONS: (1) That a 4 feet sidewalk be required the full length of the west side of Georgia Street. REASON: The high occupancy proposed for the area will generate a high degree of on -street parking which will require sidewalks to keep pedestrians off the street. for alley purposes (2) That there shall be dedicatedtthe west 5 feet of Lot "B", Block 907,Vista Del Mar Tract. REASON: The high occupancy proposed for the area will create a parking problem which will necessitate wide alleys to make garage space usable. (3) That tree planting and the $50.00 per lot park recreation fee shall be waived if the applicant agrees to condition No 2. REASON: The land to be subdivided is merely a resubdivision of an existing subdivision. It not being raw land, and the existing lake park being within a reasonable distance, the Planning Commission concluded that it be best to waive these two conditions provided the applicant agrees to Condition No 2, a condition of critical importance. 2. 118 Page n3 Minutes - H. B. Planning -Commission Wednesday, February 25th, 1959 (4) That both Street lighting'and curb and gutter requirements be waived. REASON: Both types of improvements currently exist and are in proper location. (5) That 54 feet lot frontage shall be permitted in variance to the subdivision code. REASON: The existing sewer utilitites are stubbed out for five 54 feet frontage lots. Further the character of the surrounding neigh- borhood is all basically laid out in'54 feet frontage lots. The size and shape of Lot "B" of the existing subdivision does not permit any other type of division. The interior lots of the proposed subdivision will have 6,850 sq-ft. each, or 850 sq. ft. more than required. (6) That the 6,850 sq. ft. lots shall be permitted as corner lots in variance to the subdivision code. REASON: The code requires 7000 sq. ft., corner lots & that the deviation is not severe in relationship to the interior lots which are oversized. ROLL CALL VOTE: AYES: Stang, Davis, Schryer, Presson, Chairman-Bazil. NOES: None. ABSENT: Liles, Sork. THE MOTION CARRIED. DIVISION OF LAND: DV 122 AND CONDITIONAL EXCEPTION Applicant - Fred Williams DIVISON I: N -j of E i of Lot 3, Block "E", Tract 436 Includes 48 feet of frontage and total area of 9500 sq. ft. 'DIVISION II.S j of E 2 of Lot 3, Block "E", Tract 436 Includes 48 feet of frontage and a total area of 9500 sq. ft. The applicant requests'l,,a Conditional Exception to the subdivision code permitting the two -lots to be divid with 48 feet of frontage in variance to the code. The Secretary made -a report to the Commission. He described the location on a colored land use and zoning map, where it was shown that the basic character of the neighborhood consisted of 48 feet frontage lots with single family homes built upon them. 3. 119 Page #4 11inutes - H. Planning Commission Wednesday, February 25th, 1959 It was further ascertained that the area is now zoned to R-1 Single Family Residential District and to re- quire the property owner to maintain his 96 feet of frontage would require him to maintain 19,000 sq.ft. for each dwelling. It was determined that -this was not the intent of the subdivision code to create a hardship on a resubdivision of subdivided lands where -the original size and shape is incompatible with present day development and zoning standards. A MOTION WAS MADE.BY SCHRYER AND SECONDED BY DAVIS TO RECOMMEND APPROVAL OF DV 122 CONDITIONED UPON THE CITY COUNCIL APPROVAL OF A CONDITIONAL EXCEPTION - RECOMMEND APPROVAL OF CONDITIONAL EXCEPTION FOR DV 122 WITH THE FOLLOWING CONDITIONS AND REASONS: (1) That 48 feet lot frontages shall be permitted in variance to the subdivision code. REASON: The existing zoning of R-1 in conjunction with the existing neighborhood lot size of 48 feet frontage and 9500 sq. feet of area creates a logical basis for such action. (2) That the Installation of curbs and gutters shall be assured by the posting of a $192.00 surety bond with the city clerk on the basis of $2.00 per running foot. The surety bond shall be redeemed if the applicant constructs curbs and gutters along the frontage of his lots according to city standards within the specified period. The surety bond shall be forfeited and the City Engineer shall order the required construction accomplished at no additional expense to the applicant, in the event the curbs and gutters are not con- structed within 120 days after the City Engineer has officially notified the applicant of established grades and elevations.
