Councilmen presents Lambert, Bryant, Terry, Waite, Irby. Councilmen Absents None. Minutes On motion by Bryant seconded by.Lambert the Minutes of the City Counoil meetings of February the 2nd and February the 16th, 1959 as transcribed and mailed by the City,Clerk be accepted without changes and ordered filed. Motion carried. Monthly Reports The Clerk read the reports for the .month of February, 1959 filed by the City Treasurer, City Collector, . .. the Fire Chief, the Trailer Park Manager, Superintendent of -Recreation, Director of Building and Safety and Lifeguard Chief. 1 On motion by Bryant seconded by Waite the. reports of the Department Heads as read by the Clerk for the ,month of February be ordered filed. Joe The Clerk read a letter of trans- Abandonato re: tent- ative Tract Map #2973, mittal from the Planning Commission relative to conditional exception on tentative Tract Map No. 2973, petitioner being Joe Abandonato of 200 Orange Avenue, Huntington Beach, to allow waiver on the following subdivision requirements; lot widths, corner lot area requirements, street lighting, sidewalks, curbs and gutters, tree planting, and -the $50.00 per lot park recreation fee, location being as described in Tentative Tract Map No. 2973, legal description, Block 907 -- B, Vista Del Mar Traety Following a public hearing that was held by the Planning Commission on --Wednesday, February 25th, 1959, a motion was made by Presson and ,seconded by Stang recommending approval of conditional exception 2973 with the following conditions and reasons: CONDITIONS AND REASONS: le That a 4 foot sidewalk be required the full length -of the west side of GeorgiA Street, REASON= The UJAA occupancy proposed for the area will generate a high degree of on - street parking which will require sidewalks to keep pedest- rians off the street. 2. That there shall be dedicated for alley pwposes the west 5 feet of Lot "B", Block 907, Vista, Del Mar Tract. B,EAS0,N: The high occupancy proposed for the area will create a parking problem which will necessitate wide alleys to make garage space usable. 3. That tree planting and the 050.00 per lot park recreation fee shall be waived if the applicant agrees to condition No. 2. REASON: The land to be subdivided is merely a resubdivision of an existing subdivision. It not being raw land, and the existing Lake Park being within a reason- able distance, the Planning Commission concluded that it be best to waive these two conditions provided the applicant agrees to Condition No. 2, a condition of critical importance. , 4. 1'79 1 Page #5 - Minutes, March 2, 1959 #. That both Street lighting and curb and gutter require- ments be waived. REASON: Both types of improvements cirently exist and are in proper location. 5. That 54 feet lot frontage shall be permitted in vart ance to the subdivision code. RFASONs, The existing sewer utilities are stubbed out°for five 54 feet frontage lots. Further the character of the surround- ing neighborhood is all basically laid out in 54-feet frontage lots. The size and shape of Lot "B" of tka e1i6ting subdtivisioh doesi.not.pers1i any other type of division. The interior lots of the proposed sub- division will have 6,850 sq. ft. each, or 850 ft. more than -required. 6. That the 6,850 sq. ft. lots shall be -permitted as corner lots in varinance to the subdivision code. REASON: The code requires 7000 sq, ft., corner lots and that the deviation is not severe in relationship to the interior lots which are oversized. Stewart The Clerk read a letter of transmittal Exchange of Utilities Easement Rights- from the Planning Commission relative to B1k.A, Tract 528 Consideration and action to be taken on exchange of utilities Easement Rights, petitioner being Jake R. 'Stewart of 8031 Wintersburg Avenue, Huntington Beach, to allow relocation of the easement, location being the NE corner of Wintersburg and Highway #39, legal description being the aband- oned south 150 feet of the 15 feet alley in Block "A", Tract $28. On motion by Lambert seconded by Bryant in accordance with the recomgmendation of the Planning Commission approval of the relocation of the easement in Block A, Tract 528 be approved. Notion carried. Except.-- The Clerk read a letter of trans - Fred Williams mittal from the Planning Commission relative to Division of Land #122 and Conditional Exception, petitioner being Fred Williams, 17191 Elm Street, Huntington Beach, to allow two lots to be divided with 48 feet of frontage in variance to the code, location being the west side of Elm Street approximately 190 feet south of Cypress Street and follow- ing a public hearing held on Fehruary 25th, 19590 by the City Planning Commission a motion was made by Sbhryer and seconded by Davis, to recommend approval of Conditional Exception for DV #122 with the following conditions and reasons: (a)_ That 48 feet.lot frontage shall be permitted in variance to the subdivision code. REASON: The existing zoning of R-1 In conjunction with the existing neighborhood lot size of 48 feet frontage and 9500 sq. ft. of area creates a logical basis for such action. (b) That the Installation of curbs and gutters'shall be assured by the posting of a $192.00 surety bond with the City Clerk on the basis of $2.00 per.runn- ing foot. The surety bond shall be redeemed if the applicant constructs curbs and gutters along the frontage of his lots according to city standards within the specified period. The surety bond shall be forfeited and the City Engineer shall order the required construction accomplished at no additional expense to the applicant, in the event the curbs and gutters are not constructed within 120 days after the City Engineer has. officially notified the applic- ant of established grades and elevations. The., -Clerk read a letter from the Comm. re: St. Naming Committee Planning Commission relative to formation of a Street Naming Committee informing the City Council that the Planning Commission had appointed Commiss- ioners Gordon L. Bork and W.Z. Schryer to represent the Planning Commission on the proposed committee being eondudtid by the Orange County Street Naming Committee under sanction of the Associated Chambers of Commerce and requested the City Council mom a fftreet: Naming Committee of two members representing the City Council. Public Hearing- mayor Irby' announced that 8SOO Off -Street Parking Dist._ o'Clock P.M. was the time set for the public hearing on the proposed Off -Street Parking District and requested the Clerk to read the legal notice. The Clerk read legal notice published by the Huntington Beach News on January 29, and February 5, 1959, Resolution No.' 13589 A Resolution of Preliminary deter- mination and of intention to form Parking District in -the City of Huntington Beach and to issue bonds to pay the costs and expenses thereof, Parking District No. 1, and said notice giving Umday, the 2nd day of March, 1959, at the hour of SsOO o'clock P.M4'9 at the Council Chambers, City Hallo Huntington Beach, Caiifornia, fixing the time and place when and where the Council will consider and finally determine whether the public interest, convenience and necessity require said acquisitions and improvements and when and where the Council will hear and determine all protests that have been filed. 7. i82 Page #8 - Minutes, March 2, 1959 The Mayor asked if any Protests had been filed. Legal protests filed The City Clerk reported representing 61.8% that as of 5200 o'clock P.M. on Monday, March 2nd, 1959 there was filed with the City Clerk in the City mall legal protests representing 61.5% of the assessed valuation of the property owners of -record with- in the proposed Off --Street Parking District and the Clerk Certifing thereto. Bar. Blake Mr. Blake of the firm of girkbride, Wilson, Harzfelds & Wallace legal counsel for the City of Huntington Beach on the Off -Street Parking proced- ure xade a brief report on the purpose of the district, the methods of its formation, its method of financing, and the ability of the district to be able to pay the principal and interest in the revenue bonds to be issued if the district is formed and pointed out the course the Council could take on this matter although it had been protested by a majority of property owners of record and informed the council that they could either close the hearing and cease the proceedings or could continue the hearings for further study. Wm. S. Lee Wm. S. Lee attorney -at - law representing the protesters of the district pointed out that a majority of the owners of the property in the district had protested the formation of the district and represented over 51% of the assured valuation and said that the formation of the district could be terminated, however, pointed out -'there was a possibility that the protesters may wish to study this further and the Council could continue the hearing. 8. 183 Page #9 - Minutes, March 2, 1959 Milford Dahl Milford Dahl Attorney -at -law representing a certain group of proponents of the Off -Street Parking -District pointed out the value of an Off -Street Parking District for the owners of business property and their lessee's and.stated it would be rather detrimental to the business section to kill this proposal especially from the view point by which the City is offering to finance the District and requested the City Council to continue the hearing in order that the proponents and'. the protestere could revaluate the program that has been offered. D.I. Westmoreland D.M. Westmoreland Attorney -at -lair, owner of certain property in the Off -Street Parking District condemned the entire proposed Off -Street Parking District and stated that the boundary line of the district had evidently been drawn arbitrarily and without consideration as to the feasibility of the proposed parking district and the report showed deficiencies in the present on street parking meter setup from the standpoint of use and enforcement and stated that no further additional parking was needed at this time and requested that the formation of the district be terminated. There being no further comment for or against the formation of the district, Mayor Irby declared ,the hearing closed. No further action On motion by Bryant seconded by Lambert taken on Off -St. Parking Dist. the City Council finds and determines that protests of the property owners of record have been filed and certified by the City Clerk, representing in excess of 51% of the total assessed valuation of the area of the proposed Off -Street Parking District and that no further action be taken in the formation of the district, was approved by the following roll call Vote: 9. 184 Page #10 - Minutes, March 2, 1959 AYES: Councilmen: Lambert, Bryant, Terry, Waite, Irby. No. 711 adopted The Clerk gave Ordinance No. 711, Class Titles of Employ- ees An Ordinance of the City of Hunt- ington Beach relating to Class titles of employees and adding new Sections to the Huntington Beach Ordinance Code, its second and final reading by title. On motion by Bryant seconded by Lambert Ordinance No. 711 was passed and adopted by the follow- ing roll call vote: AYES: Councilmens Lambert, Bryant, Terry, Waite, Irby. NOES: Councilmen; None. ABSENT: Councilmen: None. Mrs. Stewart Gibbs Re: Mrs. Stewart Gibbs appea .-ed before pipe in alley, 201 Main St. _ the City Council and reported that in .,Sep b!-., of last year husband wrote a letter addressed to the City Council and the City Clerk relative to the pipe that was resoved by the Street Department in the alley in the rear of the building located at 201 Main Street Causing considerable water damage as the water drained under the building and reported there were certain deficiencies in the alley that had not been corrected by the owner and requested that the drainage pipe be replaced as it existed prior to its removal. Citv Engineer The City Engineer reported to the City Council on the condition of the alley in the rear of the building at 201 Main Street reporting the deficiencies exist- ing there and what could properly be done to correct the defiftiency with certain cooperation of;the property owner. 10 . Motion carried. Request of H.B. Mayor Irby referred to the Streets Elementary School Re: St. Light and Parke Committee the request of the Huntington Beach Elementary School District asking that a street light be placed at the main gate entrance on 17th street approximately 474 feet from Palm Avenue, which was recently constructed to increase the parking faeilitiee, driveway and other improvements at the Huntington Beach Elementary School. Request of R.M. Pyles The Council referred to the City Boys Ranch to con- struct driyewar. Engineer the request of the R.B. Pyles Boys Ranch asking permission to construct a 10 foot driveway and a 135 foot opening at the curb at 815 Inoaville Street to serve the parking area at the new building being constructed at 815 Knoxville Street and to meet with the representative of the R.N. Pyles Boys Ranch who was present and to work out a solution in.order that the driveway, openings and the rewired aprons would meet with the.'.G�ty, Construction standards. Co. Tax Collector. On motion by Lambert seconded by Bryant the City Council gives consent to the County Tag Collector to sell at public auction the property described in T.C. Sale #8709 be approved. Motion carried. City of Hope to On motion by Terry seconded by Lambert solicit for funds _ the City of Hope be given permission to conduct a house to house solicitation for funds in the City of Huntington Beach on Sunday, June the 7th, 1959 be approved. Motion carried. Reso. #1364 Re: The Clerk gave Resolution No. 1364, Civil Aeronautics Board. a Resolution of the City Council of the City of Huntington Beach, California, setting forth the position of the City of Huntington Beach with regard to the Pacific -Southwest Local Service case, Docket No-. 5645 et al., 11. 1�5 Page #12 - Minutes, March 2, 1959 before the Civil Aeronautics Board. Gay On motion by Bryant, Concession. seconded by Waste the Mayor and the City Clerk be authorized to execute on be half of the City the agreement between the City of Huntington Beach and David E. Gay to operate a concession stand in a certain space located in the northwesterly corner of the Huntington Beach Pavalon, be approved. Motion carried. Agreement - Michael J. The Clerk read an agree - Ka 'or - Skating Rink. Rent between the City of Huntington Beach and Michael J. Major giving permission to conduct a certain business known as the skating rink in a portion of a city building known as the Pavalon located at the foot of Main Street at the Huntington Beach Pier. On Motion by Terry second- ed by Bryant the Mayor and the City Clerk be authorized to execute on behalf of the City the agreement between the Oity of Huntington Beach and Michael J. Major be approved. Motion carried. Fire Chief re: Seal Bch. On motion by Bryant second- Ammun. & Net Depot Mutual Fire Aid ed by Waite the City Council approve the action of the Fire Chief in advising the Seal Beach Ammunition and Net Depot that the City of Huntington Beach will withdraw its mutual fire aid verbal agreement with the Seal Beach Ammunition and Net Depot and the City of Huntington Beach should the City of Westminster 12. 187 Page #13 Minutes, March 2, 1959 , 0 annexation be successful and completed, and the City Clerk be instructed to write a letter to the Commandant of the llth Naval District, San Diego, California, Certifying as to the action taken by the City Council relative to the recommenation of the Fire Chief, be approved. Request of Lifeguard Mayor Irby referred to the Beach Chief for .salary changes. and Pier Committee and Personnel Committee for s-t.udy and report the request of the Lifeguard Chief for hourly rate changes in the classifications of Seasonal Lifeguard and Lifeguard Trainee., Request of Fire Chief Mayor Irby referred to the Fire for new classifications and Police Committee and Personnel Committee the request of the Fire Chief to create classifica- tions and authorized number to be employed in the mire Department for stixdy and report. Communication from The Clerk read a Communication Met. Wtr. Dist. of So. Calif. Re: received from the Metropolitan Assemble Bill No. 286: Water District of Southern Calif- ornia, requesting that the City Council take action in the form of a Resolution to oppose the State Legislature Assembly Bill No. 286, which sets up the legal machinery for the opening of domestic water supply reservoirs for fishing and other recreational uses. The Resolution expressing opposition to Assemb!Z Bill #286 and to the adoption by the legislature of any other statute by the California State Legislature which would authorize or encourage the use of domestic water supply reservoirs for recreational purposes. Signal Oil On motion by Terry seconded by Bryant & Gas Co. re: Location of Refinery the City Clerk be instructed to send incity a letter to the President of the Signal Oil & Gas Company informing the Company that the City of Hunt- ington Beach wholeheartedly invites them to locate their proposed refinery in the Huntington Beach City area, be approved.
