On motion by Schryer and
seconded by Davis, the Minutes
of the Huntington Beach Planning Commission Meeting of
Tuesday, February 17th, 1959, and Wednesday, February 25th,
1959, as transcribed and mailed by the Secretary were
accepted as mailed.
USE VARIANCE: UV 142 To permit an 8 unit apartment
Applicant -
Rochelle Niccole dwelling to be built in a R-2-0
Duplex Residential District.
Located 100 feet south of Geneva Street on the east side
of Delaware Street and legally described as Lots 13, 149
and the N 18 feet of Lot 15, Block 605, East Side Villa
Tract.
The Secretary read the report
and recommendation of the Planning Department. Chairman
Bazil opened the hearing to the audience.
Dwight A. Bryson, 606 Delaware
Avenue, Huntington Beach, addressed the Commission and
stated that he wished to present a petition circulated
within the neighborhood to protest the proposed variance.
The number of objectors signing was certified as 30 by the
Secretary. Mr. Bryson stated that he himself vigorously
opposed the granting of the variance.
Mr. Wilbur L. Conklin, 501
Frankfort Street, Huntington Beach, addressed the Commission

and stated that although he had signed the petition, that
he wished to personally object to the proposed variance.
Chairman Bazil ordered the
petition to be accepted and filed,,there being no further
comment, the hearing was closed.
A MOTION WAS MADE BY.SCHRYER
AND SECONDED BY DAVIS TO RECOMMEND DENIAL.

THE MOTION CARRIED.
USE VARIANCE: UV 146 To permit an existing Grocery
Applicant - Rex Funke
Store to enlarge its operation
and to provide the required parking under the new pro-
visions of the C-1 Neighborhood Commercial District
regulations as adopted on February 16th, 1959. Present
zoning is R-3-0. and is being rezoned to R-2-0.
Located at the southeast corner of Frankfort Street
and Alabama Street, and legally described as: Lots 25,
269 27, and 28, Block 1, Redburn Tract.
The Secretary read the report
and recommendations. Chairman Bazil opened the hearing
to the audience for comment:
Dwight A. Bryson, 606 Delaware
Avenue, Huntington Beach, addressed the Commission and
stated that he gave his full support to this variance
in the belief that such a grocery store was and will
continue to be an asset to the neighborhood.
Wilbur L. Conklin, 501 Frankfort
Street, Huntington Beach, addressed the Commission stated
that he was in accord with the proposed variance. He

said that the convenience and quality of the present Grocery
operation warranted favorable consideration.
A MOTION WAS MADE BY STANG AND SECONDED BY
LILES TO RECOMMEND APPROVAL WITH THE FOLLO`'rING CONDITIONS:
0-1 PROVISIONS:
1. All provisions of C-1 Zoning District as outlined in
the new zoning ordinance effective on March 19, 19599
shall prevail.
REMOVAL OF OLD STRUCTURE:
2. Action must be taken to remove the old structure
located at Lots 25 and 26, Block 1, Redburn Tract,
within 90 days of occupancy of the new structure.
SUBMITTED PLOT PLAN:
3. Use Variance 146 is granted on the basis of the sub-
mitted plot plan unless otherwise a change is author-
ized by the Planning Commission.

Located 400 feet west of Highway 39 on the North side of Aldrich
Street and legally described as Lot 28, Tract 417.

The report and recommendations
were read by the Secretary. Chairman Bazil opened the
hearing to the audience.
Ray Murray, 17411 H. B. Blvd.,
Midway City, addressed the Commission and stated that he
objected to three moved in houses being allowed across the
street from his premises. He pointed out that the area
is rapidly improving with new homes and to allow undesirable
housing would ruin it.
The Chairman asked Mrs. Benthin
for comment. She stated that she wanted to move two
identical homes on to the rear of her property and that she
would be willing to attach them as a duplex. She said that
she intended to build a new home on the front of the property
and did not wish to attach it to the older units.
A letter was read by the Secretary
written from Roderick F. Nagle, 7942 Aldrich Street, Hunt-
ington Beach, who asserted that to allow three moved in
homes to be built in this rapidly improving neighborhood
could be nothing but detrimental. He pointed out the
parking problem involved with three homes on a 50xlOO ft. lot.
A MOTION WAS MADE BY PRESSON AND
SECONDED BY STANG TO RECOMMEND APPROVAL WITH THE FOLLOWING
CONDITIONS:
DUPLEX AND ONE UNIT.
1. That the two identical moved in homes shall be attached
so as to be a duplex. That there shall also be per-
mitted one single family home of new construction.
GARAGE AND DRIVEWAY REQUIRED.-
2. That there shall be a garage or carport required for
each unit. That there shall be a 15 feet paved drive-
way required to connect each garage or carport to the
fronting street.

STUDY OF SUBDIVISION POLICY
Requested by Davis
Construction Company -
1224 N. Palm Avenue,
Anaheim, California
The applicant submitted
Tentative Tract Map No. 3126
for a policy ruling in re-
gards to a half street. The
Secretary displayed a revised map which was prepared by
the Planning and Engineering Offices which permitted the
same number of 28 lots, but with the streets all designed
as full width. The applicant was asked for a statement
in regards to whether he thought he could utilize the
suggested alternative. Davis stated that he believed that
he could alter his map in accordance with the suggestion
and derive a more satisfactory map.
Davis stated that drainage
wise it would also be more satisfactory to have the alter -
hate map. The Secretary asked the Members of the Commission
for a policy ruling in regards to half streets, in the
event the applicant or other applicants would decide to
attempt half streets. The Commission gave an informal
decision stating that they would oppose half streets or
sub -standard streets except for the most rare exceptions.
The Secretary also quoted
a hypothetical case of an estates size subdivision lots,
where a street might have to be substandard within an
undeveloped area. The Commission indicated that it might
be possible for a conditional exception in a case like this,
only depending upon the individual circumstances.
The Secretary indicated that
Tentative Tract Map No. 3126 would be placed upon the

March 17th, 1959, agenda for definite action.
RESOLUTION OF INTENT NO. 58_-A resolution -of the Planning
Commission to study the follow-
ing specifically described areas for possible rezoning was
taken under consideration.
AREA I. Would encompass the -west 530 feet of the north-
west quarter of Sectional District 1-6-11 and
is located on the east side of Highway 39
frontage between Yorktown and Garfield Street.
AREA II. Would encompass the west 660 feet of the south-
west quarter of Sectional District Map 36-5-11
except the NW 4 of NW a of SW a of said section.
And is located on the east side'of Highway 39
frontage from Garfield Street north to the South
line of NW a of NW a of SW 4 of said section.
AREA III. Would encomass the west 330 feet of NW 4 of
NW 4 of NW 4 of Section 36-5-11, and is located
on the east side of Highway'39, Talbert Avenue
south 660 feet and a depth of 300 feet.
A MOTION WAS MADE BY STANG AND
SECONDED BY DAVIS TO ADOPT RESOLUTION NO. 58.

THE MOTION CARRIED.
OIL COM1y1ITTEE
Chairman Bazil asked the
Secretary to reactivate the
Oil Committee study group in order to further proceed with
the planned code of 0-2 and 0-3. Commissioners Liles and
Stang were reminded that they were still serving on the
oil committee group and the Secretary was asked to include
such groups as were represented by Mr. George Renner, and
the Minor oil producers as represented by Donald Fairbanks.
Commissioner Schryer suggested
that a program for the abandonment of old oil lines in
place be instituted whereby the City would reduce the cost
by one half and pocket the difference. It was suggested

that this by a topic for discussion to be included in
the oil code hearing.
