problems involved with undersized lots proposed in land
divisions. In this particular case, one of the lots was
proposed to be 40 feet by 121 feet for approximately
4800 square feet. A majority opinion argued that a
large deviation in the required frontage could be tolerated
under extreme hardship if the square footage requirement
was fully met. However it was stated by majority opinion
that to deviate from both the square footage requirements
and the frontage requirements in same lot would be too
severe deviation and would destroy the purpose and
intent of a subdivision ordinance. It was further pointed
out that the applicant would still be allotted the
privilege of building his home on the property irregard-
less of the outcome of this Division of Land, rather he
would be denied permission to sell off his house separate-
ly as a separate lot at a later date.
On the basis that the proposed Division
of Land did not fulfill the purpose and intent of the
subdivision code, A MOTION WAS MADE BY SCHRYER AND
SECONDED BY BAZIL TO RECOMMEND DENIAL:
