Required legal public notice was properly given prior'to the hearing, and due consideration given to the petitioner and the general public, the following recommendation was made by the Planning Commissions A motion was made by Schryer and seconded by Davis to recommend approval with the following conditions: CURBS AND GUTTERS: The installation of curbs and gutters shall be assured by the posting of a $230.00 surety bond with the City Clerk on the basis of $2.00 per running foot. The surety bond shall be redeemed if the applicant constructs burbs and gutters along the frontage of his lot according to City standards within the specified period. The surety bond shall be forfeited and the City Engineer shall order the required construction accom- plished at no additional expense to the applicant, in the event the curbs and gutters are not constv*oted within 120 days after the City Engineer has officially notified the applicant of established grades and elevations. Page ##4 - Minutes, April 20, 1959 On motion by Lambert seconded by Bryant after hearing Gene Clingman and Robert Roes in re- gards to Division of Land #125, requesting waiving of the curb conditions since it is an unimproved street, and in accordance with the recommendations of the Planning Com- mission the Division of Land request #125, be approved with the conditions requested imposed by the Planning Commission. Fred Hermann Fred Hermann appeared before the City Council and strenuously objected to occupancy of the building until it had been made to comply with the City Building Code requirements. Public Hearing Mayor Irby opened the public hearing Reso. #1371 on Resolution No. 1371, and asked if anyone present wished to make any statements relative to the general prevailing rate of hourly wages shown in Resolution No. 1371 read by the City Clerk. City Engineer The City Engineer reported to the City Council the general prevailing rates as shown in Resol- ution No. 1371 are the prevailing rates in this general area. of Orange County. There being no further statements relative.to prevailing rates of hourly wages for each craft as shown in Resolution No. 1371 the Mayor declared the hear- ing closed. Notion carried. Police Chief -- On motion by Bryant seconded by Meeting at Indio Lambert in accordance with the request of Chief of Police, Clinton H. Wright, that he be given permission to attend the Chief s of Police meeting called by the Attorney General in Zone 6 to be held on April the,22nd and 23rd, at Indio, California, and reason- able and necessary travel.and lodging -,expense be allowed. Notion carried, Motor Grader The -Streets and Parks Committee of the city Council reported on the bids previously re- ceived by the City Purchasing Agent and reviewed by the City Council at the previous meeting. Order, for approval, by the Purchasing Agent covering the request of the Recreation Department for the purchase of 12 Widelite floodlites, 12 Mercury Vapor lamps, 12 art Brackets, with the nota- tion that the Recreation Department has approxiAateiy $1,500.00 to apply against this purchase, which runs approximately $2,900,00. The $ecreation Department requested that the balance be on a deferred payment until it could be included in the text fiscal year budget. The Clerk suggested that the CouAcil should not bind the City for an expenditure to be included in next years budget, and suggested that the difference should be paid from the Special Fund for Capital Outlay Reserve and the Recreation Department fund could reimburse the S&cial Capital Outlay Reserve, provided that it was put in the next fiscal year's budget. 10. The Clerk read Resolution No. 60 Reso. #60 - Amend Master adopted by the Planning Commission, Plan of Sts. & Hwys 1957-58 A Resolution of the Planning Com- mission of the City of Huntington Beach to amend the Master Plan of Streets and Highways 1957-1958. On motion by Waite seconded by Bryant the City Clerk be authorized to publish in the Hunt- ington Beach News, a Notice of Public Hearing calling for a public hearing oil the adoption of The Master Plarx_of Streets and Highways 1957-1958 amendment, and said hearing to be held at 8315 o*clock P.M., on May the 4th, 1959, and the City Clerk be authorized to publish the legal notice in the Huntington Beach News, be approved. Motion carried., Tract 2558 Tract No. 2558 was presented to the City Council for approval. Dedication of Planning Director Tripp and the Streets offered City Engineer pointed out to the City Council that the subdividers made an offer of dedict- tion of Lisa Street, Taylor Avenue, Roberta Circle, Thomas Circle and Huntington Beach Boulevard. The Tract has re- ceived the approval of the Planning Commission, the Plan- ning Director and the City Engineer.
