Agreement - Rainbow The Clerk read the agreement between Disposal. Co. -- the-City of Huntington Beach and Phil Hohnstein and Paul Loumena, dba Rainbow Disposal Company, to, provide for the collecting of trash and garbage on.a twice weekly basis in the residental areas and once daily in busi- ness and commercial areas and said agreement to commence on the 16th day of May, 1959, and ending on April the llth, 1962 and providing for the termination of the present agreement on the 15th day of May, 1959. On motion by Waite seconded by Bryant the Mayor and the City Clerk be authorized to execute on be- half of the City the agreement between the Vity of Huntington Beach and Phil Hohnstein and Paul Loumena dba Rainbow - epoasl Company, was approved by the following roll call vote: AYES: Councilmen: Lambert, Bryant, Terry, Waite; Irby. After due consideration given to the petitioner and the gen- eral public following the required legal public notice for hearing the following recommendation was made by the Plan- niAg Comliesion! A motion was made by Stang and seconded by Liles to recommend denial, and was passed by the Plan- ning Commission by the following roll call vote: AYES: Liles, Davis, Stang, Presson, Sark, Chairman Bazil. NOES: None., ABSENT: Schryer. Mr. Thompson ' 'Mr. Thompson appeared be- fore the City Council and stated that he had bought the par- cel of land with the understanding that he could build on the Lots and he did not know that it was an illegal division of land. Mr. Winkler Mr. Winkler the property owner who sold the property to Mr. Thompson, said he was the prior applicant on the Division of Lend and was previously denied on the division of land by the Planning Commission and the City Council and stated that he would tear down the gar- age which is located on the property line if Mr. Thompson would build a duplex. City Attorney Bauer_ City Attorney Bauer out- lined to the Council members the position in which Mr. Thompson has found himself and stated that actually the petition for'Division of Land to Mr. Thompson was theore- tically a request for a Variance and so should be considered. Clifford Tripp Clifford Tripp, the Plan- ning Director of the City reported the Conditional Exception accompanied the request for the Division of Land. Public Bearing Weed Abatement Mayor Irby announced that.8tOO o• clock P.M. of this date was the date sett for a Public Hearing in the abatement of obnoxious weeds etc., when the objections of the property owners will,be heard and given due consideration. Mayor Irby opened the hearing and re- quested the City Clerk to read the Notice to Destroy Weeds and remove rubbish, refuse and dirt. The Clerk read the affidavit of posing notices to destroy weeds filed by the Street Superintendent of the City of Huntington.Beach on the 29th day of April, 1959, stating that all notices were posted on the property listed in the Resolution of Intention No. 1368, passed by the City Coun- oil on the 6th day of April., 1959. The Clerk reported that no verbal or written protests had been filed with. the City Clerk. Mayor Irby asked if anyone wished to make a statement relative to the Notice to Destroy Weeds,and remove rubbish, refuse and dirt. Mrs. Heisner Mrs. Heisner living on Nichols Street appeared before the City Council and stated that the area they live in, and when it was in County Territory, the County of Orange road Department, sprayed the area along side the fence next to the road right-of-way and asked that the City do the same. Mrs. Heisner was informed that it was the responsibility of the City and her repponsibility was only within the confines of her property lines. There being no further comments on the hearing to destroy weeds, and remove rubbish, refuse and dirt, the Mayor declared the hearing closed. On motion by Lambert seconded by Waite the Street Superintendent of the City of Huntington Beach be instructed to proceed with the abatement of obnoxious weeds and 5: 242 Page #6 -- Minutes, May 4, 1959 the removal of 'rubbish, refuse and dirt upon or in front of property in accordance with properties posted in accordance with those included in Resolution of Intention No. 1368, be r approved. Motion carried. Public Hearing - Amend. The Mayor announced that a Master Plans of Sts. & Hiws Public Hearing had been set for 8s15 o'clock P.M., relative to the proposal to amend the Master Plan of -Streets and Highways which encompasses all the territory within the present City Limits and requested the Clerk to read the legal notice. The Clerk read the Notice of Public Hearing, published in the Huntington Beach Ness on April the 23rd, 1959, giving notice that the City Council of the City of Huntington Beach proposed to amend the faster Plan of Streets and Highwaye, which encompasses all terri- tory within the present City limits in order to guide future development, and that one public hearing will be held on said plan in accordance with the State law, and said hearing will be held on the 4th day of May, 1959, in the Council Chambere, City Hall, Huntington Beach, California, at the hour of 8s15 o'clock P.M., and any and all persons interested may appear and be heard thereon. Clifford Tripp Clifford Tripp, Planning Director, addressed the Council and the audience present and explained the amendment to the Master Plan of Streets and Highways, whereby the width provisions of arterial and major and intermediate streets will be changed on the Master Plan of Streets, and Highways. There being no statements made from anyone present the Mayor declared the hearing closed. On motion by Bryant second- ed by Lambert the City Attorney be instructed to drawup the necessary Resolution to process the amendment to the Master Plan of Streets and Highways as recommended by the City Plan- f. 24a I Page #7 -- Minutes, May 4, 1959 ning Commission, be approved. Public Hearing - Sealed Mayor announced that 8:30 o1 clock Bids Improvement - Goldenweet Ave. P.M. this date was the date set for opening of sealed bids for the reconstruction, resurfacing, and improvement of Goldenwest Street from Slater Avenue to Smeltzer Avenue, in accordance with the plans, specifications, and special provisions on file.in-the office -of the City Clerk I and the City Engineer, and requested the City Clerk to open th,e bids received. The Clerk opened and read the follow- ing bidss, (SEE. NEXT PAGE) On motion by Bryant seoonded by Lambert the bide for the improvement of Goldenwest Street from Slater Avenue to Smeltzer Avenue be referred to the City Engineer for checking and report. Acquisition - right- City Attorney Bauer reported to the of -way Yorktown St. . Extension City Council on the proposed necessary acquisition of right-of-way for the Yorktown Street extension which the tract developer will, require in order to improve the extension of Yorktown Street, and that it was a matter of de- cision of the City Council whether they wanted a fee deed or an easement. On motion by Bryant seconded by Lambert the City Attorney be instructed to contact the Attorney for the Peek Estate to negotiate a fee title for the necessary acquisi- tion of right -of --way for the Yorktown Street extension, be approved. Center from Martin Weirman of Post Office Boa 285, asking the City Council to reconsider its decision in denying the Recreation Department their request for improved lighting at the playground. On motion by Lambert seconded by Waite etc., Recr.Center the City Purchasing Agent be authorized - to issue a Purchase Order for the purchase of lighting stand- ards, brackets and arms for the Recreation Department grounds, in accordance with the purchase order previously presented be approved. Bureau re: Census the Mayor and the City Clerk be -,author- ized to execute an agreement between the Housing Division Bureau of the Census, of Washington, D.C., in the City of Huntington Beach for the purpose of collecting and publishing housing statistics by City block on a contractual basis in conjunction with the 1960 decennial census, be approved. Motion carried. .13. 250 Page #14 - Minutes, May.4, 1959 Agreement - exchange of land- Councilman Bryant reported H.B.Co. & City of H.B.- Hunt. Ave. & 101 to the City Council that in as much as the City of Huntington Beach, has no direct or in- direct use of the present parcel of land owned by the City located at the junction of Huntington Avenue and Highway #101, comprising of 1,189 acres and it would be well for the City to consider exchanging the property for other property now offered that the City has dire use of at the present time, especially a site for a much needed water reservoir as re- quired by the water supply permit given by the State of,Calif- Orni&* to the City. Qn motion by Bryant second- ed by Lambert the City Council on behalf of the City of .
