Commissioners Present: Liles, Davis, Schryer, Stang, Sork,
Presson, Chairman Bazil.
Commissioners Absent: None.
Minutes: On motion by Schryer and seconded
by Davis, the Minutes of the
Huntington Beach Planning Commission Meeting of Tuesday,
April 21st, 19599 as transcribed and mailed by the Secretary
were accepted as mailed.
CONDITIONAL PER1;!IT: A continued hearing was held to
CP 107 Applicant -
Walter Draper consider a petition for a Conditional

Permit to regulations of the District-
ing Ordinance No 668 adopting Orange County Land Use Ordinance
351 as an Interim Ordinance.
To permit a Sunday School and Church
Services to be held in a single family dwelling.
Located approximately 1200 feet
west of Highway #39, on the south side of Newman Street and
legally described as the W 50 feet of the E 1320 feet of
S 184 feet of the N 2 of the SE 4 of the SE 4 of Section
269 T. 5. S., R. 11. W., S. B. B. & M.
Chairman Bazil opened the hearing
to the audience. Rev. Aycock, representing the Southern
Baptist Church addressed the Commission and explained that
the planned conversion of the home would be only a branch
of the existing Church dovmtown. He submitted a sketch of
the proposed parking.
Robert Wright, 7892 Newman Avenue,
Huntington Beach, addressed the Commission and reiterated
his protest given at the previous meeting. He submitted

a petition containing 25 persons who were in protest of
the location of the Church.
Eddie Phillips, Newman Avenue,
Huntington Beach, addressed the Commission and entered
a protest against the Church location. He added that
he could not see where there was room for more than two
,cars to park in the front yard area. The vacant yard
next door, he pointed out, was owned by a party who
intended building a home shortly.
Rev. Aycock furnished other
information as to the plans of the Church. The hearing
was closed. A lengthy Commission discussion followed.
Commissioner Sork stated that
he would like the answer to the following two things -
he wanted to have the petition checked to.determine
property ownership and wanted a plot plan giving
adequate dimensions to prove that there was room enough
for Church parking. He stated that he could not make a
decision until this information was known. He made a
motion to continue the hearing until the next meeting.
Davis seconded the motion. The motion carried. The
hearing was continued to May 19th, 1959.

The hearing was opened to the audience,
there being no comment, the hearing was closed. -The history and
circumstances of the case is given as follows: The general area
south of Newman Street was divided by metes and bounds descriptions
many years past. While the method used was not legal, it was
never questioned concerning a legal subdivision. As a result,
today the property owners in the second tier of lots south of

Newman Street are fronting on no streets and are completely
landlocked except for a private right-of-way easement of
25 feet in width. The adjoining six acres to the south
also has a 25 feet width private easement for access.
There is no paved street, however there are presently being
constructed several multiple units on landlocked.parcels in
the same tier closer to Highway #39. These buildings could
not under present laws be denied a building permit.
The applicant asks that he be
permitted to split his 100 feet by 214 feet parcel into
two 50 foot lots and his 350 feet by 214 feet lot into four
separate parcels.
The 'Planning Commission reviewed
the case and then reviewed the subdivision ordinance and
made 'the' declaration that the land is basically undeveloped
without the slightest indication of proposed improvements.
The Commission gave the opinion
that the land should be developed through the state sub-
division regullations with its two large parcels being
over 2.1 acres.
A MOTION VIAS MADE BY SCHRYER AND
SECONDED BY LILES TO RECO11�11END DENIAL OF DV 129 AND DV 130
FOR THE FOLLOWING REASONS:
1. That the proposed DVts 129 and 130 are not in con-
formance with the City subdivision code Section 9721 (c)
*Excerpt - All lots will have proper and sufficiant access
to a public street.
2. That under City subdivision code the Planning Commission
may recommend to the City Council that a Final sub-
division map be required where in their opinion -the
intent is to ultimately divide the parcel into five
or more lots.

3. That the 50 feet frontage instead of regulation
60 feet require a conditional exception to the
ordinance approved by the city council, whereas in
this instance the Planning Commission does not re-
commend it.

ACTION TAKEN ON PROPOSED A review was held of the
SUBDIVISION REGULATIONS
RESOLUTION 61 outlined proposals for add-
itional subdivision ordinance
and policy as requested by the City Council.
The outline headings are given
as follows with the inclusion of an additional item:
Landlocked subdivisions.
1. Street Sections.
2. 1•aster Plan Highway Development.
3. Signing.
4. Lighting.
5. Sewers.
6. Water.
7. Fire Alarm System.
8. Inspection.
9. Substructures.
10. Annexations.
11. Landlocked subdivisions.
All phases of the proposed ordinance and policy were re-
viewed in detail.

REQUEST FOR VACATION: The request of the Secretary
to take a vacation June 18th
thru June 26th, 1959 was considered by the Commission.
The motion was made by Liles and seconded by Stang to approve
of vacation time to be taken by the Secretary. The motion
carried.
FISCAL BUDGE±ROPOSAL REVIEWED All items in the proposed
fiscal budget for the year
1959 - 1960 were taken under study and considered individually.
One item - Contractural
Consulting Services was reduced from $3,440 to $2,440.
