Councilmen Absent: None, Business Licenses On motion by Terry seconded by Waite the applications for license to conduct business in the City of Huntington Beach as approved by the Health Officer, Build- ing Inspector, Chief of Police, Fire Chief, and Planning Dir- ector, be granted as follows: C.T. Pursuant to the Conservation and Planning Law of the State Government Code, -a public -hearing was held May 5th, 1959 by the City Planning Commission to consider above petitioner's request. The required legal public notice was properly given prior to the hearing. With due consideration given to the petitioner and the general public, the following recommenda- tion was made by the Planning Commissions A notion was made by Presson and seconded by Liles to recommend approval with- out conditions. Motion carried by the following roll call vote: AYES: Liles, Davis, Schryer, Stang, Presson, Sork, Chair- man Bazil. NOES: None. ABSENT: None. On motion by Bryant aeconded•by Lambert in accordance with the recommendations of the Plan- ning Commission, Use Variance #150 be granted without cond- itions, be approved. A motion was made by Schryer and seconded by Liles to recommend denial of DV #130 for the following reasons: 1. That the proposed DV #130 is not in conform- _ o . e • ande with the City subdivision code Section 9721 (c) (*Excerpt - All lots will have proper and sufficient access to a public street.) 2.` That under City subdivision lode the Planning Commission may recommend to the City'Council that a Final subdivision map be required where in'their opinion the intent is to ultimately divide the parcel into five or more lots. r 3. That the 50 feet frontage instead of regula- tion 60 feet requires a conditional exception to the ordinance approved by the City Council, where- as in this instance the Planning Commission does not recommend it. Thompson for Division of Land, DV #129, the Mayor referred the petition back to the Planning Commission for further study. Planning Director On motion by Terry seconded by Waite to take vacation the request of Clifford Tripp, Planning Director, to take a vacation from June 18th to June 26th, 1959, ,,and which request has been approved by the Planning Commission, was approved. Motion carried. Ordinance No. 723 -- The Clerk gave Ordinance No. 723 its Fees of Water Department �. second reading by.title, An Ordinance of the City,of Huntington Beach relating to fees of the Hunting- tpn Beach Water Department and amending Section 3530 of the Huntington Beach Ordinance Code. On motion by Waite seconded by Bryant Ordinance No. 723 was passed and adopted by the fpllowing roll call vote: AYES: Councilmen: Lambert, Bryant, Terry, Waite, Irby. NOES: Councilmen: None, ABSENT: Councilmen: None. 5. 266 Page #6 Minutes, May 18, 1959 ordinance No. 724 - The Clerk gave Ordinance No. 724 its Job Classifications - second reading by title, An Ordinance of the City of Huntington Beach relating to job classifica- tion; amending Section 1577.7 of the Huntington Beach Ord- inance Code. On motion by Bryant seconded by Lambert Ordinance No. 724 was passed and adopted by the following roll call vote: AYES: Councilmen: Lambert, Bryant, Terry, Waite, Irby. NOES: Councilmen: bone. ABSENT: Councilmen; None. Resolution No. 1377 - The Clerk read Resolution No. 1377, Amend. Faster Plan of Streets & Highways a resolution of the city of Huntington Beach adopting an amendment to the Master Plan of Streets and Highways, 1957-1958. On motion by Bryant seconded by Waite Resolution No. 1377 was passed and adopted•by the following roll call vote: AYES: Councilmen: Lambert, Bryant, Terry, Waite, Irby. NOES: Councilmen: none. ABSENTt Councilmen: None. Chief of Police On motion by Lambert seconded by to attend conference Bryant the request of Clinton Wright, Chief of Police, for permission to attend the all zone con- ference Df Chiefs of Police and Sheriffs, the joint meeting called by the Attorney General of the State of California, to be 12e.ld on May 24th to May 27, 1959 inclusive, and rea- sonable expenses be allowed, was approved. Motion carried., Norman Smith On motion by Bryant seconded by Waite employed as Engr_ Aide the request of James Wheeler, City Engineer, do employ Norman Smith in the classification of Engineering Aide in salary Range 309 Bracket "B", effective may 19, 1959, be approved. City Engineer - The Clerk read a letter from James Flood Control Wheeler, City Engineer, stating that in view of the subdivision activity in the northern part of the City, the need for flood control works becomes more appar- ent, and at this time Flood Control Bond Issue Projects 0-5 and C-6 are scheduled for completion to Highway #39 about April 1, 1960. He further stated that it would be extremely beneficial to the City's development if the work on these pro- jects could be expedited and drainage provided for the next rainy season and at the same time, the easterly extension of these projects, to Cannery Street at least, should be construct -I ed at an earlier date than is now planned by the District. In order to formally notify the District of our interest in expediting these projects he recommends the City Council adopt a resolution requesting action by the Board of Supervisors. Resolution No. 1378 - The Clerk read Resolution No. 1378, Flood Control a resolution of the City of Huntington Beach requesting the Board of Supervisors of the County of Orange to instruct the Flood Control District Engineer to exped- ite Flood Control BoAd Issue Projects C-5`and C-6 so that facilities will be available at the earliest date possible. On motion by Lambert seconded by Bryant Resolution No. 1378 was passed and adopted by the following roll call vote: AYESs Councilmen: Lambert, Bryant, Terry, Waite,,,Irby. NOES; Councilmen: None. First Baptist Church On motion by Bryant seconded by to sell soft drinks - 4th of July Lambert the request of the Crusader Adult Sunday School Class of the First Baptist Church for per- mission to sell soft drinks in Lake,Park on the Fourth of July, be approved. Motion carried. Demands On motion by Bryant seconded by Waite the demands as approved by the Finance Committee be ordered paid. Motion carried. City grader to level On motion by Terry seconded by Waite, ball field - Hunt. Crest area in accordance with the request of .the Huntington Beach Recreation Commission, the City Engineer be authorized and instructed to assign the motor grader to the City leased property in the Huntington Crest area to level the ball field, subject to having first obtained the approval of the land owner, was approved. Motion carried. Agreements - H.B. On motion by Waite seconded by Elementary School & Ocean View Element- Terry the agreement between the ary School _ Huntington Beach Elementary School District and the Public Recreation Commission of the City of Huntington Beach, and the agreement between the Ocean View Elementary School District and the Public Recreation Commission of the City of Huntington Beach, giving permission to the Commission to use certain facilities at the Schools for recreation purposes, be approved. Motion carried. City Engineer - The Clerk read a letter from Jamew Sewer System Wheeler, City Engineer, stating that following a study of the system of sewers in the City of Huntington Beach, from which certain sewers were d6ter- mined to be trunk sewers, it is his recommendation that 8. 269 Page #9 - Minutes, May 18, 1959 Sanitary District Number 11 be asked to purchase these sewers as they are logical extensions of their trunk system and should be a part of it. Included in those sewers determined to be trunk sewers are the Ocean Avenue Trunk Sewer, from Newland Street to Twenty -Third Street, about 1.8 miles and the Lake Avenue Trunk Sewer about 1.2 miles in length. The total de- preciated value of these sewers is.$1151,145.00. A o Resolution No. 1379 - The Clerk read Resolution No. 1379, Sewer System_ a resolution of the City of Huntington Beach requesting Sanitation District Number 11 to consider the purchase of trunk sewers in the City of Huntington Beath. On motion by Terry seconded by Waite Resolution No. 1379 was passed and adopted by the following roll call vote: AYES: Councilmen: Lambert, Bryant, Terry, Waite, frby. C NOES: Councilmen: None. ABSENT: Councilmen: None. ._.Plans for.lateral On motion by Terry seconded by Bryant the City Engineer be instructed to make a study and formulate plans for lateral sewers as nec- essary, be approved. Lotion carried. City Engineer reports The City Engineer presented a detailed on water business report on the problems of the City entering the water business and presented to the Council for their consideration the following recommendations: 1. From funds available, authorize Lowry --Overmyer and Associates to design and prepare plans and specifications for reservoir and pump house. We can expect to be in a posi- tion to advertise for bids within 120 days of entering an agreement for this engineering work. 2. Authorize the Administrative Officer, City Attor- ney and City Engineer to investigate and prepare a report to the City Council on the means of handling the maintenance and operation of the Water Department for a limited period. 3. A general discussion followed. Proposed lease for On motion by Bryant seconded by development of City's acreage Lambert that the City Attorney be instimeted to draw up a proposed lease to cover the City's requirements for the development of the City's acreage for presentation to the City Council for review, in -order that a legal notice can be published inviting offers or proposals of development for the acreage.
