MINUTES: On motion by Schryer and seconded by Davis, the Minutes of the Huntington Beach Planning Commission Meeting of Tuesday, May 19th, 1959, as transcribed and mailed by the Secretary were accepted as mailed. USE VARIANCE: UV 151 To allow a 28 unit apartment Clement Fearns to be constructed in an R-4 Suburban Residential District where only 9 units would be allowed. Located at 18092 Huntington Beach Blvd., and legally described as the S 94 feet in the N 567.71 feet of W 330 feet of NW 4 of NW a of NW a of Section 36, T. 5. S., R. 11. W., S. B. B. & M. Chairman Bazil opened the hearing to the audience. Clement Fearns, applicant, addressed the Commission and asked for favorable con- sideration. Warren Crafton, 4430 Radford Avenue, Studio: City, California, represented himself as the prospective developer and answered the various questions by the Planning Commission. Robert Jones, 18112 Huntington Beach Blvd., an adjacent landowner, stated to the Commission he was in favor of the apartment development. Sabastion Bottari, 18062 Hunt- ington Beach Blvd., Huntington Beach, addressed the 163 Page 7-;r'2 Minutes - H. B.,Planning Commission Tuesday, June 2nd, 1959 Commission and went on record in protest of the variance, stating that he did not wish to have his light cut off by a two story apartment. The hearing was closed. Debate was held by the Commission with the developer concerning the advisability of using the rear alley easement to the rear if it can be extended to Talbert Avenue and improved. A MOTION WAS MADE BY DAVIS AND SECONDED BY SCHRYER TO REC0M1 END APPROVAL 17ITH THE FOLLOWING CON- DITIONS: REQUIRED ALLEY 1. A fully improved alley of 30 feet width to City Engineer's specifications will be required to extend from the applicant's property to Talbert Avenue. STREET DEDICATION 2. There shall be offered for dedication for street purposes a parcel the width of the described lot and to a depth of 40 feet. A discussion was brought to the attention of the Commission regarding the desirability of requiring garaging which the developer had previously been in accord with. The hearing was opened to the audience for comment, there being none, the hearing was closed. A MOTION WAS MADE BY DAVIS AND SECONDED BY SCHRYER TO ADOPT RESOLUTION NO 62 ENUMERATING SPECIFIED AMENDMENTS TO THE CITY SUBDIVISION ORDINANCE AND RECOIiMENDING THEIR ADOPTION TO THE CITY COUNCIL. ROLL CALL VOTE: AYES: Davis, Presson, Stang, Schryer, Sork, Chairman Bazil. NOES: None. ABSENT: Liles. THE MOTION CARRIED. AREA VARIANCE: AV 152 To allow a variance to the regulation Applicant - Fred R. Swartz 5 feet side yard requirement for the A-1 General Agricultural District as provided in Orange County Land Use Ordinance 351 and adopted by Interim Ordinance 668. Swartz, applicant, requested a 3 feet side yard be allowed in variance to the re- quired 5 feet side yard in order to add an additional room to his home. There being no further comment the hearing was closed. The Commission expressed an opinion that a 4 feet side yard would be more in line with existing ordinances. THE MOTION CARRIED. TENTATIVE TRACT MAP 3429 The Planning Commission con - Applicant - Continental management Co sidered the proposed Tentative Tract Map No 3429 inclusive with the conditional exceptions granted by City Council resolution on June 1st, 1959: To allow 56 feet Cul-de-Sac street widths to extend to a distance of 420 feet in depth. A MOTION WAS MADE BY SCHRYER AND SECONDED BY SORK TO APPROVE TENTATIVE TRACT MAP NO 3429 WITH THE FOLLOWING CONDITION: 1. That Final Map approval shall be conditioned upon the availability of the adjoining flood control channel which in the opinion of the City Engineer has reached sufficient completion for control of runoff water. The, Planning Commission considered the proposed Tentative Tract Map No 3431 inclusive with the conditional exceptions granted by City Council resolution on June 1st, 1959: To allow 56 feet Cul-de-Sac street widths to extend to a distance of 420 feet in depth. A MOTION WAS MADE BY PRESSON AND SECONDED BY STANG TO APPROVE TENTATIVE TRACT MAP NO 3431 WITH THE FOLLOWING CONDITION: 1. That Final Map approval shall be conditioned upon the availability of the adjoining flood control channel which in the opinion of the City Engineer has reached sufficient completion for control of runoff water. The Planning Commission considered the proposed Tentative Tract Map No 3430 inclusive with the Conditional Exceptions approved by City Council resolution on June 1st, 1959: To allow deviation of required lot frontages to 58 feet and 64 feet respectively in variance to the 60 feet and 70 feet corner requirement. TENTATIVE TRACT MAP 3126 The Planning Commission REVISED - Applicant - Ralph Davis - Danor Co. considered the proposed Tentative Tract Map No 3126. There being no extreme change, except for an additional 7 lots, debate centered on the systematic street naming for similiar tracts. No majority conclusion was reached. A MOTION WAS MADE BY STANG AND SECONDED BY PRESSON TO APPROVE TENTATIVE TRACT MAP 3126. ROLL CALL VOTE: AYES: Davis, Presson, Stang, Schryer, Sork, Chairman Bazil. NOES: None. ABSENT: Liles. THE MOTION CARRIED. USE PERI.IIT NO 100 To permit one double faced Applicant - Robert Metzler tract sales sign 12 feet by 40 feet with 8 feet clearance. Located the southerly end of Lot 1, tract 2558 and legally described as follows: 125 feet E of the West line of Section 36-5-11 within the W 2 of the F'7 III* of said section. Use Permit No 101 shall be a temporary permit not to exceed one year. 2. Use Permit No 101 shall not be transferable to other parties or uses.
